In this paper we describe the impact that Walton’s conception of argumentation schemes had on AI and Law research. We will discuss developments in argumentation in AI and Law before Walton’s schemes became known in that community, and the issues that were current in that work. We will then show how Walton’s schemes provided a means of addressing all of those issues, and so supplied a unifying perspective from which to view argumentation in AI and Law.

A recent French reform has revised the legal definition of the corporation. In essence, the law stipulates that the corporation must be run with due regard to the social and environmental impacts of its activity. It also introduces the notion of raison d’être and affords the possibility for any corporation to assign social or environmental purposes to itself, defined in its by-laws. This reform is similar to recent reforms in the UK and the US, but is based on an original (...) and distinctive theoretical argument. The aim of our article is to analyze the fundamental tenets of this reform and their implications for the theory of the corporation. It shows that the new law is based on a new positive definition of the enterprise as not only an economic organization or a productive entity, but more fundamentally a space for innovative collective action. We argue that this view of the enterprise challenges our conceptualization of the corporation in two important ways. First, it shows that the traditional theories overlook the activities of the enterprise and their related impacts, and that the corporation is not necessarily the appropriate legal vehicle for the innovative enterprise. Second, it suggests that the stipulation of the enterprise’s purpose or raison d’être in the corporate by-laws can provide new promising legal foundations for corporate responsibility. (shrink)

There is growing interest in examining dark personality traits, to better explain malevolent and self-serving behaviour patterns commonly observed in clinical and non-clinical settings. Recently, taxonomies of dark personalities have been developed, along with psychometric tools to measure and delineate between traits including psychopathy, Machiavellianism and narcissism. The extent to which these constructs are distinct or overlapping remains controversial. Psychophysiological research can improve understanding of biological mechanisms contributing to personality that may help to evaluate taxonomies. This study investigated diurnal variations (...) in salivary cortisol (on waking, cortisol awakening response, and at bedtime, over two days) and their relationship to personality traits (Short Dark Triad Scale and IPIP Mini), psychopathology (Depression, Anxiety and Stress Scale; DASS) and quality of life (WHOQOL-BREF) in a non-clinical sample (N=45, 26 females, 19 males, 18-59 years). Dark personality traits correlated with low bedtime cortisol, reduced sleep, depression and poorer quality of life. Hierarchical linear regressions analyses indicated that bedtime cortisol levels significantly accounted for variance in Psychopathy (F(1,39)=5.55, p=.02, R=.52, B=-1.81, 95% CI [-3.37-(-.26)], β=-.33, sr2=.10) and reduced sleep uniquely accounted for variance Machiavellianism (F(2,40)=5.99, p=.01, R=.48, B=1.01, 95% CI [.16-2.02], β=.34, sr2=.11). These data provide preliminary evidence that supports the cortisol hypoarousal hypothesis of Psychopathy and has identified a link between Machiavellianism, sleep-wake cycles, and chronotype. The hypoarousal hypothesis of Psychopathy contends that the hypothalamic-pituitary-adrenal axis is unresponsive to the stress of social engagement. Machiavellianism was predicted by longer days with evidence for an evening chronotype. These findings indicated that the Dark Triad traits have different underlying biological mechanisms that require further exploration. (shrink)

This article has two aims. The first is to open up a line of inquiry into whether epistemic and aesthetic values interact, at the most general level. Does an overall increase in epistemic or aesthetic value in the world have an effect on the alternative value? The second, and more specific, aim is to argue that yes, it does. In particular, I argue that an increase in epistemic value would result in a decrease in aesthetic value, across two important dimensions. (...) First, I argue that, if beliefs universally aligned with a commonly accepted epistemic principle—namely, doxastic correctness—then there would be less aesthetic diversity in the world. And second, I argue that, if beliefs universally aligned with doxastic correctness, then there would also be less overall aesthetic value in the world, at least in some important respects. (shrink)

