IntroductionConcussion is a growing public health concern. No uniformly established therapy exists; neurofeedback studies report treatment value. We use infralow frequency neuromodulation to remediate disabling neurological symptoms caused by traumatic brain injury and noted improved outcomes with a novel concussion protocol. Postconcussion symptoms and persistent postconcussion symptoms are designated timelines for protracted neurological complaints following TBI. We performed a retrospective study to explore effectiveness of ILF in PCS/PPCS and investigated the value of using this concussion protocol.MethodPatients with PCS/PPCS seen for (...) their first neurology office visit or received their first neurofeedback session between 1 August 2018 and 31 January 2021 were entered. Outcomes were compared following treatment as usual vs. TAU with ILF neurotherapy. The study cohort was limited to PPCS patients; the TAU+ILF group was restricted further to PPCS patients receiving at least 10 neurotherapy sessions. Within the TAU+ILF group, comparisons were made between those who trained at least 10 sessions using concussion protocol and those who trained for at least 10 sessions of ILF regardless of protocol.ResultsAmong our resultant PPCS cohort leading persistent neurological complaints were headache, memory impairment, and brain fog. PPCS patients in TAU+ILF+CP demonstrated greater net and percent improvement of symptoms compared to PPCS subjects in TAU. PPCS patients in TAU+ILF-CP trended toward significant symptom improvements compared to TAU, and TAU+ILF+CP trended toward greater efficacy than TAU+ILF-CP.ConclusionPPCS patients who received TAU+ILF+CP demonstrated significantly greater improvement as a group when compared to TAU. When used as an integrative modality to treatment as usual in managing patients with PPCS, ILF neuromodulation with use of concussion protocol provided significant symptom improvements. (shrink)

Psychedelic experiences are often compared to “transformative experiences” due to their potential to change how people think and behave. This study empirically examines whether psychedelic experiences constitute transformative experiences. Given psychedelics’ prospective applications as treatments for mental health disorders, this study also explores neuroethical issues raised by the possibility of biomedically directed transformation—namely, consent and moral psychopharmacology. To achieve these aims, we used both inductive and deductive coding techniques to analyze transcripts from interviews with 26 participants in psychedelic retreats. Results (...) indicate that psychedelic experiences can constitute transformative experiences. Twenty participants reported experiences or insights that were seemingly inaccessible or impossible to attain if not for the psychoactive effects of psychedelics. All participants besides one reported some change in identity, values, beliefs, desires, and behavior—changes in behavior being the most common. Participants also reported feeling capable deciding to use psychedelics in part due to information seeking prior to their retreats. Finally, several participants reported an enhanced capacity for enacting changes in their lives. Our results underscore both the importance of subjective embodiment to transformation and the role of transformative agency in shaping outcomes of the psychedelic experience. We examine our results relative to neuroethical issues and advocate for centering the person in psychedelic research and neuroethical inquiry about psychedelics to avoid pitfalls associated with psychedelics’ potential as moral psychopharmacological agents. Eye gaze is a ubiquitous cue in child–caregiver interactions, and infants are highly attentive to eye gaze from very early on. However, the question of why infants show gaze-sensitive behavior, and what role this sensitivity to gaze plays in their language development, is not yet well-understood. To gain a better understanding of the role of eye gaze in infants' language learning, we conducted a broad systematic review of the developmental literature for all studies that investigate the role of eye gaze (...) in infants' language development. Across 77 peer-reviewed articles containing data from typically developing human infants in the domain of language development, we identified two broad themes. The first tracked the effect of eye gaze on four developmental domains: vocabulary development, word–object mapping, object processing, and speech processing. Overall, there is considerable evidence that infants learn more about objects and are more likely to form word–object mappings in the presence of eye gaze cues, both of which are necessary for learning words. In addition, there is good evidence for