In this paper, I first consider a famous objection that the standard interpretation of the Lockean account of diachronicity (i.e., one’s sense of personal identity over time) via psychological connectedness falls prey to breaks in one’s personal narrative. I argue that recent case studies show that while this critique may hold with regard to some long-term autobiographical self-knowledge (e.g., episodic memory), it carries less warrant with respect to accounts based on trait-relevant, semantic self-knowledge. The second issue I address concerns the (...) question of diachronicity from the vantage point that there are (at least) two aspects of self—the self of psychophysical instantiation (what I term the epistemological self) and the self of first person subjectivity (what I term the ontological self; for discussion, see Klein SB, The self and its brain, Social Cognition, 30, 474–518, 2012). Each is held to be a necessary component of selfhood, and, in interaction, they are appear jointly sufficient for a synchronic sense of self (Klein SB, The self and its brain, Social Cognition, 30, 474–518, 2012). As pertains to diachronicity, by contrast, I contend that while the epistemological self, by itself, is precariously situated to do the work required by a coherent theory of personal identity across time, the ontological self may be better positioned to take up the challenge. In this paper I argue that Kant’s political and juridical philosophy justifies a type of normative legal positivism that implies specific notions of law and legal freedom which determine and restrict the sphere of action of judges and jurists. Finally, I defend that, according to Kant’s practical philosophy, the normative connection between justice and law is not supposed to be carried out at the juridical level, as a meta-juridical theory, but at the political one, making it a meta-political theory.

A central theme of Cheryl Misak’s important new history is that there are two markedly different strands of the pragmatist tradition. One pragmatism traces back to Peirce, she thinks, and it takes seriously the ideals of logical precision, truth, and objectivity. This tradition had its insights carried through later analytic philosophy by figures like C. I. Lewis, Quine, and Davidson, among others. In lieu of an abstract, here is a brief excerpt of the content:Augustine on the True Presence and the Eucharist as Sacrament of UnityElizabeth KleinAugustine's understanding of the Eucharist has been a thorny topic for theologians (both within the academy and without) since the Reformation.1 Ulrich Zwingli cited Augustine as an authority in favor of his merely symbolic understanding of the presence of Christ in the Eucharist at the colloquy of Marburg, to which Martin Luther reportedly conceded: "You have Augustine (...) and Fulgentius on your side, but we have all the other fathers."2 John Calvin also insistently took Augustine to be in his camp on the question of the Eucharist, citing, for example, Augustine's John commentary in a refutation of the Roman doctrine of transubstantiation—specifically regarding what happens when an unbeliever eats of the Eucharist: "Let those, therefore, who make unbelievers partakers of the flesh and blood of Christ, if they would agree with Augustine, set before us the visible body of Christ, since, according to him, the whole truth is spiritual."3 To this day, some Protestant commentators maintain a narrative about the theology of the Eucharist that follows a trajectory something like this: Augustine had a more spiritual or symbolic understanding of the [End Page 1325] sacrament, but this understanding was slowly effaced in the early to late Middle Ages, and then recovered at the Reformation. Correspondingly, in academia, Augustine's theology of the sacraments is often ignored or underplayed, no doubt in part due to the inheritance of this Protestant memorialist narrative.At the heart of the debate over Augustine's view of the Eucharist is his view of the effect of the sacraments. Are the sacraments, and the Eucharist in particular, a cause of sanctification for Augustine? Or are they merely a kind of symbol or reminder, one means among many for strengthening faith? Phillip Cary, perhaps the most vigorous opponent of seeing any efficacy in Augustine's sacramental theology, argues that Augustine "has no room for such a notion, which I shall label 'efficacious external means of grace.'"4 But, at the same time, the Catechism of the Catholic Church draws liberally from Augustine in its description of the Eucharist and its effects (for example, see §§1372, 1396, and 1398), as does Thomas Aquinas—particularly on the question pertaining to the effect of the sacrament.5How can Augustine's legacy be so hotly contested, claimed by two opposing camps on such an essential theological question? ABSTRACTAdam Smith infused the expression ‘impartial spectator’ with a plexus of related meanings, one of which is a super-being, which bears parallels to monotheistic ideas of God. As for any genuine, identified, human spectator, he