From the 1990s until just before his death, the legendary art critic and philosopher Arthur C. Danto carried out extended conversations about contemporary art with the prominent Italian critic Demetrio Paparoni. In this article, I examine whether the concept of testimony can be used in order to clarify the epistemological value of literary fiction. It seems that it cannot: a testimony can be wrong while it makes no sense to say that a literary fiction can be wrong. However, in the wake of a hermeneutic philosophy, the fictional story has often been qualified as a testimony of an experience, even in cases which are not merely autobiographical. I try to unravel this (...) paradoxical connection between literary fiction and testimony. Starting from an examination of Kafka’s short story “Metamorphosis”, I intend to articulate the distinction between literary fiction and testimony, on the one hand and on the other, to understand the importance of the perspective of the witness in literary fiction. Baumgarten war im Jahr seiner bei Franz v. Liszt verteidigten Dissertation nach Genf berufen worden und lehrte in Köln, Basel, Frankfurt/M. und Berlin. Von der dreiteiligen "Wissenschaft vom Recht" urteilte Albrecht Mendelssohn Bartholdy im "Archiv des öffentlichen Rechts", hier sei die Jurisprudenz auf Philosophie gegründet, und die Lehre Baumgartens werde neben Stammler und Nelson die (...) stärkste Wirkung aufs Rechtsdenken gewinnen. Mit seinen philosophischen Schriften wurde Baumgarten, beeinflusst von James und Dewey, in den zwanziger und dreißiger Jahren des vergangenen Jahrhunderts ein Vordenker des sozialliberalen Pragmatismus in der deutschen Philosophie und nahm deren Hinwendung zur angloamerikanischen philosophischen Tradition um Jahrzehnte vorweg. 1933 erklärte er, unterm NS-Regime nicht Rechtwissenschaft lehren zu können, und ging von Frankfurt in die Schweizer Emigration. Die Erfahrung von Faschismus und Krieg führte ihn in der Mitte der vierziger Jahre zu sozialistischen Überzeugungen und Erwartungen und zur Marxschen sozialwissenschaftlichen Methode, so dass er, nach Frankfurt nicht zurückberufen, gleich anderen antifaschistischen Intellektuellen in die Ostzone und spätere DDR zog. Gerd Irrlitz behandelt die Hauptwerke und die marxistisch orientierten Texte Baumgartens – wie überhaupt die sozialliberale und die späte sozialistische Periode – nicht als Gegensätze, sondern als aufeinander bezogene und einander bedingende Konzepte, überzeugt, dass das Werk des Rechtsphilosophen unterm Erfordernis der Erneuerung des sozialen Liberalismus in der hochindustriellen Zivilisation neue Aktualität gewinnen kann. Description logics are a family of knowledge representation formalisms that are descended from semantic networks and frames via the system Kl-one. During the last decade, it has been shown that the important reasoning problems (like subsumption and satisfiability) in a great variety of description logics can be decided using tableau-like algorithms. This is not very surprising since description logics have turned out to be closely related to propositional modal logics and logics of programs (such as propositional dynamic logic), for which (...) tableau procedures have been quite successful.Nevertheless, due to different underlying institutions and applications, most description logics differ significantly from run-of-the-mill modal and program logics. Consequently, the research on tableau algorithms in description logics led to new techniques and results, which are, however, also of interest for modal logicians. In this article, we will focus on three features that play an important rôle in description logics (number restrictions, terminological axioms, and role constructors), and show how they can be taken into account by tableau algorithms. Companies often benefit from others’ attributions of moral conviction for prosocial behavior, for example, attributions that a company has a sincere moral desire to improve the environment when behaving sustainably. Across four studies, we explored how organizations’ changing resource positions influenced people’s attributions for the motivations underlying prosocial organizational behaviors. Observers attributed less moral conviction following prosocial behavior when they believed an organization was losing economic resources. This effect was primarily a “penalty” assessed against organizations that were losing resources, as (...) opposed to a “reward” given to organizations gaining resources. Finally, we found that this effect occurred because people perceive organizations that are losing resources as more situationally constrained, leading them to attribute less dispositional moral conviction. We discuss theoretical and practical implications stemming from how changes in resource access can lead people to be more skeptical of organizations’ motivations following prosocial behavior.
