The title is meant to indicate that consciousness is being examined largely within the history of philosophy, and within the period of time from Descartes to Ayer. Investigators aiming to understand consciousness and minds usually try to take account of all individual human minds, so as to have the most data for the most encompassing induction. The problem with that approach is that because of the vastness of the data, its results tend to be vague, lacking the specificity of studies (...) of individuals. On the other hand, the problem with studies of individuals is that they cannot guarantee generality, as the opposing method can. This book's distinctive approach aims at a middle way, getting the best of the two opposing methods by drawing its data from the history of philosophy, especially the history of the great philosophers. Philosophers of criminal punishment widely agree that criminal punishment should be “proportional” to the “seriousness” of the offense. But this apparent consensus is only superficial, masking significant dissensus below the surface. Proposed proportionality principles differ on several distinct dimensions, including: regarding which offense or offender properties determine offense “seriousness” and thus constitute a proportionality relatum; regarding whether punishment is objectionably disproportionate only when excessively severe, or also when excessively lenient; and regarding whether the principle can deliver absolute judgments, or only (...) comparative ones. This essay proposes that these differences cannot be successfully adjudicated, and one candidate proportionality principle preferred over its rivals, in the abstract; a proportionality principle only makes sense as an integrated part of a more complete justificatory theory of criminal punishment. It then sketches a proportionality principle that best fits the responsibility-constrained pluralist theories of criminal punishment that currently predominate. The proportionality principle it favors provides that punishments should not be disproportionately severe, in noncomparative terms, relative to an agent’s culpability in relation to their wrongdoing. In Aristotle’s writings regarding the biology of embryology, especially in the Generation of Animals, he contends that the mother’s menstrual fluids provide the material for the generation of the offspring, and the father’s form determines its formation as a member of that species (e.g. human). The katamenia (menstrual fluids) of the mother are said to be potentially all the body parts of the offspring, though actually none of them. So, the fluids are potentially the offspring. But are they a first (...) potentiality or second potentiality (first actuality) of a human, in the terminology of De Anima II? In this paper I will argue that katamenia are a first potentiality of a human. My first argument is that katamenia do not have the potential for human activities such as thinking, but rather the potential of becoming something having the potential for those activities. I answer the objection that katamenia are not even a first potentiality, by appealing to an important text contending that for any x whose source of becoming is external, x is potentially y if nothing in x with respect to matter needs to be changed in order for an external principle to make x into y. Without doctors being able to explain medical decisions to patients, I argue their use of black box AIs would erode the effective and respectful care they provide patients. In addition, I argue that physicians should use AI black boxes only for patients in dire straits, or when physicians use AI as a “co-pilot” (analogous to a spellchecker) but can independently confirm its accuracy. I respond to A.J. London’s objection that physicians already prescribe some drugs without knowing why they work.

Aristotelian theory, as found in Michael Thompson and Philippa Foot, claims that to be good is to be good as a member of that kind. However, I contend that something can satisfy kind-relative standards but nonetheless be bad—I propose a hypothetical Ebola-like microbe that meets its kind-standards of being destructive for its own sake, but it would plausibly be bad for doing so. I anticipate an Aristotelian objection that evaluations should only be made from "within" the lifeform conception rather than (...) from without. (shrink)

The totalizing and absolutizing tendencies of metaphysics can undermine our essential ethical relationality. Is there a metaphysics that is robust enough and conducive to preserving this intuition? In answer, this paper will draw upon Martin Buber and Justus Buchler. Buber’s seminal work, I and Thou, explores the nature of the ethical encounter. Buchler’s Metaphysics of Natural Complexes develops a general ontology, which can be described as an ordinal metaphysics. Encounters are thoroughly relational for Buber. Buchler’s metaphysics is also thoroughly relational. (...) A phenomenological approach to relationality establishes the medium for this dialogue and provides a common ground for these texts. Not only is there a way to account for Buber’s encounter, but there is also an inherent moral understanding in Buchler’s metaphysics that preserves and is conducive to ethical relationality. Buchler’s metaphysics avoids the totalizing and absolutizing tendencies derided by Buber, while simultaneously promotes a version of the encounter. (shrink)

