The just war-criterion of legitimate authority – as it is traditionally framed – restricts the right to wage war to state actors. However, agents engaged in violent conflicts are often sub-state or non-state actors. Former liberation movements and their leaders have in the past become internationally recognized as legitimate political forces and legitimate leaders. But what makes it appropriate to consider particular violent non-state actors to legitimate violent agents and others not? This article will examine four criteria, including ‘popular support (...) and representation of a people’; ‘monopoly of violence and effective control over a people’; ‘compliance with international legal and just war standards’; and ‘predisposition to strive for a lasting peace’. It will be shown that out of these four criteria only the first can be defended. Furthermore, it will be illustrated that non-state violent agents may perfectly well satisfy this criterion. In contrast, state actors may clearly fail in this regard. But, it will also become obvious that in exceptional circumstances violent agents do not require explicit approval from the people on whose behalf they act. Finally, the article will argue that – in principle – individuals should be entitled to employ violence for political objectives. (shrink)

ABSTRACT The secondary school system in England has undergone a radical transformation since 2010 with the rapid expansion of independent academies run by private companies (?academy trusts?) and funded directly by central government. This paper examines the development of academies and their predecessors, city technology colleges, and explores the extent and nature of continuity and change. It is argued that processes of layering and policy revision, together with austerity measures arising from economic recession, have resulted in a system-wide change with (...) private, non-profit-making companies, funded by central government, rapidly replacing local authorities as the main providers of secondary school education. Increasingly, nurses conduct scientific inquiry into complex health‐care problems by collaborating on teams with researchers from other highly specialized fields. As cross‐disciplinary research proliferates and becomes institutionalized globally, researchers will increasingly encounter the need to integrate their particular research perspectives within inquiries without sacrificing the potential contributions of their discipline‐specific expertise. The work of the philosopher Bernard Lonergan (1904–1984) offers the necessary philosophical grounding. Here, I defend a role for philosophy in cross‐disciplinary research and present selected ideas in Lonergan's work. (...) These include: (1) a dynamic, normative pattern that each inquirer operates uniquely also forms the common core, or unity, in knowing; (2) the possibility of cross‐disciplinary knowledge development is dependent on each researcher's consciousness of her or his attentiveness, intelligence, reasonableness, and responsibleness; and (3) shifts in researchers' viewpoints, or horizons, facilitate their collaborative inquiry and their grasp of the unity in knowing. The desire to know, shared by team members, drives their inquiry. Lonergan's stance is consistent with nursing values because it respects, but does not unconditionally privilege, any researcher or discipline. Arguments support a claim that Lonergan's perspective is well suited to guide nurse researchers participating on cross‐disciplinary health research teams. (shrink)

The American Medical Association's Code of Ethics prohibits physicians from giving substances they believe are placebos to their patients unless the patient is informed of and agrees to use of the substance. Various questions surround the AMA policy, however. One of these has to do with what should be disclosed. The AMA holds that any treatment that the physician believes is a placebo should be identified as such to the patient. But consider a more restrictive policy that requires physicians to (...) defer to the medical community's consensus view about which treatments have a specific effect on the condition being treated. In light of the ethical goals that the AMA identifies—namely, concerns about patient trust, autonomy, and benefit—there are potential advantages to the more restrictive policy. (shrink)

A new emphasis on diversity and difference is displacing older myths of nation or community. A new attention to gender, race, language or religion is disrupting earlier preoccupations with class. But the welcome extended to heterogeneity can bring with it a disturbing fragmentation and closure. Can we develop a vision of democracy through difference: a politics that neither denies group identities nor capitulates to them? In this volume, Anne Phillips develops the feminist challenge to exclusionary versions of democracy, citizenship (...) and equality. Relating this to the crisis in socialist theory, the growing unease with the pretensions of Enlightenment rationality, and the recent recuperation of liberal democracy as the only viable politics, she builds on debates within feminism to address general questions of difference. When democracies try to wish away group difference and inequality, they fail to meet their egalitarian promise. When yearnings towards an undifferentiated unity become the basis for radical politics and change, too many groups drop out of the picture. Through her critical discussions of recent feminist and socialist theory Anne Phillips rejects this democracy of denial. She also warns, however, of the dangers on the other side. The simpler celebrations of diversity risk freezing group differences as they are, encouraging a patchwork of local identities from which people can speak only to themselves. Her arguments then combine in a powerful restatement of the case for a more active and participatory democracy. It is only through enhanced communication and discussion that people can respect and learn from their differences. (shrink)