longitudinal relationships between infants' gaze following abilities and later receptive and expressive vocabulary. However, many domains are understudied; further work is needed to decide whether gaze effects are specific to tasks, such as word–object mapping or whether they reflect a general learning enhancement mechanism. The second theme explored the reasons why eye gaze might be facilitative for learning, addressing the question of whether eye gaze is treated by infants as a specialized socio-cognitive cue. We concluded that the balance of evidence supports the idea that eye gaze facilitates infants' learning by enhancing their arousal, memory, and attentional capacities to a greater extent than other low-level attentional cues. However, as yet, there are too few studies that directly compare the effect of eye gaze cues and non-social, attentional cues for strong conclusions to be drawn. We also suggest that there might be a developmental effect, with eye gaze, over the course of the first 2 years of life, developing into a truly ostensive cue that enhances language learning across the board. La propriété et la question de sa légitimité ont alors été interrogées aux confins de l’articulation entre l’ordre du fait (s’incarnant notamment dans l’appropriation) et celui du droit. Néanmoins la mise au premier plan d’une nécessité naturelle (...) ainsi que l’inscription de l’appropriation dans un registre naturaliste ont pour vocation de soustraire la propriété à la problématique de la justice distributive. L’approche naturaliste de l’appropriation privative implique en outre un usage pragmatique de la norme juridique, renversant par là la « loi de Hume », alors même que cette norme pourrait être tout aussi légitimement mobilisée pour instaurer un devoir-être plutôt que pour instituer juridiquement un état de fait. The thesis attempts to provide a real definition of religion and argues that this is less problematic than is often assumed. It begins with a brief introduction which outlines why it is attractive to subject the attempt to define religion to a philosophical investigation. It is argued that defining religion is interesting because it is something which appears difficult to do, which scholars of religion often oppose, and which has practical implications. In addition, defining religion provides an opportunity to address (...) fundamental philosophical issues (such as defining, social kinds, and theories of concepts) and theoretical questions concerning the study of religion. The introduction also mentions the difficulties these kinds of interdisciplinary enterprises are bound to meet because of differences in terminology and academic traditions. Part I is concerned with the philosophical, historical, and methodological issues in discussions necessary to pave the way for the attempt to provide a definition of religion. The first chapter addresses some fundamental philosophical issues concerning defining as a philosophical activity. It is argued that the traditional focus on natural kind concepts in discussions about defining needs to be supplemented with considerations about domain specificity and differences between social kinds. It is also argued that empirical findings from cognitive psychology are relevant to conceptual analysis and that two-dimensional semantics provides a productive approach to an analysis of the concept of religion. The chapter concludes with describing an approach to defining religion. The second chapter is also concerned with methodological questions and considers the potential contributions empirical studies of the concept of religion could make to the study. Some outlines of potentially useful studies are suggested, and pros and cons for including them in the present study are weighed up. The chapter concludes with drawing a distinction between essential and non-essential elements and assessing their relative importance in a definition. The third chapter offers, first, an overview of historical issues: the history of the term ‘religion’, the problem of determining the content of historical philosophical concepts of religion, and the history of the discussion about defining religion within the study of religion. The major conclusions of these sections are that the term ‘religion’ is likely to be a homonym and that several theoretical discussions have been intertwined in the historical debates about definitions of religion. The second part of the chapter discusses traditional fundamental issues in the study of religion in order to disentangle the discussion about definition from related discussions (about e.g. methods and religious (anti-)realism). It is concluded that an essentialist view on defining religion is not necessarily a return to apologetic approaches to