Many bioethicists have recently shifted from using “physician-assisted suicide” (PAS) to “medical aid-in-dying” (MAID) to refer to the act of voluntarily hastening one’s death with the assistance of a medical provider. This shift was made to obscure the practice’s connection to “suicide.” However, as the charge of “suicide” is fundamental to arguments against the practice, “MAID” can only be used by its proponents. The result has been the fragmentation of the bioethical debate. By highlighting the role of human agency—as opposed (...) to natural processes—in causing death, the term “PAS” makes it easier both to perceive potential risks to vulnerable populations and to affirm suicide as a potentially autonomous choice. As such, “PAS” thus more transparently expresses the arguments of both supporters and opponents of the “right to die,” while avoiding the unnecessary stigmatization of suicide and suicidal people which is a result of the usage of “MAID.”. As they age, many people are afraid that they might become a burden to their families and friends. In fact, fear of being a burden is one of the most frequently cited reasons for individuals who request physician aid in dying. Why is this fear so prevalent, and what are the issues underlying this concern? I argue that perceptions of individual autonomy, dependency, and dignity all contribute to the fear of becoming a burden. However, this fear is misplaced; common conceptions (...) of these values should be re-framed and re-examined. Practices that support a more community-centered type of autonomy can be found in dependency and dignity. This paper offers some practical examples of how to address common end-of-life situations that may cause anxiety to patients who are worried about being a burden. These practices include discussing expectations, both for care and how the relationship among the participants might change, and modeling respectful caregiving behaviors. Most difficult of all, though, includes cultural and societal attitude changes so that people recognize the good in receiving care and get used to the idea that they do not need to do anything to be valuable. Causal reasoning and game-theoretic reasoning are fundamental topics in artificial intelligence, among many other disciplines: this paper is concerned with their intersection. Despite their importance, a formal framework that supports both these forms of reasoning has, until now, been lacking. We offer a solution in the form of (structural) causal games, which can be seen as extending Pearl's causal hierarchy to the game-theoretic domain, or as extending Koller and Milch's multi-agent influence diagrams to the causal domain. We then consider three (...) key questions: i) How can the (causal) dependencies in games - either between variables, or between strategies - be modelled in a uniform, principled manner? ii) How may causal queries be computed in causal games, and what assumptions does this require? iii) How do causal games compare to existing formalisms? To address question i), we introduce mechanised games, which encode dependencies between agents' decision rules and the distributions governing the game. In response to question ii), we present definitions of predictions, interventions, and counterfactuals, and discuss the assumptions required for each. Regarding question iii), we describe correspondences between causal games and other formalisms, and explain how causal games can be used to answer queries that other causal or game-theoretic models do not support. In this paper we explain Wittgenstein’s claim in a 1933 lecture that “aesthetics like psychoanalysis doesn’t explain anything away.” The discussions of aesthetics are distinctive: Wittgenstein gives a positive account of the relationship between aesthetics and psychoanalysis, as contrasted with psychology. And we follow not only his distinction between cause and reason, but also between hypothesis and representation, along with his use of the notion of ideals as facilitators of aesthetic discourse. Small talk plays a big role in conversational perception. In the study here, pairs of conversational participants engaged in three iterations of an ecologically valid task-break dialogue where the break was either small talk via videoconferencing or waiting the same amount of time with cameras and mics turned off. Small talk increased conversational participants’ enjoyment of conversations, their willingness to engage in future conversations with their addressees, and their actual engagement in unprompted conversations with their addressees. Dyads who were instructed (...) to engage in small talk conversation during breaks were approximately three and a half times more likely to have conversations in the sixty second unprompted conversation period at the end of the study compared to dyads whose cameras and mics were off during the earlier break periods. Reciprocity effects previously observed in audio-only and text-only communication were not observed in this study. The findings presented here demonstrate that not only can the positive influence of small talk be replicated and extended to videoconferencing interactions, but such talk can also lead to an increased desire for continued interactions