This paper sketches a theory of the reason‐giving force of well‐being that allows us to reconcile our intuitions about two of the most recalcitrant problem cases in population ethics: Jan Narveson's Procreation Asymmetry and Derek Parfit's Non‐Identity Problem. I show that what has prevented philosophers from developing a theory that gives a satisfactory account of both these problems is their tacit commitment to a teleological conception of well‐being, as something to be ‘promoted’. Replacing this picture with one according to which (...) our reasons to confer well‐being on people are conditional on their existence allows me to do better. It also enables us to understand some of the deep structural parallels between seemingly disparate normative phenomena such as procreating and promising. The resulting theory charts a middle way between the familiar dichotomy of narrow person‐affecting theories and totalist or wide‐person affecting theories in population ethics. (shrink)

According to Adam Smith, the acquisition of moral conscience is an essential part of a person’s moral education. I argue that moral conscience as conceived by Smith enables a person to intentionally take the role of an impartial spectator. I trace the process of moral education from the child in its family, to interaction with peers to learning and then to a self-evaluation, learning to become one’s own spectator and judge. This is a move from uncritical trust to external guidance (...) to acquiring the faculty of conscience. Smith recommends most people to rely on the ‘common rules of morality’ rather than on sympathetic processes alone. But such reliance represents merely a second best procedure for reaching a properly impartial moral judgment. While the ‘wise and virtuous’ may well improve on the impartiality of the ‘common rules of morality’, even their moral judgments will never be perfectly impartial or certain beyond doubt. (shrink)

Consequently, it is necessary to defend the right to an abortion in a manner that succeeds even if a Human Life Amendment successfully passes. J.J. The foundational conviction of contemporary liberal thought is that all persons possess equal moral worth and are entitled to equal concern and respect by others. At the same time, nation states, as the primary organs of our collective self-governance, frequently pursue policies that are strikingly partial towards the interests of compatriots over those of foreigners. A common strategy for justifying this national partiality is to view it as grounded in associative obligations that we incur by standing in special relationships with (...) our fellow citizens. For instance, according to familiar arguments from ‘fair play’, voluntarily partaking in and benefiting from cooperative relationships with our fellow citizens gives us reciprocal obligations to maintain these social institutions and care for needy compatriots. By contrast, we do not have corresponding associative obligations towards foreigners. I maintain that such arguments from associative obligations face an important stumbling block. I argue for the following “Boundary Principle”, according to which we cannot appeal to special relationships amongst members of a group to justify an attitude of partiality towards them unless the boundaries of this group, and the fact that they exclude other persons from membership, can also be justified. If this is right, arguments from associative obligations, by themselves, are necessarily incomplete. Most modern states severely limit the scope of economic migration, and thereby prevent many would-be contributors to the collective enterprises of affluent societies from entering into those special relationships with us that would give rise to associative obligations on our part. Not only are would-be immigrants excluded from the benefits that participation in the cooperative schemes of affluent nation-states would itself confer; in addition, the fact that they do not stand in such cooperative relationships with us is then appealed to in order to justify the fact that we assign significantly less weight to their interests in the formulation of state policy. The upshot of my discussion is not that a defense of national partiality in terms of associative obligations cannot succeed. It is rather that a successful defense of national partiality in these terms is more closely tied to the question whether principled restrictions can be placed on immigration than most political philosophers have hitherto assumed. In their paper 'After-birth abortion: why should the baby live?' Alberto Giubilini and Francesca Minerva argue that because there are no significant differences between a fetus and a neonate, in that neither possess sufficiently robust mental traits to qualify as persons, a neonate may be justifiably killed for any reason that also justifies abortion. To further emphasise their view that a newly born infant is more on a par with a fetus rather than a more developed baby, Giubilini and Minerva (...) elect to call this 'after-birth abortion' rather than infanticide. In this paper, I argue that their thesis is incorrect, and that the moral permissibility of abortion does not entail the moral permissibility of 'after-birth' abortion. (shrink)

One of the most famous, and most derided, arguments against the morality of abortion is the argument from potential, which maintains that the fetus' potential to become a person and enjoy the valuable life common to persons, entails that its destruction is prima facie morally impermissible. In this paper, I will revisit and offer a defense of the argument from potential.

