Awareness of the risks posed by excess nitrogen is low beyond the scientific community. As public understanding of scientific issues is partly influenced by news reporting, this article is the first to study how the British press has discussed nitrogen pollution. A corpus-assisted frame analysis of newspaper articles highlighted five frames: Activism, where environmental charities and organizations are portrayed as having an active role in fighting pollution; Government Responsibility, where privatization is presented as central and positioned as one of the (...) main causes of pollution; Industry Responsibility, in which industries’ actions are depicted as causing pollution to increase; Pollutions as Politics, in which pollution is not discussed as a problem to be solved but rather as a means to increase votes; and Risk, where readers are warned about the possible effects of pollution on human health, flora and fauna. The analysis also points to the absence of named scientists and sources with the coverage being dominated by politicians. (shrink)

While the value of the extended mind hypothesis for human cognition is disputed, this paper examines the explanatory utility of the extended mind framework in the domain of AI systems, specifically the Google self-driving car. I argue that the cognitive architecture of the Google-car is best explained as an instance of extended cognition. The argument for this claim begins with a description of the Google-car’s cognitive architecture, including the indispensable role of “prior maps” in its performance. I then argue that (...) the hypothesis of extended cognition provides a better explanation of the Google-car’s performance than two rival, non-extended alternatives. Consideration of the Google-car also offers insight into whether driverless vehicles have achieved human-level competency in the cognitive skills required for driving, or instead remain “poor substitutes.”. In the restoration of art and artifacts there are three salient types of value to consider: relic, aesthetic, and practical. Relic value includes an object’s age, aura, originality, authenticity, and epistemic value. Aesthetic value is connected to how an object looks, sounds, or tastes. Practical value involves whether a thing can be used as designed—whether a book can be read, a building occupied, a car driven. I argue that while these are all legitimate values, it is impossible for a restorer (...) to maximize them all. I conclude that restoration inexorably involves aesthetic choices; there is no supreme value to be maximized and we should be pluralists about the right balance of values. Restoration is like baking a cake; there are many wrong ways to do it, but there are many right ways as well. (shrink)