with conversational partners. In early work within Conversation Analysis, utterances within a request sequence which inquire regarding some of the preconditions of granting the request are analyzed as pre-requests. Levinson, in an extended discussion of the organization of pre-requests and request sequences, treats utterances such as ‘do you have X?’, ‘can I have X?’ or ‘can you X for me?’ as inquiring about preconditions that could prevent the recipient from granting the request. By checking on preconditions, the requester works to avoid producing a (...) request which will be declined, which is a dispreferred action. In other words, pre-requests, like other pre-sequences, function to project that another action will be produced if a favorable response is given; if not, that projected action may not be produced. In this view, then, they work to maintain the preference organization. This study uses requesting in service encounters to re-examine the evidence for an analysis of such utterances as pre-requests and finds that alternative analyses are more suited in these requesting activities. : Puritanism and Confucianism have little in common in terms of their substantive teachings, but they do share an emphasis on bounded, authoritative, localized human arrangements, and this profoundly challenges the dominant presumptions of contemporary globalization. It is not enough to say that these worldviews are ‘‘communitarian’’ alternatives to globalism, for that defines away what needs to be explained. This article compares the ontology of certain elements of the Puritan and Confucian worldviews, and, by focusing on the role of both (...) authority and activity in these systems, assesses (with the assistance of Max Weber) the theories of harmony that each invoke. It concludes by identifying the distinct options that these two modes of human existence suggest for those who wish to defend the relevance of boundedness and authority, and thus the very possibility of a human-scaled politics, in today’s world. Though much has been written about when paternalistic intervention is justified, and about how it is justified, much less has been written about who may do the intervening. This is a substantial lacuna in our understanding of the nature of justified paternalism. By examining the question of who it is that may most appropriately interfere with the course of our decision-making, we can learn something useful both about paternalism and about the nature of friendship.In this essay I will argue that (...) friendship and paternalistic intervention are linked. Friendship of the close, intimate variety that I will be discussing is in part constituted by the fact that one friend is morally justified in interfering with the other’s decisions. Intimate friendship involves a partial meshing of identities. This meshing of identities manifests itself in part by the liberties that one friend takes in guiding the life of the other. Paternalistic intervention between friends can thus be justified because it expresses the union of the friends, and because it preserves that union. (shrink)

Context: Although ethics consultation is commonplace in United States hospitals, descriptive data about this health service are lacking. Objective: To describe the prevalence, practitioners, and processes of ethics consultation in U.S. hospitals. Design: A 56-item phone or questionnaire survey of the “best informant” within each hospital. Participants: Random sample of 600 U.S. general hospitals, stratified by bed size. Results: The response rate was 87.4%. Ethics consultation services were found in 81% of all general hospitals in the U.S., and in 100% (...) of hospitals with more than 400 beds. The median number of consults performed by ECSs in the year prior to survey was 3. Most individuals performing ethics consultation were physicians, nurses, social workers, or chaplains. Only 41% had formal supervised training in ethics consultation. Consultation practices varied widely both within and between ECSs. For example, 65% of ECSs always made recommendations, whereas 6% never did. These findings highlight a need to clarify standards for ethics consultation practices. (shrink)

The human sciences—including psychology, anthropology, and social theory—are widely held to have been born during the eighteenth century. This first full-length, English-language study of the Enlightenment sciences of humans explores the sources, context, and effects of this major intellectual development. The book argues that the most fundamental inspiration for the Enlightenment was the scientific revolution of the seventeenth century. Natural philosophers from Copernicus to Newton had created a magisterial science of nature based on the realization that the physical world operated (...) according to orderly, discoverable laws. There is a story, which historians of modern France often tell, of the ministerial official in Paris who had only to glance at his clock in order to know the exact passage of Vergil being construed and the law of physics being expounded in every school throughout the country. Invariably, the story is told for a purpose. It is used to demonstrate the high degree of centralization and the attendant rigidity of the French educational system, usually with special reference to (...) the nineteenth century. The story, which has its roots in the rich corpus of Napoleonic legend, serves this purpose very well, but unfortunately it is both apocryphal and misleading. For while it is true that most nineteenth-century ministers with responsibility for education aspired to the ideal of total control, not one of them came close to it in reality. (shrink)