can be deemed impartial only presumptively. Such presumptive impartiality as regards the incident does not of itself carry extensive implications about his intelligence, nor about his being aligned with benevolence towards any larger whole. We may posit, however, a being who is impartial and who holds (...) higher levels of intelligence and of benevolence, and then converse over what her sentiments would be about the matter under discussion. It is natural to conceive of a being who is unsurpassable in such qualities, who is morally supreme, and who naturally takes the definite article the without having been definitized by the writer. Signal passages, new to edition 6, suggest that Smith formulates the man within the breast as a representative of the always present and everywhere morally supreme impartial spectator. The medium‐independence of computational descriptions has shaped common conceptions of computational explanation. So long as our goal is to explain how a system successfully carries out its computations, then we only need to describe the abstract series of operations that achieve the desired input–output mapping, however they may be implemented. It is argued that this abstract conception of computational explanation cannot be applied to so‐called real‐time computing systems, in which meeting temporal deadlines imposed by the systems with which a device (...) interfaces are constitutive of the computing tasks that a device performs. Instead, real‐time computing reveals the need for alternative conceptions of computational explanation, as well as computational implementation, that eschew medium‐independence. (shrink)

Klein, Renate The practice of surrogacy in Australia has been controversial since its beginning in the late 1980s. In 1988, the famous 'Kirkman case' in the state of Victoria put surrogacy on the national map. This was a two-sisters surrogacy - Linda and Maggie Kirkman and the resulting baby Alice - in which power differences between the two women were extraordinarily stark: Maggie was the glamorous and well spoken woman of the world; Linda who carried the baby, was the (...) demure school teacher in child-like frocks and pig tails. Their IVF doctor applauded altruistic surrogacy. He called it 'gestational surrogacy' and proclaimed that if the so-called surrogate mother didn't use her own eggs, thus wasn't the baby's 'genetic' mother, no attachment would ensue! This statement is haunting us to this day. It is patently absurd: as a baby grows in a woman's body over the nine months of the pregnancy, it is hard to see why the 24/7 presence of the baby inside her body, its growth, its interaction with her would be any different whether s/he has the mother's genes! This article traces the competing meanings of "master narrative" in current theoretical debates over history and culture. The phrase "master or meta narrative" has grown popular for describing stories which seem to assimilate different cultures into a single course of history dominated by the West. Master narrative, like its predecessors Universal History and speculative philosophy of history, has become something to avoid. But our increasingly global situations demand stories that can describe and explain the worldwide interactions of diverse cultures and (...) communities. From this convergence--a growing wariness of global stories coupled with situations which seem to demand them--has emerged a popular new double plot of world history in which cultural differentiation and cultural homogenization go hand in hand. The development has led to some surprising homologies and contrasts among the new histories created by thinkers from Claude Lévi-Strauss and Jean-François Lyotard to James Clifford and Francis Fukuyama. But our new "postmodern" distinctions between master and local narratives have carried over the venerable antinomy of people with and without history, and the search for timeless formal principles differentiating "historical" and "nonhistorical" modes of discourse and ways of being threatens to create new varieties of essentialism. In _Encounters with Melanie Klein: Selected Papers of Elizabeth Spillius_ the author argues that her two professions, anthropology and psychoanalysis, have much in common, and explains how her background in anthropology led her on to a profound involvement in psychoanalysis and her establishment as a leading figure amongst Kleinian analysts. Spillius describes what she regards as the important features of Kleinian thought and discusses the research she has carried out in Melanie Klein's unpublished archive, including Klein's views (...) on projective identification. Spillius's own clinical ideas make up the last part of the book with papers on envy, phantasy, technique, the negative therapeutic reaction and otherness. Her writing has a clarity which is very particular to her; she conveys complicated ideas in a most straightforward manner, well illustrated with pertinent clinical material. This essay takes a close look at specially selected features of the Göttingen mathematical culture during