Is debate on issues related to faith and reason still possible when dialogue between believers and non-believers has collapsed? Taking God Seriously not only proves that it is possible, but also demonstrates that such dialogue produces fruitful results. In teaching jurisprudence, I typically distinguish between two different families of theories of adjudication—theories of how judges do or should decide cases. “Formalist” theories claim that the law is “rationally” determinate, that is, the class of legitimate legal reasons available for a judge to offer in support of his or her decision justifies one and only one outcome either in all cases or in some significant and contested range of cases ; and adjudication is thus “autonomous” from other kinds of (...) reasoning, that is, the judge can reach the required decision without recourse to nonlegal normative considerations of morality or political philosophy. I also note that “formalism” is sometimes associated with the idea that judicial decision-making involves nothing more than mechanical deduction on the model of the syllogism—Beccaria, for example, expresses such a view. I call the latter “Vulgar Formalism” to emphasize that it is not a view to which anyone today cares to subscribe. (shrink)

Forty years ago Amartya Sen delivered his Tanner Lecture, 'Equality of What?', in which he introduced to the world a novel approach to the idea of equality by way of the notion of 'basic capability' as 'a morally relevant dimension'. We can now see with hindsight that Sen's argument - that we should focus upon equality of basic capabilities ('a person being able to do certain basic things') - launched what has become an academic armada now proceeding under the flag (...) of 'the capability approach'. While that flag has ventured far and wide and engaged many area of inquiry, this volume of essays is the first to explore how the capability approach (the CA) might shed light upon labour law. Three dimensions of the CA's potential for illuminating labour law are examined. Part I enquires into the nature of the basic relationship between CA and labour law - do they share common ground or disagree about what is important? Can the CA provide a normative 'foundation' for labour law? Part II goes further by examining the relationship of the CA and other well-established perspectives on labour law, including economics, history, critical theory, restorative justice, and human rights. Part III examines the possible relevance of the CA to a range of specific labour law issues, such as freedom of association, age discrimination in the workplace, trade, employment policy, and sweatshop goods. This article provides an explanation of Anselm’s understanding of necessity. Anselm did not write much about modality, and what he did write is puzzling. The dominant readings of Anselm see him as having two concepts of necessity, one merely physical or causal, the other logical or “alethic.” This article argues that Anselm has just one concept of necessity, which corresponds best to what is now called broadly logical or absolute necessity, but whose metaphysics is in terms of powers and lacks (...) of power. The rival interpretations of A. D. Smith, Thomas Williams, and Sandra Visser are discussed and criticized in detail. (shrink)

One of the benefits of the 2D framework we looked at last week was that it explained how we could understand a sentence without knowing which proposition it expressed. And we could do this even if we give an account of understanding which is closely tied to the possible worlds semantics we use to analyse propositions. Really this can be done very easily, without appeal to any high-flying Kripkean cases. In “Analytic Metaphysics” Jackson discusses a very simple case of it. (...) I can understand an utterance of “I have a beard” without knowing which proposition it expresses. I know how the proposition is generated from context plus meaning, if X is the speaker then the sentence expresses the proposition X has a beard. And that is enough for understanding. But if I don’t know who said the sentence, so I don’t know who X is, I don’t know which proposition is expressed by that utterance. (shrink)

Iphigenia in Aulis ( IA ) raises important doubts about popular authority by dramatizing the Achaean army’s imposition of parthenic sacrifice. The numerous vacillations of the elites represented in IA ’s dialogue provide an axis along which the distribution of power in Aulis can be assessed, and the play’s many reversals serve to highlight their lack of agency and their forced participation in troubling ritual violence. In the context of this dramatic formulation of power, the play’s aristocratic personae must either (...) yield grudgingly to the army’s demands or, like Iphigenia, construct a new political subjectivity that affirms and is complicit in the army’s assertion of power. The current study investigated the relationship of the Dark Triad with peer reporting, which occurs when an employee informs management that another coworker has engaged in counterproductive work behavior (CWB). We hypothesized that low organizational commitment would strengthen the negative relationships between each Dark Triad trait and peer reporting. Data from 281 employees suggested that low organizational commitment indeed strengthened the negative relationships between (a) narcissism and the base rate of peer reporting CWBs and (b) psychopathy and the base rate (...) of peer reporting CWBs. Our findings thus extended Dark Triad research to the topic of peer reporting. (shrink)

