Introduction Future HIV vaccine efficacy trials with adolescents will need to ensure that participants comprehend study concepts in order to confer true informed assent. A Hepatitis B vaccine trial with adolescents offers valuable opportunity to test youth understanding of vaccine trial requirements in general. Methods Youth reviewed a simplified assent form with study investigators and then completed a comprehension questionnaire. Once enrolled, all youth were tested for HIV and confirmed to be HIV-negative. Results 123 youth completed the questionnaire (mean age=15 (...) years; 63% male; 70% Hispanic). Overall, only 69 (56%) youth answered all six questions correctly. Conclusions Youth enrolled in a Hepatitis B vaccine trial demonstrated variable comprehension of the study design and various methodological concepts, such as treatment group masking. (shrink)

This letter was submitted to the Senate Standing Committee on Legal and Constitutional Affairs, Government of Canada, on 29th January, 2021, as final debate over Bill C-7 was being undertaken in the Senate regarding MAiD and the strong opposition to the legislation expressed across the Canadian disability community. It draws on our individual and joint work on eugenics, well-being, and disability.

Drugs are much more expensive whilst they are subject to patent protection than once patents expire: patented drugs make up only 20% of NHS drugs prescriptions, but consume 80% of the total NHS drugs bill. This article argues that, given the relatively uncontroversial assumption that we should save the greater number in cases where all are equally deserving and we cannot save both groups, it is more difficult than is usually thought to justify why publicly funded healthcare systems should (...) pay for patented treatments. The claim to medical treatment of those who will be sick with a given condition once the patent runs out is just as strong as those who are sick with it now, but we will be able to treat more people with the same unit of resource in the future. Hence, when resource constraints entail that both cannot be funded, publicly funded healthcare systems ought to wait until patents expire before approving drugs for general use in the publicly funded system. Joan Tronto’s new paradigm of caring democracy bases citizenship on the need to ensure that all people receive and provide care equitably. But how exactly are citizens motivated to take up these caring responsibilities? The writings of Alcoholics Anonymous (AA) co-founder William ‘Bill’ Wilson provide one answer: he pathologizes the alcoholic – dooming him to inevitable relapse and death – to compel AA members to accept shared vulnerability and mutual care as the bedrock of sobriety and AA society. (...) Wilson returns repeatedly to the threat of death to convince AA members to carry out their newfound caring and democratic responsibilities. We use Wilson’s thinking, as well as Michel Foucault’s work on biopower, to forward the concept of biocaring democracy, in which the acceptance of shared pathology compels people to care for each other but also limits their democratic responsibilities. More broadly, our analysis suggests how hinging democracy to shared vulnerability may constrain the radical possibilities that Tronto envisions. (shrink)

The act of slowness is by its very nature an implied reduction of physical engagement that one might argue has as much to do with impairment as it does with temporal devaluation. Yet when placed in a twenty-first century context there are a growing number of arguments that position slowness as a mediator of resistance to fast-paced communication transactions thus impacting on the ways in which human interaction coexists between digital technology and cultural immediacy. While it may be suggestive to (...) position this new emergence as a collective of technoanthropological treaties as found, for example, in the Slow Media Manifesto , there is an under-valued relation that I will discuss throughout this paper when