Law must evolve to play its part in addressing the anthropogenic threats of climate change and biodiversity loss. Lawyers have a key role to play in assisting that evolution, and the ethics that govern lawyers’ work will play a large part in determining its success. This article explains how four core approaches to legal ethics support lawyers in their work to address climate change and to facilitate more sustainable ways of living.

This paper argues that an expansion of this proposal—whereby provision of already existing medicines are incentivised in a similar way—would provide a more comprehensive solution to the healthcare situation in developing countries. It then considers the practical challenges that the implementation of such a proposal (expanded or otherwise) would entail. Though these include difficulties associated with disease burden metric, I argue that the most serious difficulties are associated with the problem of causal attribution. A basic idea underlying Pogge's proposal is that the disease burden reduction attributable to particular interventions can be determined. Theoretically speaking, in cases involving multiple interacting causal factors, there may be no fact of the matter regarding the extent to which disease burden reduction should be attributed to one intervention as opposed to another; and (even if workable practical solutions to this theoretical challenge can be met) the data requirements for implementation would be daunting. Inter alia, such a theory would provide (...) a principled means for striking a balance, or making trade-offs, between these values in cases of conflict. Recent developments in public health ethics have made progress in thinking about how to make trade-offs between liberty and utility in particular. While public health ethicists often claim that the least restrictive alternative should be used to achieve the public health goal in question, I argue that a plausible but under-recognized idea is that the least restrictive alternative might sometimes involve improvement of global health via redistributive taxation—i.e., rather than coercive social distancing measures. I conclude by demonstrating that the proportionality principle leaves open the question of when exactly utility outweighs liberty or vice versa—and I argue that, rather than speaking about the morality of liberty-infringing public health interventions in categorical/binary terms, it would be more fruitful and realistic to think and speak about the degree to which a liberty-infringing public health intervention is morally appropriate. Abstract A growing number of theorists have argued that toleration, at least in its traditional sense, is no longer applicable to liberal democratic political arrangements—especially if these political arrangements are conceived of as neutral. In this essay Loren Lomasky wryly proposes that the views of Rawls and Nozick might not be as radically divergent as is conventionally supposed. To demonstrate this proposition, Lomasky invents “Twin Harvard” counterparts of Rawls and Nozick. The twist is that Twin Rawls turns out to be a leading libertarian theorist while Twin Nozick endorses a regime of sweeping redistribution. In each case the position follows from familiar elements in the theories of their respective, real-world counterparts. Lomasky concludes that Twin (...) Rawls actually makes better use of familiar Rawlsian themes-such as the veil of ignorance, strains of commitment, and the priority of liberty-than does Rawls himself. Moreover, Rawls's own attempts at combating libertarianism are seen to be weak, sometimes embarrassingly so. Libertarianism is a specter that he devoutly wishes to exorcize, but cannot. Conversely, the rejection of libertarianism by Twin Nozick (and Nozick?) is striking but shallow. Abstract There are at least eight good reasons practicing historians should concern themselves with counterfactual claims. Furthermore, four of these reasons do not even require that we are able to tell which historical counterfactuals are true and which are false. This paper defends the claim that these reasons to be concerned with counterfactuals are good ones, and discusses how each can contribute to the practice of history. In just a few years, there will be a number of such programs in the United States, and if the trend mirrors the expansion of MFAs after the mid-1960s, then in a few decades the PhD will be the consensus "terminal" degree for (...) artists. Given that, it is pressing to consider how the degree might be theorized. In Australia and the United Kingdom, where the degrees already exist, their growth has been dictated in large measure by the existing educational structures and by the inevitable quest for funding. (In the United Kingdom, university departments get a disproportionate increase in their funding if they offer doctorate programs, and the same pattern occurs in state schools in America.) As a result, existing programs simply grow by exonomic necessity or opportunity, and so far they have not been well theorized apart from models already in use elsewhere in the university. Private universities and art schools in the United States are therefore well positioned to rethink the conceptual foundations of combined studio and scholarly PhDs, because they are largely freed of the temptation of increased funding and the obligation to fit the new programs into existing structures. In this essay, I propose eight configurations that such degrees might take. I close with three general observations about the future of such programs.Three pieces of background are necessary as introduction. First, the School of the Art Institute, Chicago, where I teach, is currently running an four-year undergraduate major in visual studies. Soon we will be expanding it into an MA and, in a few years, a PhD. At the BA level our program already has a large studio component. For that reason we have been looking at programs that offer comparable combinations of creative and scholarly work at the PhD level. Our own program, we hope, will be a place [End Page 22] where the possibilities of other programs can be kept open and continuously questioned.Second, this essay was originally a reader's report for a creative-arts PhD thesis called "Beyond the Surface: The Contemporary Experience of the Italian Renaissance," written by Jo-Anne Duggan for the University of Technology, Sydney. In fall 2003 Duggan was a candidate for the "DCA," Doctorate of Creative Arts." She is a photographer, and her special interest is photographing inside museums; her thesis explores the history and theory of that practice. The report I wrote for her was the basis of this essay, because I found that her thesis is a mixture of what I think are the eight principal possibilities for combining PhD-level scholarship and creative work.Third, this essay is the outgrowth of several colloquia that have been held at the College Art Association and at the Association of Independent Colleges of Art and Design/National Association of Schools of Art and Design (AICAD/NASAD) conferences (organizations of art school administrators). These ad hoc forums have been, so far, the only places where the new programs have been debated. I hope this essay can contribute to a more detailed discussion.Here are the eight configurations. The first five are (or will be) common, and the last two are rare but preferable.1. The thesis is art history, intended to inform the art practice. The most obvious relation between scholarship and creative work is that the former informs the latter. The artist positions her scholarship so that it supports her art practice. This volume is a collection of selected papers presented at the Second Asia-Pacific Computing and Philsosophy Conference, which was held in Bangkok, Thailand in January 2005. The conference was organized by the Center for Ethics of Science and Technology, Chulalongkorn University on behalf of the International Association of Computing and Philosophy (www.ia-cap.org). Computing have had a long relationship with philosophy, starting from the problem of how symbols being manipulated in computing bear a relation to the outside world, to those of (...) artificial intelligence, robotics, computer simulation, and so on. Moreover, as computer technologies have become thoroughly pervasive in today's environment, there are also issues concerning social and ethical impacts brought about by them. The papers in the volume represent a wide variety of concerns and various dimensions within which computing and philosophy are related. Furthermore, it also represents some of the first attempts to highlight cultural dimensions of computing and philosophy, which became prominent when the conference was held for the first time within the milieu of an Asian culture. (The First Asia-Pacific Computing and Philosophy was held in Canberra, Australia.) Hence, many of the papers in the volume address this added dimension. Apart form the usual problems of how computers and human lives are interconnected, the papers here also discuss how computers are related to human lives as lived in a specific culture. First published in 1985 and written by leading contributors to the field of general equilibrium analysis, this volume brings together developments in the field of applied general equilibrium modelling. Papers discuss approaches to welfare measurement in applied models, applications to hitherto unexplored areas, such as economic history, extensions to analyse micro data files, regional analyses, fixed price equilibria, and many others. Earlier versions of the papers in this volume were presented at a conference held in Canberra, Australia.

