This paper explores two main methods, employed for the analysis of regulatory law, empirical and systems-theoretical approaches. These two approaches are often portrayed in the literature as very different, mainly for two reasons. First, it is contended by some authors that systems-theoretical approaches—in contrast to empirical approaches—do not see a role for individuals in shaping social reality and regulatory law as one aspect of it. This paper, however, claims that systems-theoretical accounts do provide for human agency while empirical accounts have (...) limitations in their analysis of the role of ‘real individuals’ in shaping regulatory law. The paper argues that both empirical and systems-theoretical approaches need to provide a deeper analysis of the notion of ‘the individual’. This requires taking into account how ‘feeling rules’ influence the management of emotions. Secondly, empirical and systems-theoretical approaches are portrayed as distinct because they are considered as employing different methodologies. While systems theory involves speculative grand theory, empirical approaches are based on specific techniques of empirical data collection and analysis. This paper argues, however, that systems-theoretical ideas on how knowledge about the social world can be generated are close to qualitative empirical approaches, which stress the relativity and subjectivity of the meaning systems of the particular actors studied. But the laws' distinctive roles have proven notoriously difficult to identify--leading some philosophers to question if they hold such roles at all. This study offers original accounts of the roles that natural laws play in connection with counterfactual conditionals, inductive projections, and scientific explanations, and of what the laws must be in order for them to be capable of playing these roles. Certain scientific explanations of physical facts have recently been characterized as distinctively mathematical –that is, as mathematical in a different way from ordinary explanations that employ mathematics. This article identifies what it is that makes some scientific explanations distinctively mathematical and how such explanations work. These explanations are non-causal, but this does not mean that they fail to cite the explanandum’s causes, that they abstract away from detailed causal histories, or that they cite no natural laws. Rather, in these explanations, (...) the facts doing the explaining are modally stronger than ordinary causal laws or are understood in the why question’s context to be constitutive of the physical arrangement at issue. A distinctively mathematical explanation works by showing the explanandum to be more necessary than ordinary causal laws could render it. Parenting our biological children is a centrally important matter, but how, if it all, can it be justified? According to a contemporary influential line of thinking, the acquisition by parents of a moral right to parent their biological children should be grounded by appeal to the value of the intimate emotional relationship that gestation facilitates between a newborn and a gestational procreator. I evaluate two arguments in defence of this proposal and argue that both are unconvincing.

Scientific realism is the view that one can be justified in believing, of some theory about unobservable entities, that the entities it posits are real and accurately described by the theory, in the same sense as one can be justified in believing that the theory’s empirical predictions are accurate, and that so to believe is what it means for a scientist to “accept” that theory, because the goal of science is to describe reality, even its unobservable features. The first part (...) is an epistemic claim, whereas the second concerns the rational reconstruction of scientific practice. Together they suggest that evidence justifying scientific acceptance of a theory justifies belief that the unobservable entities it posits are real and as the theory purports them to be. Anti-realism denies ; it holds that claims about unobservables are either unjustified or justified in a different sense from predictions of observations. It also denies ; it maintains that in her scientific work, as rationally reconstructed, a scientist who accepts a claim about unobservables believes that it yields accurate predictions of observables, not that it describes unobservables. This book combines physics, history, and philosophy in a radical new approach to introducing the philosophy of physics.

Very little has been done to find out what corporations have done to build ethical values into their organizations. In this report on a survey of 1984 Fortune 1000 industrial and service companies the Center for Business Ethics reveals some facts regarding codes of ethics, ethics committees, social audits, ethics training programs, boards of directors, and other areas where corporations might institutionalize ethics. Based on the survey, the Center for Business Ethics is convinced that corporations are beginning to take steps (...) to institutionalize ethics, while recognizing that in most cases more specific mechanisms and strategies need to be implemented to make their ethics efforts truly effective. It has often been argued that Humean accounts of natural law cannot account for the role played by laws in scientific explanations. Loewer (Philosophical Studies 2012) has offered a new reply to this argument on behalf of Humean accounts—a reply that distinguishes between grounding (which Loewer portrays as underwriting a kind of metaphysical explanation) and scientific explanation. I will argue that Loewer’s reply fails because it cannot accommodate the relation between metaphysical and scientific explanation. Hempel and Giere contend that the existence of provisos poses grave difficulties for any regularity account of physical law. However, Hempel and Giere rely upon a mistaken conception of the way in which statements acquire their content. By correcting this mistake, I remove the problem Hempel and Giere identify but reveal a different problem that provisos pose for a regularity account — indeed, for any account of physical law according to which the state of affairs described by a law-statement presupposes (...) a Humean regularity. These considerations suggest a normative analysis of law-statements. On this view, law-statements are not distinguished from accidental generalizations by the kind of Humean regularities they describe because a law-statement need not describe any Humean regularity. Rather, a law-statement says that in certain contexts, one ought to regard the assertion of a given type of claim, if made with justification, as a proper way to justify a claim of a certain other kind. But there is still a good deal of statistical analysis which might be done to help identify the factors in their success.This study looks at the best available data from electoral returns in the nine districts of Antwerp, which has been the locus of the Vlaams Blok’s support.A statistical comparison is made between various social and economic factors, and the level of support for Vlaams Blok in an (...) attempt to identify significant correlations. Many philosophers endorse the Transparency Thesis, the claim that by introspection one cannot become aware of one's experience. Recently, some authors have suggested that the Transparency Thesis is challenged by introspective states reached under mindfulness. We label this the Mindfulness Opacity Hypothesis. The present paper develops the hypothesis in important new ways. First, we motivate the hypothesis by drawing on recent clinical psychology and cognitive science of mindfulness. Secondly, we develop the hypothesis by describing the implied shift in experiential perspective, (...) the scope of introspectable qualities, and the level of skill. Thirdly, we defend the hypothesis against various philosophical arguments. We conclude that the Mindfulness Opacity Hypothesis is empirically and theoretically well motivated and supported. (shrink)

