This article considers ethical dilemmas that nurse managers may confront and suggests an ethical decision-making model that could be used as a tool for resolving such dilemmas. The focus of the article is on the question: Can nurse managers choose the ethically right solution in conflicting situations when nurses’ rights collide with patients’ rights to quality care in a world of cost-effective and economic constraint? Managers’ responsibility is to ensure and facilitate a safe and ethical working environment in which nurses (...) are able to give quality care to their patients. In nursing it is frequently declared that managers’ main obligations are to patients’ needs and their rights to receive quality care. However, managers’ ethical responsibilities are not only to patients but also to the nurses working in their institution. This article describes a real (but disguised) situation from an Israeli health care context to illustrate the dilemmas that may arise. The question is posed of whether nurse managers can maintain patients’ and nurses’ rights and, at the same time, fulfill their obligation to the conflicting demands of the organization. The necessity of wearing masks in response to the spread of the Covid-19 took Europe and the USA by surprise. Legislation needed to be enacted to enforce the obligation on citizens not used to such practices. The authors investigate the semiotic function of masks, legislations enacted to enforce their usage in public places, and the mask-related discourse with a view to seeing how societies reacted to this imposition. A totally ordered group G is essentially periodic if for every definable non-trivial convex subgroup H of G every definable subset of G is equal to a finite union of cosets of subgroups of G on some interval containing an end segment of H; it is coset-minimal if all definable subsets are equal to a finite union of cosets, intersected with intervals. We study definable sets and functions in such groups, and relate them to the quasi-o-minimal groups introduced in Belegradek (...) et al. . Main results: An essentially periodic group G is abelian; if G is discrete, then definable functions in one variable are ultimately piecewise linear. A group such that every model elementarily equivalent to it is coset-minimal is quasi-o-minimal , and its definable functions in one variable are piecewise linear. (shrink)

A meta-analysis and an experiment show that the degree of compression of the in-depth dimension of visual space relative to the frontal dimension increases quickly as a function of the distance between the stimulus and the observer at first, but the rate of change slows beyond 7 m from the observer, reaching an apparent asymptote of about 50 %. In addition, the compression of visual space is greater for monocular and reduced cue conditions. The pattern of compression of the in-depth (...) dimension as a function of distance is similar to the ratio of in-depth to frontal visual angles of stimuli, but is not as extreme as this ratio would suggest, implying that observers are incapable of fully ignoring size information provided by cues to depth. Size and distance judgments may be described by an Affine transformation of physical space; however, the compression parameter in this model changes as a function of distance from the observer and other experimental conditions. The Federal Trade Commission has an important role to play in the governmental oversight of mobile health apps, ensuring consumer protections from unfair and deceptive trade practices and curtailing anti-competitive methods. The FTC’s consumer protection structure and authority is outlined before reviewing the recent FTC enforcement activities taken on behalf of consumers and against developers of mhealth apps. The article concludes with identification of some challenges for the FTC and modest recommendations for strengthening the consumer protections it provides.

ArgumentThis paper reconstructs Wronski's philosophical foundations of mathematics. It uses his critique of Lagrange's algebraic analysis as a vignette to introduce the problems that he raised, and argues that these problems have not been properly appreciated by his contemporaries and subsequent commentators. The paper goes on to reconstruct Wronski's mathematical law of creation and his notions of theory and techne, in order to put his objections to Lagrange in their philosophical context. Finally, Wronski's proof of his universal law is reviewed (...) in terms of the above reconstruction. I argue that Wronski's philosophical approach poses an alternative to the views of his contemporary mainstream mathematicians, which brings up the contingency of their choices, and bridges the foundational concerns of early modernity with those of the twentieth-century foundations crisis. I also argue that Wronski's views may be useful to contemporary philosophy of mathematical practice, if they are read against their metaphysical grain. (shrink)

The purpose of this article is to deliberate the moral and legal dilemma entailed in the weapon of the labour strike as a pressure tactic on the Israeli Finance Ministry regarding job slots, budgets and, in effect, violating the collective agreement signed by the nurses and impairing patients’ treatment, as opposed to refraining from striking and suffering the heavy burden of work, the lack of trained personnel, low wages, and the inability to give patients proper, high quality treatment.