Atkinson's method is to uncover the traits necessary for a person's being qualified to examine moral issues in a capable and competent manner. In the process he also discovers features which hinder a person being a competent thinker about moral questions. The reader is guided through this search by engaging Socrates as he appears in Plato's dialogues, not merely as a historical figure, but as an interlocutor. This path proceeds without begging any questions; its argument begins with no assumptions (...) about which moral beliefs might be true, which false, or even if moral truth exists. On the contrary, the book begins only with the supposition that there might be moral truth. And yet, by following Socrates on the attempt to ascertain its existence, the reader is brought into the realm of moral knowledge and becomes acquainted with the ideal of a genuine seeker of moral truth, an ideal which can be embraced as a guidepost to becoming a better and more fulfilled human being. --Publisher description. It is clear, irenic, and shows extensive research: nearly 1,000 footnotes in its 275 pages of text offering many avenues for further exploration including numerous references to “alternative” accounts. It is far more than an analysis of cooperation, for it exposes the reader to a universe of concepts, many of which are seldom introduced in studies on the topic. It is also bracing, an elixir likely to incite (and likely intended to incite) the reader to a deeper commitment to careful moral thought and conscientious moral action. Few readers will close this book with a feeling of time unprofitably spent.The introduction makes clear the book’s two central claims: (i) that an adequate analysis of the topic of cooperation with evil has yet to be provided and (ii) that a virtue-based approach stemming from St. Thomas Aquinas contains the elements for its provision. In support of these claims the book is organized into five chapters, the first three foundational and the last two matters of application.Chapter 1, “The Teaching of St. Thomas Aquinas: Received and Jettisoned,” begins with a presentation of St. Thomas’s treatment of five topics—borrowing money from known usurers, scandal, restitution for [End Page 709] crimes committed by agents working together, exacting oaths from known perjurers, production of objects used for sinful purposes. Literary trauma theory has traditionally been a humanist concern, and the concept of witnessing, so central to the theorization of trauma, has focused on human experience and relationships. This article stages an interdisciplinary intervention by conceptualizing trans-“species” trauma testimony as a literary encounter involving a double-layered witnessing; the human artist witnessing nonhuman animals’ witnessing to the failings and crises brought about by human society. Focusing on a selection of contemporary Australian poems, a view emerges of poetic witnessing and testimony that (...) exceeds and complicates the sub-genre lenses of old such as “nature poetry,” “ecopoetry,” and “protest poetry.” I propose a new conceptual category that testifies to traumatic structures and consequences of human practices. I explore how this testimony proceeds through a two-way channel of witnessing in which nonhuman animals are active witnessing agents and not merely witnessed by humans. I concentrate on witnessing as primarily experiential, as a corporal, affective operation in which the senses figure centrally. I argue that when poets witness nonhuman animal experience in poetry, testimony advances as an ethical engagement in an act of solidarity and advocacy. Poetry offers productive potential in this respect due to its affinity for engagement with the senses, its capacity to communicate heightened affect, and its scope for expression, articulation, and evocations of meaning outside of conventional sense-making and the limits of rational understanding. In Big Gods, Norenzayan (2013) presents the most comprehensive treatment yet of the Big Gods question. The book is a commendable attempt to synthesize the rapidly growing body of survey and experimental research on prosocial effects of religious primes together with cross-cultural data on the distribution of Big Gods. There are, however, a number of problems with the current cross-cultural evidence that weaken support for a causal link between big societies and certain types of Big Gods. Here we attempt to (...) clarify these problems and, in so doing, correct any potential misinterpretation of the cross-cultural findings, provide new insight into the processes generating the patterns observed, and flag directions for future research. In Chapter 4 of his essay Utilitarianism, “Of what sort of Proof the Principle of Utility is susceptible,” J. S. Mill undertakes to prove, in some sense of that term, the principle of utility. It has very commonly been argued that in the course of this “proof” Mill commits two very obvious fallacies. The first is the naturalistic fallacy which he is held to commit when he argues that since “the only proof capable of being given that an object is (...) visible, is that people actually see it. The only proof that a sound is audible is that people hear it: and so of the other sources of our experience. In like manner … the sole evidence it is possible to produce that anything is desirable, is that people do actually desire it.”1 Here Mill appears to hold that “X is desirable ”—a value judgment—follows deductively from “People desire x”—a factual statement. And the second is the fallacy of composition which seems to be involved in Mill'zs argument that since “each person's happiness is a good to that person … the general happiness, therefore, a good to the aggregate of all persons.”2. Bernard Lahire’s critique of Pierre Bourdieu’s sociology aims to establish a ‘dispositionalist-contextualist’ vision of human agency capable of fully sociologising biography and individuality. While accepting the utility of the notion of field, Lahire emphasises the plurality of non-field entities – including games, worlds and figurations – shaping people’s dispositions and the contexts in which they come to act, leading him to downgrade the notion of habitus and cast fields as only a small part of the picture. While appreciating the motivation (...) underpinning Lahire’s project and the usefulness of some of his research-led insights, this article argues that his skewed and partial reading of Bourdieu blinds him to the fact that solutions to some of the problems he identifies are already there in Bourdieu’s framework and, indeed, that these are more coherent and comprehensive than some of the conceptual suggestions Lahire offers. This book is open access under a CC BY 4.0 license. This book addresses the age-old problem of infinite regresses in epistemology. How can we ever come to know something if knowing requires having good reasons, and reasons can only be good if they are backed by good reasons in turn? The problem has puzzled philosophers ever since antiquity, giving rise to what is often called Agrippa's Trilemma. The current volume approaches the old problem in a provocative and thoroughly contemporary (...) way. Taking seriously the idea that good reasons are typically probabilistic in character, it develops and defends a new solution that challenges venerable philosophical intuitions and explains why they were mistakenly held. Key to the new solution is the phenomenon of fading foundations, according to which distant reasons are less important than those that are nearby. The phenomenon takes the sting out of Agrippa's Trilemma; moreover, since the theory that describes it is general and abstract, it is readily applicable outside epistemology, notably to debates on infinite regresses in metaphysics. The book is a potential game-changer and a must for any advanced student or researcher in the field. (shrink)

