This clinical case report illustrates the potential dilemmas that can arise from knowledge gained through genetic analysis. These conflicts require careful ethical analysis of presumed duties to protect patient privacy and maintain confidentiality, the duty to warn a second party of a health risk, and the duty of veracity. While the questions raised by genetic testing of one individual for disease that reveals potentially important information about relatives, such as risk for Huntington chorea or breast cancer, have been discussed, the (...) continuing expansion in our capacity for sophisticated genetic analysis continues to present new and challenging situations. Moral distress, is, at its core, an organizational problem. It is experienced on a personal level, but its causes originate within the system itself. In this commentary, we argue that moral distress is not inherently good, that effective interventions must address the external sources of moral distress, and that while there is a place for resilience in the healthcare professions, it cannot be an effective antidote to moral distress.

What does the development of a truly robust contemporary theory of domination require? Ashley J. Bohrer argues that it is only by considering all of the dimensions of race, gender, sexuality, and class within the structures of capitalism and imperialism that we can understand power relations as we find them nowadays. During a divisive political time, it is critical that social studies teachers, teacher educators, and scholars commit to justice, equity, inclusivity, and diversity when teaching, engaging, and learning with emerged bilingual (EB) students. This study examines how late arrival EB students and their teachers conceptualize social studies, citizenship, and civic education through a framework of culturally and linguistically relevant citizenship education (CLRCE). The findings in this study extend the original CLRCE framework by drawing from multiple sites of pedagogical ideas and (...) action to support late arrival EB students inside and outside of the social studies classroom. This study offers examples for how to implement CLRCE in communities experiencing similar demographic shifts as well as in schools who are interested in centering the cultural, linguistic, and civic experiences of their students. Specifically, this study reveals pedagogical examples and sites of critical citizenship that center EB students’ ideas, experiences, assets, and actions in civic society and in the social studies classroom, offering ways to rethink and reimagine civics education. This conceptual paper argues for the reconfiguring of Intercultural Communication Education (ICE) through a dialogical engagement with Istina (Truth) and Pravda (Truth in Justice). The paper argues that the field of ICE is predominantly characterised by normative conceptualisations of truth (e.g., characterised by fixed or ‘objective’ interpretations of language and culture) or hyper-relativist post-truth conceptualisations (e.g., non-essentialist approaches to ICE). This conceptual paper, therefore, addresses the following research question: To what extent can a dialogical approach to truth address and redress (...) epistemic power imbalances in ICE? Through engaging with Russian language and the dialogical approach of Mikhail Bakhtin a non-normative approach for ICE is proposed. The paper conceptually argues in moving beyond the binary of normative and post-truth interpretations in ICE through dialogism. The paper serves at an important juncture amidst calls that the field of ICE is characterised by epistemic violence and epistemic power imbalances. The proposed dialogical approach to truth in ICE aims to redress epistemic imbalances in arguing for a form of non-normative dialogical ethics. (shrink)

For more than a decade, the United States has been fighting wars so far from the public eye as to risk being forgotten, the struggles and sacrifices of its volunteer soldiers almost ignored. Photographer and writer Ashley Gilbertson has been working to prevent that. His dramatic photographs of the Iraq war for the New York Times and his book Whiskey Tango Foxtrot took readers into the mayhem of Baghdad, Ramadi, Samarra, and Fallujah. But with Bedrooms of the Fallen, Gilbertson (...) reminds us that the wars in Afghanistan and Iraq have also reached deep into homes far from the noise of battle, down quiet streets and country roads—the homes of family and friends who bear their grief out of view. The book’s wide-format black-and-white images depict the bedrooms of forty fallen soldiers—the equivalent of a single platoon—from the United States, Canada, and several European nations. Left intact by families of the deceased, the bedrooms are a heartbreaking reminder of lives cut short: we see high school diplomas and pictures from prom, sports medals and souvenirs, and markers of the idealism that carried them to war, like images of the Twin Towers and Osama Bin Laden. A moving essay by Gilbertson describes his encounters with the families who preserve these private memorials to their loved ones, and shares what he has learned from them about war and loss. After a period of relative neglect, awe has been the focus of substantial empirical work in psychology and has also begun to receive some philosophical attention. Thus far, though, little attention has been devoted to a line of reasoning present in the literature on environmental ethics that moves from being awe-inspiring to being worthy of preservation. I argue here that this neglect ought to be remedied, as this argument potentially has a significant role to play in various ethical contexts involving (...) non-persons. I also identify key questions that would need to be addressed in delivering an all-things-considered verdict on this argument, and argue that the argument is largely independent of empirical work on the ‘pro-social effects’ of awe. My primary goal is to motivate, and provide a clear direction for, further work devoted to the prospects and implications of this line of reasoning. (shrink)