considering the role that slow motion plays out as a condition rather than an effect of lens based practice. Discussion will integrate the ideas of Proust, Mearleu Ponty, and Murch with review of contributions from Wes Anderson, The Wachowski Siblings, Bill Viola, and Adam Magyar. In July 2019, Stella Creasy MP and her team succeeded in attaching an amendment to a largely administrative bill which would require the UK government to liberalise abortion laws in Northern Ireland by 21 October 2019, provided the Northern Ireland government does not resume before that date.1 The amendment succeeded in the Commons, 332 votes to 99 and later, with some adjustments, in the Lords, 182 votes to 37. The Bill received Royal Assent on 24 July 2019. In (...) Northern Ireland, abortion remains a criminal offence punishable by up to life imprisonment in all except exceptional circumstances, that is, where it is ‘necessary to preserve the life of the woman’ or where there is a ‘risk of serious adverse effect which is either long term or permanent’.2 The law makes no provision for women who are pregnant as a result of rape, incest or in the case of fatal fetal abnormality. Because there is a lack of clarity around which circumstances or conditions would have a sufficiently ‘serious and long-term adverse effect’, it has been argued that the law has had a ‘chilling effect’ on service provision.3 As a result, only 13 abortions were performed in Northern Ireland in 2018/2019.4 Instead, more than 1000 women travelled from Northern Ireland to England to access legal abortion services.5 A recent review of the law in Northern Ireland concluded that this situation disadvantages women who cannot afford to or are unable to travel.3 Women are also reportedly purchasing abortifacients unlawfully online, exposing them to the risk of prosecution as well as to risks where the pills are unsafe or lead to complications. Interwoven are many bioethics themes, including the doctor–patient relationship, conflict of interest, autonomy, and patient welfare. For those unaware of the sadness and torment running directly alongside the sunny, bubbly life (...) of The Beach Boys, this film is an eye-opener. Abstract—How do judges decide cases? Are judges controlled by rules, principles and professional standards of reasoning or do they decide as politicians, using the law as an instrument to achieve predetermined goals. In Australia one influential view on this issue was expressed by Sir Owen Dixon when he called for a ‘strict and complete legalism’ for judges. Dixon’s strict legalism no longer commands the respect that it once did and his view is now commonly seen as naïve or as a (...) noble lie intended to hide the freedom open to judges when they decide cases. This article examines first Dixon’s understanding of strict legalism. It will argue that Dixon understood it as a form of practice and not as a rigorous scholarly system. Secondly, it will analyse Wilson v Darling Island Stevedoring to see whether the leading judgment of Fullagar J is in accord with Dixon’s judicial method. In Wilson the High Court was presented with a persistent legal problem—could stevedores claim the benefits of exemption and limitation clauses that commonly featured in bills of lading arising from the transport of goods and people? The third section of the article will consider the obvious belief of many of the judges in the authorities examined that the commercial inconvenience of not protecting stevedores was too great to ignore. These judges were willing to grant stevedores the protection of exemption clauses in contracts of carriage, a trend that continued, indeed accelerated, after Wilson. So, even if Fullagar J did judge as a strict legalist, does this perceived commercial imperative raise doubts about the appropriateness of this style of judging? In conclusion the article will consider the implications of showing that the reasoning in Wilson displayed a fidelity to Dixon’s notion of strict and complete legalism. (shrink)