religion. The fourth chapter offers an overview of positions for and against realism concerning religion and the possibility of providing a definition of religion. Important distinctions are drawn between two kinds of conceptual essentialism (related to definition) and two kinds of ontological essentialism (related to theories). A discussion of the various forms of essentialism concludes that a ‘soft essentialist’ approach to defining religion is preferable. It is also concluded that constructivist and other anti-realist objections to providing a real definition of religion are less obvious than is often assumed because they fail to offer a detailed account of the supposed ‘construction’ that is free of realist assumptions. They also appear to rely on controversial philosophical assumptions. The second part of the thesis is concerned with providing a definition of religion. It begins in chapter five with an overview of some multifactorial, or ‘soft essentialist’, approaches to defining religion. The purpose of this is to prepare the ground for the conceptual analysis, which opens with a discussion of various aspects of religion. Ten possible candidates for necessary and/or sufficient conditions for religion are discussed in order to determine their importance in a definition of religion. It is concluded that although many aspects are typical and/or relevant, only certain cognitive, normative, and practical aspects are necessary conditions for religion. It is also concluded that the necessary conditions for a religious cognitive aspect is supernatural and normative content of a certain scope combined with a certain attitudinal character. The chapter ends with a model of the working definition based on these intermediate conclusions. Chapter six contains the second step in the conceptual analysis. It confronts the working definition with various cases of more or less contested examples of religion or other systems of beliefs and practices in order to assess whether the definition needs revisions. The following discussions of special cases of beginning and ceasing of religious traditions, persons, and objects serve the same purpose. It is concluded that a revision of the working definition is unnecessary. Chapter seven concludes part II by tying up a few loose ends concerning the definition, some methodological aspects, and theories of concepts. The third and last part of the thesis contains, first, a brief discussion of practical implications of definitions of religion. Chapter eight illustrates the practical importance of a definition of religion by addressing the issue of the so-called ‘politics of defining religion’. It argues that scholars of religion as such are not unjustified in entering the debate about definitions, and it recommends efforts are made to separate discussions about defining religion from discussions about using definitions of religion as political tools. The final chapter of the thesis sums up important findings and insights of the study and points to some natural limitations. I warn that this study is only a rough outline of how a definition can be provided and which theoretical discussions lie behind such an attempt. Yet I also conclude that defining religion is a rewarding case study because it offers an opportunity to discuss fundamental questions in both philosophy and the study of religion while at the same addressing an interesting issue with immediate practical implications. In this paper, we present a new account of teleological reasons, i.e. reasons to perform a particular action because of the outcomes it promotes. Our account gives the desired verdict in a number of difficult cases, including cases of overdetermination and non-threshold cases like Parfit’s famous _Drops of water._ The key to our account is to look more closely at the metaphysics of causation. According to Touborg (_The dual nature of causation_, 2018), it is a necessary condition for causation that (...) a cause increases the security of its effect. Building on this idea, we suggest, roughly, that you have a teleological reason to act in a certain way when doing so increases the security of some good outcome. This represents a middle way between the proposal that you have a reason to act in a certain way just in case this _would_ cause a good outcome and the proposal that you have a reason to act in a certain way just in case this _could_ cause a good outcome. This Correspondence argues in response to Coolsaet et al. (2024) that there is an important role to play for stance-independent justice discussions that are not tied to specific social, political or critical perspectives. These can be valuable for climate research audiences, but also as a basis upon which to critically debate and research injustices.

