Yet, despite its distinct originality, philosophers have mostly avoided the question of what modal concepts the argument uses, and whether Anselm's metaphysics entitles him to use them. Here, Brian Leftow sets out Anselm's modal metaphysics. He argues that Anselm has an "absolute", "broadly logical", or "metaphysical" modal concept, and that his metaphysics provides acceptable truth makers for claims in this modality. This chapter focuses specifically on the case of pain. Despite traditional opposition to the representational thesis, the latter has won widespread assent. The most important early proponents of the representational thesis were David Armstrong and George Pitcher, both of whom held that pain is a form of perception. Following Armstrong and Pitcher, intentionalists have traditionally held that the experience of pain has a content with roughly the following form: there is a disturbance with such-and-such features at location L. Since the (...) internal states associated with the experience of pain arguably track local physical properties of disturbances, it seems that the tracking intentionalist must identify the pain qualities represented by pain experience with these physical properties. A central concern of nearly every environmental ethic is its desire to extend the scope of direct moral concern beyond human beings to plants, nonhuman animals, and the systems of which they are a part. Although nearly all environmental philosophies have long since rejected modernity’s conception of individuals as isolated and independent substances, few have replaced this worldview with an alternative that is adequate to the organic, processive world in which we find ourselves. In this context, Brian G. Henning (...) argues that the often overlooked work of Alfred North Whitehead has the potential to make a significant contribution to environmental ethics. One standard criterion for there being objectivity in an area of discourse is that there is conceptual space between what someone thinks to be the case and what actually is the case. That is, participants can be mistaken. This article explores one aspect of the objectivity debate as regards law: does it make sense to say that all legal officials or practitioners in a jurisdiction are mistaken (over a significant period of time) about some legal proposition? The possibility of legal (...) error is important to discourse within and about the law. In contrast to the views of some American legal realists, it is important to deny that law is only what the officials declare it to be. However, as this article argues, claims of long-term global error in law are more problematic. The truth of legal propositions seems to be a complex function of official actions and the meaning of the terms used in authoritative legal texts. Because of the conventional nature of law, there are problems with claiming global error regarding propositions of (within) law, the existence of legal norms, and structural priorities among types of legal norms. At times, the law may in fact simply be what officials (collectively) say it is, over the long term. However, the article also notes areas where claims of long-term global error are more sustainable: where the law incorporates a term from another discourse, or where the law purports to interpret an authoritative text. It is not unusual for researchers in ethnography (and sometimes Institutional Review Boards) to assume that research of “public” behavior is morally unproblematic. I examine an historical case of ethnographic research and the sustained moral outrage to the research expressed by the subjects of that research. I suggest that the moral outrage was legitimate and articulate some of the ethical issues underlying that outrage. I argue that morally problematic Ethnographic research of public behavior can derive from research practice that includes (...) a tendency to collapse the distinction between harm and moral wrong, a failure to take account of recent work on ethical issues in privacy; failure to appreciate the deception involved in ethnographers’ failure to reveal their role as researchers to subjects and finally a failure to appropriately weigh the moral significance of issues of invasion of privacy and inflicted insight in both the research process and subsequent publication of research. Consent, in terms of voluntary choice, is - or, at least, appears to be or purports to be - at the essence of contract law. Contract law, both in principle and in practice, is about allowing parties to enter arrangements on terms they choose - each party imposing obligations on itself in return for obligations another party has placed upon itself. This freedom of contract- an ideal by which there are obligations to the extent, but only to the extent, freely (...) chosen by the parties - is contrasted to the duties of criminal law and tort law, which bind all parties regardless of consent. At the same time, consent, in the robust sense expressed by the ideal of freedom of contract, is arguably absent in the vast majority of the contracts we enter these days, but its absence does little to affect the enforceability of those agreements. Consent to contractual terms often looks like consent to government: present, if at all, only under a fictional (as if) or attenuated rubric. This article explores a variety of topics relating to consent, and the role it plays in contract law doctrine and theory. The article begins by a brief examination of the nature of consent, then turns to contract doctrines that turn on the alleged absence of consent (e.g., duress and undue influence); contract rules and principles (e.g., implied terms) that turn on hypothetical consent; the challenges to consent that arise from electronic contracting and bounded rationality, and theories of contract law that emphasize consent. Emotivism has enjoined a revival of sorts over the past few decades, primarily driven by a Darwinian interpretation of the Humean metaethic. Evolutionary ethics, the metaethical view that at the heart of our moral sense lies a set of moral sentiments whose existence 'pre-dates' in evolutionary terms our species' ability to engage in more explicit, cognitive moral deliberations and discourse, whether in the discovery of deontological rules or in the crafting of social contracts, figures prominently in Robert Solomon's work in (...) justice theory and J. Baird Callicott's work in environmental ethics, to name just two efforts to revive emotivism. Though the idea that our moral sense is grounded in our evolved biology lies at the heart of the new ethical emotivism, there has been a curious lack of a truly evolutionary account of the origin of that biological predisposition in the work of Solomon, Callicott, and others involved in the revival. In particular, what is missing is an account of how we evolved our moral sense as an adaptation to the ecology in which our very early ancestors existed. The typical explanation is to treat it as selected for by the pressure to cooperate that bore upon our early ancestors; for example, the advantage that cooperative effort confers in bringing down big game or warding off competing groups. But this type of explanation, I hope to show, rather than providing an account of how our moral sense came to be, actually must presuppose the existence of a rudimentary moral sense. If so, then the origin of our moral sense must be accounted for as an adaptation to our pre-social, ecological environment. As a model for what such an explanation might look like I will use Jared Diamond's recent work in biogeography, Guns, Germs and Steel. (shrink)

Typical of ecocentric approaches such as the land ethic and the deep ecology movement is the use of concepts from ecological science to create an “ecoholistic” ontological foundation from which a strong environmental ethic is generated. Crucial to ecocentric theories is the assumption that ecological science has shown that humanity and nonhuman nature are essentially integrated into communal or communal-like arrangements. In this essay, I challenge the adequacy of that claim. I argue that for the most part the claim is (...) false, and that, if it were true, it would overextend the sphere of morally considerable entities to include entities that are implausibly deserving of moral consideration. In either case, the foundation of ecocentrism is significantly weakened. (shrink)

Market events of the past few years have resurrected long unheeded calls for the professionalization of the occupation of business manager, not in terms of increased technical proficiency, but in terms of a renewed vigor to shape the practice of management and the education of those who will fill its ranks along the lines of the “ideal of service” which characterizes socially established professions like law and medicine. In this paper I argue that the push to professionalize business management can (...) be grounded in an ISCT (Integrative Social Contracts Theory) treatment of the “vulnerable values” argument which itself has served as a source for the professionalization of medicine and law. Additionally, I offer a sketch of an argument that once business managers are considered to be members of a profession, we can begin to develop an account of “business malpractice” which would, when it occurs, represent an ethical violation of the “publicpledge” that members of all professions make to serve the broader good of society.