Two related themes have dominated discussions about the Left in advanced industrial democracies in recent years. The first is that an increasingly integrated world economy is creating a fundamentally new situation for leaders and publics, imposing burdens and constraining choices. You can either opt out of the system and languish, or put on what New York Times columnist Thomas Friedman has called neoliberalism's “Golden Straightjacket”—at which point “two things tend to happen: your economy grows and your politics shrinks.” The second (...) is that traditional social democracy has played itself out as a political ideology, creating a vacuum that can and should be filled by some new progressive movement with greater contemporary relevance. For example, Ralf Dahrendorf has argued that “socialism is dead, and … none of its variants can be revived,” while Anthony Giddens has written that reformist socialism has become “defensive” and perhaps even “moribund.”. This review essay of Victor Tadros’s new book, “The Ends of Harm: The Moral Foundations of Criminal Law,” responds to Tadros’s energetic and sophisticated attacks on retributivist justifications for criminal punishment. I argue, in a nutshell, that those attacks fail. In defending retributivism, however, I also sketch original views on two questions that retributivism must address but that many or most retributivists have skated past. First, what do wrongdoers deserve – to suffer? to be punished? something else? Second, what does (...) it mean for them to deserve it? That is, what is the normative force or significance of valid desert claims, either with respect to retributivist desert in particular or with respect to all forms of desert? Because the answers that this essay offers are preliminary, the essay also serves as a partial blueprint for further work by criminal law theorists with retributivist sympathies. (shrink)

HUME AND COLLINS ON MIRACLES Some portions of 18th century intellectual history seem like puzzles of which the most important pieces are missing. In some lucky instances the pieces have not been lost altogether but only misplaced in some other puzzle, so that once this is recognised it is possible to solve both puzzles at once. The following, I believe, may comprise one such case. In his erudite (...) History of Freethought (London 1936), p. 757, J. M. Robertson presents us with the first puzzle:...seven years before the issue of Hume's Essay on Miracles, we find the thesis of that essay tersely affirmed in a note, to Book II of an anonymous translation (ascribed to T. Francklin) of Cicero's De Natura Deorum. The passage is worth comparing with Hume: "Hence we see what little credit ought to be paid to facts said to be done out of the ordinary course of nature. These miracles [cutting the whetstone, etc., related by Cicero, De Div i, c. xvii] are well attested. They were recorded in the annals of a great people, believed by many learned and otherwise sagacious persons, and received as religious truths by the populace; but the testimonies of ancient records, the credulity of some learned men, and the implicit faith of the vulgar, can never prove that to have been, which is impossible in the nature of things ever to be." M. Tullius Cicero Of the Nature of the Gods... with Notes, London, 1741, p. 85. The ascription to Thomas Francklin seems to have been drawn primarily from the "new edition" (London: T. Davies, 1775), on the title-page of which the translation and notes are said to be "By the Rev. Dr. Francklin". Also relevant to 151!. this attribution are these two facts: (1) that Thomas Francklin' s father, Richard Francklin, originally printed the book in 1741, and (2) that Thomas later translated other classical authors into English, notably Sophocles in 1759. But it is surely puzzling that Thomas, who in 1741 was barely twenty years old, and soon to be ordained and later made a Doctor of Divinity, should anticipate Hume's famous criticism of miracles. Consider now the second puzzle. It concerns Anthony Collins, the "Goliath of Freethinking" - as T. H. Huxley called him. In his Scheme of Literal Prophecy Considered (London, 1727) Collins promised a discourse on miracles "which is almost transcribed" (p. 439); and, indeed, it was about time, since by that date Collins had attacked nearly every other part of the Christian edifice. But no such work ever appeared in Collins' s lifetime. Nor is this the only book which Collins came close to publishing. From private letters of Collins' s in the British Library (MS 4282) we learn that he planned to publish an annotated translation of two of Cicero's writings. Thus in a letter of 26 September 1721 he speaks of "publishing my translation of Cicero's books of ye Nature of the Gods and of Divination" For "Nothing [he writes in the same letter] can more tend to promote good sense in the world than some of his [Cicero's] Philosophical Works; which are applicable to all sorts of folly and superstition by those who have Eyes to see and Ears to hear." The reader will now probably guess my drift: Collins was responsible for the 1741 edition of Cicero and its acute comment on miracles. But why, it will be asked, has this connection not been made before? The obvious answer is that since Collins died in 1729 twelve years separated his name from the 1741 edition. The evidence which firmly connects him with it is to be found (a) on the last page (279) of his Historical and Critical Essay on the Thirty Nine Articles (London 1724): "Speedily will be published, Cicero's Treatises of the 152. Nature of the Gods and of Divination. Translated into english [sic], with annotations. In two volumes." and (b) on the title-page. For the Historical and Critical Essay was printed by none other than R. Francklin, the very one who printed the 1741 edition of Cicero. Could Christians and Muslims be referring to the same God? Consider Gareth Evans’s causal theory of reference, on which a name refers to the dominant source of information in the name’s “dossier”. I argue that information about experiences, in which God is simply the object of acquaintance, can dominate the dossier. Thus, this "demonstrative" use of names offers a promising alternative avenue by which users of the divine names can refer to the same referent despite having different conceptions of God.