‘Writing Pain’ argues that Anna Seward‘s Letters and Mary Robinson‘s letters create alternative models of sensibility from the suffering poet of Charlotte Smith‘s Elegiac Sonnets. Immensely popular, Smith‘s sonnets made feminine suffering a source of poetic agency by aestheticizing and privatizing it. However, despite their sincerity, her sonnets effaced the physical, nervous body of sensibility on which Seward‘s and Robinsons early poetic reputations had depended and for which they had been mocked. The popularity of Smith‘s model made it an important (...) model for women poets, but, by the end of the eighteenth century, sensibility was also associated with sickness and artifice. For Seward and Robinson, who wanted to build their literary reputations but were living with disabled bodies, Smiths example needed to be reimagined to account for the reciprocity of body and mind as they struggled to write through pain. The permissibility of euthanasia and physician-assisted suicide is actively debated worldwide. Writers such as Ruth Macklin and Steven Pinker have argued that dignity is not a useful concept in bioethics and cannot be used legitimately by either side in the debate. In this essay, the author expands on a defense of the human person based in dignity and rooted in the work of Karol Wojtyla (Pope John Paul II) and Gabriel Marcel. He defends the idea, introduced by John F. Crosby, (...) that a human person has dignity because of her “unrepeatableness,” a concept known as incommunicability. There is a deep distrust of experts in America today. Influenced by populist politics, many question or downright ignore the recommendations of scientists, scholars, and others with specialized training. It appears that expertise, a critical component of democratic life, no longer appeals to wide swaths of the body politic. On Expertise is a robust defense of the expert class. Ashley Rose Mehlenbacher examines modern and ancient theories of expertise through the lens of rhetoric and interviews some forty professionals, revealing (...) how they understand their own expertise and how they came to be known as “experts.” She shows that expertise requires not only knowledge and skill but also, crucially, an acknowledgment by others—both specialists and laypeople—that one is a credible authority. At its heart, expertise is a rhetorical construct, and to be persuasive, experts must have the ability to apply their knowledge and skills rightly—in the right way, at the right time, to achieve the right end. Ultimately, Mehlenbacher argues that experts apply their technical knowledge effectively and win others’ trust through acting prudently and cultivating goodwill. Timely, practical, and sophisticated, On Expertise provides vital scaffolding for our understanding of expertise and its real-world application. The use of nonhuman animals as models in research and drug testing is a key route through which contemporary scientific knowledge is certified. Given ethical concerns, regulation of animal research promotes the use of less “sentient” animals. This paper draws on a documentary analysis of legal documents and qualitative interviews with Named Veterinary Surgeons and others at a commercial laboratory in the UK. Its key claim is that the concept of animal sentience is entangled with a particular imaginary of how (...) the general public or wider society views animals. We call this imaginary societal sentience. Against a backdrop of increasing ethnographic work on care encounters in the laboratory, this concept helps to stress the wider context within which such encounters take place. We conclude that societal sentience has potential purchase beyond the animal research field, in helping to highlight the affective dimension of public imaginaries and their ethical consequences. Researching and critiquing societal sentience, we argue, may ultimately have more impact on the fate of humans and nonhumans in the laboratory than focusing wholly on ethics as situated practice. Nanotechnology is viewed by those in favor of its development in two different ways, and the divide is not recent. This article describes the origins of the differing visions of nanotechnology and examines their broader impacts. The typical history of the field tells nothing about these differing visions, which perhaps misleads. At least two distinct camps among scientists and engineers pursue work on the nanoscale, but