It suggests a parallel between Aquinas's understanding of acedia and invidia as the two vitia capitalia most directly undermining of God's caritas and AA founder Bill Wilson's understanding of two contemporary deadly sins, self-pity and resentment, as the "root" of alcoholics' troubles. I argue that AA's understanding of sin and addiction is relevant far beyond the lives of alcoholics. This book offers the first sustained critique of individualism in psychology, a view that has been the subject of debate between philosophers such as Jerry Fodor and Tyler Burge for many years. The author approaches individualism as an issue in the philosophy of science and by discussing issues such as computationalism and the mind's modularity he opens the subject up for non-philosophers in psychology and computer science. Professor Wilson carefully examines the most influential arguments for individualism and identifies the (...) main metaphysical assumptions underlying them. Since the topic is so central to the philosophy of mind, a discipline generating enormous research and debate at present, the book has implications for a very broad range of philosophical issues including the naturalisation of intentionality, psychophysical supervenience, the nature of mental causation, and the viability of folk psychology. Newton’s famous Hypotheses non fingo raises many questions. While he castigated the Cartesians for their vortex hypothesis, and his follower Cotes attacked mechanical chemistry, Newton himself ventured many hypotheses, notably in his Opticks, the Queries to the Opticks and in the last book of the Principia. Although it is true that Newton, unlike Descartes, fit his data to mathematical models, what he said about hypotheses seems straightforwardly false. To explain this situation, Wilson explores the web of associations between Cartesianism, (...) hypotheses, ‘speculation’ and ‘vain philosophy’ in the Pauline sense. She shows how Cartesian hypotheses concerning the origins of the world were understood as dangerously pagan, and how Newton and his supporters took pains to distinguish their brand of science from his by denying that they were engaged in any form of speculative or ‘vain’ philosophy. It is argued that, for the purpose of an audit to be really ethical rather than merely a tool to increase the levels of the reputation of the company, tranparency must be inherent to accountability. To do this, it is claimed that the concept of tranparency is anaced should be seen from the point of view of civic ethics, in order to establish how it is implied in a normative approach to stakeholders theory. The article ends arguing that any process of accountability must include some minimal normative components of transparency for it to be applied in companies wanting to be considered as fair companies. _Jokes, Life after Death, and God _has two main tasks: to try to understand exactly what a joke is, and to see whether there are any connections between jokes, on the one hand, and life after death and God, on the other hand. But it pursues other tasks as well, tasks of an ancillary sort. This book devises a general and comprehensive, but brief, theory of jokes. The author begins with critiques of other writers’ views on the subject. 1) Ted (...) Cohen thinks that such a theory is impossible. 2) Ronald Berk, on the other hand, provides just such a theory. And 3) John Morreall provides a general theory of laughter, which may include some things which can be used in a general theory of jokes. 4) Neil Schaeffer, too, provides a general theory of laughter, which makes a big point out of what he calls the “ludicrous context”; but he does include a chapter on jokes. 5) Christopher Wilson offers a general theory of jokes in which he focuses on form and content. And 6) Thomas Werge, in reflecting on the comic, suggests a general theory of jokes which identifies their matter, form, agents, purposes, and beyond these, the underlying shared relational context, which makes it possible for jokes to arise. 7) Bill Fuller’s message is that there is more funniness coming out of two or more heads than out of one, just as Socrates’ message was that there is more clarity coming out of two or more heads than out of one. 8) Umberto Eco feels that monks should laugh, just as ordinary people do; for laughter not only refreshes our seeking spirits, it also illuminates the truth we seek. 9) Simon Critchley, in his reflections on humor, notes that jokes bring on a kind of everyday anamnesis, that they are anti-story stories, that they are like prayers, that they are like philosophy; and that they require a certain underlying context, which is implicitly recognized by both teller and listener, and which renders possible the tension needed to make the punch line work. 10) Martha Wolfenstein, pursuing a psychological analysis of children’s humor, proposes that the underlying motive for telling jokes remains the same from childhood to adulthood, i.e., to transform painful and frustrating experiences so as to extract pleasure from them; and that the agent or productive cause of jokes is the repressing unconscious, as suggested by Freud. As John Morreall has argued, neither the Superiority Theory, nor the Relief Theory, nor the Incongruity Theory appears to work as a general and comprehensive theory. Moreover, these writers talk more about humor and laughter than about jokes. To be sure, a joke is a type of humor. Thus, to say something about humor is to say something, though of a generic sort, about jokes. Similarly, to say something about the laughter caused by humor is to say something, though generic, about the laughter caused by jokes. Most of the authors considered in chapter one are concerned with jokes, and not only with humor as such. Section 11 of chapter one puts together, out of the combined contributions of these authors, what can be considered the beginnings of, some thoughts toward, a general and comprehensive theory of jokes. This task the author illustrates in a concrete way, by looking at individual jokes of different sorts; not, however, without inviting the reader to enjoy these jokes. The author looks particularly at Jewish jokes, Christian jokes, and Islamic jokes, jokes about philosophy and philosophers, yo mama jokes, Italian jokes and Slovak jokes, all of which makes for a clearer understanding of exactly what a joke is. The analysis of general theory is then followed by some views on the morality of jokes and joke-telling, and an analysis of the connection between jokes and life after death, on the one hand, and God, on the other. It is almost 30 years since the sociobiology controversy burst into full bloom. The modern theory of the evolution of animal behavior was born in the mid 1960’s with Bill Hamilton’s seminal papers on inclusive fitness and George William’s book Adaptation and Natural Selection. The following decade saw an avalanche of important ideas on the evolution of sex ratio, animal conflicts, parental investment, and reciprocity, setting off a revolution our understanding of animal societies, a revolution that is still going (...) on today. By the mid-1970’s, Richard Alexander, E. O. Wilson, Napoleon Chagnon, Bill Irons, and Don Symons among others began applying these ideas to understand human behavior. Humans are evolved creatures, and quite plausibly the same evolutionary forces that shaped the behavior of other animals also molded our behavior. Moreover, the new theory of animal behavior—especially, kin selection, parental investment, and optimal foraging theory—seemed fit the data on human societies fairly well. (shrink)