The study considers development and use of verb/predicate chaining constructions by Hebrew speakers from early childhood to adolescence, based on analysis of authentic conversational and narrative corpora. Three types of such constructions are considered, ordered hierarchically by stage of acquisition: (1) monoclausal extended predicates consisting of a verb (modal, aspectual, or evaluative) marked for tense or mood and followed by one or more complements in the infinitive – e.g., yaxol la-asot ‘can, is able to-do’; (2) coreferential interclausal predicate chaining; and (...) (3) mature discursively-motivated topic-chaining. Relevant typological features of Modern Hebrew are reviewed to explain the lack of canonic clause-chaining construction in the language (e.g. the paucity of non-finite constructions in everyday usage, lack of an uninflected basic form of verbs, lack of auxiliary verbs expressing categories of aspect and voice, and monolexemic verb-internal complexity). Monoclausal verb-chaining emerges early in the speech of toddlers in interaction with their caretakers, whereas predicate chaining by coordination across clauses occurs only later, and chunking of such constructions at the service of discourse connectivity is a late-developing device. Nonfinite subordination is an advanced form of clause-combining, in contrast to straightforward subordination with the multifunctional subordinator še’that’. The conclusion is that, unlike the obligatorily fused monoclausal “extended predicates”, bi- and multi-clausal predicate chaining represents an optional rhetorical choice on the part of a given speaker-writer in a particular communicative context. On January 22, 2002, California Governor Gray Davis released the state's long-anticipated, proposed regulations establishing hospital nurse-to-patient ratio requirements. The Safe Staffing Law mandating minimum ratios was enacted in October 1999 in response to legislators concerns that [q]uality of patient care is jeopardized because of staffing changes implemented in response to managed care. While the law was scheduled to take effect by January 1, 2002, conflict within the medical community regarding appropriate ratios slowed down the rulemaking process. Lawmakers now anticipate (...) that the rule will be implemented by January 2003. Approximately 5,000 new nurses will need to be hired for California's hospitals to come into compliance with the proposed regulation. (shrink)

For the first two years of my daughter's life, I was scheduled to teach an Introductory Logic course. While I had taught Critical Thinking courses in the past, having to steep myself in categorical and propositional logic left a lasting impression on my own thinking. More importantly, though, these courses influenced my speech-habits during the early years of my child's development. By no means do I intend to assert that my child somehow gained some cognitive benefit from my communication with (...) her during these early stages of her life. Rather, it seems that she acquired the particular virtue of tolerating her father's habit of voicing strangely worded utterances. As she has passed the three and half year mark, her own communication skills and means of expression are well on their way towards developing into her own distinct styles. This I know because we talk a lot. Often times these dialogues are about day care, her friends, or princesses and lots of pink stuff. But sometimes a gem of an argument develops. (shrink)

Probably no doctrine has excited as much horror and abuse as atheism. This first history of British atheism, first published in 1987, tries to explain this reaction while exhibiting the development of atheism from Hobbes to Russell. Although avowed atheism appeared surprisingly late – 1782 in Britain – there were covert atheists in the middle seventeenth century. By tracing its development from so early a date, Dr Berman gives an account of an important and fascinating strand of intellectual history.

Philosophers of criminal punishment disagree about whether infliction of punishment for negligence can be morally justified. One contending view holds that it cannot be because punishment requires culpability and culpability requires, at a minimum, advertence to the facts that make one’s conduct wrongful. Larry Alexander and Kim Ferzan are prominent champions of this position. This essay challenges that view and their arguments for it. Invoking a conceptual distinction between an agent’s being _blameworthy_ for an act and their _deserving punishment_ (or (...) suffering) for that act, it explains that an agent can be blameworthy for negligent conduct, and thus liable to reasonable blaming practices, even if negligence is not culpable, hence not sufficient to ground negative desert. Turning from conceptual inquiry to substantive questions of political morality, it then argues that a faulty actor’s lack of culpability does not render them immune from just punishment, but does significantly limit the severity of punishment that may be inflicted, for punishment should not be disproportionately severe relative to an agent’s culpability in relation to wrongdoing.