Using an ethnographic case study based in a UK state school for 11- to 18-year-olds, this paper explores the tensions that arose when the senior leadership team (SLT) introduced a justice-based ethic-of-care that prioritized good grades and equal treatment for all pupils over a feminist ethic-of-care (preferred by most teachers in non-leadership roles) that accentuated individual pupil need and placed greater emphasis on a broader social education. Through highlighting the tensions between a feminist ethic-of-care and a more ‘masculine’ style, justice-based (...) approach to care-ethics, the paper extends the organisational care-ethics literature. We emphasise that such tensions occurred whether the different ethics were enacted by men, women, or non-binary individuals. In order to better understand the tensions between these two ethical approaches, we draw upon the theoretical work of Donald Winnicott, which highlights the importance both of maternal and paternal roles during infancy. We update Winnicott’s ideas, noting how maternal and paternal caring roles can be undertaken by people of varied gender identities. Building on Winnicott’s theory, we propose a new ‘Parentalist’ ethic-of-care, which has the potential to balance and hold together ideas of both a feminist ethic-of-care, and a justice-based ethic. A Parentalist ethic-of-care could support teachers yet recognize the context of the contemporary neo-liberal environment, where most children need to attain formal qualifications in a marketized world, and where such measures of success are highly valued. Humans can follow different social learning strategies, sometimes oriented toward the models’ characteristics. The goal of the present study was to explore which who-strategy is preferentially followed in the technological context based on the models’ psychological characteristics. We identified three potential who-strategies: Copy the pedagogue, copy the engineer, and copy the friend. We developed a closed-group micro-society paradigm in which participants had to build the highest possible towers. Participants began with an individual building phase. Then, they were gathered to discuss (...) the best solutions to increase tower height. After this discussion phase, they had to make a new building attempt, followed by another discussion phase, and so forth for a total of six building phases and five discussion rounds. This methodology allowed us to create an attraction score for each participant. We also assessed participants’ theory-of-mind skills, technical-reasoning skills, and prosocialness to predict participants’ attraction scores based on these measures. Results show that we learn from engineers because they are the most successful. Their attraction power is not immediate, but after they have been identified as attractors, their technique is copied irrespective of their pedagogy or friendliness. These findings open avenues for the study of the cognitive bases of human technological culture. (shrink)

A growing body of research reveals that abusive supervision may have negative impacts in organizations. The purpose of the present study is to expand the knowledge regarding the impacts of this dysfunctional leadership behavior by examining its relationship with innovation in work teams. Specifically, we investigate the process through which abusive supervision may undermine team innovation by taking into account the mediating role of team proactive behavior. Moreover, we propose a boundary condition of the negative effect of abusive supervision by (...) considering leader–members interdependence as a moderator. Using a multisource approach, data were gathered from 394 members and 82 immediate supervisors in a public safety organization. Results of path analyses reveal that the relationship between abusive supervision and team innovation is mediated by team proactive behavior. Furthermore, we found that the relationship between abusive supervision and team proactive behavior is moderated by leader–members interdependence, such that this relationship is stronger when the level of interdependence is high. Taken together, the findings of this study improve the understanding of why and under what circumstances abusive supervision may impair team innovation. (shrink)

This paper also presents the role of analogy in the development of philosophy in China and how Mohism played a key role in establishing rigorous standards of evidence, logical reasoning, and argumentation that had a lasting impact on Chinese thought. BackgroundAs the range of therapeutic options in the field of oncology increases, so too does the strain on health care budgets. The imbalance between what is medically possible and financially feasible is frequently rendered as an issue of tragic choices, giving rise to public controversies around health care rationing.Main bodyWe analyse the Norwegian media discourse on expensive cancer drugs and identify four underlying premises: (1) Cancer drugs are de facto expensive, and one does not and should not question why. (2) (...) Cancer drugs have an indubitable efficacy. (3) Any lifetime gained for a cancer patient is an absolute good, and (4) cancer patients and doctors own the truth about cancer. Applying a principle-based approach, we argue that these premises should be challenged on moral grounds. Within the Norwegian public discourse, however, the premises largely remain