This study examined health professionals’ (HPs) experience, beliefs and attitudes towards brain death (BD) and two types of donation after circulatory death (DCD)—controlled and uncontrolled DCD. Five hundred and eighty-seven HPs likely to be involved in the process of organ procurement were interviewed in 14 hospitals with transplant programs in France, Spain and the US. Three potential donation scenarios—BD, uncontrolled DCD and controlled DCD—were presented to study subjects during individual face-to-face interviews. Our study has two main findings: (1) In the (...) context of organ procurement, HPs believe that BD is a more reliable standard for determining death than circulatory death, and (2) While the vast majority of HPs consider it morally acceptable to retrieve organs from brain-dead donors, retrieving organs from DCD patients is much more controversial. We offer the following possible explanations. DCD introduces new conditions that deviate from standard medical practice, allow procurement of organs when donors’ loss of circulatory function could be reversed, and raises questions about “death” as a unified concept. Our results suggest that, for many HPs, these concerns seem related in part to the fact that a rigorous brain examination is neither clinically performed nor legally required in DCD. Their discomfort could also come from a belief that irreversible loss of circulatory function has not been adequately demonstrated. If DCD protocols are to achieve their full potential for increasing organ supply, the sources of HPs’ discomfort must be further identified and addressed. (shrink)

Several studies have explored differences between North American and European doctor patient relationships. They have focused primarily on differences in philosophical traditions and historic and socioeconomic factors between these two regions that might lead to differences in behaviour, as well as divergent concepts in and justifications of medical practice. However, few empirical intercultural studies have been carried out to identify in practice these cultural differences. This lack of standard comparative empirical studies led us to compare differences between France and the (...) USA regarding end-of-life decision-making. We tested certain assertions put forward by bioethicists concerning the impact of culture on the acceptance of advance directives in such decisions. In particular, we compared North American and French intensive care professional's attitudes toward: (1) advance directives, and (2) the role of the family in decisions to withhold or withdraw life-support. Se buscará comprender la necesidad de abandonar los intentos de retornar al proyecto «humanístico» y se señalará su mayor riesgo: el «cínico ilustrado». Adicionalmente, se considerará «el humanismo» como el solemne destello de una «estrella que murió hace mucho» pero que da señales para la construcción de una ética excéntrica fundada en la compasión y (...) el dolor. Overview The evolution of multicellularity raises questions regarding genomic and developmental commonalities and discordances, selective advantages and disadvantages, physical determinants of development, and the origins of morphological novelties. It also represents a change in the definition of individuality, because a new organism emerges from interactions among single cells. L’atmosphère« Atmosphère » est un terme employé communément par des auteurs dans le domaine de l’esthétique que dans celui de la météorologie. Ils le comprennent pourtant de manière assez différente, chacun prétendant que leur emploi est la plus fondamentale et que l’autre est seulement métaphorique. Pour les esthéticiens, l’atmosphère réelle est une aura qui émane des choses et qui affecte nos humeurs et nos motivations; pour les météorologistes, il s’agit de l’enveloppe gazeuse qui entoure la planète. Je montre que les (...) deux sens excluent l’air ou le réduisent à un éther immatériel. D’une part, pour la science météorologique, tout se passe comme l’air était enfermé à l’intérieur et considéré comme un ensemble d’effets mesurables et calculables. D’autre part,l’esthétique de l’affect a relié l’atmosphère aux formes solides des artéfacts et des paysages. En ramenant le medium aérien, je cherche une signification de l’atmosphère qui transcende l’opposition entre l’affectif et le météorologique. Je le fais en suivant Merleau-Ponty, qui traite l’atmosphère comme un espace d’inspiration et d’expiration. En tant que tel, il correspond étroitement à ce que Merleau-Ponty lui-même appelle la « chair ». Ce concept pourrait aussi être traduit par « meshwork » (réseau/filet/grillage), référant à