This contribution focuses on legal issues raised by the audiovisual broadcasting of performing arts, which has significantly increased due to the SARS-CoV-2 pandemic. First, we contextualize this practice and briefly present the emergence and evolution of the practice of “filmed theater”, as well as any other form of performances (e.g., concert, ballet, opera) originally conceived for the stage but subsequently diffused through other channels. Secondly, we address the current legal issues that have arisen because of the increase of such practice (...) due to the containment measures taken by government. Two axes are of particular attention: the matter of copyrights and related rights, on the one hand, and the question of public financing, on the other. Concerning intellectual property, audiovisual broadcasting leads to several legal consequences and issues: effectiveness of related rights, emergence of new modes of exploitation and new authors, recognition of the recording as an original work, etc. This new practice is, moreover, likely to disrupt the categories established by public funding legal mechanisms, which are often poorly adapted to hybrid artistic objects. The objective of this part is therefore to analyze the new legal issues raised by the audiovisual distribution of performances. Finally, we go beyond exclusively legal issues to examine the very specificities of performing arts and, more specifically, the possible loss that would result from a fixation of a production on a reproducible medium, making its diffusion possible beyond the stage. Antoine Arnauld and Pierre Nicole were philosophers and theologians associated with Port-Royal Abbey, a centre of the Catholic Jansenist movement in seventeenth-century France. Their enormously influential Logic or the Art of Thinking, which went through five editions in their lifetimes, treats topics in logic, language, theory of knowledge and metaphysics, and also articulates the response of 'heretical' Jansenist Catholicism to orthodox Catholic and Protestant views on grace, free will and the sacraments. In attempting to combine the categorical theory of (...) the proposition with a Cartesian account of knowledge, their Logic represents the classical view of judgment which inspired the modern transformation in logic and semantic theory by Frege, Russell, Wittgenstein and recent philosophers. Attention to internal body sensations is practiced in most meditation traditions. Many traditions state that this practice results in increased awareness of internal body sensations, but scientific studies evaluating this claim are lacking. We predicted that experienced meditators would display performance superior to that of nonmeditators on heartbeat detection, a standard noninvasive measure of resting interoceptive awareness. We compared two groups of meditators (Tibetan Buddhist and Kundalini) to an age- and body mass index-matched group of nonmeditators. Contrary to our prediction, (...) we found no evidence that meditators were superior to nonmeditators in the heartbeat detection task, across several sessions and respiratory modulation conditions. Compared to nonmeditators, however, meditators consistently rated their interoceptive performance as superior and the difficulty of the task as easier. These results provide evidence against the notion that practicing attention to internal body sensations, a core feature of meditation, enhances the ability to sense the heartbeat at rest. (shrink)

Antoine Pecquet wrote in the eighteenth century during the reign of Louis XV. Although he included Pascal among those he admired, he considered Alexander Pope his true mentor. In Part 1 of "Diverse Thoughts on Man," Pecquet reflects on Man's responsibilities as an individual: in Part 2, on Man's responsibilities as a member of society. Among these responsibilities he includes human and social concerns, such as parental and filial obligations, and the transfer of wealth between generations. In the tradition (...) of Montaigne, Pecquet intended his "Diverse Thoughts on Man" to help his readers learn more about themselves. Although he felt that those who would profit most from his book were readers who had not greatly pondered about themselves, he believed that every reader could find something of value in it. It is possible to draw upon Marx’s thinking without emphasizing an automatic relationship between an economic ‘base’ and a political ‘superstructure’. The development of capitalism must then be understood as resulting from the ‘conceptual separation’ of the economic and political issues. However, the research that favours this approach fails to provide the tools