Civil Dialogue on Abortion provides a cutting-edge discussion between two philosophy scholars on each side of the abortion debate. Bertha Alvarez Manninen argues for her pro-choice view, but also urges respect for the life of the fetus, while Jack Mulder argues for his pro-life view, but recognizes that for the pro-life movement to be consistent, it must urge society to care more for the vulnerable. Coming together to discuss their views, but also to seek common ground, the two authors (...) show how their differing positions nevertheless rest upon some common convictions. The book helps to provide a way forward for a divide that has only seemed to widen the aisle of public discourse in recent years. This engaging book will prove essential reading for students across multiple disciplines, including applied ethics, medical ethics, and bioethics, but will also be of interest to students of religious studies and women's studies. We read Adam Smith's Theory of Moral Sentiments as a critical response to David Hume's moral theory. While both share a commitment to moral sentimentalism, they propose different ways of meeting its main challenge, that is, explaining how judgments informed by (partial) sentiments can nevertheless have a justified claim to general authority. This difference is particularly manifest in their respective accounts of ‘moral optics’, or the way they rely on the analogy between perceptual and moral judgments. According to Hume, making (...) perceptual and moral judgments requires focusing on frequently co-occurring impressions (perceptions of objects or reactive sentiments) for tracking an existing object with its perceptual properties or an agent's character traits. Smith uses visual perception for the purpose of illustrating one source of the partiality of the sentiments people feel in response to actions. Before making a moral judgment, people have to disregard this partiality and accept that they are all equally important. Smith and Hume's different ways of relying on the same analogy reveals the still-overlooked and yet profound differences between their moral theories. (shrink)

One argument used by detractors of human embryonic stem cell research (hESCR) invokes Kant's formula of humanity, which proscribes treating persons solely as a means to an end, rather than as ends in themselves. According to Fuat S. Oduncu, for example, adhering to this imperative entails that human embryos should not be disaggregated to obtain pluripotent stem cells for hESCR. Given that human embryos are Kantian persons from the time of their conception, killing them to obtain their cells for research (...) fails to treat them as ends in themselves. (shrink)

By emphasizing the parallels between both racial vilification and the vilification that takes place when we discuss abortion in our society, I hope to provide a new perspective on the way the United States converses about this divisive issue. This perspective, in turn, can help us see how we can move forward from the stagnate polemics that have permeated the abortion debate in the United States for the past 40 years.

Jane Austen has long been recognized as a moral thinker. Below the surface of romance there is in her novels a moral message. I focus on Pride and Prejudice. Certain passages of this novel have been traced to Adam Smith’s Theory of Moral Sentiments before. But Jane Austen did not only borrow two short passages from Adam Smith and inserted them into the text of her novel. My claim is that Jane Austen relied much more extensively on the Theory of (...) Moral Sentiments as a source of inspiration for this novel. Indeed, she used it, and in particular book VI.iii., the chapter on ‘self-command’ in the TMS, as a source of inspiration for designing the plot of this novel, for shaping some of the main characters, and for composing the moral message in the sub-text of this novel. By inviting her readers to share the point of view of the heroine, Elizabth Bennet, she involves them in a process of learning to be virtuous that bears strong resemblance to this process as Adam Smith described it in his moral theory. In general, the false cause fallacy occurs when the “link between premises and conclusion depends on some imagined causal connection that probably does not exist”. There are three different ways an argument can commit the false cause fallacy: post hoc ergo propter hoc; cum hoc ergo propter hoc; and ignoring common cause. This chapter focuses on one of the common fallacies in Western philosophy, 'ignoring common cause'. The commercial exploited the false cause fallacy to get consumers to buy its product. (...) This fallacy is also present in many of the arguments concerning the alleged connection between vaccines and autism despite the plethora of evidence otherwise. The chapter consists of various examples showcasing the fallacy of ignoring common cause. It also compares the examples, showing that slight changes can lead the other types of false cause fallacies to occur. (shrink)