ces faisceaux de lignes et de chemins par lesquels chaque être humain est cousu à la fabrique du monde. Pour Merleau-Ponty, la portée de la notion de chair réside dans l’affirmation que la perception est fondamentalement réversible. On ne peut être sentant que dans un monde sentant; c’est pourquoi, comme il le soutient, notre perception des choses dans l’environnement répond à la perception par l’environnementde notre soi. Cependant, je soutiens au contraire que ces deux mouvements d’inspiration et d’expiration ne sont pas le contraire exact l’un de l’autre. Comme le mouvement de la brasse en nataion, le premier est un mouvement de rassemblement et le second de propulsion. Nous inhalons l’atmosphère, mais nous exhalons selon les lignes du réseau. Bref, réseau et atmosphère sont deux côtés de la chair, et c’est dans leur alternance rythmique que nous trouvons la relation entre les lignes et le temps météorologique, qui est, comme je le soutiens, fondamental à la vie.L’atmosfera‘Atmosfera’ è una parola usata comunemente tanto da chi scrive di estetica come dai metereologi. Da una parte, per la scienza metereologica, è come se l’aria fosse stata portata al chiuso e presentata come una serie di effetti misurabili e calcolati. Dall’altra, l’estetica dell’affetto ha legato l’atmosfera alle forme solide degli artefatti e dei paesaggi.Nel reintrodurre l’ambiente aereo, intendo trovare un significato di atmosfera che trascenda l’opposizione tra i sensi affettivo e meteorologico. Faccio questo, seguendo Merleau-Ponty, trattando l’atmosfera come uno spazio di inalazione e esalazione. Come tale, corrisponde da vicino a ciò che Merleau-Ponty stesso chiama “la carne”. Ma questo concetto potrebbe anche essere tradotto come ‘reticolo’ (meshwork), riferendosi a quei grovigli di linee e percorsi lungo i quali ogni essere vivente è cucito al tessuto del mondo. Per Merleau-Ponty, il significato della carne risiede nella sua affermazione secondo la quale la percezione è fondamentalmente reversibile. Si può essere senzienti soltanto in un mondo senziente; quindi, ritiene il filosofo, la nostra percezione delle cose nell’ambienteè ricambiata dalla percezione che quest’ultimo ha di noi. La voix féminine dans l’œuvre lyrique mozartienne chante sur un unique registre, le registre aigu. Tous les personnages féminins possèdent une voix unique : celle du soprano ; par contre, la voix masculine, elle, chante sur deux registres : aigu et grave. Cette séparation sexuée des voix qui apparaît pour la première fois dans l’histoire de l’opéra avec Mozart délimite nettement, côté masculin, des rôles bien séparés : ceux des fils - ténor, registre aigu - et ceux des pères - (...) basse, registre grave -. Par contre, côté féminin, les rôles sont confondus ; jeunes filles, épouses, sœurs, mères, duègnes, non seulement possèdent une commune tessiture mais s’expriment musicalement, très souvent, de la même manière : la grande aria virtuose. C’est à travers le personnage de la mère et en particulier celui de la Reine de la Nuit dans La Flûte enchantée, que nous avons tenté de comprendre le pourquoi de cette voix unique de la féminité selon Mozart. Le fil de cette voix féminine est noué avec le fil d’une autre voix qui résonne dans la correspondance mozartienne, celle de la mère de Mozart, Anna-Maria. An adequate theory of rights ought to forbid the harming of animals to promote trivial interests of humans, as is often done in the animal-user industries. But what should the rights view say about situations in which harming some animals is necessary to prevent intolerable injustices to other animals? I develop an account of respectful treatment on which, under certain conditions, it’s justified to intentionally harm some individuals to prevent serious harm to others. This can be compatible with recognizing the (...) inherent value of the ones who are harmed. My theory has important implications for contemporary moral issues in nonhuman animal ethics, such as the development of cultured meat and animal research. (shrink)

