Edna Ullmann-Margalit provides an original account of the emergence of norms. Her main thesis is that certain types of norms are possible solutions to problems posed by certain types of social interaction situations. She presents illuminating discussions of Prisoners' Dilemma, co-ordination, and inequality situations.

In this paper we explore quarantining as a more ethical method for delimiting the spread of Hate Speech via online social media platforms. Currently, companies like Facebook, Twitter, and Google generally respondreactivelyto such material: offensive messages that have already been posted are reviewed by human moderators if complaints from users are received. The offensive posts are onlysubsequentlyremoved if the complaints are upheld; therefore, they still cause the recipients psychological harm. In addition, this approach has frequently been criticised for delimiting freedom (...) of expression, since it requires the service providers to elaborate and implement censorship regimes. In the last few years, an emerging generation of automatic Hate Speech detection systems has started to offer new strategies for dealing with this particular kind of offensive online material. Anticipating the future efficacy of such systems, the present article advocates an approach to online Hate Speech detection that is analogous to the quarantining of malicious computer software. If a given post is automatically classified as being harmful in a reliable manner, then it can be temporarily quarantined, and the direct recipients can receive an alert, which protects them from the harmful content in the first instance. The quarantining framework is an example of more ethical online safety technology that can be extended to the handling of Hate Speech. Crucially, it provides flexible options for obtaining a more justifiable balance between freedom of expression and appropriate censorship. (shrink)

Normal Rationality is a selection of the most important work of Edna Ullmann-Margalit, presenting some influential and widely admired essays alongside some that are not well known. She was an unorthodox and deeply original philosopher whose work illuminated the largest mysteries of human life. Much of her writing focuses on two fundamental questions. (1) How do people proceed when they cannot act on the basis of reasons, or project likely consequences? (2) How is social order possible? Ullmann-Margalit's answers, (...) emphasizing what might be called biased rationality, are important not only for philosophy, but also for political science, psychology, sociology, cognitive science, economics (including behavioral economics), law, and even public policy. Ullmann-Margalit demonstrates that people have identifiable strategies for making difficult decisions, whether the question is small (what to buy at a supermarket) or big (whether to transform one's life in some large-scale way). She also shows that social dilemmas are solved by norms; that invisible-hand explanations take two identifiable (and dramatically different) forms; that trust can emerge in seemingly unpromising situations; and that considerateness is the foundation on which our relationships are organized in both the thin context of the public space and the intimate context of the family. One of the distinguishing features of Ullmann-Margalit's work is its close attention to the details of human experience, and its use of those details to offer fresh understandings of social phenomena. Her essays cast new light on a diverse assortment of problems in philosophy, social science, and individual lives. (shrink)

Mhealth technology is mushrooming world-wide and, in a variety of forms, reaches increasing numbers of users in ever-widening contexts and virtually independent from standard medical evidence assessment. Yet, debate on the broader societal impact including in particular mapping and classification of ethical issues raised has been limited. This article, as part of an ongoing empirically informed ethical research project, provides an overview of ethical issues of mhealth applications with a specific focus on implications on autonomy as a key notion in (...) the debate. A multi-stage model of references to the potential of mhealth use for strengthening some or other form of self-determination will be proposed as a descriptive tool. It illustrates an assumed continuum of enhanced autonomy via mhealth broadly conceived: from patient to user autonomy, to improved health literacy, and finally to the vision of supra-individual empowerment and democratised, participatory health and medicine as a whole. On closer examination, however, these references are frequently ambivalent or vague, perpetuating the at times uncritical use of established autonomy concepts in medical ethics. The article suggests zooming in on the range of autonomy-related aspects against the backdrop of digital innovation and datafied health more generally, and on this basis add to existing frameworks for the ethical evaluation of mhealth more specifically. Dürfen wir die Überzeugungen und Erfahrungen anderer einfach ignorieren oder bagatellisieren? In gewissen Fällen mag das plausibel sein. Aber Menschen ignorieren die Überzeugungen gewisser Personen und Gruppen oft ohne nachvollziehbaren Grund, indem sie sie aufgrund von Vorurteilen als Unwissende abstempeln. In solchen Fällen werden Personen ungerechterweise von der gesellschaftlichen Praxis der Wissensproduktion und Wissensweitergabe abgeschnitten. Die Philosophin Miranda Fricker bezeichnet dies als „epistemische Ungerechtigkeit“. In diesem Beitrag wird exemplarisch für das große Feld der sozialen Erkenntnistheorie die gesellschaftliche und philosophische Bedeutung (...) des Phänomens der epistemischen Ungerechtigkeit näher erklärt und anhand vieler Beispiele erläutert. Konkrete Unterrichtsimpulse werden in Form von drei Aufgabenblöcken angeboten. (shrink)

