Street vendors are prominent on public streets and in traditional markets in most developing countries. They raise significant problems for public authorities, residents, pedestrians, and formal retailers. Their informal business is problematic, leading to conflicts and sometimes violence. Moreover, unlicensed street vendors employ children and women and are accused of counterfeiting and drug trading. However, they participate in reducing poverty and unemployment. The current data article aims to formulate a public perception on the problematic issue of street vending pervasiveness (...) by describing a survey dataset on street vending and its main driving factors. Street vending has traditionally be examined by linking it with one or more determinants; thus, the dataset covers poverty, lack of education, immigration, unemployment, urban culture, low-income consumption, resistance, and lack of microfinance as latent constructs. Five measurable variables are introduced that reflect each construct. All variables are measured via seven-point Likert scales. Using a Google Form, 425 responses were collected that reflect the attitudes of the general public in Baghdad, Iraq. This dataset is useful for research on socio-economic problems; more specifically, it introduces reliable measurement models for street vending and the eight factors driving it. (shrink)

It is widely accepted among medical ethicists that competence is a necessary condition for informed consent. In this view, if a patient is incompetent to make a particular treatment decision, the decision must be based on an advance directive or made by a substitute decision-maker on behalf of the patient. We call this the competence model. According to a recent report of the United Nations (UN) High Commissioner for Human Rights, article 12 of the UN Convention on the Rights (...) of Persons with Disabilities (CRPD) presents a wholesale rejection of the competence model. The High Commissioner here adopts the interpretation of article 12 proposed by the Committee on the Rights of Persons with Disabilities. On this interpretation, CRPD article 12 renders it impermissible to deny persons with mental disabilities the right to make treatment decisions on the basis of impaired decision-making capacity and demands the replacement of all regimes of substitute decision-making by supported decision-making. In this paper, we explicate six adverse consequences of CRPD article 12 for persons with mental disabilities and propose an alternative way forward. The proposed model combines the strengths of the competence model and supported decision-making. (shrink)

Modeling law search and retrieval as prediction problems has recently emerged as a predominant approach in law intelligence. Focusing on the law article retrieval task, we present a deep learning framework named LamBERTa, which is designed for civil-law codes, and specifically trained on the Italian civil code. To our knowledge, this is the first study proposing an advanced approach to law article prediction for the Italian legal system based on a BERT (Bidirectional Encoder Representations from Transformers) learning framework, (...) which has recently attracted increased attention among deep learning approaches, showing outstanding effectiveness in several natural language processing and learning tasks. We define LamBERTa models by fine-tuning an Italian pre-trained BERT on the Italian civil code or its portions, for law article retrieval as a classification task. One key aspect of our LamBERTa framework is that we conceived it to address an extreme classification scenario, which is characterized by a high number of classes, the few-shot learning problem, and the lack of test query benchmarks for Italian legal prediction tasks. To solve such issues, we define different methods for the unsupervised labeling of the law articles, which can in principle be applied to any law article code system. We provide insights into the explainability and interpretability of our LamBERTa models, and we present an extensive experimental analysis over query sets of different type, for single-label as well as multi-label evaluation tasks. Empirical evidence has shown the effectiveness of LamBERTa, and also its superiority against widely used deep-learning text classifiers and a few-shot learner conceived for an attribute-aware prediction task. What is good bioethics? Addressing this question is key for reinforcing and developing the field. In particular, a discussion of potential quality criteria can heighten awareness and contribute to the quality of bioethics publications. Accordingly, the objective of this article is threefold: first, we want to identify a set of criteria for quality in bioethics. Second, we want to illustrate the added value of a novel method: in-depth analysis of a single article with the aim of deriving quality (...) criteria. The third and ultimate goal is to stimulate a broad and vivid debate on goodness in bioethics. An initial literature search reveals a range of diverse quality criteria. In order to expand on the realm of such quality criteria, we perform an in-depth analysis of an article that is acclaimed for being exemplary. The analysis results in eleven specific quality criteria for good bioethics in three categories: argumentative, empirical, and dialectic. Although we do not claim that the identified criteria are universal or absolute, we argue that they are fruitful for fueling a continuous constitutive debate on what is “good bioethics.” Identifying, debating, refining, and applying such criteria is an important part of defining and improving bioethics. What should the EU do about the fact that some Member States are backsliding on their commitments to democracy, supposedly a fundamental value of the EU? The Treaty provisions under Article 7 TEU are widely criticized for being ineffective in preventing such developments. Are they legitimate? I argue that the ultimate sanction of Article 7 TEU falls into a performative contradiction, which undermines its ability to coherently defend fundamental values. Instead, expulsion from the EU is the appropriate, coherent (...) and legitimate final political sanction for democratic and rule of law backsliding by a Member State. The argument has the following steps: In Part 1, I argue that the current Article 7 framework for responding to democratic and rule of law backsliding in the EU is normatively problematic, in that the mechanism currently in the Treaty undermines the values it purports to defend; in other words, it falls into a performative contradiction. It is undemocratic to deprive Member States of their right to vote in the Council while holding them subject to Council decisions. However, Part 2 studies relevant philosophical arguments from an adjacent literature on criminal disenfranchisement, concluding that allowing backsliding Member States to keep their voting rights in the Council _also_ taints the democratic character of Council decision-making. In Part 3, I consider the resulting paradox in light of the literature on militant democracy. Could militant democracy justify Article 7? I argue not; even if we accept the hypothetical justifiability of militant measures, they are not legitimate here since a democratically acceptable alternative exists that would safeguard the democratic character and legitimacy of Council decision-making: expulsion from the Union. I also address a central objection to an expulsion mechanism—that it would require treaty change and is therefore practically impossible. (shrink)

