This Element examines Kant's innovative account of labour in his political philosophy and develops an intersectional analysis of Kant. By demonstrating that Kant's analysis of slavery, citizenship, and sex developed in inter-linked ways over several decades, culminating in his development of a 'trichotomy' of Right, the author shows that Kant's normative account of independence is configured through his theory of labour, and is continuous with his anthropological accounts of race and gender, providing a systemic justification for the dependency of women (...) and non-whites embedded in his philosophy of right. By examining Kant's arguments about slavery as intertwined with his account of domestic labour, the author argues that his ultimate rejection of slavery may owe more to his changing conceptualization of labour than to his theory of race, and that his final arguments against slavery rehearse strategies for embedding intersectional patterns of domestic dependence in his account of the rightful state. The Conventionality of Simultaneity espoused by Reichenbach, Grunbaum, Edwards, and Winnie is herein extended to mechanics and electrodynamics. The extension is seen to be a special case of a generally covariant formulation of physics, and therefore consistent with Special Relativity as the geometry of flat space-time. Many of the quantities of classical physics, such as mass, charge density, and force, are found to be synchronization dependent in this formulation and, therefore, in Reichenbach's terminology, "metrogenic." Pascoe, David The notion of stewardship is an emerging reality in the Catholic Church,1 albeit somewhat confined to some Western localities, particularly the USA, and also developing in the Australian context. While the notion is not new to the wider Christian Church, there remain questions as to the theological foundation for stewardship as a principle of Christian living in its Catholic context. There is, for example, a question of how stewardship is a lived reality for the people who are the (...) Catholic Church, when stewardship is understood as giving expression to the nature and mission of the church. If, as the Second Vatican Council teaches, the one sole purpose of the church is 'that the kingdom of God may come and the salvation of the human race may be accomplished' (GS 45), how does stewardship play a part in accomplishing this purpose? And, perhaps more importantly, there is the question what is it about stewardship in our time that presents the Church with a renewed impetus to take up its central purpose as noted in Gaudium et spes, with more deliberate vigour? This paper formulates a response to standard accounts of Kantian sexual morality, by first clarifying why sex should be understood as a case of using a person as a thing, rather than merely as a means. The author argues that Kant’s remedy to this problem is not sexual consent, but a model of setting and sharing sexual ends. Kant’s account of sexual morality, read in this way, is a critical framework for contemporary moves to think beyond consent, and to grapple (...) with concerns about sexual violation and “bad sex” that have gained uptake in the wake of the MeToo movement. The author defends an account of sex as a process of setting and sharing sexual ends in a Kantian key, which provides us with resources for thinking about the robust ongoing project of making our sexual selves in nonideal conditions, as well as for identifying the wrongs of both “bad” sex and sexual harassment. In doing so, they offer a critical middle ground between contemporary accounts of sexual morality that center questions of individual agency or autonomy, and those that foreground the intersubjective nature of sex. The author of handbooks that reflected the Victorian emphasis on bettering one's prospects, Charles Eyre Pascoe addressed the topic of female education in this work of 1879, at a time when the Cambridge colleges of Girton and Newnham were in their infancy. 'Chiefly designed for the use of persons of the upper middle class', the guide aims to assist parents in making informed choices about their daughters' education. The coverage extends from kindergarten through to university, before focusing on career options (...) for women in the late nineteenth century, in fields such as teaching, the arts and medicine. Throughout, Pascoe's recommendations are based on consideration of the breadth of the curriculum, the qualifications of the teaching staff and the results achieved in examinations. We consider a sequence of absolute-space kinematical theories which differ more or less from the special theory of relativity (STR) in the amount of clock retardation which they predict, but which agree with STR with respect to roundtrip light experiments, such as Michelson-Morley and Kennedy-Thorndike. This sequence of theories is imbedded in the synchrony-free formulation of STR developed by Winnie by modifying the equal passage time principle. The paper has bearing on the relationship between the slow clock transport behavior of (...) clocks and the one-way velocity of light. Experiments which claim to measure the latter are discussed. ABSTRACT. Public discourse about ethics in the COVID-19 pandemic has tended to focus on scarcity of resources and the protection of civil liberties. We show how these preoccupations reflect an established disaster imaginary that orients the ethics of response. In this paper, we argue that pandemic ethics should instead be oriented through a relational account of persons as vulnerable vectors embedded in existing networks of care. We argue for the creation of a new disaster imaginary to shape our own understandings (...) of the interrelated social, political, and economic hardships under conditions of