This paper addresses early modern botanical nomenclature, the practices of identifying and publishing synonyms in particular, as a collaborative “information science”. Before Linnaean nomenclature became the lingua franca of botany, it was inevitable that, over time, the same plant was given several names by different people, which created confusion and made communication among botanists increasingly difficult. What names counted as synonyms and actually referred to the same plant had to be identified by meticulously comparing living and dried specimens of this (...) and similar plants as well as relevant illustrations und descriptions in the botanical literature. Identifying synonyms required and generated an ever-expanding mass of data, which was used continuously to adjust and rearrange plant names. Despite the greatest care, judgements on synonyms were not definitive, which meant that published lists of synonyms for individual species of plants were in a state of flux and had to be constantly updated, corrected, and rewritten. This required long-term international collaborations, the accumulated results of which were not published once but consecutively, in augmented and corrected editions of a book. As a result of this networked approach, synonyms are networked names that reflect the epistemic interconnectedness of the botanical community. These questions will be discussed with a focus on the Dutch botanist Johannes Burman, who placed synonyms at the centre of his work as posthumous editor—and co-author—of the botanical manuscripts that were left behind by other botanists. L’auteur retrace l’histoire du droit de l’environnement dans l’entrelacement des droits privés, administratif, constitutionnel et international public. Elle montre que les notions de préjudice écologique, de sécurité humaine et de Droits de l’Humanité permettent, par-delà une simple responsabilité éthique, d’incarner juridiquement un véritable ordre public écologique.

Este artigo ocupa-se dos aspectos essenciais do processão plotiniana, com base nas Enéadas e em intérpretes de projeção mundial, como Giovanni Reale e Werner Beierwaltes. A processão de Plotino trata da origem das coisas, a partir do Uno, o qual se identifica com Super-Ser, divino, eterno, perfeito e imutável, não podendo ser entendido como conceito abstrato universalíssimo. O trabalho pretende mostrar que Plotino não é emanatista, nem panteísta, mas panenteista. Há mesmo quem o considere criacionista. É abordada, especialmente, a paisagem (...) metafisica de Plotino, com as três hipóstases do mundo inteligível e, dependendo deste, a origem do mundo sensível - a matéria - tida pelo filósofo como princípio do mal, porém não em sentido gnóstico-maniqueísta. Por fim, o artigo conclui que a processão implica, necessariamente, o retorno da alma humana ao Uno. O objetivo da filosofia plotiniana era levar os seus seguidores à união mais intima possível com o Uno. (shrink)

Em sua obra, Plotino recorre constantemente aos antigos, porquanto crê neles encontrar- se a verdade. Também não desconhece os mitos que lera nas obras de Platão. Interpreta-os metafísica e eticamente. Neste pequeno artigo, entende-se por mito 'algo que alude a', 'algo que indica", "algo que metaforiza". Três tipos de mitos são aqui apresentados brevemente: mitos da mitologia olímpica, mitos da escatologia órfica e mitos filosóficos. Em todos eles, percebe-se o esforço de Plotino por mostrar que o mito tenta exprimir o (...) que a palavra não logra explicar, atingindo as fronteiras do silêncio e do inefável. O artigo conclui com o mito do silêncio, na união com o Uno, sem palavras. (shrink)