unchallenged due to what we find to be unjustified claims of moral superiority. We therefore explore alternative framings of the issue of expensive cancer drugs and discuss their potential to escape the predicament of tragic choices.ConclusionsIn a media discourse that has seemingly stagnated, awareness of the framings within it is necessary in order to challenge the current tragic choices predicament the discourse finds itself in. In order to allow for a discourse not solely concerned with the issue of tragic choices, the premises that underlie it must be subjected to critical examination. As the field of oncology advances rapidly, we depend on a discussion of its opportunities and challenges that is meaningful, and that soberly addresses the future of cancer care—both its potential and its limits. "Civilization" stresses progress of science and technology, along with the process of globalization. This perspective promotes unity while respecting individuality. The research suggests that integrating ancient Chinese philosophy could enhance global cooperation by acknowledging the depth of cultural heritage and the importance of diverse societal values. Visual research methods like photography and digital storytelling are increasingly used in health and social sciences research as participatory approaches that benefit participants, researchers, and audiences. Visual methods involve a number of additional ethical considerations such as using identifiable content and ownership of creative outputs. As such, ethics committees should use different assessment frameworks to consider research protocols with visual methods. Here, we outline the limitations of ethics committees in assessing projects with a visual focus and highlight the sparse knowledge (...) on how researchers respond when they encounter ethical challenges in the practice of visual research. We propose a situated approach in relation to visual methodologies that encompasses a negotiated, flexible approach, given that ethical issues usually emerge in relation to the specific contexts of individual research projects. Drawing on available literature and two case studies, we identify and reflect on nuanced ethical implications in visual research, like tensions between aesthetics and research validity. The case studies highlight strategies developed in-situ to address the challenges two researchers encountered when using visual research methods, illustrating that some practice implications are not necessarily addressed using established ethical clearance procedures. A situated approach can ensure that visual research remains ethical, engaging, and rigorous. (shrink)

In this paper we suggest that there is a need to examine what is meant by “context” in Social Psychology and present an example of how to place identity in its social and institutional context. Taking the case of British naturalisation, the process whereby migrants become citizens, we show that the identity of naturalised citizens is defined by common-sense ideas about Britishness and by immigration policies. An analysis of policy documents on “earned citizenship” and interviews with naturalised citizens shows that (...) the distinction between “elite” and “non-elite” migrants is evident in both the “reified” sphere of policy and the “common sense” sphere of everyday identity construction. While social representations embedded in lay experience construct ethno-cultural similarity and difference, immigration policies engage in an institutionalised positioning process by determining migrants' rights of mobility. These spheres of knowledge and practice are not disconnected as these two levels of “managing otherness” overlap—it is the poorer, less skilled migrants, originating outside the West who epitomise difference (within a consensual sphere) and have less freedom of mobility (within a reified sphere). We show that the context of identity should be understood as simultaneously psychological and political. (shrink)

The project scrutinizes the prevalent themes associated with paradisiacal imagery, dissecting the intricate weave of religious doctrines, mythologies, and the intrinsic nature of paradise – be it a tangible realm or a metaphysical state. This inquiry critically assesses the role of AI-generated art, derived from complex algebraic formulations, in mirroring conventional (...) iconography and exposing inherent biases. Such revelations underscore the cultural resonance of diverse traditions and the potential presence of subconscious prejudices. Employing AI algorithms capable of transforming textual prompts into vivid illustrations, this research unveils insights into the nexus of AI and cultural portrayals of utopia, thereby provoking profound philosophical deliberations. Central to these contemplations is the extent of human dominion over conceptualized ideals and the prospect of AI-crafted art inadvertently molding our paradisiacal perceptions, with implications ranging from reinforcement of stereotypes to shaping intrinsic cognitive schemas. ABSTRACT This paper aims to illustrate the contribution of Acquisition Linguistics combined with the dialogic view driven by Bakhtin’s ideas, in order to describe morpho-syntactic acquisitions. According to the first approach, interaction is the main driver of syntactic acquisition processes, especially adults’ adjustments to the morpho-syntactic attempts of children and children’s repetitions of adults’ speech. In parallel, a dialogic approach to language acquisition focuses on how the two speakers’ co-construction of discourse leads children to use and acquire the linguistic ability (...) to share and construct meaning in discourse. We analyse conversations between adults and children aged between 2 and 4 years old, with typical and atypical developments. Our results show how inter-discursive facts in dialogue and repetition in interaction are major contributors of language acquisition processes. (shrink)