social distancing. We develop a pandemic ethics framework rooted in uBuntu and care ethics that makes visible the underlying multidimensional structural inequities of the pandemic, attending to the problems of resource scarcity and inequities in mortality while insisting on a response that surges existing and emergent forms of solidarity. Maiese and Hanna (2019) argue that social institutions shape and transform our embodied minds, and that detrimental and harmful institutions can be reverted in order to promote mentally healthy, authentic, and fulfilling lives. This commentary aims to complement this proposal by understanding the role that narratives and narrative practices play in shaping our embodied minds, by highlighting narrativity’s (1) active, deliberative, and productive functions, and (2) its strong entanglement with embodiment. We will argue that this addition to Maiese and Hanna’s (...) account allows agents to assume a more active role within social institutions by engaging in conscious and deliberative self-narration. This is because, we contend, not only do we understand ourselves and others according to cultural narrative archetypes; we also, crucially, bring about concrete changes in our embodiment and behavior by narrative deliberation and intention formation. As such, self-narration is not only an intellectual endeavor, but can also have profound consequences for how we experience the world; in other words, narrative practices can purposefully alter our affective framing which, in Maiese and Hanna’s account, is fundamental in the process of changing detrimental institutions into constructive, enabling institutions. Although medicolegal challenges to the use of neurologic criteria to declare death in the USA have been well-described, the management of court cases in the United Kingdom about objections to the use of neurologic criteria to declare death has not been explored in the bioethics or medical literature. This article (1) reviews conceptual, medical and legal differences between death by neurologic criteria (DNC) in the United Kingdom and the rest of the world to contextualize medicolegal challenges to DNC; (2) summarizes (...) highly publicized legal cases related to DNC in the United Kingdom, including the nuanced 2022 case of Archie Battersbee, who was transiently considered dead by neurologic criteria, but ultimately determined to be in a vegetative state/unresponsive-wakeful state; and (3) provides an overview of ethical issues raised by medicolegal challenges to DNC in the United Kingdom and a comparison to the management of these challenges in the USA. This article examines Elisabeth of Bohemia's account of the emotions. I argue that Elisabeth's objections against Descartes' ethics, which is often characterized as ‘Neo-Stoic’, show striking similarities to the arguments that the ancient Peripatetics made against classical Stoic approaches. Like the Peripatetics, she challenges the feasibility as well as the desirability of Descartes' ethical injunctions regarding emotional control. In particular, Elisabeth joins the Peripatetics in holding that certain external goods are essential for happiness and that the emotions are necessary for (...) motivating, guiding and correcting action. In aligning Elisabeth's thinking about the emotions with the Aristotelian tradition, I depart from various other interpretations, especially from those who see her position as a precursor of later feminist accounts, or as embodying a distinctively female perspective. In this article, I compare Kant’s and Marx’s analysis of women and domestic labour in their mature political works, and argue that Kant offers more analytic tools for understanding the social and economic role of domestic labour than does Marx. While domestic labour becomes visible to Marx only as it is outsourced, Kant develops a clear account of the specific rules governing domestic labour in the emerging bourgeois household. Because of his commitment to the domestic realm as a core feature (...) of the just state, however, much of Kant’s account of domestic labour should be challenged by contemporary Kantian feminists. Therefore, the ε -generalized Lorentz equations derived by Winnie are the equations governing accelerated systems. The ε -generalized equation for time is used in analyzing two cases of the clock paradox: (1) the case in which a clock travels in a straight line, stops, and returns, and (2) the case in which a clock travels with uniform velocity in a circular path. Gertrude Stein may be regarded as one of the most innovative and obscure modernist writers. At the core of Tender Buttons (1914), her most experimental work, lies a dialectical tension between meaning and non-meaning, order and disorder, the opacity of which some of the earliest critical studies of Stein described as both “an eloquent mistake” and “the ravings of a lunatic,” resisting interpretation. In this paper, I show that phenomenology offers an appropriate tool for opening up the much-discussed dialectic of (...) this work. By “bracketing” the hard facts of our object-world, Stein enacts an epoché of sorts, allowing us to “see fine substances strangely” before the conventional structures of objectivity and factuality take over. After a consideration of Reichenbach's and Winnie's axiomatizations of Special Relativity, three synchrony-free axioms which can be used to simultaneously axiomatize Special Relativity, Classical Aether Theory, and a threefold continuum of theories in between are suggested. The specific theory obtained from the axioms depends on the value of a parameter in each axiom. It is shown that the values of the three parameters are empirically determined by the Michelson-Morley, Kennedy-Thorndike, and Ives-Stilwell experiments.