According to Lange,?Really Statistical explanations? constitute an important kind of non-causalscientific explanation. However, Roski has argued that all alleged RS explanations are either causalexplanations or not explanations at all. In so arguing, Roski has invoked Kahneman?s interpretation of onealleged RS explanation. I employ Roski?s arguments as an opportunity to elaborate and defend RS explanations. Iargue that?RS explanations? genuinely explain rather than deny the presuppositions of why-questions. I argue thatthe RS model is not excessively permissive in allowing some explanations to (...) work purely statistically rather than bydescribing causal relations. I argue that Roski?s view that some?RS explanations? operate by describing causalrelations fails to capture the kind of explanatory insight that RS explanations provide. I elaborate the notion of a?characteristically statistical phenomenon? that figures in the RS model and thereby explain how an RS explanationreveals that its explanandum is independent of any causal facts or specific chances, but rather depends only on ageneric sort of arrangement of chances. Finally, I argue that Roski misinterprets Kahneman, who actually holds thatthe explanation he discusses is a non-causal explanation that nicely fits the RS model. Although all mathematical truths are necessary, mathematicians take certain combinations of mathematical truths to be ‘coincidental’, ‘accidental’, or ‘fortuitous’. The notion of a ‘ mathematical coincidence’ has so far failed to receive sufficient attention from philosophers. I argue that a mathematical coincidence is not merely an unforeseen or surprising mathematical result, and that being a misleading combination of mathematical facts is neither necessary nor sufficient for qualifying as a mathematical coincidence. I argue that although the components of a mathematical coincidence (...) may possess a common explainer, they have no common explanation ; that two mathematical facts have a unified explanation makes their truth non-coincidental. I suggest that any motivation we may have for thinking that there are mathematical coincidences should also motivate us to think that there are mathematical explanations, since the notion of a mathematical coincidence can be understood only in terms of the notion of a mathematical explanation. I also argue that the notion of a mathematical coincidence plays an important role in scientific explanation. When two phenomenological laws of nature are similar, despite concerning physically distinct processes, it may be that any correct scientific explanation of their similarity proceeds by revealing their similarity to be no mathematical coincidence. With the rise and public accessibility of AI-enabled decision-support systems, individuals outsource increasingly more of their decisions, even those that carry ethical dimensions. Considering this trend, scholars have highlighted that uncritical deference to these systems would be problematic and consequently called for investigations of the impact of pertinent technology on humans’ ethical decision-making. To this end, this article conducts a systematic review of existing scholarship and derives an integrated framework that demonstrates how intelligent decision-support systems (IDSSs) shape humans’ ethical decision-making. In particular, we identify resulting consequences on an individual level (i.e., deliberation enhancement, motivation enhancement, autonomy enhancement and action enhancement) and on a societal level (i.e., moral deskilling, restricted moral progress and moral responsibility gaps). We carve out two distinct methods/operation types (i.e., processoriented and outcome-oriented navigation) that decision-support systems can deploy and postulate that these determine to what extent the previously stated consequences materialize. Overall, this study holds important theoretical and practical implications by establishing clarity in the conceptions, underlying mechanisms and (directions of) influences that can be expected when using particular IDSSs for ethical decisions. Several foundational documents of bioethics mention the special obligation researchers have to vulnerable research participants. However, the treatment of vulnerability offered by these documents often relies on enumeration of vulnerable groups rather than an analysis of the features that make such groups vulnerable. Recent attempts in the scholarly literature to lend philosophical weight to the concept of vulnerability are offered by Luna and Hurst. Luna suggests that vulnerability is irreducibly contextual and that Institutional Review Boards (Research Ethics Committees) can only (...) identify vulnerable participants by carefully examining the details of the proposed research. Hurst, in contrast, defines the vulnerable as those especially at risk of incurring the wrongs to which all research ethics participants are exposed. We offer a more substantive conception of vulnerability than Luna but one that gives rise to a different rubric of responsibilities from Hurst's. While we understand vulnerability to be an ontological condition of human existence, in the context of research ethics, we take the vulnerable to be research subjects who are especially prone to harm or exploitation. Our analysis rests on developing a typology of sources of vulnerability and showing how distinct sources generate distinct obligations on the part of the researcher. Our account emphasizes that the researcher's first obligation is not to make the research participant even more vulnerable than they already are. To illustrate our framework, we consider two cases: that of a vulnerable population involved in international research and that of a domestic population of people with diminished capacity. (shrink)