How best to avoid the Levinas Effect, as it has been called, the tendency to make Emmanuel Levinas everything to everyone? One way is to demonstrate that Levinas's thinking does not fit into any of the categories by which we ordinarily approach political theory. If one were forced to categorize Levinas's political theory, the term "inverted liberalism " would come closest to the mark. As long, that is, as one emphasizes the term "inverted" over "liberalism." Levinas's defense of liberalism is (...) likely the strangest defense the reader has encountered. We should, argues Levinas, foster and protect the individual because only the individual can see the tears of the other, the tears that even the just regime cannot see. The individual is to be fostered and protected for the sake of the other individual. Whether this has anything to do with "real" liberalism, and whether it should, is the topic of this essay. The debate over the determination of death has been raging for more than fifty years. Since then, objections against the diagnosis of brain death from family members of those diagnosed as dead-have been increasing and are causing some countries to take novel steps to accommodate people’s beliefs and preferences in the determination of death. This, coupled with criticism by some academics of the brain death criterion, raises some questions about the issues surrounding the determination of death. In this paper, we (...) discuss some of the main approaches to death determination that have been theoretically proposed or currently put into practice and propose a new approach to death determination called "weak pluralism" as a reasonable ethical and political alternative to respect diversity in death determination. Corporate governance is increasingly becoming an issue of global concern, not least because we are more and more living in a corporate world that transcends international boundaries. The main purpose and motivation of this study is to determine how the international community should motivate businesses in fostering exemplary corporate governance, therefore eliminating obstacles to ethically exemplary behavior. The empirical approach utilized here has been applied to 161 businesses, both listed and over-the-counter (OTC) companies, with the results indicating that ethical considerations, (...) corporate governance and organizational performance are inextricably linked and, to an extent, demonstrably proportional. This study also indicates a major finding that family management is a significant mediating variable of the ethical considerations of corporate governance and organizational performance. Finally, this study has developed an operational model of ethical considerations of corporate governance as a consultancy aid for businesses that wish to implement and/or boost their performance in respect to corporate governance. This article considers various approaches used in complementary and alternative medicine research, and discusses the challenges that reviewing such research poses for Human Research Ethics Committees. Drawing on our experience with the University of Technology Sydney HREC, we offer some suggestions about how ethical principles governing conventional medical research can be applied in the context of research in complementary and alternative medicine. We argue that effective HREC review requires members to gain familiarity with such research, which helps ensure that such (...) research is conducted rigorously and ethically. (shrink)

Sextus, Montaigne, Hume: Pyrrhonizers. Brill: Leiden, 2021. Pp. 165. Hardback, $154.00. Brian C. Ribeiro’s Sextus, Montaigne, Hume: Pyrrhonizers is a charming and quirky investigation of his three titular skeptics. It is perhaps best understood as a skeptical investigation of skepticism. By that I mean that, like a good Pyrrhonist, Ribeiro explains how (...) things appear to him without claiming to lay down a doctrine or dogma. His topic is how and why skepticism still matters (7). And he suggests that those who are moved by skeptical arguments can learn intellectual modesty from them and thereby achieve a degree of philosophical “calmness of soul” (141).Ribeiro approaches his three figures by taking the cogency of their skeptical arguments for granted. There is little investigation of why these philosophers call various beliefs into question, and his concern is rather what remains once the skeptical doubts are taken on board. Because what he calls “Pyrrhonizing” philosophers reveal that large swaths of our beliefs lack epistemic merit, they also show us how we are not fully rational creatures in our everyday lives. In the case of Sextus, Ribeiro’s focus is on the famous question of whether skeptics can live their skepticism once they have actually suspended all belief. With Sextus, as with Montaigne and Hume, Ribeiro opts for the more radical of the interpretive options; he is not persuaded by Michael Frede’s suggestion that Pyrrhonists restrict their suspension only to abstruse matters, not the everyday (51). But even if we follow the “four-fold way” (20–23) that Sextus offers us as guides for life—the directives of nature, feelings, custom, and expertise—Ribeiro still thinks we will inevitably fall back into belief. He concludes that the original