ABSTRACT This paper proposes a vision of rhetoric as metaphysical enactment. This position contrasts with traditionally accepted views of rhetoric as phenomenological practice, evidenced prominently in contemporary rhetorical theory. I advance a framework that employs metaphorical accommodation and indicates a way that rhetoric can be situated as a perpetually productive force. The analytic tradition affords a method and vocabulary that when placed in conversation with rhetorical studies offers an alternative for viewing rhetoric as metaphysical enactment. I determine that rhetorical theory (...) should engage with rhetoric as a measure of action, activity, and vitality that raises our awareness and connects us. (shrink)

Since early 2020, the Covid-19 pandemic has affected our world in multiple ways. What we know and how we know it has shifted on a global scale. How we move throughout the world has been restricted and locked down. How we see one another has changed the cultural narrative in numerous countries throughout the world. As we seek to rid ourselves of the novel coronavirus infecting our everyday, three significant paradigm shifts have mutated our realities and imaginaries in which we (...) dwell. With millions dead or sickened by the evolving Covid-19 virus, we are a different world now than we were. As guest editors for this Special Issue, Visible Mutations of the Information Imaginary: Knowledge, Movement, and Cultural Discourse in the Wake of Covid-19, we pay tribute to the millions affected by these changes by offering this collection of scholarship as a critical path forward. We examine three primary areas in which life, law, and legality have mutated with results that demand our immediate attention. The first section of contributing articles, Knowledge, engages with the dissemination of knowledge and information as either fact or fiction in lexicons and media outlets throughout the world. The second section, Movement, focuses on aspects of motion and its restriction in terms of bodies, legislation, access, and the threat of viral contamination across borders and within communities. The third section, Cultural Discourse, considers the visibility of viral spread ranging from masks that cover the face to the separation of bodies through social distancing to the politicization of religion and vaccination. What once were normative cultural positionalities of space and politics have been volatized by institutionalized risk reduction and the confrontation of the unknown in the tenuous unforeseeable realm we now globally inhabit: L'idée se fait jour qu’il s’agit au moins autant d’une syndémie que d’une pandémie. Ethical and sustainable business practices in global supply chains have become a major concern for firms. Media stakeholders hold firms accountable for the environmentally unethical behavior of their suppliers. Based on agenda-setting theory and stakeholder theory, this study presents a model that shows how various internal and external factors explain media reporting of environmental supply chain sustainability risks. It also examines the role of firms’ risk avoidance practices. The study uses regression analysis of secondary data from 541 buying firms. The (...) results show that the size and brand visibility of buying firms, and their affiliation to high-risk industries increase the frequency of media coverage of suppliers’ environmental misconduct, while their affiliation to high-risk countries decreases the frequency of media coverage. In addition, companies can reduce media coverage by implementing proactive supply chain sustainability risk avoidance practices. However, reactive supply chain sustainability risk avoidance practices are not effective in reducing media coverage. (shrink)

Henrich et al. propose that humans are genetically equipped with learning mechanisms that enable them to acquire the preferences and beliefs related to economic prosocial behaviors. In addition to their cross-cultural data, they cite developmental evidence in support of this theory. We challenge Henrich et al.'s interpretation of the developmental data in a discussion of recent work which suggests that preferences for altruism and fairness may have an innate basis.

This paper will explore the positionalities of bodies that contribute to the transformation of cultural spaces and social interactions against the legalized backdrop of combatting viral spread (...) of Covid-19 in the United States, France, and Poland. It is nearly universally presumed that redistribution can be carried out effectively only at the national or even global level, because local redistribution will be negated through personal mobility: recipients will move to high-paying jurisdictions while taxpayers will move away from those jurisdictions. To avoid this situation requires redistribution to be concentrated at national and not at local levels. In contrast to this standard line of argument, we explore how redistribution might be carried out more effectively at local levels than (...) at the national level. To explain this reversal from standard analytical implications, we integrate three concepts that are not present in the standard analysis. These concepts are the Samaritan’s dilemma, co-production, and polycentricity. It is interaction among these three concepts that reverses the implications of the standard analysis of redistribution. The theorizing of utopia is a persistent theme throughout several generations of the French continental tradition, and alongside the process theory of Alfred North Whitehead to a large degree recuperates the concept of utopia from its supposed dismissal by Marx and his intellectual descendants. Most recently, attention to the notion of plasticity, popularized by Catherine Malabou, extends speculation on utopian possibility. Compelled to answer to Marx’s denigration of utopia as fantasy, the tendency was to compensate for the absence of a (...) programmatic politics by stressing what is “useful” about utopian dreaming, and therefore where or how exactly a utopian text reveals or creates political drive, or motivates political action. In this essay, I argue that theorists have overlooked the use of utopia as not only the reproduction of difference, or what Malabou calls positive plasticity, but also as, therefore, a disruption; Malabou might prefer the term accident here. Tracing the concept of plasticity from Roland Barthes to Malabou, with a nod at Miguel Abensour, this essay teases out the links between a contemporary notion of plasticity to argue, simply put, that utopia is plastic. This plasticity of the concept ensures its political force. These links, obscured in the essay “Plastic,” Barthes makes only later in his writing. But for Malabou, plasticity underlies a principle of futurity and/as generativity, such that new forms, new meanings, new concepts emerge through difference. Utopia’s horizons of potentiality depend on difference, and on non-achievement. Finally, I argue that the persistence of utopia as a form of thinking is the most important, and political, effect of utopian plasticity. (shrink)