Really statistical explanation is a hitherto neglected form of noncausal scientific explanation. Explanations in population biology that appeal to drift are RS explanations. An RS explanation supplies a kind of understanding that a causal explanation of the same result cannot supply. Roughly speaking, an RS explanation shows the result to be mere statistical fallout.

We propose a ‘Moral Imagination’ methodology to facilitate a culture of responsible innovation for engineering and product teams in technology companies. Our approach has been operationalized over the past two years at Google, where we have conducted over 50 workshops with teams from across the organization. We argue that our approach is a crucial complement to existing formal and informal initiatives for fostering a culture of ethical awareness, deliberation, and decision-making in technology design such as company principles, ethics and privacy (...) review procedures, and compliance controls. We characterize some distinctive benefits of our methodology for the technology sector in particular. (shrink)

Philosophers who regard some mathematical proofs as explaining why theorems hold, and others as merely proving that they do hold, disagree sharply about the explanatory value of proofs by mathematical induction. I offer an argument that aims to resolve this conflict of intuitions without making any controversial presuppositions about what mathematical explanations would be.

Musical ensemble performances provide an ideal environment to gain knowledge about complex human interactions. Network structures of synchronization can reflect specific roles of individual performers on the one hand and a higher level of organization of all performers as a superordinate system on the other. This study builds on research on joint singing, using hyperscanning of respiration and heart rate variability from eight professional singers. Singers performed polyphonic music, distributing their breathing within the same voice and singing without and with (...) physical contact: that is touching each other's shoulder or waist. The idea of singing with touch was motivated by historical depictions of ensemble performances that showed singers touching each other. It raises the question of the potential benefit of touch for group performances. From a psycho-physiological point of view, physical contact should increase the synchronization of singing coordination. The results confirm previous findings on synchronization of respiration and HRV during choir singing and extend those findings to a non-homophonic musical repertoire while also revealing an increase in synchronization in respiration during physical contact. These effects were significant across different frequency ranges. The effect of physical contact was stronger when all singers were singing in comparison to the partial ensemble. Importantly, the synchronization could not be fully explained by the singing action or by the standing position or touch. This finding suggests a higher level of organization of all singers, forming a superordinate system. (shrink)

The mobile phone has become part of our everyday lives with astonishing speed. Over four billion people now have access to mobile phones, and this number keeps increasing. Mobile media technologies shape how we communicate with each other, and relate to the world. This raises questions about their influence on identity. Medium-specific properties and user-practices challenge the idea that we understand ourselves through stories. It is proposed that the notion of play sheds new light on how technologies shape identities. The (...) mobile phone mediates identities on four play levels: we play on the mobile, with the mobile, through the mobile, and at the same time we are played by the mobile. Mobile media bring new freedom of movement. Yet at the same time they constrict us. In this dialectic we become moving circles. (shrink)

Shastri & Ajjanagadde argue convincingly that both structured connectionist networks and parallel dynamic inferencing are necessary for reflexive reasoning - a kind of inferencing and reasoning that occurs rapidly, spontaneously, and without conscious effort, and which seems necessary for everyday tasks such as natural language understanding. As S&A describe, reflexive reasoning requires a solution to thedynamic binding problem, that is, how to encode systematic and abstract knowledge and instantiate it in specific situations to draw appropriate inferences. Although symbolic artificial intelligence (...) systems trivially solve the dynamic binding problem using computers' registers and pointers, it has remained a difficult problem for connectionist systems. S&A's temporal synchrony solution to the dynamic binding problem using synchronous firing of argument units and the entities that are bound to them illustrates one way in which connectionist networks can do thisusing a constrained but important class of long-term knowledge rules. Their structured connectionist solution allows dynamic inferencing to proceed in parallel and therefore has a number of advantages for reflexive reasoning over most other connectionist and symbolic systems. Many philosophers have believed that the laws of nature differ from the accidental truths in their invariance under counterfactual perturbations. Roughly speaking, the laws would still have held had q been the case, for any q that is consistent with the laws. (Trivially, no accident would still have held under every such counterfactual supposition.) The main problem with this slogan (even if it is true) is that it uses the laws themselves to delimit qs range. I present a means of (...) distinguishing the laws (and their logical consequences) from the accidents, in terms of their range of invariance under counterfactual antecedents, that does not appeal to physical modalities (or any cognate notion) in delimiting the relevant range of counterfactual perturbations. I then argue that this approach explicates the sense in which the laws possess a kind of necessity. (shrink)