for a precise and systematic study of the political work which makes this separation possible. For his part, through the development of field theory and the emphasis on (...) the notion of symbolic power, Pierre Bourdieu offers the means to analyse the political work of multiple agents, but he does not formulate a theory of capitalism tailored to his findings. It seems worthwhile to take up and extend some of his proposals to open up avenues of thought in this direction. It is then about considering that different fields coexist, each of which lends itself to a political struggle based on the assertion of symbolic power; each field contributes to a ‘conceptual separation’ of the economic and political issues, which is itself constitutive of capitalism. As a result, production and trade operations seem to be part of a natural and autonomous process. Capital can thus be accumulated without necessitating the direct use of force. The combination of fields can lend itself to certain variations. It always shapes the political structures of accumulation. (shrink)

Dussault Cet article renforce l’objection des dysfonctions bénignes soulevée par Jerome Wakefield contre la théorie biostatistique de Christopher Boorse, en en présentant une version qui prend acte d’une critique importante de l’analyse conceptuelle comme visée pour une théorie de la santé et de la pathologie. Cette objection prend pour cible la considération, par la théorie de Boorse, que la dysfonction de la partie d’un organisme est suffisante pour la pathologie de cet organisme. Situant sa critique dans le (...) cadre méthodologique de l’analyse conceptuelle, Wakefield soutient que cet aspect de la théorie de Boorse pose problème au regard des dysfonctions qui, parce qu’elles sont bénignes, ne sont pas considérées comme pathologiques par la médecine. Je présente une version de l’objection des dysfonctions bénignes intégrant les apports méthodologiques de l’explication philosophique telle que caractérisée par Peter Schwartz. Je fais valoir que sa considération des dysfonctions bénignes comme pathologiques fait échouer la théorie de Boorse à rendre compte de la portée pratique qu’ont les concepts de santé et de pathologie dans la médecine occidentale. This paper discusses Millstein’s criticism of the consensus view formed against selected-effects ecological functions. I argue that Millstein’s defense of coevolution-based selected-effects ecological functions applies to a notion of function as an activity, whereas proponents of the consensus view are concerned with a notion of ecological function as the contribution of an organism, population, species, or abiotic item to the maintenance of its community and/or the functioning of its ecosystem. Millstein’s arguments hence do not invalidate the consensus view but draw (...) attention to a notion of function that has been neglected in philosophical discussions and that deserves more attention. This paper reinforces the current consensus against the applicability of the selected effect theory of function in ecology. It does so by presenting an argument which, in contrast with the usual argument invoked in support of this consensus, is not based on claims about whether ecosystems are customary units of natural selection. Instead, the argument developed here is based on observations about the use of the function concept in functional ecology, and more specifically, research into the relationship between biodiversity and (...) ecosystem functioning. It is argued that a selected effect account of ecological functions is made implausible by the fact that it would conflict with important aspects of the understanding of function and ecosystem functional organization which underpins functional ecology’s research program. Specifically, it would conflict with (1) Functional ecology’s adoption of a context-based understanding of function and its aim to study the functional equivalence between phylogenetically-divergent organisms; (2) Functional ecology’s attribution to ecosystems of a lower degree of part-whole integration than the one found in paradigm individual organisms; and (3) Functional ecology’s adoption of a physiological or metabolic perspective on ecosystems rather than an evolutionary one. The capacity to stabilize the content of attention over time varies among individuals, and its impairment is a hallmark of several mental illnesses. Impairments in sustained attention in patients with attention disorders have been associated with increased trial-to-trial variability in reaction time and event-related potential deficits during attention tasks. At present, it is unclear whether the ability