the period 1895–1920. Drawing heavily on personal accounts and archival resources, it describes the changing roles played by Felix Klein and David Hilbert, as Göttingen's two senior mathematicians, within a fast-growing community that attracted an impressive number of young talents. Within the course of these twenty-five years Göttingen exerted a profound impact on mathematics and physics throughout the world. Many factors contributed to the (...) creation of a special atmosphere that served as a model for several other important centers for mathematical research. Göttingen exemplified a dynamic new way of doing mathematics within a highly competitive community in which the spoken word often carried more weight than did information conveyed in written texts. Joseph Beuys, Andy Warhol, Yves Klein, and Marcel Duchamp form an unlikely quartet, but they each played a singular role in shaping a new avant-garde for the 1960s and beyond. Each of them staged brash, even shocking, events and produced works that challenged the way the mainstream art world operated and thought about itself. Distinguished philosopher Thierry de Duve binds these artists through another connection: the mapping of the aesthetic field onto political economy. Karl Marx provides the red thread (...) tying together these four beautifully written essays in which de Duve treats each artist as a distinct, characteristic figure in that mapping. He sees in Beuys, who imagined a new economic system where creativity, not money, was the true capital, the incarnation of the last of the proletarians; he carries forward Warhol’s desire to be a machine of mass production and draws the consequences for aesthetic theory; he calls Klein, who staked a claim on pictorial space as if it were a commodity, “The dead dealer”; and he reads Duchamp as the witty financier who holds the secret of artistic exchange value. Throughout, de Duve expresses his view that the mapping of the aesthetic field onto political economy is a phenomenon that should be seen as central to modernity in art. Even more, de Duve shows that Marx—though perhaps no longer the “Marxist” Marx of yore—can still help us resist the current disenchantment with modernity’s many unmet promises. Oleg B. Zaslavskii. The little in a non-Euclidean world: On the artistic space in Tom Stoppard's film and play “Rosencrantz and Guildenstern are dead”. It is shown that quite different aspects of Tom Stoppard’s work — spatial organization, relationship between reality and the conditional character of events, causality and narrative links, the problems of choice and personality — are united by the spatial one-sided model like the Möbius strip or Klein bottle. The artistic space turns out to be not (...) orientable, the time being cyclic. This enables us to explain the mutual exchange of names between Rosencrantz and Guildenstern and a number of other paradoxical features in the plot and composition. The model like the Möbius strip embodies the absence of a free choice: there is no other side in the world and there is no chance to escape from the fate indicated in the title of Tom Stoppard’s work. The relevance of topology, e.g. the property of a globalnature, is connected with the fact that a bearer of danger is the world as a whole. Apart from this, it points to the fact that such a structure of the world is essentially “non-Euclidean” and cannot be understood on the basis of observations from every-day life or “obvious” experiments like those carried out by Rosencrantz. This paper introduces the model of Utilitarian Principlism as a framework for crisis healthcare ethics. In modern Western medicine, during non-crisis times, principlism provides the four guiding principles in biomedical ethics—autonomy, nonmaleficence, beneficence, and justice; autonomy typically emerges as the decisive principle. The physician–patient relationship is a deontological construct in which the physician’s primary duty is to the individual patient and the individual patient is paramount. For this reason, we term the non-crisis ethical framework that guides modern medicine Deontological Principlism. (...) During times of crisis, resources become scarce, standards of care become dynamic, and public health ethics move to the forefront. Healthcare providers are forced to work in non-ideal conditions, and interactions with individual patients must be considered in the context of the crisis. The COVID-19 pandemic has forced healthcare to shift to a more utilitarian framework with a greater focus on promoting the health of communities and populations. This paper puts forth the notion of Utilitarian Principlism as a framework for crisis healthcare ethics. We discuss each of the four principles from a utilitarian perspective and use clinical vignettes, based on real cases from the COVID-19 pandemic, for illustrative purposes. We explore how Deontological Principlism and Utilitarian Principlism are two ends of a spectrum, and the implications to healthcare as we emerge from the pandemic. (shrink)