This chapter is concerned with representing the semantics of natural language plurals and mass terms in property theory; a weak first-order theory of Truth, Propositions and Properties with fine-grained intensionality (Turner 1990, Turner 1992, Aczel 1980). The theory allows apparently coreferring items to corefer without inconsistency. This is achieved by using property modifiers which keep track of the property used to refer to a term, much like Landman’s roles (Landman 1989). We can thus predicate apparently contradictory properties of “the judge” (...) and “the cleaner,” for example, even if they turn out to be the same individual. The same device can also be used to control distribution into mereological terms: when we say “the dirty water is liquid,” we can infer that those parts that are dirty water are liquid without inferring that the dirt is liquid. The theory shows how we can formalise some aspects of natural language semantics without being forced to make certain ontological commitments. This is achieved in part by adopting an axiomatic methodology. Axioms are proposed that are just strong enough to support intuitively acceptable inferences, whilst being weak enough for some ontological choices to be avoided (such as whether or not the extensions of mass terms should be homogeneous or atomic). The axioms are deliberately incomplete, just as in basic PT, where incomplete axioms are used to avoid the logical paradoxes. The axioms presented are deliberately too weak to say much about ”non-denoting’ definite descriptors. For example, we cannot erroneously prove that they are all equal. Neither can we prove that predication of such definites results in a proposition. This means that we cannot question the truth of sentences such as “the present king of France is bald.”. (shrink)

Allen Buchanan argues that it doesn’t matter whether a state has authority in the sense of being able to create binding obligations for its citizens, so long as it is morally justified in wielding political power. In this paper, I look at this issue from a slightly different angle. I argue that it matters a great deal whether citizens relate to their state in an obligatory fashion. This is for two reasons. First, a fully morally justified state must be an (...) efficacious state; it must be able to realise its values and make its rules stick. My contention will be that enduring stability can only be secured when citizens, or at least a significant proportion of citizens, are tangibly bound to regulate their conduct in accordance with a principle of obedience to just states. Second, it is only when individuals interact in the right way with the justification for state power that the state itself as a pervasive and coercive entity does not pose a problem for them as reason-responsive agents. This article sets out a new conception of ‘property as an asset of resilience’. Building on Fineman’s emphasis on ‘webs’ of resilience, and applying insights from Actor-Network Theory and Resilient Property Theory, we examine how the rhetorical claims asserted by owners and non-owners, individually and collectively, and the ways that law recognizes and endorses those claims, affect the production of property-as-resilience. Applying Fineman’s framework, we argue that the ‘embodiment’ and ‘embeddedness’ of human vulnerability is revealed by the necessary and inevitable (...) relationship we have with land, housing and place. Everyone—including homeless people—must ‘be’ somewhere (embodiment); however, it is our ability to access ‘assets of resilience’ through our social embeddedness in institutional structures and relationships that mitigates (or not) our experience and life opportunities. In this article we analyze the nature of real property as an asset of resilience, the consequences of exclusionary concepts of ownership for how resilience is allocated, and the implications for how we think and talk about ‘exclusion’ and ‘inclusion’ in property theories and property law. We consider the roles that states perform in the allocation of property as an asset of resilience: both directly, through the protection and enforcement of private property rights and official narratives about the nature of private property; and indirectly, as owners leverage the hinterland of privilege extended to ‘ownership’ and owners to deepen their own networks of resilience. Mercier and Sperber (M&S) suggest that human reasoning is reflective and has evolved to support social interaction. Cognitive agents benefit from being able to reflect on their beliefs whether they are acting alone or socially. A formal framework for argumentation that has emerged from research on artificial cognitive systems that parallels M&S's proposals may shed light on mental processes that underpin social interactions.