to sustain attention and its underlying brain circuitry are transformable through training. Here, we show, with dichotic listening task performance and electroencephalography, that training (...) attention, as cultivated by meditation, can improve the ability to sustain atten- tion. Three months of intensive meditation training reduced variability in attentional processing of target tones, as indicated by both enhanced theta-band phase consistency of oscillatory neural responses over anterior brain areas and reduced reaction time variability. Furthermore, those individuals who showed the greatest increase in neural response consistency showed the largest decrease in behav- ioral response variability. Notably, we also observed reduced variability in neural processing, in particular in low-frequency bands, regardless of whether the deviant tone was attended or unattended. Focused attention meditation may thus affect both distracter and target processing, perhaps by enhancing entrainment of neuronal oscillations to sensory input rhythms, a mechanism important for controlling the content of attention. These novel findings highlight the mechanisms underlying focused attention meditation and support the notion that mental training can significantly affect attention and brain function. (shrink)

The writings by the 'state philosophers' of nineteenth-century France are often seen, either as entirely driven by political or ideological concerns, or reduced to mere history of philosophy. Hence, ironically, those who established the philosophical canon that still now informs philosophy teaching in France were themselves excluded from that canon. Using the heuristic concept of a philosophical figure, this contribution intends to show how, for these philosophers, historiography represented a seemingly inoffensive, but in reality extremely efficient, means of searching out (...) philosophical alternatives to the institutionally dominant philosophy of Victor Cousin (1792-1867). Focalizing on the almost forgotten case of Joseph-Marie Degérando (1772-1842), I show how he used the philosophical figure of Descartes and how he used it to counter Cousin. (shrink)

For Van Rensselaer Potter (1911–2001), Global Bio-Ethics is about building on the legacy of Aldo Leopold (1887–1948), one of the most notable forest managers of the twentieth century who brought to light the importance of pragmatism in the sciences and showed us a new way to proceed with environmental ethics. Following Richard Huxtable and Jonathan Ives's methodological 'Framework for Empirical Bioethics Research Projects' called 'Mapping, framing, shaping,' published in BMC Medicine Ethics (2019)), we propose operationalizing a framework for Global Bio-Ethics (...) by hybridizing approaches in empirical bioethics and ecosystem management. We explain this framework using the metaphor of forest management. This mixed approach is articulated through three phases: (1) mapping the “landscape” to build a working theory, (2) framing the “scene” to prepare the fieldwork, and (3) shaping bioethics “tools” to stimulate cooperation. Applying this methodology, an adaptive management cycle is outlined to help ensure that political processes are sustainable and socially acceptable, still based on strategic and ethical thinking, but also capable of reshaping failing policies. Background: Even in countries with an opt-out or presumed consent system, relatives have a considerable influence on the post-mortem organ harvesting decision. However, their reflection capacity may be compromised by grief, and they are, therefore, often prone to choose refusal as default option. Quite often, it results in late remorse and dissatisfaction. So, a high-quality reflection support seems critical to enable them to gain a stable position and a long-term peace of mind, and also avoid undue loss of potential grafts. (...) In practice, recent studies have shown that the ethical aspects of reflection are rarely and often poorly discussed with relatives and that no or incomplete guidance is offered. No review of the literature is available to date, although it could be of value to improve the quality of the daily practice. Objectives: The objective was to review and synthesize the main concepts and approaches, theories and practices of ethical reflection support of the relatives or surrogates of potential post-mortem organ donors. Research design: A narrative review was performed in the medical, psychological and ethical fields using PubMed, PsycArticles and Web of Science databases (1980–2020). Results: Out of 150 papers, 25 were finally retained. Four themes were drawn: the moral status of