European integration needs to be analyzed in terms that address the normative self-understanding of the emerging polity or, in other words, the self-understanding of European modernity. While it is often argued that such European self-understanding is either entirely indistinct from the general self-understanding of the West, i.e. a commitment to human rights and liberal democracy, or highly problematic, because it makes overly ‘thick’ presuppositions, which are untenable against the background of European cultural diversity and risk to revive non-liberal European political (...) traditions, the attempt here to reconstruct European political modernity suggests that the general, universalist commitment to liberal democracy is insufficient to understand Western polities, and it aims to propose this argument by elaborating a more complex concept of political modernity than can usually be found in political theory. The struggles about European political modernity across history are interpreted with a view to understanding how the self-understanding of a modern polity evolved and changed. (shrink)

Three issues have preoccupied Dummett: a distinction between realism and antirealism; the idea of a theory of meaning for a language L; and the nature of analytic philosophy. All three appear here, but in different measures. While Dummett's conception of philosophy plays a large role, it receives little discussion, and his remarks on related questions about thought and language are a nadir of the book. The treatment of realism, which includes Dummett's noted distinction between reductionism and antirealism, is of much (...) greater interest. Dummett's main idea here is to explicate the elusive notion of antirealism as mind-dependence via a logico-semantic criterion involving the failure of bivalence. This is one of the most inspired moves in recent philosophy. The present book, however, hardly works through the consequent problems. Dummett runs aground on counterexamples to his construal of antirealism and himself slides between incompatible interpretations of "realism." Thus I turn to issues about meaning. (shrink)

Grace de Laguna was a philosopher working in the first part of the twentieth century on analytic and speculative philosophy, as well as on the psychology and philosophy of language, especially the social function of language. Joel Katzav’s lead essay focuses mainly on the former part of her work, while my commentary focuses mostly on the latter. Katzav shows how her work played a role in the development of analytic philosophy, I try to show how her work played a role (...) in the development of pragmatic linguistics, whose development overlapped with some aspects of analytic philosophy. I situate it in the context of an emerging ‘pragmatic Weltanschauung’ that was embraced by many working in linguistics, philology, philosophy, psychology, anthropology and what would later be called linguistic pragmatics. This paper aims to determine whether we can locate temporal passage in a non-dynamical (block universe) world. In particular, we seek to determine both whether temporal passage can be located somewhere in our world if it is non-dynamical, and also to home in on where in such a world temporal passage can be located, if it can be located anywhere. We investigate this question by seeking to determine, across three experiments, whether the folk concept of temporal passage can be satisfied (...) in our world if it is non-dynamical, and, if it can, what sort of thing in our world satisfies that concept. In particular, we focus on the question of whether that concept (if satisfied) is satisfied by something mind-dependent or something mind-independent. In other words, we ask, is temporal passage something that is at least partially in the mind, or is it entirely external to the mind? We find, contrary to what is often assumed by dynamists and non-dynamists alike, that the folk concept of temporal passage is satisfied in our world conditional on it being non-dynamical, and that the concept is satisfied by something mind-independent. This provides further ammunition for recent deflationary accounts of temporal passage that attempt to locate passage somewhere in our non-dynamical world. (shrink)

The aim of this dissertation is twofold: first, to provide an account of the notion of creativity, and second, to consider some aspects of the scope of the concept of creativity, in particular whether it makes sense to speak of creativity in science. ;With regard to the first issue, I argue that creativity consists in the production of a radically new intelligibility and that for this production special, creative processes are required. The latter point is established through an analysis of (...) non-creative processes, which in turn is provided in terms of Kant's notion of schemata, interpreted as patterns of cognition. My claim is that these processes are not sufficient to bring about the radically new intelligibility that characterizes creative outcomes. The creative process is properly to be analysed through a consideration of Kant's conception of artistic genius and reference to some recent work in psychology. ;The final chapter treats the second issue, the topic of creativity in the sciences. I question whether it makes sense to speak of creativity in science. I argue that since the sciences provide radically novel, yet intelligible, ways of understanding the world, creativity is required here as well. (shrink)