they rarely interact, and when they do, they get nowhere. This article looks first at (...) definitional issues in the field; then turns to the common history of nanotechnology, the history's shortcomings, and one particular episode that highlights the divide; and then examines the broader impacts of this dispute. The divide among those interested in nanotech tells something about the way different groups of people see technology and the application of science. Physicians, nurses, and healthcare professional students openly participated in the medical atrocities of the Shoah. In this paper, a physician-bioethicist and nurse-bioethicist examine the role of hierarchical power imbalances in medical education, which often occur because trainees are instructed ‘to do so’ by their superiors during medical education and clinical care. We will first examine the nature of medical and nursing education under National Socialism: were there cultural, educational, moral and legal pressures which entrenched professional hierarchies and thereby commanded obedience (...) in the face of an ever-diminishing individual and collective conscience? We will then outline relevant parallel features in modern medical education, including the effects of hierarchy in shaping ethical decision making and conscience formation. We then propose several solutions for the prevention of the negative effects of hierarchical power imbalances in medical education: universal Holocaust education in medical and nursing schools; formative and experiential ethics instruction, which teaches students to ‘speak up’ when ethical issues arise; acceptance of, and adherence to, a personalistic philosophical anthropology in healthcare; support for rigorous conscience protection laws for minority ethical views that respect the role of integrity without compromising patient care. Many philosophers have suggested that claims of need play a special normative role in ethical thought and talk. But what do such claims mean? What does this special role amount to? Progress on these questions can be made by attending to a puzzle concerning some linguistic differences between two types of 'need' sentence: one where 'need' occurs as a verb, and where it occurs as a noun. I argue that the resources developed to solve the puzzle advance our understanding of (...) the metaphysics of need, the meaning of 'need' sentences, and the function of claims of need in ethical discourse. Aristotle claims that character friends are similar to each other. How should we understand this similarity, and what role does it play in friendship? In the paper, I argue that a broad similarity of ‘tastes’—which I understand as the appreciation of relatively good ends—is at least a facilitating condition on the formation of character friendship. This is because it (i) facilitates seeing the other as good in the first place, which is essential to character friendship; and (ii) enables the friends (...) to spend time and share in activities together, which is characteristic of character friendship. Abnormalities in the ability of cells to properly degrade proteins have been identified in many neurodegenerative diseases. Recent work has implicated synaptojanin 1 (SynJ1) in Alzheimer's disease and Parkinson's disease, although the role of this polyphosphoinositide phosphatase in protein degradation has not been thoroughly described. Here, we dissected in vivo the role of SynJ1 in endolysosomal trafficking in zebrafish cone photoreceptors using a SynJ1‐deficient zebrafish mutant, nrca14. We found that loss of SynJ1 leads to specific accumulation of late endosomes and (...) autophagosomes early in photoreceptor development. An analysis of autophagic flux revealed that autophagosomes accumulate because of a defect in maturation. In addition we found an increase in vesicles that are highly enriched for PI(3)P, but negative for an early endosome marker in nrca14 cones. A mutational analysis of SynJ1 enzymatic domains found that activity of the 5'phosphatase, but not the Sac1 domain, is required to rescue both aberrant late endosomes and autophagosomes. Finally, modulating activity of the PI(4,5)P2 regulator, Arf6, rescued the disrupted trafficking pathways in nrca14 cones. Our study describes a specific role for SynJ1 in autophagosomal and endosomal trafficking and provides evidence that PI(4,5)P2 participates in autophagy in a neuronal cell type. -/- . (shrink)

