Context Informed consent is crucial in daily clinical practice and research in medicine and psychiatry. A recent neuroethical investigation explored the psychological factors that are crucial in determining whether or not subjects give consent. While cognitive functions have been shown to play a central role, the impact of empathy and emotions on subjects' decisions in informed consent remains unclear. Objective To evaluate the impact of empathy and emotions on subjects' decision in informed consent in an exploratory study. Design Decisional capacity (...) and informed consent to a subsequent imaging study were evaluated with the MacArthur Competence Assessment Tool for Clinical Research (MacCAT-CR). Empathy and emotion recognition were measured with the Multifaceted Empathy Test (MET) and the Florida Affect Battery (FAB). Setting Psychiatric subjects were recruited from a general psychiatric hospital and a forensic state hospital. Patients A mixed group of 98 healthy men and forensic and non-forensic psychiatric subjects were investigated. Results Both empathy (MET) and emotion recognition (FAB) correlated with MacCAT-CR scores. Higher cognitive empathy and good emotion recognition (compared with low empathy and emotion recognition) were associated with increased decisional capacity and higher rates of refusal to give informed consent. Conclusions This study shows an empirical relationship between decision-making and informed consent, on the one hand, and emotions and empathy on the other. While this study is exploratory and preliminary, the findings of a relationship between informed consent, emotions and empathy raise important neuroethical questions with regard to an emotional-social concept of informed consent and potential clinical implications for testing informed consent. This article, corresponding to a part of the restitution of a financed international research project between France, Brazil, Canada, Italy and Belgium, aims to offer a modelisation and qualitative evaluation of mediation care settings based on an original methodological tool that involves identifying the typical games at the foundations of creativity, following a multidisciplinary perspective. Therapeutic mediations are settings or devices organised around a “pliable medium”, often artistic, like painting, modeling, writing, ​and theatre, which are very widespread in institutional practices, (...) both in France and abroad. The scientific objectives of this research consist in a multi-disciplinary exploration (anthropology, criminology, neuroscience, clinical psychology) of the process of creative symbolisation understood as a process of transformation involving play. According to this orientation, play can be defined as a psychic process whereby a subjective experience can be explored with pleasure, and consequently symbolised and appropriated. Our fundamental and original hypothesis is that play is at the source of the creative process, conceived as a work of metabolisation by the psyche of playful experiences during the different stages of life. The review of the understanding of play in psychoanalysis, anthropology, criminology and neuroscience emphasises the richness of this model and the importance of reflecting on the typical games in the field of psychic care. A clinical example of treatment in a pictorial therapeutic mediation setting of a child with psychotic disorders makes it possible to identify a number of typical games as well as the modalities of interpretation of the therapists through play. These multidisciplinary studies lead to the presentation of a general table of typical games, and these first results highlight the richness of identifying typical games in clinical settings. Ultimately, the multidisciplinary approach shows the interest of the model of play in the evaluation of therapeutic mediation settings, with a convergence of the different disciplines emphasising the pertinence of this model. The scientific impact of this research overlaps with its societal impact, through the development of innovative tools for evaluating therapeutic mediations, in order to take account of the evolution of the different forms of social expression of psychic suffering. The ArgumentThe publication of Johannes Kepler's brilliant and revolutionary Astronomia nova has hitherto been viewed as somehow inevitable. This paper argues that, on the contrary, the book's very existence and a measure of its unusual form and content are in fact highly contingent, and derive from a legal dispute between Kepler and Tycho's heirs over the right to capitalize on his astronomical legacy. On Tycho's death, Kepler rather accidentally found himself in charge of Tycho's posthumous astronomical publications, especially the highly (...) prestigious Rudol phine Tables. Tycho's legal heirs, not having been paid by the emperor for Tycho's astronomical assets and feigning Kepler's unworthiness as his successor, wrested this mandate back. Ordered in turn to justify his employment, Kepler contrived the Astronomia nova as an interim announcement of the fruits of his astronomical research. In an effort to block Kepler's continuing exploitation of Tycho's observations, the heirs obtained the legal right to censor his publications, which severely threatened his philosophical freedom. The threat of editorial interference was responsible in part for Astronomia nova's unusual narrative form. (shrink)

I begin by discussing the ways in which a would‐be blamer's own prior conduct towards the person he seeks to blame can undermine his standing to blame her (to call her to account for her wrongdoing). This provides the basis for an examination of a particular kind of ‘bar to trial’ in the criminal law – of ways in which a state or a polity's right to put a defendant on trial can be undermined by the prior misconduct of the (...) state or its officials. The examination of this often neglected legal phenomenon illuminates some central features of the criminal law and the criminal process, and some of the preconditions for the legitimacy of the criminal law in a liberal republic. So, we stick out our neck (...) and formulate the challenges for artificial cognitive systems. These challenges are articulated in terms of a definition of what a cognitive system is: a system that learns from experience and uses its acquired knowledge (both declarative and practical) in a flexible manner to achieve its own goals. Studies of AGL have frequently used training and test stimuli that might provide multiple cues for learning, raising the question what subjects have actually learned. Using a selected subset of studies on humans and non‐human animals, Trotter et al. demonstrate how a meta‐analysis can be used to identify relevant experimental variables, providing a first step in asssessing the relative contribution of design features of grammars as well as of species‐specific effects on AGL.