The United States is in its fifth year of what is now widely referred to as “the new medical malpractice crisis.” Although some professional liability insurers have begun to report improvements in their overall financial margins, there are few signs that the trend toward higher costs is reversing itself - particularly for doctors and hospitals. In 2003-2004, the presidential election and tort reform proposals in Congress brought heightened public attention to the need for some type of policy intervention to ease (...) the effects of the crisis.The darling of tort reformers at both the federal and state levels has been legislation to limit, or “cap,” damages awarded to plaintiffs in malpractice cases. Health care provider groups, liability insurers, and the Bush Administration have all seized on the example of California's MICRA law, which since 1975 has capped noneconomic damages in malpractice cases at a flat $250,000, as the path to financial recovery. THE TITLE OF THIS PAPER calls for clarification. Not only are there several senses in which something may be said to "be," there are also many nuances to the terms "categorial" and "intuition." Taking Aristotle as a guide, let us focus upon the primary sense of "being," that is, substance considered both as first substance and second substance. We may then take "categorial" as referring to what Aristotle calls the "figures of predication," the ways in which predicates characterize subjects, indicating (...) "what" the subject is, its quality, quantity, relation, its "where," its "when," and so forth. The term "intuition" expresses something too primitive to be defined, but Edmund Husserl's metaphorical contrast between the "emptiness" of thought and speech and the "fullness" of intuition successfully highlights its essential characteristic. A couple of examples should suffice to grasp the import of Husserl's distinction. Consider the difference, for instance, between first entertaining vague plans of visiting a foreign city and then experiencing the fulfillment of actually strolling through its streets, or the difference between first reading a manual of instructions for performing some task and then actually executing the task skillfully. Taking Husserl as a guide, let us therefore characterize intuition broadly as the presentation of something in its fullness, as opposed to thinking or talking about it in an empty way. Finally, combining Husserlian and Aristotelian terminologies, we may describe categorial intuition as the presentation of figures of predication. Rather than presenting some particular thing, say a red chair, categorial intuition presents the chair's being red, the red quality's belonging to the chair. The United States juvenile justice system has primary oversight of youth who come into contact with legal authorities. This system is purposefully distinct from the adult system given the presumption of youths’ reduced culpability for delinquent behavior and increased potential for rehabilitation. Some juvenile court policies and practices are supportive of youth while others may drive youth further into the juvenile justice system. Today, we are at a point in which we can—and should—use information technology to accrue data to unpack (...) the impact of these policies and practices on and across youth. Moreover, technology-driven policies and practices such as electronic monitoring may be detrimental to the well-being of youth, whereas others such as video conferencing could be more widely used to benefit youth. While juvenile courts hold youth accountable for their behavior, courts also need to be accountable to youth by employing data-informed policies and practices that advance the health and well-being of youth. Much of the research on the delivery of advice by professionals such as physicians, health workers and counsellors, both on the telephone and in face-to-face interaction more generally, has focused on the theme of client resistance and the consequent need for professionals to adopt particular formats to assist in the uptake of the advice. In this article we consider one setting, Kid’s Helpline, the national Australian counselling service for children and young people, where there is an institutional mandate not to (...) give explicit advice in accordance with the values of self-direction and empowerment. The article examines one practice, the use of script proposals by counsellors, which appears to offer a way of providing support which is consistent with these values. Script proposals entail the counsellors packaging their advice as something that the caller might say — at some future time — to a third party such as a friend, teacher, parent or partner, and involve the counsellor adopting the speaking position of the caller in what appears as a rehearsal of a forthcoming strip of interaction. Although the core feature of a script proposal is the counsellor’s use of direct reported speech, they appear to be delivered not so much as exact words to be followed, but as the type of conversation that the client needs to have with the third party. Script proposals, in short, provide models of what to say as well as alluding to how these could be emulated by the client. In their design, script proposals invariably incorporate one or more of the most common rhetorical formats for maximizing the persuasive force of an utterance such as a three-part list or a contrastive pair. Script proposals, moreover, stand in a complex relation to the prior talk and one of their functions appears to be to summarize, respecify or expand upon the client’s own ideas or suggestions for problem solving that have emerged in these preceding sequences. We evaluate here the performance of four models of cross-situational word learning: two global models, which extract and retain multiple referential alternatives from each word occurrence; and two local models, which extract just a single referent from each occurrence. One of these local models, dubbed Pursuit, uses an associative learning mechanism to estimate word-referent probability but pursues and tests the best referent-meaning at any given time. Pursuit is found to perform as well as global models under many conditions extracted from (...) naturalistic corpora of parent-child interactions, even though the model maintains far less information than global models. Moreover, Pursuit is found to best capture human experimental findings from several relevant cross-situational word-learning experiments, including those of Yu and Smith (), the paradigm example of a finding believed to support fully global cross-situational models. Implications and limitations of these results are discussed, most notably that the model characterizes only the earliest stages of word learning, when reliance on the co-occurring referent world is at its greatest. Bertrand Russell's work on the foundations of mathematics apparently played a decisive role in persuading Wittgenstein to abandon his aeronautical engineering studies in favor of philosophy. Wittgenstein's influence on Russell turned out to be profound as well: two years after they first met, Wittgenstein had delivered an objection to Russell's theory of judgment that was so devastating that it led to the abandonment of a major philosophical project of Russell's, leaving him reportedly “paralysed”. Two fundamental elements are pivotal to the (...) logicism of Russell's Principles of Mathematics: his conception of a proposition, and his commitment to the doctrine of the unrestricted variable. In addition to the ontological problems facing his theory of propositions, Russell also became convinced that his ontology of propositions contained fundamental logical problems, as he encountered recurring contradictions in his attempts to formalize a propositional logic that would comport with his philosophical theory. Gallup Polls have reported on the perceived ethics of various professions in the US since 1976. Clergymen and pharmacists were consistently identified as two of the most ethical professionals in the 1980''s and 1990''s. Business executives have not fared well in these polls and have not been rated among the top ten most ethical professions in any of the years the poll was taken. Ethical codes have not done much to belay the perception that the US business executive is not (...) very ethical. Whether the Sarbanes-Oxley Act will impact the ethical behavior of business executives remains to be seen. (shrink)

