In the Social Contract Rousseau gives what could be called a philosophical rule of recognition for law in Modernity: a law is law if and only if 'the whole people rules over the whole people'. Thus, he defines self-legislation as, at bottom, collective intentional action. I will first map out the speech act structure [LEX] underlying self-legislation on this account. In particular, I argue for a first person plural counterpart of the reflexive structure inherent to intentions generally: the notion of (...) a collective self. Then I take issue with Bratman's analysis of shared intentional activity in terms of mutuality, submitting that it misses out on the specifically political presupposition involved in 'doing something together'. I will show why 'mutuality' requires representation of the unity of a polity, and how this representation can take form without either external authority or mutual responsiveness. (shrink)

Zu den Grenzfragen des Lebens. Bioethik als Feld intensiver Auseinandersetzung im fachwissenschaftlichen Diskurs und kontroverser Diskussionen in der breiten Öffentlichkeit. Das Handbuch erläutert die Grundlagen und gibt einen Überblick über Bereiche, in denen bioethische Fragen relevant sind, wie Menschenwürde, Leben, Tod und Krankheit. Daneben widmet es sich den speziellen bioethischen Problemen wie etwa Zulässigkeit von Sterbehilfe, Präimplantationsdiagnostik oder embryonaler Stammzellenforschung und zeigt die Schnittstellen der Bioethik zu anderen Disziplinen und gesellschaftlichen Bereichen auf (Bioethik in der Lehre, Biopolitik, Biorecht und Ethikkommissionen).

Spanish has a series of evidential discourse markers that combine the lexical semantics of visual perception with reference to inference or hearsay, for example, evidentemente ‘evidently’, por lo visto ‘visibly, seemingly’, al parecer ‘seemingly’ and se ve ‘one sees that, apparently’. The main aim of this article is to examine the grammatical, semantic and interactional properties of these four evidential discourse markers in informal and formal spoken Spanish. From a semantic point of view, we study the evidential values expressed by (...) these markers and discuss the correlations between them. From a functional point of view, we analyse the evidential markers on the basis of discourse-interactional criteria such as illocutionary force, position in the turn and kind of turn. From a grammatical point of view, we address the preferences in terms of person and Tense/aspect/modality experienced by these evidential markers in discourse. The main result of our analysis is that, as far as the semantic and discourse properties are concerned, evidentemente differs from por lo visto, al parecer and se ve que. The former seems to refer primarily to shared thoughts, developing a reading that goes beyond any of the traditionally distinguished evidential values. The three other markers, by contrast, refer to indirect evidence, often combining the evidential values of reported knowledge and inference. In talk-in-interaction, the two types of markers behave differently: evidentemente does not enhance turn-taking, whereas the other markers leave room for the co-participant to give his or her view of the state of affairs. As research on meaning in work progresses, access to theoretically integrated, differentiated survey instruments becomes crucial. In response to this demand, the present article introduces ME-Work, a modular inventory to measure meaning in work. Derived from research findings on meaning in life, the ME-Work inventory offers three modules that can be used separately or jointly. Module 1 assesses four facets of meaning in work, i.e., coherence, significance, purpose and belonging; module 2 measures the subjective assessment of work as meaningful or (...) meaningless, and module 3 records the extent to which work is perceived as a source of meaning. We report on the development of the instrument and the results of an exploratory factor analysis in a pilot study of 115 working adults. A further study with 278 working adults provided evidence for construct and incremental validity. Relationships with meaning in life, mental health, job satisfaction, socio-moral climate, burnout and work as meaning were investigated. Confirmatory factor analysis supported the factor structure. Gender-specific analyses of the four facets of meaning’s differential predictive power provided additional insights. Practical implications and further research needs are discussed. (shrink)