This article explores the early history of Roman exemplary literature through the case study of the elder Cato’s account of his imitation of the parsimony and self-sufficiency of M’. Curius Dentatus. I reconstruct from Cicero, Plutarch, and other sources a Catonian prose text that unified the exemplary narrative of Curius’ refusal of a bribe from Samnite emissaries with an evocative location at the hearth of a humble Sabine farmstead, an approving “audience” in Cato himself, and a model for the replication (...) of Curius’ virtue. The narrative itself served as the monumentum for the exemplum, and its details are often evoked in place of the exemplary deed itself. I argue that this narrative is both a very early instance of exemplary literature and a self-conscious reflection on the power of literature to transcend temporal and spatial limitations and to extend cultural models for the familial replication of elite virtues to a broader audience. In this essay, I draw on Kant’s legal philosophy in order to defend the right to voluntary motherhood by way of abortion at any stage of pregnancy as an essential feature of women’s basic rights. By developing the distinction between innate and acquired right in Kant’s legal philosophy, I argue that the viability standard in US law (as established in Planned Parenthood v. Casey) misunderstands the nature of embodied right. Our body is the site of innate right; it is the (...) means through which we can set and pursue ends in the world. The law, therefore, cannot adjudicate the relationship between the will and the body: it cannot require us to allow our bodies to be used against our will. By comparing unwanted pregnancy to sexual assault, I problematize the notion that consent to pregnancy, like consent to sex, can ever be conclusive. I examine Kant’s own account of unwanted pregnancy, in which he describes mother and child finding themselves “in a state of nature” in order to rethink the status of the fetus in law, and I argue that we should understand the fetus’s right to life as provisional, rather than as enforceable by law. At face value, these quotes from three generations of Australian mothers imply a trajectory of shifting understandings of care, work, gender, and subjectivity, with women’s self-identity increasingly associated with paid work outside the home. Each of these women positions herself in relation to the dominant gender culture at the time she experienced matrescence.2 Marjorie, who had her children in the 1950s, characterizes herself as “the little wife” and recalls being contented with her role as a stay-at-home mother. Sally, who became a mother in the late 1970s, remembers wanting to believe that “women can do it all” without sacrificing family or career, but she experienced this radical ideal as conflicted at both a cultural and personal level. Ariana, a twenty-first-century mother, feels ambivalent about sending her children to childcare, but had always assumed that she would combine paid work with mothering. Despite this seemingly linear progression from a female identity centered on mothering to one focused on paid work, I argue that closer attention to these maternal narratives reveals that changing gender discourses were experienced as riven with internal contradictions by individual mothers. Drawing on a new collection of fifty-six oral history interviews co-created with Australian women about their experiences of becoming mothers, I will analyze the ways in which changing cultural understandings of selfhood, work, care, and gender have played out in the lives of mothers from 1945 to the present. When I started this project, I envisaged it partially as a history of my grandmother’s, my mother’s, and my own maternal generations. This article explores the dynamics of the discourse and practice of corporate social responsibility (CSR) in France to illustrate the interplay between endogenous and exogenous factors in the development of CSR in a country. It shows how the cultural, socioeconomic, and legal traditions influence the way ideas are raised, the kinds of questions considered relevant, and the sorts of solutions conceived as desirable and possible. Furthermore, the article traces how expectations and practices evolve as a result of various social and (...) economic factors within a country, and increasingly, as a result of global influences such as the international academic discourse, the international practices of multinational companies, nongovernmental organizations and trade unions, and initiatives of supranational organizations. The article closes with reflections about what can be learned from the French experience with CSR and how to stimulate such cross-border learning. (shrink)