This paper is a survey of how economists and philosophers approach the issue of comparisons. More precisely, it is about what formal representation is appropriate whenever our ability to compare things breaks down. We restrict our attention to failures that arise with ordinal comparisons. We consider a number of formal approaches to this problem including one based on the idea of parity. We also consider the claim that the failure to compare things is a consequence of vagueness. We contrast two (...) theories of vagueness; fuzzy set theory and supervaluation theory. Some applications of these theories are described. (shrink)

In this paper we examine the use of companion animals (pets) in studies of drugs and devices aimed at human and animal health and situate it within the context of philosophy of technology. We argue that companion animals serve a unique role in illuminating just what it means to use biological technologies and examine the implications for human-animal relationships. Though philosophers have often treated animals as technologies, we argue that the biomedical use of companion animals presents a new configuration of (...) ethical and technological concerns that deserves more attention. Though it seems that companion animals solve many of the ethical dilemmas caused by the use of laboratory animals, the use of companion animals presents its own set of ethical concerns. We are in a position today to appreciate the ambiguity of technologies: that they are good, and bad, and neutral and present challenges in different ways. Reading U.S. national nanotechnology documents and histories of nanotechnology, one finds that rhetoric idealizing progress without serious consideration of negative side-effects remains unfortunately fixed within stories constructed about technology. Though we should be better aware of the potential for unintended consequences and negative social effects (and, if anything, we should expect these things), the narratives (...) about nanotechnology today still center on unlimited power over nature, much like technological narratives of eras past. David Nye, in America as Second Creation: Technology and Narratives of New Beginnings, explains how American narratives during the 19th century focused on technology as both transformative and stabilizing. In this time, it seemed as if nature was ready and waiting to be transformed and made useful for the new Americans. While negative effects are predicted and worried about by some elements, the overwhelming voice in discussions of nanotechnology come from the funding agencies, governments, and businesses that seek to profit from it. This article gives us reason to be more skeptical about the types of rhetoric used in this field. The rhetoric used in nanotechnology mimics that of earlier rhetorics of progress. By focusing specifically on narratives of progress within the United States, this article reveals the odd correspondence of rhetoric about nanotechnology with earlier American rhetoric on other technologies. Actions that do not have instrumental goals can communicate social goals that are not rituals. Many non-instrumental actions such as bowing or kissing communicate a commitment to or roles in dyadic relationships. What is unclear is when people understand such actions in terms of ritual and when they understand them in terms of relationships.

Our thoughts, feelings, and behaviors are shaped in critical ways by our beliefs about how we compare to other people. Prior research has predominately focused on the consequences of believing oneself to be better than average (BTA). Research on the consequences of worse-than-average (WTA) beliefs has been far more limited, focusing mostly on the downsides of WTA beliefs. In this paper, we argue for the systematic investigation of the possible long-term benefits of WTA beliefs in domains including motivation, task performance, (...) and subjective well-being. We develop a conceptual framework for examining these possible benefits, we explore the usefulness of this framework to generate novel insights in an important psychological domain (skill learning), and we conclude with broader recommendations for research in other domains such as friendship formation, moral, and political decision making. This paper seeks to demonstrate that in Lyotard’s later works the sublime is posited as a response to nihilism. This demonstration is significantly complicated by the fact that while Lyotard frequently gave the sublime a positive valuation, he also identified it with nihilism. The paper charts Lyotard’s confrontation with nihilism throughout his career, showing how the themes with which he characterizes nihilism in his earlier works are repeated as characteristics of the sublime in his later works. It then argues that (...) for Lyotard the sublime acts as both a characterization of the nihilism of contemporary cultural conditions, and as a resource with which to respond to nihilism. Lyotard’s deployment of the sublime as such a response can be understood as an instance of his use of the sophistical strategy of retorsion, finding from within nihilism itself the potential for resistance. Moreover, this position may be understood as motivated by a rejection of revolutionary programmes for changing social conditions, and by the desire to preserve a space for justice – understood as respect for difference. For Lyotard, the abyss between meaning and existence which characterizes both nihilism and the sublime preserves this space better than any attempt to close or bridge it. (shrink)