Adolescent brain development has become an important target for governments to act upon, in the name of healthy individuals and economic prosperity. In the Foresight Project on Mental Capital and Wellbeing , initiated by the Government Office for Science, adolescent behaviour was identified as one of the key challenges for UK policy. The report draws on 'state of the art′ evidence from scientific experts, to recommend ways in which to 'capitalize′ on mental faculties to improve, boost, and make maximum use (...) of the cognitive resources and mental health of individuals during the entire lifespan. Specifically, through a close analysis of the category of adolescence in cognitive neuroscience, we examine the perspective of personhood espoused by MCW. We show how the notion of 'plasticity′, which underpins the recommendations about how to “make the most” of adolescents′ developing brains and cognitive resources, creates vital linkages between neuroscience and neosocial policy. Environmental philosophy – broadly conceived as using philosophical tools to develop ideas related to environmental issues – is conducted and practised in highly diverse ways in different contexts and traditions in Asia. ‘Asian environmental philosophy’ can be understood to include Asian traditions of thought as well as grassroots perspectives on environmental issues in Asia. Environmental issues have sensitive political facets tied to who has the legitimacy to decide about how natural resources are used. Because of this, the works, practices, and (...) researchers in Asian environmental philosophy are exposed to being (mis)used by diverse stakeholders and actors to support political ends not related to environmental sustainability. Two processes are at play at the nexus of the construction of identities in relation to conceptualisations of nature: eco-orientalism and ecological nationalisms. This paper analyzes and exemplifies these dynamics through a conceptual framework that distinguishes ideological and socio-technical explanations of environmental degradation. Finally, to minimise the risks of political misuse, five pathways are presented to carefully help curate environmental, philosophical statements: contextualise, quantify uncertainty and ‘uniqueness’, downscale, confront claims with local realities and literature, and collaborate with researchers from other disciplines. Conjointly, these pathways aim at favouring intercultural collaboration while valuing diversity, thus supporting the development and exchanges in environmental philosophy in Asia and beyond. Many medical‐ethics advisory boards have concluded that human embryonic stem cell research can be conducted in an ethical manner. Yet, almost all the recommendations of the ethics advisory boards have included a rather obscure requirement: the embryos that are to be destroyed for stem cell research must be treated with profound respect. In none of these recommendations, however, do we see an adequate explanation of what proper respect for human embryos actually entails. In this essay I argue that showing proper (...) respect for human embryos, on the one hand, and simultaneously destroying them for stem cell research, on the other hand, are not mutually exclusive. In addition, I maintain that given current U.S. in vitro fertilization practices, which deliberately produce more embryos than will be implanted, proper respect for surplus embryos requires their use in embryonic stem cell research. In recent years, there has been a marked increase in the use of imaginative play in child psychotherapy, yet the theoretical conceptualization of the meaning of play is lacking behind its application in practice. In search of a deeper understanding of the phenomenon of imaginative play, the author turns to Merleau-Ponty's ontology and to his phenomenology of structure, of the lived body, of perception, and of expression. In light of his work, play is an embodied mode of being in the (...) world and a body-world phenomenon. Imaginative play in particular exemplifies the human order in that it enables the child to create and re-create his own meanings within his play world. In a therapeutic context, the evocation of play imagery and the expressive shaping and reshaping of play meanings lead to surprising insights and new discoveries relevant to the child's life-world. A central therapeutic value of imaginative play lies in its promise for facilitating change and healing. A clinical case illustration of a young boy is provided, and the meaning of his imaginative play is exemplified in light of Merleau-Ponty's thought. Some implications are drawn for the theory of play in child psychotherapy. (shrink)

In this essay, I provide evidence that a new generation of prochoice advocates wishes to move away from defending abortion rights via the view that fetal life has little or no value and toward a more complex view of abortion rights. This newer view simultaneously grants that fetuses are more than simply “clumps of cells,” that they are, to some extent, entities that possess some degree of value, and also that women still have the right to decide whether they wish (...) to continue a pregnancy. Prima facie, this may sound like an impossible task—an instance of “having your cake and eating it too”—but I will show throughout my paper that, and how, such a task can indeed be accomplished. I disagree with several of Chow's traditional descriptions and justifications of null hypothesis testing: (1) accepting the null hypothesis whenever p > .05; (2) random sampling from a population; (3) the frequentist interpretation of probability; (4) having the null hypothesis generate both a probability distribution and a complement of the desired conclusion; (5) assuming that researchers must fix their sample size before performing their study.