Resumo: Este estudo objetiva retomar o diálogo efetuado entre a tradição da ontologia hermenêutica heideggeriana e a psicanálise freudiana, a fim de discutir se ele ainda tem lugar na atualidade e, em caso positivo, problematizar como ele tem sido construído. Apesar de existirem muitos argumentos que questionam a possibilidade de articulação entre esses dois campos, eles não encerram consensualmente essa discussão e exigem ser atualizados. No cenário mais recente, algumas pesquisas têm acenado para o estabelecimento de pontos de conexões entre (...) elas, sem, contudo, desconsiderarem a especificidade dos campos teóricos em questão. Essa forma de interlocução parece o grande desafio aos pesquisadores na atualidade.: This study aims to retake the dialogue made between the tradition of the heideggerian hermeneutic ontology and freudian psychoanalysis, in order to discuss whether it still has a place in the actuality and, if so, to problematize how it has been constructed. Despite having a lot of arguments which question the possibility of articulation between both fields, they don't enclose consensually this debate and require an updating. In the last scenario, some researches go towards the establishment of connection points among them, without, however, disregarding the specificity of the theoretical fields in question. The research aims to investigate the characteristics and risks associated with the handling of sensitive data in the implementation of public policies within the digital government model. To achieve this, a hypothetical-deductive method and bibliographic and documentary procedures are employed, proposing an interdisciplinary discussion on technological advancement, data protection, transparency, and public policies. The justification revolves around the importance of a comprehensive, cohesive system that genuinely protects sensitive personal data, considering the need to keep pace with technological developments and maintain (...) a minimum level of security in the digital age at both national and international levels. There is no doubt that the judicious and strategic use of data has the potential to drive substantial improvements in policy evaluation, decision-making, and the relationship between government and citizens. However, dealing with personal data also means addressing risks with responsibility, transparency, and respect for individual rights. (shrink)

: Para que se possa abordar a sociabilidade em Hannah Arendt (1906-1975), é importante mencionar a importância que a autora confere, em suas obras, à necessidade de organização dos grupos humanos por meio de regras, assim como de que essas regras sejam seguidas para a preservação da vida em conjunto. Segundo a autora, a política é a maneira humana de convívio entre os homens e mulheres por meio do gerenciamento de questões emergentes, sem o uso de qualquer coação. Ainda, para (...) ela, a igualdade não se origina da linhagem, do status social, mas da igualdade no sentido de poder agir em conjunto. Assim o indivíduo tem um importante papel a ser exercido na esfera política, enquanto cidadão. Nesse contexto, é preciso que haja um “espaço público”, bem como, que os cidadãos tenham a liberdade para expressar-se, podendo contestar, discutir as ideias e ideais, sem utilizar-se de qualquer tipo de violência, buscando, por meio dessa elaboração conjunta, adquirir outros direitos, por exemplo, à saúde, à educação, à moradia, ao emprego. A existência da possibilidade de ver e ser visto, discordar e poder expor isso, para Arendt, apenas ocorre em uma convivência política, na pluralidade, buscando a elaboração de regras para a organização do grupo em que vivem e pelo qual se sentirão partícipes e responsáveis. Ou seja, é uma atitude que ocorre em um espaço público de encontro de iguais, enquanto cidadãos, diferentes, enquanto seres únicos por nascimento, a fim de conseguir, mesmo que momentaneamente, a garantia de paz no convívio das singularidades. O presente texto visa a destacar a importância da necessidade dos laços de sociabilidade em um Estado Democrático de Direito, a partir da obra Origens do Totalitarismo, no qual Arendt descreve o Regime Totalitário vivenciado por ela, bem como, a ruptura dos laços de sociabilidade, fatos passíveis de discussão para pensar a situação política, não somente do Brasil como também de outros estados considerados democráticos. Confidentiality is one of the foundations on which psychotherapy is built. Limitations on confidentiality in the therapeutic process have been explained and explored by many authors and organizations. However, controversy and confusion continue to exist with regard to the limitations on confidentiality in situations where clients are considering their options at the end of life and after a client has died. This article reviews these 2 areas and provides some suggestions for future research.

