We present a computational model of dialectical argumentation that could serve as a basis for legal reasoning. The legal domain is an instance of a domain in which knowledge is incomplete, uncertain, and inconsistent. Argumentation is well suited for reasoning in such weak theory domains. We model argument both as information structure, i.e., argument units connecting claims with supporting data, and as dialectical process, i.e., an alternating series of moves by opposing sides. Our model includes burden of proof as a (...) key element, indicating what level of support must be achieved by one side to win the argument. Burden of proof acts as move filter, turntaking mechanism, and termination criterion, eventually determining the winner of an argument. Our model has been implemented in a computer program. We demonstrate the model by considering program output for two examples previously discussed in the artificial intelligence and legal reasoning literature. (shrink)

The interview reconstructs Jeffrey Schnapp's brilliant career from his origins as a scholar of Dante and the Middle Ages to his current multiple interdisciplinary interests. Among other things, Schnapp deals with knowledge design, media history and theory, history of the book, the future of archives, museums, and libraries. The main themes of the interview concern the relationships between technology and pedagogy, the future of reading, and artificial intelligence.

Collective Intelligence, the book in French, that Pierre Levy wrote before the existence of the worldwide web, when only the Internet existed, it's a philosophical vision of the future, a philosophical vision of what could be a global civilization based on the digital and the general interconnection of all the computers. In the interview, Levy addresses the creation o the WWW by Tim Berners Lee as a form of collective intelligence. He then discusses Berners Lee's proposal for a reform of (...) the WWW to avoid its confiscation by the big platforms, such as Google, Facebook, and Amazon. Then, he introduces his most recent project the IELM as a tool for semantic metadata and a code between the natural languages and the algorithms, and all the apparatus of computations. (shrink)

This book gathers together for the first time an important body of texts written between 1672 and 1686 by the great German philosopher and polymath Gottfried Leibniz. These writings, most of them previously untranslated, represent Leibniz's sustained attempt on a problem whose solution was crucial to the development of his thought, that of the composition of the continuum. The volume begins with excerpts from Leibniz's Paris writings, in which he tackles such problems as whether the infinite division of matter entails (...) perfect points, whether matter and space can be regarded as true wholes, whether motion is truly continuous, and the nature of body and substance. Comprising the second section is Pacidius Philalethi, Leibniz's brilliant dialogue of late 1676 on the problem of the continuity of motion. In the selections of the final section, from his Hanover writings of 1677-1686, Leibniz abandons his earlier transcreationism and atomism in favor of the theory of corporeal substance, where the reality of body and motion is founded in substantial form or force.Leibniz's texts (one in French, the rest in Latin) are presented with facing-page English translations, together with an introduction, notes, appendixes containing related excerpts from earlier works by Leibniz and his predecessors, and a valuable glossary detailing important terms and their translations. The research project described in this report represents one of the most extensive studies of character education ever undertaken, including over 10,000 students and 255 teachers in schools across England, Scotland, Northern Ireland and Wales. Research techniques consisted of a mixture of surveys, moral dilemmas and semi-structured interviews. There is an apparent ambiguity in Thomas Hobbes’s account in Leviathan1 of the source of the sovereign’s right to punish. Hobbes appears to both claim and deny that the prospective sovereign is granted the right to punish by prospective subjects. In claiming that the sovereign is granted the right to punish, we understand Hobbes to hold that the acquisition of the right follows from authorization—a process by which a representative is commissioned to act on the behalf of another person. In (...) denying that the sovereign is granted the right to punish, we understand Hobbes to hold that the possession of the right is merely the product of the mass relinquishment of natural rights; the prospective sovereign alone does .. This paper has a threefold purpose: first, to criticize the customary application of Hohfeld’s theory of rights to Hobbes’s juridical/political theory that reduces all Hobbesian rights to Hohfeldian privileges; second, to defend the appropriateness of a proper application of a Hohfeldian analysis of rights to Hobbes’s theory by responding to criticisms offered by Eleanor Curran; and, lastly, to reveal the value a Hohfeldian analysis offers in clarifying a Hobbesian right that has been generally misunderstood in the literature. I argue that (...) a Hohfeldian analysis helps make sense of the complex juridical relationships between the sovereign, the perpetrator of crime, and the victim of crime involved in Hobbes’s treatment of the sovereign’s right to punish.