The lack of gender parity in philosophy has garnered serious attention recently. Previous empirical work that aims to quantify what has come to be called “the gender gap” in philosophy focuses mainly on the absence of women in philosophy faculty and graduate programs. Our study looks at gender representation in philosophy among undergraduate students, undergraduate majors, graduate students, and faculty. Our findings are consistent with what other studies have found about women faculty in philosophy, but we were able to add (...) two pieces of new information. First, the biggest drop in the proportion of women in philosophy occurs between students enrolled in introductory philosophy classes and philosophy majors. Second, this drop is mitigated by the presence of more women philosophy faculty. (shrink)

According to a bodily view of pain, pains are objects which are located in body parts. This bodily view is supported by the locative locutions for pain in English, such as that “I have a pain in my back.” Recently, Liu and Klein (Analysis, 80(2), 262–272, 2020) carry out a cross-linguistic analysis, and they claim that (1) Mandarin has no locative locutions for pain and (2) the absence of locative locutions for pain puts the bodily view at risk. This (...) paper rejects both claims. Regarding the philosophical claim, I argue that a language without locative locutions for pain only poses a limited challenge to the bodily view. Regarding the empirical claim, I identify the possible factors which might have misled Liu and Klein about the locative locutions for pain in Mandarin, and argue that Mandarin has a wide range of locative locutions for pain by conducting a corpus analysis. I conclude that compared to English, Mandarin lends no less, if not more, support to the bodily view of pain. (shrink)

Although both are characterizations of the mappings between signals and meanings, their emergence and evolution in communication systems has generally been explored independently. We present an experiment in which both arbitrariness and systematicity are probed. Participants invent signs from scratch to refer to a set of items that share salient semantic features. Through interaction, the systematic re-use of arbitrary signal elements emerges.

Initial Teacher Education quality is often judged through the auspices of audit-style mechanisms designed to facilitate the identification of matters pertaining to the ‘readiness’ of student teachers to enter the world of the classroom as fully qualified. In this regard, quality of programmes is often determined by the knowledge and skills student teachers demonstrate. Whilst ontological aspects are not necessarily elided, they are often ignored in favour of such epistemological matters. While such knowledge-based positions do not describe the totality of (...) ITE quality evaluation they do predominate. This paper identifies a tripartite heuristic for the identification of ITE epistemology that explicitly refers to, and is requiring of, ontological matters in the development of student teachers: identifying teaching, doing teaching, knowing teaching. BackgroundResponsive neurostimulation has been utilized as a treatment for intractable epilepsy. The RNS System delivers stimulation in response to detected abnormal activity, via leads covering the seizure foci, in response to detections of predefined epileptiform activity with the goal of decreasing seizure frequency and severity. While thalamic leads are often implanted in combination with cortical strip leads, implantation and stimulation with bilateral thalamic leads alone is less common, and the ability to detect electrographic seizures using RNS System thalamic leads is (...) uncertain.ObjectiveThe present study retrospectively evaluated fourteen patients with RNS System depth leads implanted in the thalamus, with or without concomitant implantation of cortical strip leads, to determine the ability to detect electrographic seizures in the thalamus. Detailed patient presentations and lead trajectories were reviewed alongside electroencephalographic analyses.ResultsAnterior nucleus thalamic leads, whether bilateral or unilateral and combined with a cortical strip lead, successfully detected and terminated epileptiform activity, as demonstrated by Cases 2 and 3. Similarly, bilateral centromedian thalamic leads or a combination of one centromedian thalamic alongside a cortical strip lead also demonstrated the ability to detect electrographic seizures as seen in Cases 6 and 9. Bilateral pulvinar leads likewise produced reliable seizure detection in Patient 14. Detections of electrographic seizures in thalamic nuclei did not appear to be affected by whether the patient was pediatric or adult at the time of RNS System implantation. Sole thalamic leads paralleled the combination of thalamic and cortical strip leads in terms of preventing the propagation of electrographic seizures.ConclusionThalamic nuclei present a promising target for detection and stimulation via the RNS System for seizures with multifocal or generalized onsets. These areas provide a modifiable, reversible therapeutic option for patients who are not candidates for surgical resection or ablation. (shrink)