Pyrrhonists should be read aspirationally: insofar as we develop our capacities [End Page 517] to argue on both sides of every question and thus are able to suspend judgment, to that extent we will achieve tranquility. In the case of Montaigne, Ribeiro focuses on his Christian fideism. Once he recognizes the incapacity of reason to resolve intellectual problems, he falls back on faith. And Ribeiro argues that the Catholic flavor of this faith is simply a reflection of Montaigne’s surroundings. In a different community, he could just as easily have embraced a different faith. The heart of the book concerns Hume, whom Ribeiro discusses in three chapters, as opposed to the one each devoted to Sextus and Montaigne. In keeping with his interpretive preferences, Ribeiro’s Hume is a radical skeptic, though he acknowledges the significant yet “utterly perplexing” (95n22) naturalist strains that are also present. Ribeiro takes the resulting tension to be insoluble (98), though I was not convinced. Consider that, in both the Treatise and the Enquiry, Hume uses causal reasoning to investigate causal reasoning. He learns that our ideas are caused by prior impressions; that repeated experience of conjoint events causes us to associate our ideas of similar events; and so on. In the Treatise, he concludes the argument that association is at the root of such causal reasoning by presenting a set of rules, a “logic,” for it. The argument is not as such skeptical, though when Hume “recasts” it in the first Enquiry, he does so in terms of “sceptical doubts” and a “sceptical solution.” In the Treatise, “total” and “extravagant” skepticism come into play only as “systems of philosophy” that Hume uses to shed light on his own core commitments. The problem, I think, is that Ribeiro tends to read Hume a little too literally, as if he is himself falling prey to the skeptical upheaval of the conclusion to the first book of the Treatise, or the final section of the first Enquiry. But I would suggest that Hume is rather deploying the rhetoric of skepticism in these discussions, using it for his ultimate philosophical ends (a point that is especially clear in Ribeiro’s favorite of Hume’s works, the Dialogues). He is showing his reader how his naturalistic philosophical project is itself rooted in human nature, and thus does not yield insight into the intrinsic structure of... (shrink)

We give a short, critical review of the issue of decoherence. We estab- lish the most general framework in which decoherence can be discussed, how it can be quantified and how it can be measured. We focus on environment induced decoher- ence and its degree of usefulness for the interpretation of quantum theory. We finally discuss the emergence of a classical world. An overall emphasis is given in pointing at common fallacies and misconceptions.

The Holocaust marks a decisive moment in modern suffering in which it becomes almost impossible to find meaning or redemption in the experience. In this study, C. Fred Alford offers a new and thoughtful examination of the experience of suffering. Moving from the Book of Job, an account of meaningful suffering in a God-drenched world, to the work of Primo Levi, who attempted to find meaning in the Holocaust through absolute clarity of insight, he concludes that neither strategy works well (...) in today's world. More effective are the day-to-day coping practices of some survivors. Drawing on testimonies of survivors from the Fortunoff Video Archives, Alford also applies the work of Julia Kristeva and the psychoanalyst Donald Winnicot to his examination of a topic that has been and continues to be central to human experience. Philosopher Kings? The Adjudication of Conflicting Human Rights and Social Values, by George C. Christie, examines the attempts by courts to sort out conflicts involving freedom of expression, including religious expression, on the one hand, and rights to privacy and other important social values on the other. It approaches the subject from a comparative perspective, using principally cases decided by European and United States courts. A significant part of this book analyzes conflicts between freedom of expression and the right to (...) privacy. In a world in which, freedom of expression and privacy are said to be of equal value, the book explores whether it is possible to develop, through case-by-case adjudication, a legal regime which can give clear direction as to what expression is or is not permitted. Otherwise, if such a regime proves impossible, in the guise of recognizing the equal value of expression and privacy, privacy may become de facto the preferred value. (shrink)