I argue that the account of the epistemic modalities developed by Kripke and Putnam is incomplete since it does not make use of the possible worlds machinery that is indispensable to their analysis of the metaphysical modalities. It would have been simpler and more elegant if they had used the concept of 'possible world' to explain both modalities. Instead, they provide an explication of the epistemic modalities in terms of the vague concepts of conceivability and revisability. I show that logical (...) omniscience as a consequence of a possible worlds analysis of the epistemic modalities can be made palatable. (shrink)

David Lewis’s property-centered account of belief falls prey to the problem of egocentric omniscience: In self-ascribing the property of being an eye doctor, an agent is thereby self-ascribing the property of being an oculist. It is argued that the problem of egocentric omniscience can be made palatable for Lewis’s property-centered account of belief, at least for the case of linguistic beliefs. Roughly, my solution is as follows: An agent can believe that he or she has the property of being an (...) eye doctor/oculist under the description ‘eye doctor’ without believing that he or she has this property under the description ‘oculist’. Believing that one has a property P under a description D involves the additional self-ascription of the propositional property of inhabiting a world with respect to which that description denotes the property P. This is not the same sort of solution as the one proposed for singular beliefs by Nathan Salmon. Unlike Salmon’s account, belief on the account I am defending is regarded as a two place-relation rather than a three-place relation. Since, on Lewis’s account, self-ascriptive belief subsumes de dicto belief, my solution also sheds light on the problem of logical omniscience. (shrink)

Within the context of Carruthers’ general analysis of the relation between language and thought, I present a specific hypothesis about how grammar uses perspective flow to unify disparate cognitions. This perspective hypothesis allows us to understand the neolithic burst in creativity as a cultural advance in methods for knitting together thoughts.

Our current planetary emergency is one in which we are facing significant global warming as a result of human-driven climate change. This is having and will continue to have catastrophic results for the earth’s ecosystems and for life as we know it. The Christian tradition often works actively against the seriousness of these challenges due to its eschatological outlook. Process theology, as one stream within the Christian tradition, embraces a different vision of the future that fosters engagement in current concerns (...) rather than an escapist approach. A process theological proposal is therefore offered that calls for an embodied ethic that embraces the acronym SHE. SHE stands for Sustainability, Health, and Ethics. It provides a dietary grid as a way to embody ethics to bring about societal change in light of environmental challenges. SHE is proposed against a background that argues for Christian engagement in our current global crisis. The idea of “small turnings” as a conceptual idea is adopted to help frame how the SHE grid might be understood. (shrink)

R. M. Cook has recently pointed out that the transport of warships across the Isthmus of Corinth was not the normal use of the diolkos since there was no regular need for such transport. Rather, the diolkos from its inception served a commercial function and its use provided the Corinthian state with a source of revenue.

Typical of ecocentric approaches such as the land ethic and the deep ecology movement is the use of concepts from ecological science to create an “ecoholistic” ontological foundation from which a strong environmental ethic is generated. Crucial to ecocentric theories is the assumption that ecological science has shown that humanity and nonhuman nature are essentially integrated into communal or communal-like arrangements. In this essay, I challenge the adequacy of that claim. I argue that for the most part the claim is (...) false, and that, if it were true, it would overextend the sphere of morally considerable entities to include entities that are implausibly deserving of moral consideration. In either case, the foundation of ecocentrism is significantly weakened. (shrink)

Market events of the past few years have resurrected long unheeded calls for the professionalization of the occupation of business manager, not in terms of increased technical proficiency, but in terms of a renewed vigor to shape the practice of management and the education of those who will fill its ranks along the lines of the “ideal of service” which characterizes socially established professions like law and medicine. In this paper I argue that the push to professionalize business management can (...) be grounded in an ISCT (Integrative Social Contracts Theory) treatment of the “vulnerable values” argument which itself has served as a source for the professionalization of medicine and law. Additionally, I offer a sketch of an argument that once business managers are considered to be members of a profession, we can begin to develop an account of “business malpractice” which would, when it occurs, represent an ethical violation of the “publicpledge” that members of all professions make to serve the broader good of society. Public administration curricula typically offer only very limited exposure to computers, despite the growing importance of computers in public management. This paper examines an approach to teaching computer management in a masters of public administration program, and relates that approach to the broader question of what public administrators need to know about computers. The approach involves instruction in computer literacy, computer applications, and management of computer resources. Instruction in these three areas appears to increase the importance students place on managing (...) computer resources and on understanding computer concepts, and to decrease the relative importance students place on managers' knowledge about specific computer applications. This shift in viewpoint appears appropriate based on interviews which suggest that practicing administrators place greater emphasis on understanding the broad issues of computer resource management, rather that on more specific computer knowledge or skill.