In this paper we consider persuasion in the context of practical reasoning, and discuss the problems associated with construing reasoning about actions in a manner similar to reasoning about beliefs. We propose a perspective on practical reasoning as presumptive justification of a course of action, along with critical questions of this justification, building on the account of Walton. From this perspective, we articulate an interaction protocol, which we call PARMA, for dialogues over proposed actions based on this theory. We outline (...) an axiomatic semantics for the PARMA Protocol, and discuss two implementations which use this protocol to mediate a discussion between humans. We then show how our proposal can be made computational within the framework of agents based on the Belief-Desire-Intention model, and illustrate this proposal with an example debate within a multi agent system. Three levels are proposed to explain lying as a process in discourse production, to characterize different types of lies and to distinguish them from mistakes, ignorance and forgetting as well fr from ill-timed or irrelevant utterances.

The name ‘Chloe’ appears four times in Horace'sOdes, once in Book 1 (1.23) and three times in Book 3 (3.7, 3.9, 3.26). Whether the ‘Chloes’ represent a woman or women from Horace's real life is probably not something we could know. Furthermore, there is no obvious reason to assume that all the ‘Chloes’ are the same person. However, there is likewise no obvious reasonnotto read the odes in which the name ‘Chloe’ appears, as some scholars have done, as referring to (...) the same woman, fictional or otherwise. This article argues both that ‘Chloe’ is a consistent character in theOdesand that the portrayal of Chloe is not only connected across odes but also sequential. Taking the poems in order, we see Chloe grow up from a girl who is inexperienced in the world of men to a mature mistress who plays the dominant role in her love affairs. (shrink)

The Berkson effect shows that two independent diseases, A and B, become negatively correlated if they are confined within the walls of a hospital. We explain that, simply by adding a third disease, C, the negative correlation may flip into a positive one, and we identify the point where this happens. That leads to a necessary and sufficient condition for a positive as well as a negative correlation between A and B. We further explain that a flip from negative to (...) positive is impossible if C is independent of A, of B, and of the disjunction of A and B: with these three independences in place, the Berkson effect remains in force. However, if only two of the three independences hold, the effect is not guaranteed. (shrink)