A conservation law in physics can be either a constraint on the kinds of interaction there could be or a coincidence of the kinds of interactions there actually are. This is an important, unjustly neglected distinction. Only if a conservation law constrains the possible kinds of interaction can a derivation from it constitute a scientific explanation despite failing to describe the causal/mechanical details behind the result derived. This conception of the relation between “bottom-up” scientific explanations and one kind of “top-down” (...) scientific explanation is motivated by several examples from classical and modern physics. This paper proposes an account of why proof is the only way to acquire knowledge of some mathematical proposition’s truth. Admittedly, non-deductive arguments for mathematical propositions can be strong and play important roles in mathematics. But this paper proposes a necessary condition for knowledge that can be satisfied by putative proofs (and proof sketches), as well as by non-deductive arguments in science, but not by non-deductive arguments from mathematical evidence. The necessary condition concerns whether we can justly expect that if (...) the mathematical proposition is actually false, despite the evidence for its truth, then this fact has an explanation. Digital duplicates reduce the scarcity of individuals and thus may impact their instrumental and intrinsic value. I here expand upon this idea by introducing the notion of collective scarcity, which pertains to the limitations faced by social groups in maintaining their size, cohesion, and function.

Scientific essentialism aims to account for the natural laws' special capacity to support counterfactuals. I argue that scientific essentialism can do so only by resorting to devices that are just as ad hoc as those that essentialists accuse Humean regularity theories of employing. I conclude by offering an account of the laws' distinctive relation to counterfactuals that portrays laws as contingent but nevertheless distinct from accidents by virtue of possessing a genuine variety of necessity.

I identify the special sort of stability (invariance, resilience, etc.) that distinguishes laws from accidental truths. Although an accident can have a certain invariance under counterfactual suppositions, there is no continuum between laws and accidents here; a law's invariance is different in kind, not in degree, from an accident's. (In particular, a law's range of invariance is not "broader"--at least in the most straightforward sense.) The stability distinctive of the laws is used to explicate what it would mean for there (...) to be multiple grades (or degrees) of physical necessity. Whether there are is for science to discover. This paper argues that in at least some cases, one proof of a given theorem is deeper than another by virtue of supplying a deeper explanation of the theorem — that is, a deeper account of why the theorem holds. There are cases of scientific depth that also involve a common abstract structure explaining a similarity between two otherwise unrelated phenomena, making their similarity no coincidence and purchasing depth by answering why questions that separate, dissimilar explanations of the two phenomena (...) cannot correctly answer. The connections between explanation, depth, unification, power, and coincidence in mathematics and science are compared. (shrink)

Rosenberg has recently argued that explanations supplied by (what he calls) functional biology are mere promissory notes for macromolecular adaptive explanations. Rosenberg's arguments currently constitute one of the most substantial challenges to the autonomy, irreducibility, and indispensability of the explanations supplied by functional biology. My responses to Rosenberg's arguments will generate a novel account of the autonomy of functional biology. This account will turn on the relations between counterfactuals, scientific explanations, and natural laws. Crucially, in their treatment of the laws' (...) relation to counterfactuals, Rosenberg's arguments beg the question against the autonomy of functional biology. This relation is considerably more subtle than is suggested by familiar slogans such as Laws support counterfactuals; accidents don't. (shrink)

Recently, biologists and computer scientists who advocate the "strong thesis of artificial life" have argued that the distinction between life and nonlife is important and that certain computer software entities could be alive in the same sense as biological entities. These arguments have been challenged by Sober (1991). I address some of the questions about the rational reconstruction of biology that are suggested by these arguments: What is the relation between life and the "signs of life"? What work (if any) (...) might the concept of "life" (over and above the "signs of life") perform in biology? What turns on scientific disputes over the utility of this concept? To defend my answers to these questions, I compare "life" to certain other concepts used in science, and I examine historical episodes in which an entity's vitality was invoked to explain certain phenomena. I try to understand how these explanations could be illuminating even though they are not accompanied by any reductive definition of "life.". (shrink)