The majority of food in the US is distributed through global/national supply chains that exclude locally-produced goods. This situation offers opportunities to increase local food production and consumption and is influenced by constraints that limit the scale of these activities. We conducted a study to assess perspectives of producers and consumers engaged in food systems of a major Midwestern city. We examined producers’ willingness to include/increase cultivation of local foods and consumers’ interest in purchasing/increasing local foods. We used focus groups (...) of producers (two groups of conventional farmers, four local food producers) and consumers (three conventional market participants, two locavores) to pose questions about production/consumption of local foods. We transcribed discussions verbatim and examined text to identify themes, using separate affinity diagrams for producers and consumers. We found producers and consumers are influenced by the _status quo_ and real and perceived barriers to local foods. We also learned participants believed increasing production and consumption of local foods would benefit their community and creating better infrastructure could enhance efforts to scale up local food systems. Focus group participants also indicated support from external champions/programs could support expansion of local foods. We learned that diversifying local food production was viewed as a way to support local community, increase access to healthy foods and reduce environmental impacts of conventional production. Our research indicates that encouraging producers and consumers in local food systems will be more successful when support for the local community is emphasized. (shrink)

L'ouvrage publié réunit les actes d'une journée d'étude consacrée à L'imprévu et le droit, souhaitée par les doctorants et organisée par l'Ecole doctorale de droit comparé de l'Université Paris 1 Panthéon-Sorbonne. Le sujet est immédiatement apparu très riche. Si le terme d'imprévu n'est pas essentiellement juridique, il fait écho à des critères du droit tels que la prévisibilité d'une situation ou d'un texte, ou l'imprévisibilité d'un événement comme cause exonératoire de responsabilité. Il renvoie plus généralement à l'exigence de sécurité juridique (...) qui s'opposerait à l'imprévu juridique. En outre le contexte était des plus propices, quelle que soit la discipline concernée, droit public, droit privé et/ou droit pénal. L'imprévu est entendu comme tout ce qui n'a pas été prévu, tout ce qui arrive lorsqu'on ne s'y attend pas. Prévoir, c'est admettre comme probable. La question de l'imprévu confronté au droit est intéressante car les deux concepts semblent antinomiques. Le droit apparaît en effet comme quelque chose de figé, permettant de régler par anticipation les comportements humains. Il doit permettre à chacun de régler sa conduite puisque nul n'est censé ignorer la loi. Le droit doit donc être à la fois connu et prévisible dans ses effets même s'il n'en est pas toujours ainsi. La notion d'imprévu semble rencontrer le droit de deux manières. D'une part, il existe la norme imprévue : la norme nouvelle, la coutume en formation ou l'interprétation surprenante. Se posent alors les questions de la prévisibilité du droit, et corrélativement celle de la sécurité juridique. D'autre part, il y a le fait imprévu. La norme doit se saisir de comportements humains ou de situations de fait qui n'avaient pas été anticipés. L'appréhension du risque et de la survenance d'événements inattendus par des règles de droit préexistantes devient alors un enjeu essentiel. (shrink)

Digital Earth applications provide a common ground for visualizing, simulating, and modeling real-world situations. The potential of Digital Earth applications has increased significantly with the evolution of artificial intelligence systems and the capacity to collect and process complex amounts of geospatial data. Yet, the widespread techno-optimism at the root of Digital Earth must now confront concerns over high-risk artificial intelligence systems and power asymmetries of a datafied society. In this commentary, we claim that not only can current debates about data (...) governance and ethical artificial intelligence inform development in the field of Digital Earth, but that the specificities of geospatial data, together with the expectations surrounding Digital Earth applications, offer a fruitful lens through which to examine current debates on data governance and artificial intelligence ethics. In particular, we argue that for the implementation of ethical artificial intelligence and inclusive approaches to data governance, Digital Earth initiatives need to involve stakeholders and communities at the local level and be sensitive to social, legal, cultural, and institutional contexts, including conflicts that might arise within those contexts. Husserlian reduction is a rigorous method for describing the foundations of psychiatric experience. With Jaspers we consider three main principles inspired by phenomenological reduction: direct givenness, absence of presuppositions, re-presentation. But with Binswanger alone we refer to eidetic and transcendental reduction: to establish a critical epistemology; to