Many philosophers hold that punishment has an expressive dimension. Advocates of expressive theories have different views about what makes punishment expressive, what kinds of mental states and what kinds of claims are, or legitimately can be expressed in punishment, and to what kind of audience or recipients, if any, punishment might express whatever it expresses. I shall argue that in order to assess the plausibility of an expressivist approach to justifying punishment we need to pay careful attention to whether the (...) things which punishment is supposed to express are aimed at an audience. For the ability of any version of expressivism to withstand two important challenges, which I call the harsh treatment challenge’ and the ‘publicity challenge’ respectively. will depend on the way it answers them. The first of these challenges has received considerable discussion in the literature on expressive theories of punishment; the second considerably less. This is unfortunate. For careful consideration of the publicity challenge should lead us to favor a version of the expressive theory which has been under-discussed: the view on which punishment has an intended audience, and on which the audience is society at large, rather than—as on the most popular version of that view—the criminal. Furthermore, this view turns out to be better equipped to meet the harsh treatment challenge, and to be so precisely because of the way in which it meets the publicity challenge. (shrink)

Recent literature portrays caring as a psychological, social, and ethical orientation associated with female gender identity. This essay focuses on Giliigan's influential view that “care” is a broad theme of moral development which is under-represented in dominant theories of human development such as Kohlberg's theory. An alternative hypothesis is proposed portraying care development as a set of circumscribed coping strategies tailored to dealingwith sexism. While these strategies are practically effective and partially “liberated,” from the moral point of view, they also (...) reflect the debilitating influences of sexist socialization even at the highest level. Gilligan and her colleagues seem to misidentify these inadequacies of mature care. This alternative hypothesis is briefly related to the critical and feminist tradition. Thomas Pogge has argued, famously, that ‘we’ are violating the rights of the global poor insofar as we uphold an unjust international order which provides a legal and economic framework within which individuals and groups can and do deprive such individuals of their lives, liberty and property. I argue here that Pogge’s claim that we are violating a negative duty can only be made good on the basis of a substantive theory of collective action; and that it can only provide (...) substantive ethical guidance when combined with an account of how collective action gives rise to forward-looking responsibility and/or accountability on an individual level. I consider accounts of these two topics given in work by Peter French and Christopher Kutz; and I argue that neither of them give Pogge what he needs. Although there is a sense in which 'we' can be said to be violating the rights of the worst off, the sense in which this is true does not generate any plausible action-guiding claims for individuals. On September 22, 1998, California Governor Pete Wilson signed Senate Bill 1785 into law, dramatically affecting the entire California animal sheltering community. Dubbed the "Hayden law" by the animal protection community after the bill's sponsor, it represents the state of California's attempt to legislate a solution to both the companion animal overpopulation problem and the friction between the agencies trying to end it. The persistence of the bill's primary supporters, a Los Angeles veterinarian and a UCLA (...) law school professor and the overall lack of opposition to it helped SB 1785 sail through the California legislature. Because of the scope of the bill and the immense cost of implementation, its passage shocked many in the sheltering community. This case study highlights the consequences of legislation that was crafted based on worse case scenarios and over which there was little collaborative effort. It concludes with suggestions that might be useful to other states contemplating similar such legislation. (shrink)

Virtue theorists have recently been focusing on the important question of how virtues are developed, and doing so in a way that is informed by empirical research from psychology. However, almost all of this recent work has dealt exclusively with the moral virtues. In this paper, we present three empirically-informed accounts of how virtues can be developed, and we assess the merits of these accounts when applied specifically to intellectual (or epistemic) virtues.

This essay provides evidence to support a promising conceptual and potentially practical set of ideas at once both principled and effective found in the work of Max Weber and Alfred Schutz addressed to the issue of ‘adequacy’ as a goal in social research. Efforts to achieve adequacy beyond the epistemological conditions required by Weber’s demand that evidence meet both causal adequacy and adequacy on the level of meaning were significantly refocused by Schutz’s later concern, responding specifically to Weber, that the (...) social sciences also address themselves to his postulate of adequacy. It states that “Each term used in a scientific system referring to human action must be so constructed that a human act performed within the life-world by an individual actor in the way indicated by the typical construction would be reasonable and understandable for the actor himself, as well as for his fellow men”. A serious attempt to implement a more expansive notion of adequacy by practically activating this postulate in the ways suggested can be beneficial not only for the social research situation but in everyday life as well. Aarne Naess, in a seminal paper on environmental philosophy, distinguished between two streams of environmental philosophy and activism—shallow and deep. The deep, long-range ecology movement has developed over the past four decades on a variety of fronts. However, in the context of global conferences on development, population, and environment held during the 1990s, even shallow environmentalism seems to have less priority than demands for worldwide economic growth based on trade liberalization and a free market global economy.

In this paper I attempt to show how an appeal to a particular kind of collective obligation - a collective obligation falling on an unstructured collective consisting of the world’s population as a whole – can be used to undermine recently influential objections to the idea that there is a human right to health which have been put forward by Gopal Sreenivasan and Onora O’Neill. -/- I take this result to be significant both for its own sake and because it (...) helps to answer a challenge often put to Those who argue for the existence of collective obligations: namely, to explain why the question of whether there are any such obligations might matter from a practical point of view. One way of introducing the objection is to focus on questions of agency. Here I'll argue both that there can be obligations on groups that are not themselves collective agents, and that these can play an important explanatory and clarifcatory role in accounting for obligations which fall on individuals. The Birth of American Law: An Italian Philosopher and the American Revolution tells the forgotten, untold story of the origins of U.S. law. School choice positions parents as consumers who select schools that maximize their preferences. This account has been shaped by rational choice theory. In this essay, Terri Wilson contrasts a rational choice framework of preferences with John Dewey's understanding of interest. To illustrate this contrast, she draws on an example of one parent's school decision-making process. Dewey's concept of interest offers an alternative conceptual vocabulary attentive to the complex, value-laden, and evolving process of choosing a school.