Although death by neurologic criteria is legally recognized throughout the United States, state laws and clinical practice vary concerning three key issues: the medical standards used to determine death by neurologic criteria, management of family objections before determination of death by neurologic criteria, and management of religious objections to declaration of death by neurologic criteria. The American Academy of Neurology and other medical stakeholder organizations involved in the determination of death by neurologic criteria have undertaken concerted action to address variation (...) in clinical practice in order to ensure the integrity of brain death determination. To complement this effort, state policymakers must revise legislation on the use of neurologic criteria to declare death. We review the legal history and current laws regarding neurologic criteria to declare death and offer proposed revisions to the Uniform Determination of Death Act and the rationale for these recommendations. Since the 90’s, neurolaw is on the rise. At the heart of heated debates lies the recurrent theme of a neuro-revolution of criminal responsibility. However, caution should be observed: the alleged foundations of criminal responsibility (amongst which free will) are often inaccurate and the relative imperviousness of its real foundations to scientific facts often underestimated. Neuroscientific findings may impact on social institutions, but only insofar as they also engage in a political justification of the changes being called for, convince populations, (...) and take into consideration the ensuing consequences. Moreover, the many limits of neuroscientific tools call for increased vigilance when, if ever, using neuroscientific evidence in a courtroom. In this article, we aim at setting the basis for future sound debates on the contribution of neuroscience to criminal law, and in particular to the assessment of criminal responsibility. As such, we provide analytical tools to grasp the political and normative nature of criminal responsibility and review the current or projected use of neuroscience in the law, all the while bearing in mind the highly-publicized question: can neuroscience revolutionize criminal responsibility? Answering this question implicitly requires answering a second question: should neuroscience revolutionize the institution of criminal responsibility? Answering both, in turn, requires drawing the line between science and normativity, revolution and dialogue, fantasies and legitimate hopes. (shrink)

Edmund Beecher Wilson is generally celebrated for his contribution to chromosome theory and genetics, whereas opinion concerning his cytological thinking is often restricted to the idea that he provided evidence for the dominant role of the nucleus. But Wilson's cell theory was much more. It was a child of the German Zellforschung, and its attempt to provide a comprehensive cellular answer to a wide range of biological and physiological questions. Wilson developed a corpuscular, micromeristic and preformistic concept, and treated the (...) cell as an organism subject to ontogenetic and phylogenetic processes. He defended his comprehensive theory even in the 1920's, when cytological research had become specialised and directed at more practical goals. For many of his younger readers this concept might have seemed antiquated, but today many of its features sound surprisingly modern. (shrink)

Differences between men and women in the performance of tests designed to measure spatial abilities are explained by evolutionary psychologists in terms of adaptive design. The Hunter-Gatherer Theory of Spatial Ability suggests that the adoption of a hunter-gatherer lifestyle (assuming a sexual division of labor) created differential selective pressure on the development of spatial skills in men and women and, therefore, cognitive differences between the sexes. Here, we examine a basic spatial skill—wayfinding (the ability to plan routes and navigate a (...) landscape)—in men and women in a natural, real-world setting as a means of testing the proposition that sex-based differences in spatial ability exist outside of the laboratory. Our results indicate that when physical differences are accounted for, men and women with equivalent experience perform equally well at complex navigation tasks in a real-world setting. We conclude that experience, gendered patterns of activity, and self-assessment are contributing factors in producing previously reported differences in spatial ability. (shrink)

There is no doubt that Immanuel Kant has a woman problem. His anthropo-logical studies of women are full of cutting remarks, and despite a generation offeminist Kantian scholarship, it is an open question whether he meant to include women as full, equal agents in either his moral or political philosophy. Those who engage this question within Kant’s political philosophy ask whether or not women can “work their way up” to full, active citizenship. If women can achieve equality in this way, (...) the argument goes, then we can solve Kant’s woman problem. But this approach, I argue, asks the wrong question. It focuses on the status of wives rather than on the structure of the domestic sphere as a whole, and therefore obscures the ways in which the valuation of domestic space and reproductive labor shape access to rights and equality in Kant’s political philosophy. I will argue that this approach misses the deeper structural and gendered inequalities built into Kant’s conception of the state. Re-examining Kant’s “woman problem” points us toward a larger problem with labor and inequality in the Kantian state: Kant’s map of the rightful institutional order normatively requires that someone do the dependency work