directly investigate the constitutive processes of mental phenomena and their disturbances, freed from their nosological background; to question the constitution of our own experience when facing a person with mental illness. Regarding the last (...) item, we suggest a specific kind of reduction, typically intersubjective from the start, which we call the ‘looking-glass reduction'. The schizophrenic experience -- understood as a ‘loss of taken-for-grantedness’ implying the constitutions of the body, of the other, and of internal time -- is a real ‘epochal provocation’ for the psychiatrist. As the horizon it opens seems to be both corporeal and narrative, this ‘provoking’ of an epoche in the attitude of the psychiatrist himself and the resistances it implies raise important issues regarding the general constitution of human experience. Nearly five centuries have elapsed since Apollonia von Freyberg departed from her convent in Mülhausen. Little is known about this Poor Clare nun who witnessed the dissolution of her conventual shelter in the midst of her community’s protracted financial struggles as well as spiritual conflict catalyzed by the emerging Reformation. It is fortuitous, however, that documents related to Apollonia are preserved at the National Gallery of Art in Washington, DC and at the Archives de Mulhouse, in Mulhouse, France. In order to implement cost-benefit analysis of protective actions to reduce radiological exposures, one needs to attribute a monetary value to the avoided exposure. Recently, the International Commission on Radiological Protection has stressed the need to take into consideration not only the collective exposure to ionising radiation but also its dispersion in the population. In this paper, by using some well known and some recent results in the economics of uncertainty, we discuss how to integrate these recommendations in the valuation (...) of the benefit of protection. Background There is growing consensus in favor of returning individual specific research results that are clinically actionable, valid, and reliable. However, deciding what and how research results should be returned remains a challenge. Researchers are key stakeholders in return of results decision-making and implementation. Multi-omics data contains medically relevant findings that could be considered for return. We sought to understand researchers' views regarding the potential for return of results for multi-omics data from a large, national consortium generating multi-omics data. Methods (...) Researchers from the Molecular Transducers of Physical Activity Consortium (MoTrPAC) were recruited for in-depth semi-structured interviews. To assess understanding of potential clinical utility for types of data collected and attitudes towards return of results in multi-omic clinical studies, we devised an interview guide focusing on types of results generated in the study for hypothetical return based on review of the literature and professional expertise of team members. The semi-structured interviews were recorded, transcribed verbatim and co-coded. Thematic trends were identified for reporting. Results We interviewed a total of 16 individuals representative of 11 sites and 6 research roles across MoTrPAC. Many respondents expressed positive attitudes regarding hypothetical multi-omics results return, citing participant rights to their data and perception of minimal harm. Ethical and logistical concerns around the return of multi-omics results were raised, and they often mirrored those in the published literature for genomic return of results including: uncertain clinical validity, a lack of expertise to communicate results, and an unclear obligation regarding whether to return multi-omics results. With the exception of privacy concerns, respondents were able to give examples within multi-omics of how each point was relevant. Further, researchers called for more guidance from funding agencies and increased researcher education regarding return of results. Conclusion Overall, researchers expressed positive attitudes toward multi-omic return of results in principle, particularly if medically actionable. However, competing ethical considerations, logistical constraints, and need for more external guidance were raised as key implementation concerns. Future studies should consider views and experiences of other relevant stakeholders, specifically clinical genomics professionals and study participants, regarding the clinical utility of multi-omics information and multi-omics results return. This study aimed to outline the profile of retractions of scientific articles on COVID-19 published in journals indexed in the Scopus database between 2020 and 2021. To analyze the data, we used a bibliometric technique, with the Bibliometrix package in the R-Studio software, and descriptive statistics. Twenty-nine retractions were analyzed, and we found that the most common reasons for retraction were related to ethical issues and that 68.97% of authors have previously retracted articles. We concluded that there appears to have (...) been a change in the publication policies of journals, which resulted in an increase in scientific retractions related to COVID-19 during the study period.