The Anatomy of Neoplatonism was the crowning achievement of A. C. Lloyd, the distinguished scholar of late ancient philosophy. He offers a rich and authoritative study of this school of thought, which was highly influential not only on subsequent philosophy but also on Christian theology. His discussion ranges over metaphysics, epistemology, logic, and language, and reveals the fundamental structure of Neoplatonist thought; the book is essential reading for all who work in this area. This paper studies the relationship between Argumentation Logic, a recently defined logic based on the study of argumentation in AI, and classical Propositional Logic. In particular, it shows that AL and PL are logically equivalent in that they have the same entailment relation from any given classically consistent theory. This equivalence follows from a correspondence between the non-acceptability of sentences in AL and Natural Deduction proofs of the complement of these sentences. The proof of this equivalence uses a restricted form (...) of ND proofs, where hypotheses in the application of the Reductio of Absurdum inference rule are required to be “relevant” to the absurdity derived in the rule. The paper also discusses how the argumentative re-interpretation of PL could help control the application of ex-falso quodlibet in the presence of inconsistencies. (shrink)

The current legal status and medical ethics of routine or religious penile circumcision of minors is a matter of ongoing controversy in many countries. We focus on the United Kingdom as an illustrative example, giving a detailed analysis of the most recent British Medical Association guidance from 2019. We argue that the guidance paints a confused and conflicting portrait of the law and ethics of the procedure in the UK context, reflecting deeper, unresolved moral and legal tensions surrounding child genital (...) cutting practices more generally. Of particular note is a lack of clarity around how to apply the “best interests” standard—ordinarily associated with time-sensitive proxy decision making regarding therapeutic options for a medically unwell patient—to a parental request for a medically unnecessary surgery to be carried out on the genitalia of a healthy child. Challenges arise in measuring and assigning weights to intended sociocultural or religious/spiritual benefits, and even to health-related prophylactic benefits, and in balancing these against potential physical, functional, and psychosexual risks or harms. Also of concern are apparently inconsistent safeguarding standards being applied to children based on their birth sex categorization or gender of rearing. We identify and discuss recent trends in British and international medical ethics and law, finding gradual movement toward a more unified standard for evaluating the permissibility of surgically modifying healthy children's genitals before they can meaningfully participate in the decision. Is it possible to measure the dispersion of ex ante chances among people, be it gambling, health, or social opportunities? We explore this question and provide some tools, including a statistical test, to evidence the actual dispersion of ex ante chances in various areas, with a focus on chronic diseases. Using the principle of maximum entropy, we derive the distribution of the risk of becoming ill in the global population as well as in the population of affected people. We find (...) that affected people are either at very low risk, like the overwhelming majority of the population, but still were unlucky to become ill, or are at extremely high risk and were bound to become ill. Issues connected to the pair of notions of image and reality have been present in philosophy at least since Plato’s times. The main question that accompanies the mentioned notions concerns the relation between image and reality. Does image present reality adequately, or is it perhaps a sort of falsification? However, this question may have no sense, because, as it is claimed for example by Richard Rorty, there is no possibility to differentiate between image and reality. An interesting exemplification of the (...) mentioned issue is the philosophy of photography, where the question about representation takes the following form: does a photograph (as an image) adequately mirror given reality? The aim of this paper is to present the problem of representationalism and antirepresentationalism, first in the broad philosophical context (based on the example of Rorty’s considerations), and then in the field of the philosophy of photography (based on the example of Barthes’s and Flusser’s reflections). Material Engagement Theory is currently driving a conceptual change in the archaeology of mind. Drawing upon the dictates of enactivism