ObjectivesTo investigate the views of Human Research Ethics Committee (HREC) members and of researchers concerning the human research ethics review process in Australia.To examine whether there are differences between views of researchers and HREC members.Design and settingRegistrants at the NHMRC Ethics in Human Research Conference held in Canberra in May 2005 were surveyed by anonymous questionnaire comprising 14 questionnaire items and background demographic questions.ResultsOf the 407 registrants, 252 completed the questionnaire (62% response rate). Respondents comprised 219 (87%) HREC (...) members or administrators, and 33 (13%) researchers who were not HREC members. Researchers generally had a less positive attitude to the HREC process than did HREC members. Researchers were less likely to believe that HRECs: make clear and reasonable decisions in an acceptable timeframe; provide informal guidance to researchers; and have the necessary expertise to make appropriate decisions. The largest difference related to relations between researchers and HRECs: 82.5% of HREC members thought relations were good, but only 59.3% of researchers held this view. Despite these differences, both HREC members and researchers held the view that the ethics review process in Australia is working well.ConclusionAlthough our study suggests that both HREC members and researchers are satisfied with the process of human research ethics review in Australia, there are areas of concern that merit further investigation. These include the timeliness and clarity of HREC decisions, the methodological expertise available to HRECs and the basis for HREC decisions. (shrink)