In volume 75 of Heidegger’s Complete Works, there is an article written in 1943 in which Heidegger cited the whole of chapter 11 of the Lao Zi to illustrate his view of the uniqueness of the poet. This essay attempts to expose Heidegger’s rendering and interpretation of that chapter. They contain both a deepened exegesis of his doctrine of “Being” and “time” in his earlier writing, and a methodological revealing of the guiding word “appropriation” in his late works.

The following text is a voice in the discussion around normative problems of innovative therapies. It particularly refers to the amendment to the Polish Act on the Professions of Physician and Dentist, also discussed in this issue in the article by Rafał Kubiak "Criminal liability for crimes related to the illegal conduct of a medical experiment.".

This paper attempts to rethink the philosophy of Muhammad Iqbal (1877–1938) and challenge the still prevailing tendency in Iqbal scholarship to view it merely as an outcome of the influence of the ideas of various Western/European philosophers. I present Iqbal’s arguments in their particular historical and intellectual context to show that they developed in response to a specific philosophical problem and that Iqbal looked for a solution to that problem in Islamic tradition. I suggest that Iqbal’s philosophy is best understood (...) in the context of, and as a response to, the problem of nihilism as it was debated in modern German philosophy during ‘the pantheism controversy’ in the eighteenth and nineteenth centuries. To demonstrate this, I analyse Iqbal’s article on ʿAbd al-Karīm al-Jīlī to show his concern with the problem of nihilism, and his solution to it based on al-Jīlī’s Sufism. (shrink)

The renewed interest in the foundations of quantum statistical mechanics in recent years has led us to study John von Neumann’s 1929 article on the quantum ergodic theorem. We have found this almost forgotten article, which until now has been available only in German, to be a treasure chest, and to be much misunderstood. In it, von Neumann studied the long-time behavior of macroscopic quantum systems. While one of the two theorems announced in his title, the one he (...) calls the “quantum H-theorem,” is actually a much weaker statement than Boltzmann’s classical H-theorem, the other theorem, which he calls the “quantum ergodic theorem,” is a beautiful and very non-trivial result. It expresses a fact we call “normal typicality” and can be summarized as follows: For a “typical” finite family of commuting macroscopic observables, every initial wave function ψ0 from a micro-canonical energy shell so evolves that for most times t in the long run, the joint probability distribution of these observables obtained from ψ is close to.. From personalised medicine to big data and social media, these platforms facilitate new kinds of interactions, challenge longstanding understandings of privacy and consent, and raise fundamental questions about how the translational patient pathway should be organised.This editorial introduces the cross-journal article collection "Translation in healthcare: ethical, legal, and social implications", briefly outlining the genesis of (...) the collection in the 2015 Translation in healthcare conference in Oxford, UK and providing an introduction to the contemporary ethical challenges of translational research in biology and medicine accompanied by a summary of the papers included in this collection. Responses to my article on Dawkins and God have fallen into two classes: those that challenge my criticism of Dawkins’ atheism, and those that challenge my criticism of the morality on display in some Bible stories. I will briefly respond to those in the first class, and then those in the second class. P. J. Moss suggests I am attracted to “the Cartesian notion of mind body dualism,” and do not have regard to “the work of those philosophers of (...) mind who … see the task of the philosopher as posing the problem into a precise enough form so that it admits of scientific resolution;” and he commends the work of John Searle. I am indeed attracted to a kind of dualism. However, it is not the Cartesian dualism of “two distinct realms” rejected by Searle, but rather a dualism that accepts, as Searle does, that there are two categories of empirical reality, subjective and objective, which are mutually irreducible The Rediscovery of the Mind, pp19, 98), and that there are features of subjective reality that cannot be fully understood in terms of objective reality. In a major work published in 2001, Rationality in Action, Searle even leaves open as a reasonable possibility a view I support, namely that consciousness may be able to cause things that cannot be fully explained by the causal behaviour of neurons, and he also supports a non Humean notion of the self, as an entity that can, as a whole, consciously try to do things: see my review in Journal of Consciousness Studies 9, 92 94. In any event, my argument against Dawkins does not depend on acceptance of dualism, just on the undoubted fact that science does not yet have the first idea what objective features are necessary and sufficient to give rise to subjectivity. Robert McLaughlin makes out a reasoned case against my three suggested errors in Dawkins. It would take a book to deal fully with points of the kind he raises, but I have to be brief here. (shrink)

Review of Oksala's 2016 Feminist Experiences: Foucauldian and Phenomenological Investigations.

