The individual right of access to one’s own data is a crucial privacy protection long recognized in U.S. federal privacy laws. Mobile health devices and research software used in citizen science often fall outside the HIPAA Privacy Rule, leaving participants without HIPAA’s right of access to one’s own data. Absent state laws requiring access, the law of contract, as reflected in end-user agreements and terms of service, governs individuals’ ability to find out how much data is being stored and how (...) it might be shared with third parties. Efforts to address this problem by establishing norms of individual access to data from mobile health research unfortunately can run afoul of the FDA’s investigational device exemption requirements. The semantic view of scientific theories has been defended as more adequate than the “received” view, especially with respect to biological theories (Beatty 1980, 1981; Thompson 1983). However, the semantic view has not been evaluated on its own terms. In this paper I first show how the theory of sociobiology propounded by E.O. Wilson (1975) can be understood on the semantic approach. I then discuss the criticism that Wilson’s theory is beset by the problem of unreliable generalizations. I suggest that (...) this problem results from the use of the model-building strategy in theory. I conclude that the problem is pressing enough to impugn the semantic view as an adequate account of sociobiological theory.According to proponents of the semantic view of theories, scientific theories function to specify a class of “models,” interpretations, or representations of their postulates. The aim of this article is to present the circumstances of Noël Coypel’s appointment as rector of the French Academy in Rome and to trace the route of his didactic journey from Paris to Rome with the Prix de Rome scholars entrusted to him. The paper is an attempt to answer the following questions: why a more difficult route through the Alps was chosen, in what way was the journey educational, and what role did the documents given to Coypel play (...) in securing the expedition. The article is based on an analysis of administrative records during the reign of Louis XIV, lists of superintendents and directors of the French Academy in Rome, accounts of royal buildings, and minutes of the Royal Academy of Painting and Sculpture in Paris. The paper uses the analytical method, the comparative method, the synthetic method, source criticism, argumentum ex silentio inference, and the geographical method when discussing the itinerary. Although the trip was purposeful and related to Coypel’s new position, he designed it in such a way as to not so much get to the destination quickly, but to show his students as much as possible. Coypel introduced the royal scholars to masterpieces of painting and sculpture at centers along a route through Dijon, Lyon, Chambéry, the Mont Cenis Pass, Turin, Milan, Bologna and Florence. The crossing of the Alps, though dangerous, was most often chosen because of the artistic reputation of the cities there. The trip was educational at the expense of comfort or safety. Coypel, as a guide and teacher led his charges by overseeing their learning during and through the journey. Wandering to the Eternal City was part of a painter’s education in the seventeenth century and was part of Coypel’s didactic work allowing young people to be inspired by direct exposure to masterpieces. The journey had an eminently didactic and artistic character, but also an initiatory one, as it gradually initiated and prepared the students for the experience of Rome, the center of artistic life at that time. In this paper, we present a model of pathos, delineate its operationalisation, and demonstrate its utility through an analysis of natural language argumentation. We understand pathos as an interactional persuasive process in which speakers are performing pathos appeals and the audience experiences emotional reactions. We analyse two strategies of such appeals in pre-election debates: pathotic Argument Schemes based on the taxonomy proposed by Walton et al. (Argumentation schemes, Cambridge University Press, Cambridge, 2008), and emotion-eliciting language based on psychological lexicons of (...) emotive words (Wierzba in Behav Res Methods 54:2146–2161, 2021). In order to match the appeals with possible reactions, we collect real-time social media reactions to the debates and apply sentiment analysis (Alswaidan and Menai in Knowl Inf Syst 62:2937–2987, 2020) method to observe emotion expressed in language. The results point to the importance of pathos analysis in modern discourse: speakers in political debates refer to emotions in most of their arguments, and the audience in social media reacts to those appeals using emotion-expressing language. Our results show that pathos is a common strategy in natural language argumentation which can be analysed with the support of computational methods. (shrink)

Film theory has for so long been concerned with sociological, empirical and psychoanalytic approaches that its place within our aesthetic sensibilities seems to have been forgotten.Deleuze and Cinema aims to bring back debates about film as an art form - as part of an aesthetic process which incorporates the 'bodies' of our material, technological and molecular worlds. While much film theory has looked at desire in terms of (visual and spectator) pleasure, Barbara Kennedy suggests, in this provocative new study, that (...) these different perceptions of 'body' are responsible, as well as the brain/mind, for the ways in which visual elements of colour, movement, rhythm and sensation are acquired within, through and beyond our consciousness.Film is visceral, vital and dynamic, and wider frameworks of understanding are needed to explain these aesthetic resonances. Deleuze and Cinema asks: how can we begin to understand the cinematic experience as one of material capture, processuality and movement - as opposed to a spectator/text relationship - where desire and pleasure are part of a complex 'aesthetics of sensation'?Through discussions of Orlando, The English Patient, Romeo and Juliet, Strange Days and Leon the book offers a new and creative collusion between Deleuzian philosophy - specifically Deleuze's ideas about desire, pleasure, sensation, affect and 'becoming-woman' - and contemporary film studies. The paper addresses charges of risk and loss aversion as well as of irrationality directed against the precautionary principle, by providing an epistemic analysis of its specific role in the safety law system. In particular, I contend that: 1) risk aversion is not a form of irrational or biased behaviour; 2) both risk and loss aversion regard the form of the utility function, whereas PP rather regards the information on which to base the decision; 3) thus PP has formally nothing (...) to do with risk or loss aversion but rather with risk awareness; 4) PP removes a fictional construct in the legal system, according to which any hazard should be ignored and denied until it is scientifically proven; 5) the quandary originates in the tension between current methods of evidence evaluation, and the logic underlying PP which demands for a probabilistic epistemology. Studies of neuropsychological patients are relevant to models of how long-term memories are stored. If amnesia is considered a binding deficit and not a difficulty in transferring information from short-term to long-term memory, it is unclear why context-free semantic learning is impaired. Also the model should account for the reverse temporal gradient seen in patients with semantic dementia.

In the paper I point out to some problems of the traditional epistemology, i.e. epistemology oriented to search the foundations of cognitive evaluation. The epistemology of that kind which makes up the world outlook of science, I oppose the cultural studies reflection in a scientific knowledge practiced within one of the humanities domains of knowledge, for example, the theoretical history of science, which is limited in its cognitive tasks to the descriptive, reconstructive and explanatory study of science.

Is it possible to find an ethical and generative way to speak about the ‘work’ of Indigenous art? Regardless of what prohibitions exist to protect sacred knowledge from the gaze of Western eyes, Indigenous work is circulating; it is being read, misread, interpreted, misinterpreted and otherwise known. How can a non-Indigenous person ‘speak’ about Indigenous art without reducing it to the diagram, collapsing it into Western modes of knowing, or intruding into the domain of restricted cultural information? Given the lessons (...) of the Indigenous cultural practices, I propose that the work of art is performative and not merely representational. Through attention to the operation of rhythm in Kathleen Petyarre’s paintings, I propose to reconfigure contemporary understandings of performativity. In this formulation I will argue that in the dynamic productivity of the performative act, the world intrudes into practice, and in a double movement, practice casts its effects back towards the world. In this way I suggest that just as life gets into images, so imaging also produces reality. This mutual reflection is the work of art. (shrink)