the potential post-mortem organ donor, the principlistic approach with its limits and critics, the narrative approach and the transcendental approach. Discussion: This review suggests an extension of psychological support towards ethical reflection support. The process of helping relatives in their ethical exploration of post-mortem organ donation is psychologically and morally characterized. The need for specialized professionals educated and experienced both in clinical psychology and in health ethics to carry out this task is discussed. Practical impact: This review could contribute to optimize the quality of the ethical reflection support by initiating an evolution from an empirical, partial and individual-dependent support to a more systematized, professionalized and exhaustive support. pAt various junctures in its history, Buddhist thought has adapted in inventive ways to accommodate important ideological features of the new cultural spheres with which it came into contact. The concept of “skill-in-means” (upāya-kauśalya) played an important role in most of these syncretistic developments by facilitating critical reflexivity, doctrinal flexibility, and expositional creativity. It is surprising that a principle that has favored crosscultural dialogue, co-integration, and hybridization throughout Buddhism’s history should elicit little interest amongst contemporary philosophers wishing to syncretize Anglo-American (...) philosophy with precisely those Indian (and Indo-Tibetan) Buddhist philosophical traditions in which skill-in-means qua meta-doctrine features most prominently, that is, the various traditions falling under the broad banner of Madhyamaka. In this paper, I argue that failure to give due consideration to skill-in-means in “fusion philosophy” methodology and hermeneutics is expressive of lingering metaphilosophical parochialism in what ought to be--and may yet become--a more reflective and cosmopolitan field of research. I further argue that paying heed to skill-in-means makes it clear that, if “fusion” with Madhyamaka philosophical traditions really is the goal, then philosophers engaged in this project will have to expand their metaphilosophical horizons such as to respect and accommodate these traditions’ irreducibly therapeutic orientation./p. Recent brain imaging studies using functional magnetic resonance imaging (fMRI) have implicated insula and anterior cingulate cortices in the empathic response to another’s pain. However, virtually nothing is known about the impact of the voluntary generation of compassion on this network. To investigate these questions we assessed brain activity using fMRI while novice and expert meditation practitioners generated a loving-kindness-compassion meditation state. To probe affective reactivity, we presented emotional and neutral sounds during the meditation and comparison periods. Our main hypothesis (...) was that the concern for others cultivated during this form of meditation enhances affective processing, in particular in response to sounds of distress, and that this response to emotional sounds is modulated by the degree of meditation training. The presentation of the emotional sounds was associated with increased pupil diameter and activation of limbic regions (insula and cingulate cortices) during meditation (versus rest). During meditation, activation in insula was greater during presentation of negative sounds than positive or neutral sounds in expert than it was in novice meditators. The strength of activation in insula was also associated with self-reported intensity of the meditation for both groups. These results support the role of the limbic circuitry in emotion sharing. The comparison between meditation vs. rest states between experts and novices also showed increased activation in amygdala, right temporo-parietal junction (TPJ), and right posterior superior temporal sulcus (pSTS) in response to all sounds, suggesting, greater detection of the emotional sounds, and enhanced mentation in response to emotional human vocalizations for experts than novices during meditation. Together these data indicate that the mental expertise to cultivate positive emotion alters the activation of circuitries previously linked to empathy and theory of mind in response to emotional stimuli.. De Dreu and Gross's description of the proximate mechanisms conditioning success in intergroup conflict omits humans' deontological morality. Drawing on research on sacralization and moral objectivism, I show how “moral rigidity” may have evolved through partner selection mechanisms to foster coalitions’ cohesion and combativeness in intergroup conflict.