Mechanistic accounts of explanation have recently found popularity within philosophy of science. Presently, we introduce the idea of an extended mechanistic explanation, which makes explicit room for the role of environment in explanation. After delineating Craver and Bechtel’s account, we argue this suggestion is not sufficiently robust when we take seriously the mechanistic environment and modeling practices involved in studying contemporary complex biological systems. Our goal is to extend the already profitable mechanistic picture by pointing out the importance of the (...) mechanistic environment. It is our belief that extended mechanistic explanations, or mechanisms that take into consideration the temporal sequencing of the interplay between the mechanism and the environment, allow for mechanistic explanations regarding a broader group of scientific phenomena. With few exceptions, the literature on withdrawing and withholding life-saving treatment considers the bare fact of withdrawing or withholding to lack any ethical significance. If anything, the professional guidelines on this matter are even more uniform. However, while no small degree of progress has been made toward persuading healthcare professionals to withhold treatments that are unlikely to provide significant benefit, it is clear that a certain level of ambivalence remains with regard to withdrawing treatment. Given that the absence of clinical (...) benefit means treating patients is not only ethically questionable but also taxing on resources that could meet the needs of others, this ambivalence is troubling. Equally, the enduring ambivalence of professionals might be taken to indicate that the issue warrants further attention. In this paper, we review the academic literature on the ethical equivalence of withdrawing and withholding medical treatment. While we are not in outright disagreement with the arguments presented, we suggest that asserting theoretical and decontextualized claims about the ethical equivalence of withdrawing and withholding life-saving treatment does not fully illuminate the moral questions associated with the relevant clinical realities. We argue that what is required is a broader perspective, one rooted in an understanding that withdrawing and withholding life-saving treatment are different practices, the meanings of which are fully comprehensible only through an appreciation of their place within the practice of healthcare more generally. Such an account suggests that if one is to engage with the inappropriate protraction of life-saving treatment resulting from healthcare professionals’ disinclination to withdraw it, then the differences between these practices should be taken seriously. Healthcare professionals encounter many moral challenges in their daily clinical practice. However, there have been few studies on the subject matter in Tanzania. This study aims to provide an account of moral challenges faced by healthcare professionals in Tanzanian hospitals, their understanding of clinical ethics, and the ethics education they have received. Many participants reported receiving some kind of ethics training through formal education and on-the-job training. Some participants understood ethics in healthcare settings as adherence to established laws, regulations, guidelines, (...) procedures, norms, and rules essential in clinical practice. Analysis of the data identified four themes of moral challenges. These challenges are related to 1) decision-making and communication in clinical practice, 2) scarcity of medical resources and prioritization in clinical practice, 3) withdrawal of curative treatment, and 4) conflicts between professional judgment, religious convictions and adherence to alternative treatments. Based on the findings, we suggest a context-sensitive form of clinical ethics training to prepare healthcare professionals to recognize and address these moral challenges. (shrink)

According to Huemer, existence is evidence of immortality, provided past time is infinite. The argument is based on, inter alia, an alleged contradiction between the fact of one’s existence now and its improbability. I suggest that Huemer’s argument is flawed in equating the infinitesimally small with its limit value, and in assuming a philosophically significant difference between the a priori probability of the occurrence of a unique incarnation and that of anyone among an infinite number.

Collaborative consumption activities like saving food and buying used clothes are an important and rapidly growing part of sustainable consumer behavior. Many political and commercial campaigns promote collaborative consumption practices by highlighting subsets of normative motives, such as sustainable, social, and ecological effects. Whether or not consumers can comprehend these claims and incorporate them into their decision-making process is, however, unclear. This article introduces a new experimental study design to ethical consumer research—an adapted version of the Defining Issues Test—that enables (...) to assess consumers’ ability to cognitively and intuitively understand moral arguments in collaborative consumption contexts. The experiment was conducted with N = 435 collaborative consumers from Germany. The findings indicate that in different collaborative consumption contexts, consumers consider different moral arguments as important. Furthermore, the findings also indicate that consumers can incorporate the provider’s point of view in their moral judgment. (shrink)