Heisenberg’s uncertainty principle is a milestone of twentieth-century physics. We sketch the history that led to the formulation of the principle, and we recall the objections of Grete Hermann and Niels Bohr. Then we explain that there are in fact two uncertainty principles. One was published by Heisenberg in the Zeitschrift für Physik of March 1927 and subsequently targeted by Bohr and Hermann. The other one was introduced by Earle Kennard in the same journal a couple of months later. While (...) Kennard’s principle remains untarnished, the principle of Heisenberg has recently been criticized in a way that is very different from the objections by Bohr and Hermann: there are reasons to believe that Heisenberg’s formula is not valid. In multi-agent systems (MAS), abstract argumentation and argumentation schemes are increasingly important. To be useful for MAS, argumentation schemes require a computational approach so that agents can use the components of a scheme to construct and present arguments and counterarguments. This paper proposes a syntactic analysis that integrates argumentation schemes with abstract argumentation. Schemes can be analysed into the roles that propositions play in each scheme and the structure of the associated propositions, yielding a greater understanding of the schemes, a (...) uniform method of analysis, and a systematic means to relate one scheme to another. This analysis of the schemes helps to clarify what is needed to provide denotations of the terms and predicates in a semantic model. (shrink)

Firewalls are an important tool in the assurance of network security. Packet filtering firewalls are configured by providing a set of rules that identify how to handle individual data packets that arrive at the firewall. In large firewall configurations, conflicts may arise between these rules. Argumentation provides a way of handling conflicts such that their origin is illuminated, and hence can help a system administrator understand the effects of a given configuration. To show how argumentation might help in this domain (...) we examine the use of a system of metalevel argumentation for firewall configuration, showing how it makes conflicts and their origins clear, and showing how different instantiations of a metalevel argumentation system provide alternative ways to resolve conflicts. This paper engages with Manuel DeLanda’s Deleuze-inspired ‘assemblage theory’ from a perspective sympathetic to Pierre Bourdieu’s field theory. It first outlines DeLanda’s proposed new ‘philosophy of society’, focusing on his major works in this vein, and registers some scepticism as to its originality for sociology. It then introduces and responds to DeLanda’s critique of Bourdieu. Rather than simply reject assemblage theory outright, however, I draw on selected insights from DeLanda to push field theory in new directions. More specifically, I conceptualise (...) the interplay of fields and assemblages and use notions of ‘exteriority’ and ‘possibility space’ to help conceive individual plurality of social positioning and its effects for subjectivity and practice. As the average age of the population increases, so too do the number of people living with chronic illnesses. With limited resources available, the development of dialogue-based e-health systems that provide justified general health advice offers a cost-effective solution to the management of chronic conditions. It is however imperative that such systems are responsible in their approach. We present in this paper two main challenges for the deployment of e-health systems, that have a particular relevance to dialogue and argumentation: collecting (...) and handling health data, and trust. For both challenges, we look at specific issues therein, outlining their importance in general, and describing their relevance to dialogue and argumentation. Finally, we go on to propose six recommendations for handling these issues, towards addressing the main challenges themselves, that act both as general advice for dialogue and argumentation research in the e-health domain, and as a foundation for future work on this topic. Models of deliberative dialogue are fundamental for developing autonomous systems that support human practical reasoning. The question discussed in this paper is whether existing models are able to capture the complexity and richness of natural deliberation. In real-world contexts, circumstances relevant to the decision can change rapidly. We reflect on today’s leading model of deliberation dialogue and we propose an extension to capture how newly exchanged information about changing circumstances may shape the dialogue. Moreover, in natural deliberation, a dialogue may (...) be successful even if a decision on what to do has not been made. A set of criteria is proposed to address the problem of when to close off the practical reasoning phase of dialogue. We discuss some measures for evaluating the success of a dialogue after closure and we present some initial efforts to introduce the new deliberation features within an existing model of agent dialogue. We believe that our extended model of dialogue may contribute to representing that richness of natural deliberative dialogue that is yet to be addressed in existing models of agent deliberation.