A fundamental question in the field of consciousness is how and why physical processes in the brain give rise to consciousness, a problem named the ‘hard problem of consciousness’ by David Chalmers. Despite numerous studies, neuroscience has yet to agree on a single account that addresses the hard problem of consciousness. Here, I introduce the energy-information generation (EIG) theory to answer this problem. The EIG theory posits that consciousness emerges when a neuron generates an EM field which represents the information (...) encoded in the neuron through its energy via numerous neural mechanisms. This paper explains how the mechanisms that allow neurons to store information about the environment can control the energy of the electromagnetic field of neurons through their impact on dendritic spikes during rhythmic synchronized activity. This theory proposes an answer to the hard problem of consciousness and could serve as a framework for future neuroscience research. (shrink)

According to portfolio managers, agriculture in general, and farmland in particular, can be considered an emerging asset class. Specialized financial vehicles, such as private equity and mutual funds, are emerging and competing to attract potential investment in this asset class. In recent years, there has been significant development of such vehicles targeting South Africa’s farming sector. These innovations are led by a group of market intermediaries who endeavour to “re-shape” South African farmland as an opportunity for institutional investors. These “pioneers” (...) engage in a multifaceted mediation process between global financial investors on one hand, and the South African agricultural sector on the other. Drawing upon an empirical study of such intermediaries in South Africa, this paper analyses the concrete mechanisms that facilitate this particular form of commodification. The paper presents and compares the intermediaries, giving particular attention to their structure, governance mechanisms and asset allocations within this “market in the making”. It describes how intermediaries develop different paths of asset valorization to unlock the “financial value” of South African farmlands. But, it also highlights some of the difficulties faced in the process of translating between international investors and local managers, questioning the “land-asset fiction” that is materializing through the subordination of farmland to the needs of financial society. Scholars have generally followed this injunction and found in history pretty much what they set out to discover. For a long time, the nineteenth century was seen as an age of progress, its own self-image seeming to bear this out. More recently our own concern with decadence has led us to discover similar views in earlier times. After A. E. Carter, 1 Professor Koenraad Swart has given us The Sense o] Decadence in NineteenthJCentury France (The Hague : 1964), the seventh volume to appear in Martinus Nijhoff's International Archives of the History of Ideas. This is a broader chronicle than Carter's. It presents the antecedents of the idea of decadence from antiquity to the French Revolution, its modern forms rooted in a diversity of romantic reactions, its fin-de-si~cle culmination and its (temporary) waning before the brief affirmative revival that preceded World War I. In terms of present preoccupations, this is a timely book. A solid concluding chapter sketches "the foreign perspective," in which French developments appear as part of a broader context. The study provides a mine of information, a convenient companion and counterindicator to Bury's Idea o] Progress. Why, then, is it a dull and unsatisfactory book? In the first place because, having suggested the existence of another dimension to the histoire de grand-papa, the history of ideas cannot be written as, simply, another version of the serial chronicle of events. John Law left a remarkable legacy of economic concepts from a time when economic conceptualization was very much at an embryonic stage. Yet he is best known--and generally dismissed--today as a rake, duellist, and gambler. This intellectual biography offers a new approach to Law, one that shows him to have been a significant economic theorist with a vision that he attempted to implement as policy in early-eighteenth-century Europe. Law's style, marked by a clarity and use of modern terminology, stands out (...) starkly against the turgid prose of many of his contemporaries. His vision of a monetary and financial system was certainly one of a later age, for Law believed in an economy of banknotes and credit where specie had no role to play. Ultimately Law failed as a policy-maker, in part because of the entrenchment of the financiers and their aristocratic backers and in part because of theoretical flaws in his vision. His struggle for power took place against the background of Europe's first major stock boom and collapse. The collapse of the Mississippi System, which he had conceived, and the South Sea Bubble led to a lasting impression of Law as a failure. It is this impression that Antoin Murphy seeks to dispel. Spiritualism designates a philosophy that lays claim to the separation of mind and body and the ontological and epistemological primacy of the former. In France, it is associated with the names of Victor Cousin and René Descartes, or more precisely with what Cousin made of Descartes as the founding father of a brittle rational psychology, closed off from the positive sciences, and as a critic in respect to the empiricist legacy of the idéologues. Moreover, by considering merely the end result, (...) severed from its polemical genesis, we are prevented from understanding how the category of experience constituted a crucial question for spiritualism itself. Through returning to the origin of these discussions in the 1826 preface to Cousin’s Fragments philosophiques, this essay pursues a threefold path: to show that the public birth of Cousinian spiritualism coincides with the affirmation of applying the experimental method, issuing from Bacon, to the study of facts of consciousness; that Cousin’s later evolution follows a process of radicalization—that is, in this context, of ontologization and of reduction; and that by recovering this genesis, we can distinguish many forms of spiritualisms committed to the experimental method, both in alliance with the early Cousin and against the later Cousin. In this way, we can rediscover the interwoven philosophical links, lost in the process of institutionalization, between metaphysical demands and empiricist concerns, or between “French” philosophy and the legacy of Condillac.