We analyse how memes construct networks of feminist critique and response, mobilising the derisive laughter that energises current feminisms. Using the 2012 case of the ‘Binders Full of Women’ meme, we argue that feminist memes create online spaces of consciousness raising and community building. The timeliness, humorous affect and media techné of meme propagators become significant infrastructures for feminist critique, what we term ‘doing feminism in the network’. Despite global warming and climate change remaining top environmental issues, many people do not prioritize the environment. However, religious and spiritual beliefs can influence pro-environmental behavior. Therefore, we focused on understanding how religiosity and spirituality among Christians, the non-religious, and atheists, influence ecologically conscious consumer behavior (ECCB) through environmental values (i.e. egoistic, altruistic, and biospheric) and issue involvement. Using Qualtrics, we recruited a US sample of Christians ( n = 362), the non-religious ( n = 132), and atheists ( n (...) = 84). Exploratory factor analysis (EFA) and confirmatory factor analysis (CFA) analyses confirmed the hypothesized model. Overall, the findings suggest that religiosity is related to the environmental values of Christians and the non-religious. This relationship increased issue involvement and positively impacted participants’ ECCB. More importantly, irrespective of religious affiliation, perceived spiritual connection with nature promoted ECCB. (shrink)

The aim of this paper is to propose a research agenda for future studies of local forms of caregiving. It does this by exploring practices of care giving and receipt through the prism of childcare. Focusing on Nairobi, it investigates one critical form of care work in the city: the labour of women who work as ‘nannies’ in private homes, a form of labour that has received little systematic study or scholarly attention. Every day, women in Nairobi construct complex and (...) far-ranging care chains that ensure that the socially necessary labour of childcare takes place. The phenomenon of ‘diverted mothering’ that has been associated with the globalisation of care can also be understood as a local phenomenon. Whereas global care chains involving migrant domestic workers have been the focus of detailed investigation, hitherto the workings of more widespread and highly fragile local care chains in the cities of the third world have been neglected. We argue that it is critical to understand practices of intimate and emotional labour in the context not just of global migration but in situations of severe intersecting inequalities within the global south. This paper explores how, at the 1875 Royal Commission on Vivisection, the anaesthetised animal was construed as a boundary object around which “cooperation without consensus” Computer supported cooperative work: cooperation or conflict? Springer, London, 1993) could form, serving the interests of both scientists and animals. Advocates of anaesthesia presented it as benevolently intervening between the scientific agent and animal patient. Such articulations of ‘ethical’ vivisection through anaesthesia were then mandated in the 1876 Cruelty to Animals Act, and thus have had (...) significant downstream effects on the regulation of laboratory animals in Britain and beyond. Constructing this ‘consensus’ around the anaesthetised animal, however, required first excluding abolitionists and inhumane scientists, and secondly limiting the interests of experimental animals to the avoidance of pain through anaesthesia and euthanasia, thereby circumventing the issue of their possible interest in future life. This consensus also served to secure the interests of vivisecting scientists and to limit the influence of public opinion in the laboratory to administrative procedure and scheduled inspection. The focus on anaesthesia was connected with discussions of what supporting infrastructures were required to ensure proper ethical procedure was carried out by scientists. In contrast to the much studied polarisation in British society between pro- and antivivisectionists after 1876, we understand the 1875 Commission as a conflict amongst scientists themselves, while also being an intra-class conflict amongst the ruling class. This article critically examines the practice of unnamed sourcing in journalism. A literature review highlights arguments in favor of and against their use. The authors examine some common examples of anonymous sourcing using the lens of utilitarianism, the ethical model commonly used to justify the practice. We find that few uses of unnamed sourcing can be justified when weighed against diminished credibility and threats to fair, transparent reporting. The authors suggest specific guidelines for journalists that, if followed, would curb many (...) of the pedestrian uses of unnamed sourcing but still allow for the practice in specific circumstances.