In order to properly distinguish between pastoral and psychotherapeutic counseling, one must clarify both the interpretive presuppositions underlying each of these professional practices and their respective societal contexts. As a common ground for both kinds of practice, at least insofar as they maintain a distance from the usual medical-scientific model of therapeutic intervention, an ontology of playing is recommended. More precisely, in order for counseling to truly come “into play,” any latent neo-pastoral power discourses must be critically exposed. Psychoanalytic counseling (...) is characterized by rules of abstinence and neutrality as well as by attention to unconscious dynamics, especially those of transference and countertransference. Pastoral counseling, even when it takes place outside of the Ignatian exercises, can still orient itself toward the Ignatian model of spiritual accompaniment, thus requiring a discernment of spirits and a reference to transcendence. Both pastoral and psychotherapeutic counseling can profit from each other. Both must be evaluated in terms of whether, in the course of an authentic communication, they succeed in proposing what truly profits the person seeking advice. All of this applies with special urgency to bioethical decision making and conflict resolution: Persons seeking pastoral advice desire an authentic exposition of the values of the Gospel and their church community in order to reach a well-founded conclusion in conscience. Other persons (or even the same ones) seeking psychotherapeutic help in a bioethical conflict situation desire an empathetic mirroring back of the biographic background framing their decision and of possible psychic consequences that may ensue from their acting accordingly. On 22 January 2019, New York state passed the Reproductive Health Act (RHA), which specifies three circumstances under which a healthcare provider may perform an abortion in New York: (1) the patient is within twenty-four weeks of pregnancy, (2) the fetus is non-viable, or (3) the abortion is necessary to protect the patient’s life or health. The first one, that of abortion being accessible within the first twenty-four weeks of pregnancy, is not unique to New York, as many other states (...) allow medical professionals to provide abortions during this time. The latter two have caused significant controversy because they detail certain circumstances in which abortions would be accessible after twenty-four weeks. This paper will focus on these latter two circumstances. I will first argue that any debate or discussion about (2) must go beyond the conventional debate about the ethics of abortion and incorporate, more appropriately, a discussion on euthanasia and the ethics of end-of-life care for nascent human life. In particular, it requires us to consider the morality of non-voluntary active euthanasia for non-viable fetuses, rather than just a discussion of the ethics of late term abortions. When it comes to (3), I will argue that assessing its moral permissibility actually raises some legitimate moral concerns, even from a reproductive rights perspective. On certain readings, it seems as if condition (3) would allow for the termination of a healthy fetus for reasons not related to the mother’s physical health or life. If this is the case, I argue, the right to an abortion would be construed as a right to fetal termination, rather than just fetal evacuation. However, I will argue that there are good reasons that pro-choice advocates should interpret the right to an abortion as a right to fetal evacuation instead of termination, and if this is the case, a woman should not be able to demand the death of a healthy fetus if ending the pregnancy safely via fetal evacuation would suffice. Many bioethicists working in reproductive ethics tacitly assume some theory of diachronic personal identity. For example, Peter Singer argues that there is no identity relation between a foetus and a future individual because the former shares no robust mental connections with the latter. Consequently, abortion prevents the existence of an individual; it does not destroy an already existing individual. Singer's argument implicitly appeals to the psychological account of personal identity, which, although endorsed by many philosophers such as Derek Parfit, is (...) contentious. Singer does not attempt to defend the psychological account before applying it to the moral permissibility of abortion. Indeed, with some notable exceptions, very few bioethicists attempt antecedently to defend their chosen theory of personal identity before applying it to their ethical arguments. In this paper, I look at the issues of abortion, embryonic stem cell research, and human reproductive cloning in order to illustrate how many of the arguments made by bioethicists on these topics are, at least partly, based upon veiled metaphysical assumptions. My objective is to illustrate that progress can be made on these topics by attending to their fundamental metaphysical claims. (shrink)

This paper will explain three reasons why pro-choice advocates should move away from arguments in favor of abortion choice that is dependent upon the fetus’ non-personhood, and more towards generating arguments in favor of abortion choice that embraces a more respectful view of fetal life. First, the future of the legal right to an abortion in the United States may depend on generating an argument that does not rely on denying fetal personhood. Second, pro-choice advocates should be more respectful of (...) fetal life because the hesitancy of doing so has not gone over well in the general public. Even individuals who are sympathetic to a pro-choice perspective are sometimes hesitant to align themselves with the pro-choice community because of the perception that it is antithetical to the value of fetal life. The third reason is that some women who choose abortion regard it as a morally significant act precisely because they regard the fetus as a morally significant being. (shrink)

In this paper, I appeal to two aspects of Immanuel Kant’s philosophy – his metaphysics and ethics – in defense of abortion rights. Many Kantian pro-life philosophers argue that Kant’s second principle formulation of the categorical imperative, which proscribes treating persons as mere means, applies to human embryos and fetuses. Kant is clear, however, that he means his imperatives to apply to persons, individuals of a rational nature. It is important to determine, therefore, whether there is anything in Kant’s philosophy (...) that permits regarding embryos and fetuses as persons, since they lack the capacity for sentience (at least until mid-gestation), let alone rational thought. In the first part of the paper, I will illustrate why there are difficulties maintaining, from a Kantian perspective, that conception marks the genesis of a new person. Even granting that embryos and fetuses are persons, however, this alone would not entail the moral impermissibility of abortion rights, mainly because prohibiting abortion, and compelling women to gestate, violates the formula of humanity against them. Developing this thesis encompasses the second part of my essay. Finally, although I argue that Kant’s philosophy lends strong support to abortion rights, this does not thereby entail that it allows for the complete dehumanization of the human fetus. By appealing to the writings of Kantian scholar Allen Wood, I will argue that a fetus’ status as a potential person does render it worthy of some degree of respect and moral value. (shrink)

Far too often in our society, the input of a potential father is not deemed relevant in a woman’s abortion decision. Men, however, can suffer emotional strains due to the abortion of their potential child, and given this harm it seems that morality must make room for a potential father’s voice in the abortion decision. I will argue that a man cannot have the right to veto a woman’s decision to procure an abortion, yet there may be times where a (...) woman may exercise her right to an abortion in a manner not indicative of a virtuous character. This is especially a danger in the face of a dissenting man who may suffer greatly if his potential child is abortedand thus I will delineate circumstances where a virtuous woman would concede to carrying a fetus to term in order to give a man the child he so desperately desires. In addition to using virtue ethics to make the argument, I will incorporate certain aspects of care ethics in order to further what may seem to some to be a rather contentious claim. (shrink)