Humility holds a modest but important place among the judicial virtues. But in spite of its growing popularity, it does not yet have a place on the ‘central judicial virtues’ lists. This paper provides an argument that judicial humility, especially institutional judicial humility, should be considered a necessary judicial virtue at least in common-law jurisdictions. This is because it is a necessary ingredient in precedent-based decisions that are fully justified from the point of view of the law and of political (...) morality. Further, while it is sufficient that individual judges make decisions that a humble judge would have made, the judicial community must in fact be humble in order to produce fully justified common-law decisions – humility is therefore necessary as a community-virtue. Feminist argumentation theorists have criticized the Dominant Adversarial Model in argumentation, according to which arguers should take proponent and opponent roles and argue against one another. The model is deficient because it creates disadvantages for feminine gendered persons in a way that causes significant epistemic and practical harms. In this paper, I argue that the problem that these critics have pointed out can be generalized: whenever an arguer is given a role in the argument the associated tasks and norms of (...) which she cannot fulfill, she is liable to suffer morally significant harms. One way to react to this problem is by requiring arguers to set up argument structures and allocate roles so that the argument will be reasons-reflective in as balanced a way as possible. However, I argue that this would create to heavy a burden. Arguers would then habitually have to take on roles that require them to divert time and energy away from the goals that they started arguing for and instead serve the goal of ideal reasons-reflectiveness. At least prima facie arguers should be able to legitimately devote their time and energy towards their own goals. This creates a problem: On the one hand, structures that create morally significant harms for some arguers should be avoided—on the other hand, arguers should be able to take argument-roles that allow them to devote themselves to their own argumentative goals. Fulfilling the second requirement for some arguers will often create the morally significant harms for their interlocutors. There are two possible solutions for this problem: first, arguers might be required to reach free, consensual agreements on the structure they will adopt for their argument and the way they will distribute argumentative roles. I reject this option as both fundamentally unfeasible and practically unrealistic, based on arguments developed by theorists like Krabbe and Jacobs. I argue that instead, we should take a liberal view on argument ethics. Arguers should abide by moral side constraints to their role taking. They should feel free to take roles that will allow them to concentrate on their argumentative goals, but only if this does not create a situation in which their interlocutors are pushed into a role that that they cannot effectively play. Bertrand Russell's 1903 masterpiece "The Principles of Mathematics" places great emphasis on the need to separate propositions from psychological items such as thoughts. In 1919 Russell explicitly retracts this view, however, and defines propositions as "psychological occurrences". These psychological occurrences are held by Russell to be mental images. In this paper, I seek to explain this radical change of heart. I argue that Russell's re-psychologising of the proposition in 1919 can only be understood against the background of his struggle with (...) the problem of the unity of the proposition in earlier work. Once this is recognized, and the solution to the problem offered by the 1919 theory is appreciated, new light is also shed on Russell's naturalism. I go on to compare Russell's psychological "picture theory" with the vehemently anti-psychological picture theory of Wittgenstein's "Tractatus Logico-Philosophicus" and suggest that, once the background of the dispute is brought into clearer focus, Russell's position can be seen to have many advantages over its more celebrated rival. BackgroundType-Token Ratio, given its relatively simple hand computation, is one of the few LSA measures calculated by clinicians in everyday practice. However, it has significant well-documented shortcomings; these include instability as a function of sample size, and absence of clear developmental profiles over early childhood. A variety of alternative measures of lexical diversity have been proposed; some, such as Number of Different Words/100 can also be computed by hand. However, others, such as Vocabulary Diversity and the Moving Average Type Token (...) Ratio rely on complex resampling algorithms that cannot be conducted by hand. To date, no large-scale study of all four measures has evaluated how well any capture typical developmental trends over early childhood, or whether any reliably distinguish typical from atypical profiles of expressive child language ability.Materials and MethodsWe conducted linear and non-linear regression analyses for TTR, NDW, VocD, and MATTR scores for samples taken from 946 corpora from typically developing preschool children, engaged in adult-child toy play, from the Child Language Data Exchange System. These were contrasted with 504 samples from children known to have delayed expressive language skills. We also conducted a separate sub-analysis which examined possible contextual effects of sampling environment on lexical diversity.ResultsOnly VocD showed significantly different mean scores between the typically -developing children and delayed developing children group. Using TTR would actually misdiagnose typical children and miss children with known language impairment. However, computation of VocD as a function of toy interactions was significant and emerges as a further caution in use of lexical diversity as a valid proxy index of children’s expressive vocabulary skill.DiscussionThis large scale statistical comparison of computer-implemented algorithms for expressive lexical profiles in young children with traditional, hand-calculated measures showed that only VocD met criteria for evidence-based use in LSA. However, VocD was impacted by sample elicitation context, suggesting that non-linguistic factors, such as engagement with elicitation props, contaminate estimates of spoken lexical skill in young children. The postgenomic era has seen rapid shifts in research methodology, funding, scientific labor, and disciplinary structures. Postgenomics is transforming our understanding of disease and health, our environment, and the categories of race, class, and gender. At the same time, the gene retains its centrality and power in biological and popular discourse. When evaluating the arguer instead of the argument, we soon find ourselves confronted with a puzzling situation: what seems to be a virtue in one argumentative situation could very well be called a vice in another. This paper will present the idea that there are in fact two sets of virtues an arguer has to master—and with them four sometimes very different roles.