that makes independence possible. This collective book analyzes seriality as a major phenomenon increasingly connecting audiovisual narratives (cinematic films and television series) in the 20th and 21st centuries. The book historicizes and contextualizes the notion of seriality, combining narratological, aesthetic, industrial, philosophical, and political perspectives, showing how seriality as a paradigm informs media convergence and resides at the core of cinema and television history. By associating theoretical considerations and close readings of specific works, as well as diachronic and synchronic approaches, this volume offers a (...) complex panorama of issues related to seriality including audience engagement, intertextuality and transmediality, cultural legitimacy, authorship, and medium specificity in remakes, adaptations, sequels, and reboots. Written by a team of international scholars, this book highlights a diversity of methodologies that will be of interest to scholars and doctoral students across disciplinary areas such as media studies, film studies, literature, aesthetics, and cultural studies. Whereas evidence-based medicine (EBM) encourages the translation of medical research into decision-making through clinical practice guidelines (CPGs), patient-centred care (PCC) aims to integrate patient values through shared decision-making. In order to successfully integrate EBM and PCC, I propose a method of orienting physician decision-making to overcome the different obligations set out by a formally-rational EBM and substantively-rational ethics of care. I engage with Weber’s concepts “the ethic of responsibility” andverstehenas a new model of clinical reasoning that reformulates the relationship between (...) medical knowledge and social values, while demonstrating the relevance of the classical sociological cannon to contemporary medical humanities. The American Policy Sciences, Complexity and the Crisis of Government: On the Social Embeddedness of Concept Formation in the Social Sciences. By analyzing debates about social “complexity” in the American policy sciences and in intellectual discourse of the 1970s, this article draws attention to the social embeddedness of concept formation and theory building in the social sciences. In the 1970s, a new concept of social “complexity” emerged in the social sciences, when scholars transferred and adapted elements of complexity theory from (...) mathematics, computer science, cybernetics, and general systems theory to refine social theory. The article analyzes the context and conditions in which this transfer occurred. It shows that the scholarly debates about social complexity were entwined with broader public-political discourses, dealing in particular with the challenges of government and public policy in the advanced Western democracies. The discourse on complexity among social scientists had additional layers of meaning: even in academic discourse, “complexity” was also used as a buzzword and as a metaphor. (shrink)

Elvira Basevich, Martin Sticker, and Helga Varden offered generative criticism of my monograph, Kant’s Theory of Labour. In this response, I explore how the resources they offer for thinking about gender, labour, and the state’s responsibility to ensure the material conditions of freedom can deepen both our attentiveness to patterns of systemic injustice in Kant’s political philosophy, and the resources Kant offers for addressing contemporary patterns of intersectional and material injustice.

In “Rethinking Race and Gender in Kant: Toward a Non-Ideal, Intersectional Kant,” Jordan Pascoe argues that Kant’s moral philosophy is productively read through the “non-ideal” lens of the sociopolitical concerns he faced and espoused. This lens in turn offers possibilities for thinking differently about the particular articulation that his formal principles take. She defends a non-ideal, modified methodological approach in which Kant’s problematic conception of race and gender are opportunities for expanding our reflection on Kant’s moral philosophy as a whole.

The rise of Islamic activism in Egypt during the 1970s relied in large part on the production and mass dissemination of religiously oriented periodicals. Islamic social movement organizations ranging from the established al-Gamʿiyya al-Sharʿiyya to the revived Muslim Brotherhood utilized magazines to inform, orient, and mobilize Egyptians while engaging the state directly during Anwar al-Sadat’s ‘Infitah’. By comparing the framing processes within three of the most prominent Islamist periodicals of this period, this article investigates the process by which movement leaders (...) actively constructed the frames around which activists recruited and mobilized supporters. I argue that Islamist magazines attempted to offer historical continuity with prior movements, authenticity in their teaching of religious thought and practice, and a reframing of a political agenda that was traditionally dominated by state institutions. More significantly, by forging a message that attempted to unify all of these elements, these publications aided in the construction of new communities of believers that charted the course for the next era of Islamic activism in Egypt.