The current use of citation-based metrics to evaluate the research output of individual researchers is highly discriminatory because they are uniformly applied to authors of single-author articles as well as contributors of multi-author papers. In the latter case, these quantitative measures are counted, as if each contributor were the single author of the full article. In this way, each and every contributor is assigned the full impact-factor score and all the citations that the article has received. This has (...) a multiplication effect on each contributor's citation-based evaluative metrics of multi-author articles, because the more contributors an article has, the more undeserved credit is assigned to each of them. In this paper, I argue that this unfair system could be made fairer by requesting the contributors of multi-author articles to describe the nature of their contribution, and to assign a numerical value to their degree of relative contribution. In this way, we could create a contribution-specific index of each contributor for each citation metric. This would be a strong disincentive against honorary authorship and publication cartels, because it would transform the current win-win strategy of accepting honorary authors in the byline into a zero-sum game for each contributor. Harmonic Resonance Theory: An alternative to the "Neuron Doctrine" paradigm of neurocomputation to address the Gestalt properties of perception.

In societies of high legal culture, criminal law is regarded as a protective and repressive measure of the state, as an imperative of crime and inevitable punishment (as a strict rule). Therefore, the article attempts to show the fact that the entirety of the provisions and norms of criminal law, consolidated in a modern democratic state under the rule of law (or, at least, a state that is attempting to become such a state), allows for the assertion that the (...) purpose of criminal law is coordination or, at least, the balance of the interests of conflicting subjects—the victim and the culprit, the culprit and the state. Thus, by means of criminal law, one can try to attain legal concord in seemingly irreconcilable situations. The reality of such striving is confirmed by court practice and statistics in criminal justice. The article analyses the origin of the reconciliation function, essentially a new aspect of criminal law. A position is formed that the fundamentals of such a function of criminal law are “laid” by the provisions of the Preamble to the Constitution of the Republic of Lithuania that the striving of the Nation is an open, just and harmonious civil society and a state under the rule of law. For the implementation of these provisions, one makes use of the possibilities of penal law-making and respectively corrects the penal policy. (shrink)

The paper is a translation of an article by D. Prole which examines the difference and the resemblance of the phenomenological project and the early avant-garde movements. Responding to the crisis of the classical in the realms of aesthetics and strict philosophy both phenomena strive for authenticity, approaching it each in their own way: the Dadaists and the Expressionists fundamentally reject all the rationality and oppose academicism, while phenomenologists do not dispute the academic tone of philosophizing, even when they (...) go beyond the Husserlian methodology. Phenomenology absorbs the classical spirit and places it at the heart of modern philosophizing. Exploring the kindship of phenomenology with the early avant-garde, the author focuses on the concept of neutralization, which replaced the concept of negation in the 20th century. Turning to the understanding of neutralization by Husserl, Heidegger, Sartre, Adorno, the author shows that both in the field of the free artistic experiment and within the framework of the strict philosophical discourse, neutralization enables contemporary subjectivity to present itself as a distant individuality. The preface to the translation discusses the possibility of placing phenomenology in a situation of dialogue with the theories and practices of the Russian avant-garde. The similarity of two approaches is evidenced by the examples of the Russian avant-gardists’ appeal to the tradition and their sensory approach to the experience of reality. (shrink)

There are some problems in the implementation of rulings of the Constitutional Court. The legislator should make more efforts for implementing the concept of the provisions of the Constitution provided in the reasoning parts of rulings of the Constitutional Court. The Statute of the Seimas should be supplemented with provisions obligating structural sub-units of the Seimas to carry out permanent and systemic analysis of reasoning parts of rulings of the Constitutional Court. It would allow timely to prepare proposals how to (...) amend still unchallenged legal regulation which, however, from the constitutional standpoint is doubtful. One should consider whether the norm of Item 4 of Paragraph 1 of Article 64 of the Law on the Constitutional Court, which allows one to challenge the compliance of a legal act with the Constitution on the grounds of the procedure for adoption regardless of any terms expired after the adoption of a law or other legal act, should be amended. It is to be presumed that the principles of legal certainty and legal security entrenched in the Constitution, as well as other constitutional provisions, imply a certain reasonable period of time within which the subjects provided for in the Constitution may apply to the Constitutional Court with a petition requesting to investigate whether a law or other legal act is not in conflict with the Constitution according to the procedure of their adoption. This period of time should not be a long one, for example, half a year or a year since the official publishing of the law; this term should be a prescriptive one–after it has finished, it would not be allowed to challenge the compliance of a law or other legal act with the Constitution according to the procedure of their adoption. In order to speed up the consideration of cases at the Constitutional Court, one would have to change the procedure of consideration of cases in this Court in essence. (shrink)