In response to a commentary on our research article (Azima and Mundler in Agric Hum Values 39:791–807, 2022), we address the argument that increased reliance on family farm labor with low or no opportunity costs leads to higher net revenue and greater economic satisfaction. Our response provides a nuanced perspective on this issue in the context of short food supply chains. We also examine the share of total farm sales from short food supply chains in terms of its effect size (...) on farmer job satisfaction. Finally, we emphasize the need for further research into the sources of occupational satisfaction among farmers involved in such marketing channels. (shrink)

It is well known that Russell abandoned his multiple-relation theory of judgment, which provided the philosophical foundations for _PM_'s ramified type-theory, in response to criticisms by Wittgenstein. Their exact nature has remained obscure. An influential interpretation, put forth by Sommerville and Griffin, is that Wittgenstein showed that the theory must appeal to the very hierarchy it is intended to generate and thus collapses into circularity. I argue that this rests on a mistaken interpretation of type-theory and suggest an alternative one (...) to explain Russell's reaction. (shrink)

Is argumentation essentially adversarial? The concept of a devil's advocate—a cooperative arguer who assumes the role of an opponent for the sake of the argument—serves as a lens to bring into clearer focus the ways that adversarial arguers can be virtuous and adversariality itself can contribute to argumentation's goals. It also shows the different ways arguments can be adversarial and the different ways that argumentation can be said to be "essentially" adversarial.

This paper provides a game-theoretic analysis of contrastive focus, extending insights from recent work on the role of noisy communication in prosodic accent placement to account for focus within sentences, sub-sentential phrases and words. The shared insight behind these models is that languages with prosodic focus marking assign prosodic prominence only within elements which constitute material critical for successful interpretation. We first take care to distinguish the information-structural notion of focus from an ontologically distinct notion of givenness marking, and then (...) outline the core properties of focus. We then introduce a signaling game between a speaker and hearer in which the goal is to transmit semantic content with the smallest signal possible. We apply the Iterated Best Response method of Franke to find equilibrium strategies in this game, where a unique equilibrium strategy in this case picks out the “critical information” of an utterance, which by hypothesis constitutes its focus. We show that iterating this game at different syntactic levels of a sentence makes correct predictions about the role of contrast in determining stress within words and phrases, and can be extended to account for association and second occurrence focus effects. This article introduces Harvey Brown and Oliver Pooley’s ‘dynamical approach’ to special relativity, and argues that it may be construed as a relationalist form of Einstein’s ‘practical geometry’. This construal of the dynamical approach is shown to be compatible with related chapters of Brown’s text and also with recent descriptions of the dynamical approach by Pooley and others.

This paper investigates the process of reasoning through which a judge determines whether a precedent-case gives her a binding reason to follow in her present-case. I review the objections that have been raised against the two main accounts of reasoning by precedent: the rule-account and the analogy-account. I argue that both accounts can be made viable by amending them to meet the objections. Nonetheless, I believe that there is an argument for preferring accounts that integrate analogical reasoning: any account of (...) reasoning by precedent that is descriptively minimally adequate will leave some room for judicial discretion. Discretion should be used under consideration of the best legally relevant arguments for and against a decision. Integrating analogical reasoning helps the judge to bring to her own attention the strongest case for following. Analogical reasoning also eases the recognition of possible reasons for distinguishing. Thereby, it facilitates a more balanced decision-making process. (shrink)

Successful psychopaths, defined as individuals in the general population who nevertheless possess some degree of psychopathic traits, are receiving increasing amounts of empirical attention. To date, little is known about such individuals, specifically with regard to how they respond to ethical dilemmas in business contexts. This study investigated this relationship, proposing a mediated model in which the positive relationship between psychopathy and unethical decision-making is explained through the process of moral disengagement, defined as a cognitive orientation that facilitates unethical choice. The literature on affective determinants of physical activity is growing rapidly. The present paper aims to provide greater clarity regarding the definition and distinctions among the various affect-related constructs that have been examined in relation to PA. Affective constructs are organized according to the Affect and Health Behavior Framework, including: affective response to PA; incidental affect; affect processing; and affectively charged motivational states. After defining each category of affective construct, we provide examples of relevant research showing how each construct may (...) relate to PA behavior. ABSTRACT This paper contributes to the debate about the strawman fallacy. It is the received view that strawmen are employed to fool not the arguer whose argument they distort, but instead a third party, an audience. I argue that strawmen that fool their victims exist and are an important variation of the strawman fallacy because of their special perniciousness. I show that those who are subject to hermeneutical lacunae or who have since forgotten parts of justifications they have provided earlier (...) are especially vulnerable to falling for strawmen aimed at their own positions or arguments. Adversarial argumentation provides especially fertile ground for strawmen that fool their own victims, but cooperative argumentation is no fail-safe protection from them either. (shrink)

The law of torts is concerned with the secondary obligations generated by the infringement of primary rights. This work seeks to show that this apparently simple proposition enables us to understand the law of torts as found in the common law. Using primarily English materials, but drawing heavily upon the law of other common law jurisdictions, Stevens seeks to give an account of the law of torts which relies upon the core material familiar to most students and practitioners with (...) a grasp of the law of torts. This material is drawn together in support of a single argument in a provocative and accessible style, and puts forward a new theoretical model for analysing the law of torts, providing an overarching framework for radically reconceiving the subject.