In July 2007, Rwanda became the first country to provide a notification under the WTO General Council Decision 2003 of its intent to import a fixed-dose, triple combination HIV/AIDS drug (...) manufactured by the Canadian generic pharmaceutical manufacturer Apotex, Inc. In September 2007, Apotex was granted the first compulsory licence application under Canada's Access to Medicines Regime. This article considers the convoluted and protracted negotiations between the Government of Rwanda, Apotex and three patent holders, GlaxoSmithKline, Boehringer Ingleheim Canada and Shire BioChemical, Inc. It questions the efficiency of this process. This article considers the review of the Jean Chrétien Pledge to Africa Act 2004 (Canada). It is critical of the refusal of the Conservative Government of Canada to make any amendments to the legislation to improve the cost-effective delivery of essential medicines. This article queries the proposed Hong Kong Amendment to the TRIPS Agreement 1994, given the concerns of the Africa Group. It is submitted that it is undesirable to codify the WTO General Council Decision 2003, given its failure to provide a speedy, efficient and cost-effective delivery of essential medicines. Profesor Andrzej Walicki, born in 1930, is a historian of philosophy and social thought connected with the so called „Warsaw School of the History of Ideas" prevalent during the 1960s. His field of specialization is the history of Russian and Polish thought and also that of Marxist philosophy. Until 1981, he was professor at the Institute of Philosophy and Sociology PAN. During the time of martial law, Walicki was in Australia as a visiting professor of the Australian National University (...) of Canberra. This Master of Arts thesis is in two parts: a novel, An Anarchy of Man, and an exegesis which places the novel in relation to philosophical concerns about the self and the way those concerns are portrayed in selected works of Western literature. The novel is set in Canberra and Sydney and tells the story of the relationship between two characters: Joe and Gin. It explores the way we in the modern Western world think about ourselves and those around (...) us. Chapter One considers the view of the self in the work of the philosopher Rene Descartes and explores how this view is portrayed in three contemporary Australia novels, and in An Anarchy of Man. Chapter Two examines post-Cartesian views of the self, especially those in the work of the philosopher Ludwig Wittgenstein, and then considers the way the self is portrayed in Proust's Remembrance of Things Past, and in my own An Anarchy of Man. Chapter Three examines postmodern conceptions of the self and considers how these conceptions are portrayed in the work of the contemporary American novelist Don DeLillo and in my own An Anarchy of Man. Alstin, Zac At a March lecture in Canberra, Australian ethicist and pro-abortion activist Dr Leslie Cannold, spoke about the 'unfinished business' of abortion law reform in Australia. A frustrated friend sent me the transcript of this lecture and asked me to write something in response. But given the context of Cannold's lecture: a pro-abortion speech to a pro-abortion audience about pro-abortion law reform, a direct response seems impertinent. Plus, as a rule of thumb, when you play 'Pin the (...) Tail' on a live donkey you're liable to get a kick in the teeth. It makes more sense to take Cannold's speech at face value as evidence of an abortion activist's self-imposed mission in our society. To attack her for saying what she believes is perhaps in Cannold's own words "like blaming a leopard for having spots.". (shrink)

The Indian realists argue for the unique claim that universals are perceptible. The possibility of allowing perceptual access to universals puts pressure on the Nyāya theory of perception. The Nyāya philosophers introduced the notion of nirvikalpaka pratyakṣa (non-conceptual perception) to accommodate the perceptibility of universals. Since there is no direct introspective evidence for non-conceptual perception, it is difficult, if not impossible, to specify the content of nirvikalpaka pratyakṣa or non-conceptual perception. This paper addresses this concern by turning to Ned Block's (...) work in contemporary philosophy of perception. Using Block's arguments, I propose that we have an independent empirical route to specify the content of a non-conceptual perception which is not subject to the ‘myth of the given’ objection. This paper argues that the “Canberra Plan” picture of physicalistic reduction of mind--a picture shared by both its proponents and opponents, philosophers as diverse as David Armstrong, David Chalmers Frank Jackson, Jaegwon Kim, Joe Levine and David Lewis--neglects ground (Fine, 2001, 2012). To the extent that the point of view endorsed by the Canberra Plan has an account of the physical/functional ground of mind at all, it is in one version trivial and in another version implausible. In its (...) most general form, the point of view of the Canberra Plan is committed to unacceptably treating indexical or name-related facts as part of the ultimate physical/functional ground of the mental. In this paper I argue that the Canberra Plan is ill-equipped to offer a satisfactory theory of gender. Insofar as the Canberra Plan aims to provide a general and unified approach to philosophical theorising, this is a significant problem. I argue that this deficit in their method stems from the robust role assigned to pre-theoretical beliefs in constructing philosophical analyses. I utilise a critical conception of ideology to explain why our pre-theoretic beliefs about certain social kinds are likely (...) to deliver politically dubious metaphysics of the social world. The first half of the paper is dedicated to exercising this theoretical shortcoming. In the second half, I suggest a way in which the Canberra Plan can address and rectify this problem, with a view to maintaining the theoretical viability of the Canberra Plan with respect to politically important concepts. A popular approach in philosophy, the so-called Canberra Plan, is critically scrutinized. Two aspects of this research program, the formal and the informal program, are distinguished. It is argued that the formal program runs up against certain serious technical problems. It is also argued that the informal program involves an unclear leap at its core. Consequently, it is argued that the whole program is much more problematic than its advocates recognize.