Work on a computer program called SMILE + IBP (SMart Index Learner Plus Issue-Based Prediction) bridges case-based reasoning and extracting information from texts. The program addresses a technologically challenging task that is also very relevant from a legal viewpoint: to extract information from textual descriptions of the facts of decided cases and apply that information to predict the outcomes of new cases. The program attempts to automatically classify textual descriptions of the facts of legal problems in terms of Factors, a (...) set of classification concepts that capture stereotypical fact patterns that effect the strength of a legal claim, here trade secret misappropriation. Using these classifications, the program can evaluate and explain predictions about a problem’s outcome given a database of previously classified cases. This paper provides an extended example illustrating both functions, prediction by IBP and text classification by SMILE, and reports empirical evaluations of each. While IBP’s results are quite strong, and SMILE’s much weaker, SMILE + IBP still has some success predicting and explaining the outcomes of case scenarios input as texts. It marks the first time to our knowledge that a program can reason automatically about legal case texts. (shrink)

Programmatic secularism aims to secure public reason from rival rationalities, notably those from religious experience and education. The gathering of knowledge in clinical ethics into a concrete array of consensus claims and consensus-derived principles are thought by Janet Malek to secure such public reason—an essential tool for clinical ethics consultants to execute their professional role. The author compares this gathering of knowledge to an understanding of what technology is. Accordingly, the following interrogates Malek’s programmatic secularism, which is a moral technique (...) that not only homogenizes moral dialogue but also dehumanizes persons as it tyrannizes the creative freedom for moral conversation and genuine encounter. According to the powerful qualities view, properties are both powerful and qualitative. Indeed, on this view the powerfulness of a property is identical to its qualitativity. Proponents claim that this view provides an attractive alternative to both the view that properties are pure powers and the view that they are pure qualities. It remains unclear, however, whether the claimed identity between powerfulness and qualitativity can be made coherent in a way that allows the powerful qualities view to constitute this sort (...) of alternative. I argue here that this can be done, given a particular conception of both the qualitativity and powerfulness of properties. On this conception, a property is qualitative just in the sense that its essence is fixed independently of any distinct properties, and it is powerful just if its essence grounds its dispositional role. Understanding everyday behavior relies heavily upon understanding our ability to improvise, how we are able to continuously anticipate and adapt in order to coordinate with our environment and others. Here we consider the ability of musicians to improvise, where they must spontaneously coordinate their actions with co-performers in order to produce novel musical expressions. Investigations of this behavior have traditionally focused on describing the organization of cognitive structures. The focus, here, however, is on the ability of the time-evolving patterns of (...) inter-musician movement coordination as revealed by the mathematical tools of complex dynamical systems to provide a new understanding of what potentiates the novelty of spontaneous musical action. We demonstrate this approach through the application of cross wavelet spectral analysis, which isolates the strength and patterning of the behavioral coordination that occurs between improvising musicians across a range of nested time-scales. Revealing the sophistication of the previously unexplored dynamics of movement coordination between improvising musicians is an important step towards understanding how creative musical expressions emerge from the spontaneous coordination of multiple musical bodies. The age of modern biomedical science has raised many difficult ethical questions. Accordingly, leaders in bioethics have articulated methods to direct the on-going discourse while providing the systems necessary for making morally efficient decisions. In this thought-provoking study, Ashley John Moyse suggests a theory of ethics that interrupts and transforms the contemporary and abstract modes of moral discourse. Moyse moves the moral discussion of bioethics beyond abstract ends, obligations, and common moral categories. At the same time, he challenges readers (...) to take seriously the concrete moral tasks of existence. Moyse engages with Karl Barth's philosophical and theological thinking in order to investigate the moral discussions surrounding biomedical ethics. The book engagingly illuminates a path toward moral discernment that recognizes the significance of human flourishing. According to Moyse, Barth's moral theology not only grounds humans as ontologically relational but also fuels responsibility to, with, and for one's neighbors. (shrink)

To examine the ethical duty to patients and families in the setting of the resuscitation bay, we address a case with a focus on providing optimal care and communication to family members. We present a case of nonsurvivable traumatic injury in a minor, focusing on how allowing family more time at the bedside impacts the quality of death and what duty exists to maintain an emotionally optimal environment for family grieving and acceptance. Our analysis proposes tenets for patient and family-centric (...) care that, in alignment with trauma-informed care principles, optimize the long-term well-being of the family, namely valuing family desires and sensitivity to location.