Debates about freedom, an ideal continually contested, were first set out in their modern version by the eighteenth-century French philosopher Jean-Jacques Rousseau. His ideas and analyses were taken up during the philosophical enlightenment, often invoked during the French Revolution, and still resonate in contemporary discussions of freedom. This volume, first published in 2010, examines Rousseau's many approaches to the concept of freedom, in the context of his thought on literature, religion, music, theater, women, the body, and the arts. Its expert (...) contributors cross disciplinary frontiers to develop thought-provoking new angles on Rousseau's thought. Cognitive reappraisal is an important emotion regulation strategy that shows considerable developmental change in its use and effectiveness. This paper presents a systematic review of the evidence base regarding the development of cognitive reappraisal from early childhood through adolescence and provides methodological recommendations for future research. We searched Scopus, PsycINFO, and ERIC for empirical papers measuring cognitive reappraisal in normative samples of children and youth between the ages of 3 and 18 years published in peer-reviewed journals through August 9th, 2018. (...) We identified 118 studies that met our inclusion criteria. We first present a quantitative review of the methodologies used to investigate cognitive reappraisal in children and adolescents, with attention to variations in methodologies by the sample age range. We then present a qualitative review of findings with attention to: the age at which children begin to effectively use cognitive reappraisal to regulate their emotions, and developmental changes in cognitive reappraisal from early childhood through adolescence. We consider how methodological differences may contribute to inconsistencies in findings, highlight gaps in the literature that remain to be addressed, and make recommendations for future directions. In this book, developed by a group of collaborating scholars in bioethics from different European countries, an overview is given of the most salient themes in present-day bioethics. The themes are discussed in order to enable the reader to have an in-depth overview of the state of the art in bioethics. Introductory chapters will guide the reader through the relevant dimensions of a particular area, while subsequent case discussions will help the reader to apply the ethical theories to specific clinical (...) problems and health policy queries. The book focuses on perspectives typical for the European context. This highlights not only particular bioethical themes such as social justice, choices in health care, and health policy (e.g., in post-communist countries), it also emphasizes specific approaches in ethical theory, in relation to Continental philosophies such as phenomenology and hermeneutics. Because of its articulation of what is typical for the European health care setting as well as for bioethical debate, this book is unique in comparison to existing textbooks in bioethics. The book is an introductory textbook acquainting the reader with the major issues in present-day health care as well as the various theoretical and practical approaches to clarify these issues. The author presents Gernot Böhme’s median mode of being theory, which attempts to find an anthropological middle ground between the rational and the irrational, the spiritual and the corporeal and the active and passive in human experience. Böhme’s reflections on the median mode of being are normative in character and linked to the concept of “sovereign man,” which he strongly defends and whose main characteristics Hoffmann outlines in the first part of the essay. Among others, Hoffmann argues against (...) Böhme’s excessive emphasis on the controlling/restrictive functions of awareness at the cost of those functions which serve to protect and stimulate life, his non-distinction between the distance to a cognized object and its intellectual instrumentalisation, and his rather one-sided tendency to seek the sources of European rationalism in the Socra-tean tradition. Background Research on the impact of ethics reflection groups (ERG) (also called moral case deliberations (MCD)) is complex and scarce. Within a larger study, two years of ERG sessions have been used as an intervention to stimulate ethical reflection about the use of coercive measures. We studied changes in: employees’ attitudes regarding the use of coercion, team competence, user involvement, team cooperation and the handling of disagreement in teams. Methods We used panel data in a longitudinal design study to measure (...) variation in survey scores from multidisciplinary employees from seven departments within three Norwegian mental health care institutions at three time points (T0–T1–T2). Mixed models were used to account for dependence of data in persons who participated more than once. Results In total, 1068 surveys (from 817 employees who did and did not participate in ERG) were included in the analyses. Of these, 7.6% (N = 62) responded at three points in time, 15.5% (N = 127) at two points, and 76.8% (N = 628) once. On average, over time, respondents who participated in ERG viewed coercion more strongly as offending (p < 0.05). Those who presented a case in the ERG sessions showed lower scores on User Involvement (p < 0.001), Team Cooperation (p < 0.01) and Constructive Disagreement (p < 0.01). We observed significant differences in outcomes between individuals from different departments, as well as between different professions. Initial significant changes due to frequency of participation in ERG and case presentation in ERG did not remain statistically significant after adjustment for Departments and Professions. Differences were generally small in absolute terms, possibly due to the low amount of longitudinal data. Conclusions This study measured specific intervention-related outcome parameters for describing the impact of clinical ethics support (CES). Structural implementation of ERGs or MCDs seems to contribute to employees reporting a more critical attitude towards coercion. Ethics support is a complex intervention and studying changes over time is complex in itself. Several recommendations for strengthening the outcomes of future CES evaluation studies are discussed. CES evaluation studies are important, since—despite the intrinsic value of participating in ERG or MCD—CES inherently aims, and should aim, at improving clinical practices. (shrink)