and active externalism, it specifically calls for a radical reconceptualization of mind and material culture. Unpersuaded by the common assumption that cognition is brain-bound, Malafouris argues in favour of a process ontology that situates thinking in action. In granting ontological primacy to material engagement, MET seeks to illuminate the emergence of human ways of thinking through the practical effects of the (...) material world. Considering that this is a characteristic example of a pragmatic take on cognition, this contemporary theoretical platform appears to share a lot with pragmatism. As of late, scholars working at the intersection of philosophy, semiotics, and cognitive science have made important steps towards the rapprochement between pragmatism and externalism. Looking to contribute to this growing corpus of work, the present paper focuses on MET’s relation to the pragmatism of Peirce, Dewey, and Mead. Having elsewhere recognized the overlap and complementarity between Malafouris’ and Peirce’s theories in particular, I developed a pragmatic and enactive theory of cognitive semiotics that is suitably geared to trace the nature, emergence, and evolution of material signs. Therefore, besides noting some obvious historical connections, I hereby aim to establish the theoretical backdrop upon which this composite theory is supposed to function, while also exploring new potential avenues. Given that this cognitive semiotic framework can be seen as a pragmatic extension of Malafouris’ enactivist approach to archaeology, the current paper delves into MET’s theoretical underpinnings, seeking to complement its working hypotheses and concepts with philosophical notions and ideas advanced long ago. This synthesis ultimately concludes with a call for the reconceptualization of ‘representation’ as a heuristic concept. (shrink)

Many researchers believe the tremendous industrial development over the past two centuries is unsustainable because it has led to unintended ecological deterioration. Despite the ever-growing attention sustainable supply-chain management has received, most SSCM research and models look at the consequences, rather than the antecedents or motives of such responsible practices. The few studies that explore corporate motives have remained largely qualitative, and large-scale empirical analyses are scarce. Drawing on multiple theories and combining supply-chain and business ethics literature, we purport that (...) instrumental, relational, and moral motives are behind a firm’s engagement in SSCM practices. Specifically, we examine the links between corporate motives, SSCM practices, and firm performance. Using a sample of 259 supply-chain firms in Germany, we empirically test five hypothesized relationships. Our results reveal that relational and moral motives are key drivers, and that firms exhibiting high levels of moral obligations tend to outperform those primarily driven by amoral considerations. Findings of this study contribute to multiple literatures espousing sustainability management and can help policy makers, stakeholder groups, and scholars develop more robust strategies for encouraging firms to practice SSCM. This work undertakes a normative assessment of the problem of colonization of the habitats of free-roaming (“wild”) animals and proposes a normatively guided institutional solution. The first part of the article identifies the colonial wrongs associated with the colonization of animal habitat. The article contends that the defining injustice of the colonization of animal habitats consists in the violation of the animals’ collective and individual property rights—that is, their “habitat rights.” These rights are grounded in the interest the animals have (...) in their habitat: They depend on it for the fulfilment of their basic needs. It is argued that any institutional solution regulating human-animal relations needs to be appropriately contextualized as a decolonial enterprise. Thus, the article proposes to codify the framework of habitat rights using the existing decolonial policies. A sketch of such a solution based on the native title doctrine is further provided. The main ideas underlying Bauman’s liquid modernity are explained and then extended to incorporate current ideas about complexity and turbulence. This combination is used to argue that although Bauman himself refuses to offer any resolution to the paradoxes of liquid modernity, complexity theory may be useful: in particular the argument that the seemingly chaotic may actually result in some sort of order. The section also points to the ways in which liquid modernity provides a constant reminder of the underside of (...) contemporary existence; vagabonds and waste as well as tourists and flexibility.