I take up the task of examining how someone who takes seriously the ambitious programme of conceptual analysis advocated by the Canberra School can minimise the eliminative consequences which I argue the Ramsey-Carnap-Lewis recipe of conceptual analysis is likely to have for many folk discourses. The objective is to find a stable means to preserve the constative appearance of folk discourse and to find it generally successful in its attempts to describe an external world, albeit in non-scientific terms that (...) do not reflect the nature of things. The view I settle on, quasi-fictionalism, is modelled on a modified descriptivist version of Kendall Walton’s account of prop-oriented games of make-believe. (shrink)

Jackson argues that conceptual analysis plays a modest, albeit crucial, role in ‘serious metaphysics’: roughly, the project of demystifying phenomena we take to be mysterious by locating them in the natural world. This defence of conceptual analysis is associated with ‘the Canberra Plan’, a philosophical methodology that has its roots in the works of both Lewis :427–446, 1970, Australas J Philos 50:249–258, 1972) and Jackson. There is, however, a distinction to be drawn between conceptual analysis, as it is typically (...) employed in the Canberra plan, and a version of it defended by Jackson himself. In this paper, I elucidate this distinction, and employ examples from the history of science to argue the use of the former, but not the latter, incurs certain problems of conceptual change. Moreover, I also argue neither can be used to undertake serious metaphysics—the former because of the aforementioned problems, and the latter due to the machinery it employs to solve them. (shrink)

Lawyers in many jurisdictions are ageing, and yet there is little information concerning the age profile of the legal profession. This paper presents the first consideration of the age profile of lawyers outside of the US, showing that Australian lawyers are ageing and delaying retirement. These findings have serious implications. Problems associated with a growing proportion of older lawyers include an increasing risk of lawyers suffering from age-related cognitive and physical impairment, and the related rise of complaints and malpractice claims (...) against older lawyers. It is also clear that the Australian legal profession is unprepared to address these problems. The legal profession has ignored important gender-specific implications of ageing, such as female lawyers experiencing menopause and the lower savings of female lawyers moving into retirement. Regulatory regimes have not considered the impact of the profession's ageing profile, and there is no mandatory reporting of lawyers suffering from age-related impairment or provisions should a lawyer die. The profession also has not provided strategies to positively transition lawyers into retirement, and there is a lack of flexible working arrangements and succession planning, especially in firms located outside urban centres. An online survey of 654 Australians found that the NP seniors is associated with positive personal characteristics of health and well-being such as ‘like to travel’, ‘lead an involved and active life’, ‘are vibrant and full of purpose’. Older people is also associated with positive characteristics, but somewhat less so than seniors and more socially oriented. Older people are seen to ‘benefit the workforce through their experience’, ‘have wisdom and can always be turned to for advice’, ‘play an important role (...) in their extended family’s life’. By contrast, the characteristics of those typically referred to by the elderly are negative in that the referents are incompetent or impose a burden on society, cf. ‘are frail and fall more often’, ‘are often victims of mental and physical abuse’, ‘are unable to look after themselves and depend on others for help’. The referents of old people and oldies have no particular set of characteristics assigned to them; perhaps that is why they only figure in the one characteristic ‘are tight-fisted with money’ that itself is not strongly associated with any one of the five NPs.