The term ‘locked-in’ syndrome (LIS) describes a medical condition in which persons concerned are severely paralyzed and at the same time fully conscious and awake. The resulting anarthria makes it impossible for these patients to naturally communicate, which results in diagnostic as well as serious practical and ethical problems. Therefore, developing alternative, muscle-independent communication means is of prime importance. Such communication means can be realized via brain–computer interfaces (BCIs) circumventing the muscular system by using brain signals associated with preserved cognitive, (...) sensory, and emotional brain functions. Primarily, BCIs based on electrophysiological measures have been developed and applied with remarkable success. Recently, also blood flow–based neuroimaging methods, such as functional magnetic resonance imaging (fMRI) and functional near-infrared spectroscopy (fNIRS), have been explored in this context. After reviewing recent literature on the development of especially hemodynamically based BCIs, we introduce a highly reliable and easy-to-apply communication procedure that enables untrained participants to motor-independently and relatively effortlessly answer multiple-choice questions based on intentionally generated single-trial fMRI signals that can be decoded online. Our technique takes advantage of the participants’ capability to voluntarily influence certain spatio-temporal aspects of the blood oxygenation level–dependent (BOLD) signal: source location (by using different mental tasks), signal onset and offset. We show that healthy participants are capable of hemodynamically encoding at least four distinct information units on a single-trial level without extensive pretraining and with little effort. Moreover, realtime data analysis based on simple multi-filter correlations allows for automated answer decoding with a high accuracy (94.9%) demonstrating the robustness of the presented method.. A collegial procedure refers to the fact that, before making a delicate medical decision, the opinion of the entire care team responsible for the patient is sought, including nurses and orderlies, among others. The Claeys-Leonetti end-of-life law (2016) enshrines this in French law as mandatory when implementing deep and continuous sedation until death (DCSD). The aim of the study was to take stock of the awareness of this aspect of the law among all the healthcare staff of a cancer institute (...) and to identify how collegiality was established for a DCSD decision, depending on the department. We administered an anonymous online questionnaire to all those involved in healthcare (knowledge of the Claeys-Leonetti Act), and then met healthcare workers from the various departments in discussion groups (managers, nursing staff and orderlies) or in individual interviews (doctors). The results show that young healthcare staff (with less than 5 years’ experience) are more familiar with the law, across all professions, and that nurses and orderlies are more likely to assert their rights than doctors. We report on the diversity of the implementation of collegiality for sedation decisions, in terms of formalisation, standardisation and inter-professionalisation. We conclude that the implementation of collegiality in advance of a decision broadens the methods of multi/inter-professional communication and helps to alleviate the suffering of patients, doctors and care givers. L’auteure retrace les controverses qui ont émaillé l’histoire du principe de précaution en France dans les trente dernières années après son adoption au niveau international et européen. Elle montre que le principe de précaution constitue une dimension nouvelle de la rationalité adaptée aux défis de la société contemporaine.

Zusammenfassung Sexualisierte Gewalt gehört zu den lang tabuisierten Themen unserer Gesellschaft. Die in jüngster Zeit bekannt gewordenen Fälle von sexualisierter Gewalt in pädagogischen Institutionen werden im vorliegenden Beitrag zum Anlass genommen, den Fragen nachzugehen, was bislang über sexualisierte Gewalt im Sport bekannt ist und welche Strukturen und Prozesse gerade in Organisationen des Sports zu sexualisierter Gewalt und ihrer Verdeckung beitragen können. Dazu wird sowohl der Forschungsstand über sexualisierte Gewalt im Sport und in pädagogischen Institutionen herangezogen, als auch ein durch qualitative (...) Forschung generiertes Fallbeispiel von Machtmissbrauch und sexualisierter Gewalt im Kontext des Sports rekonstruiert und analysiert. (shrink)

Goal-setting theory states that challenging, specific, and concrete goals (i.e., subordinate goals) are powerful motivators and boost performance in goal pursuit more than vague or abstract goals (i.e., superordinate goals). Goal-setting theory predominantly focuses on single, short-term goals and less on broad, long-term challenges. This review article extends goal-setting theory and argues that superordinate goals also fulfill a crucial role in motivating behavior, particularly when addressing broad, long-term challenges. The purpose of this article is to show theoretically that people pursue (...) long-term goals more successfully when they focus on subordinate and superordinate goals simultaneously than when they focus on either subordinate or superordinate goals alone. This article examines how local experiments and negotiation processes contribute to social and field-level learning. The analysis is framed within the niche development literature, which offers a framework for analyzing the relation between projects in local contexts and the transfer of local experiences into generally applicable rules. The authors examine 2 case studies drawn from a meta-analysis of 27 new energy projects. The case studies, both pertaining to biogas projects for local municipalities, illustrate the diversity of applications for a technology (...) through processes of local variation and selection. The authors examine the diversity of expectations and the negotiation and alignment of these expectations underlying the diversity of local solutions. Moreover, the authors address how the transfer of lessons from individual local experiments can follow different pathways and yet always require due attention to the social and cultural limits to the transferability of solutions. The growing number of known plants, and the need repeatedly to correct their names and their taxonomic attributions, demanded strategies for combining the static nature of a printed book with the fluctuating nature of the information it contained. From the second half of the seventeenth century botanists increasingly relied on publishing multiple updated editions of a book instead of attempting to correct, polish, and thus delay the appearance of a manuscript until, in the author’s opinion, it was finished. Provisional by (...) nature, iterative books offered a solution. They were transient, open-ended and open to intervention, whether by one or multiple authors. Taking as an example the posthumous publication of orphaned material and manuscripts, a widespread phenomenon in eighteenth-century botany, this essay will focus on the sequence of iterative books that were published during the first half of the eighteenth century, based on the herbaria and papers left behind by the German botanist Paul Hermann (1646–95).