In this book Tobias Hoffmann studies the medieval free will debate during its liveliest period, from the 1220s to the 1320s, and clarifies its background in Aristotle, Augustine, and earlier medieval thinkers. Among the wide range of authors he examines are not only well-known thinkers such as Thomas Aquinas, Duns Scotus, and William of Ockham, but also a number of authors who were just as important in their time and deserve to be rediscovered today. To shed further light on (...) their theories of free will, Hoffmann also explores their competing philosophical explanations of the fall of the angels, that is, the hypothesis of an evil choice made by rational beings under optimal psychological conditions. As he shows, this test case imposed limits on tracing free choices to cognition. His book provides a comprehensive account of a debate that was central to medieval philosophy and continues to occupy philosophers today. (shrink)

The goal of this paper is to argue that there is indeterminacy in causation. I present three types of cases in which it is indeterminate whether an event c caused another event e: (1) cases of absence causation recently discussed by Bernstein and by Swanson, (2) cases leading to Sorites paradoxes for causation, and (3) cases where c and e occur in certain indeterministic causal structures and it is therefore indeterminate whether there is a causal relation between them. These cases, (...) I argue, provide strong evidence that indeterminacy is an important general feature of the causal relation and that philosophical theorizing about causation should take this observation into account. In this paper, I examine whether the use of artificial intelligence (AI) and automated decision-making (ADM) aggravates issues of discrimination as has been argued by several authors. For this purpose, I first take up the lively philosophical debate on discrimination and present my own definition of the concept. Equipped with this account, I subsequently review some of the recent literature on the use AI/ADM and discrimination. I explain how my account of discrimination helps to understand that the general claim in (...) view of the aggravation of discrimination is unwarranted. Finally, I argue that the use of AI/ADM can, in fact, increase issues of discrimination, but in a different way than most critics assume: it is due to its epistemic opacity that AI/ADM threatens to undermine our moral deliberation which is essential for reaching a common understanding of what should count as discrimination. As a consequence, it turns out that algorithms may actually help to detect hidden forms of discrimination. (shrink)

As indicated in the title this article is a brief description of the body, soul and spirit of man, based on the divine revelations received by the Austrian mystic Jakob Lorber between 1840 and 1864. While it is common knowledge that man has a body and a soul, very little is known about the spirit in man which is the primary source of knowledge and power, penetrating both the soul and body.

Ethicists differ considerably in their reasons for using empirical data. This paper presents a brief overview of four traditional approaches to the use of empirical data: “the prescriptive applied ethicists,” “the theorists,” “the critical applied ethicists,” and “the particularists.” The main aim of this paper is to introduce a fifth approach of more recent date (i.e. “integrated empirical ethics”) and to offer some methodological directives for research in integrated empirical ethics. All five approaches are presented in a table for heuristic (...) purposes. The table consists of eight columns: “view on distinction descriptive-prescriptive sciences,” “location of moral authority,” “central goal(s),” “types of normativity,” “use of empirical data,” “method,” “interaction empirical data and moral theory,” and “cooperation with descriptive sciences.” Ethicists can use the table in order to identify their own approach. Reflection on these issues prior to starting research in empirical ethics should lead to harmonization of the different scientific disciplines and effective planning of the final research design. Integrated empirical ethics (IEE) refers to studies in which ethicists and descriptive scientists cooperate together continuously and intensively. Both disciplines try to integrate moral theory and empirical data in order to reach a normative conclusion with respect to a specific social practice. IEE is not wholly prescriptive or wholly descriptive since IEE assumes an interdepence between facts and values and between the empirical and the normative. The paper ends with three suggestions for consideration on some of the future challenges of integrated empirical ethics. (shrink)