The handbook is a partial survey of multiple areas of food ethics: conventional agriculture and alternatives to it; animals; consumption ethics; food justice; food workers; food politics and policy; gender, body image, and healthy eating; and, food, culture and identity. -/- Food ethics, as an academic pursuit, is vast, incorporating work from philosophy as well as anthropology, economics, environmental sciences and other natural sciences, geography, law, and sociology. This Handbook provides a sample of recent philosophical work in food ethics. This (...) philosophical work addresses ethical issues with agricultural production, the structure of the global food system, the ethics of personal food consumption, the ethics of food policy, and cultural understandings of food and eating, among other issues. The work in this Handbook draws on multiple literatures within philosophy, including practical ethics, normative ethics, and political philosophy, as well as drawing on non-philosophical work. Part I considers ethical issues concerning the industrial model of farming that dominates in developed countries, looking most closely at industrial crop farming and its environmental effects. Part II concerns the ethics of animal agriculture. Part III concerns the ethics of consumption: is it morally permissible to consume various products? Part IV concerns justice—including racial, social, and economic justice—in the food system. Part V discusses some ethical and legal issues with specific kinds of food policies, including healthy eating policies, food labeling, and agricultural guest worker programs. Part VI includes four essays taking a critical eye to our public discourse about, and personal experiences of, dieting, healthy eating, and obesity prevention. Two works are attributed to Peter the Philosopher in the manuscripts, an author active in the reign of Manuel I Comnenos. The first, a letter condemning Patriarch Luke Chrysoberges' practice of astrology, highlights the author's attachment to medical knowledge. The second is a peculiar astronomical treatise that mixes Antiochene descriptions of a hemispherical universe with notions of spherical astronomy. Together these works emphasise Peter the Philosopher's attempt at defining boundaries within which one could study the stars. This article offers an (...) analysis of Peter the Philosopher's works in the context of twelfth-century Byzantine scholarship, an edition and translation of the treatise, as well as a translation of the letter. Care workers frequently withdraw from elderly people in their care; this has resulted in a number of scandals in the media. Here I analyze an empirical scene observed at an old people’s home in Denmark, which contains behavioral patterns among the care workers which could be seen as withdrawal. At the same time it illustrates the care workers' commitment to the elderly. A paradoxical "empathy at a distance" is characteristic of the scene. When analyzing my written observations in an interpretation (...) group, my use of language was a point of discussion. What did it mean when I described the interactions between care workers and elderly residents in words commonly used to describe mother-child interactions? My use of language became a "hermeneutical key" which enabled a psychoanalytically inspired interpretation. This focuses on the care relationship as activating our earliest memories of our own care relations, independently of whether we are in the role of care providers or care receivers. Through collusion theory, the interpretation accepts both the anxiety which the helpless elderly people arouse in the care workers and their motivation for care work as two sides of a subjectively important theme. The article illustrates how working consciously with the researcher's subjectivity makes it possible to understand apparently irrational patterns. The insights thus gained may be used to prevent withdrawals in care work as an argument for care workers’ need for emotional supervision. (shrink)

Western science has generally addressed human nature in its most negative aspects-the human potential for violence, the genetic and biochemical bases for selfishness, depression, and anxiety. The starting point of this chapter is the observation that at the global level the climate system is failing to produce the outcomes it was set up to produce and as such is lacking consistency integrity. That is, it is failing to act in accordance with its public institutional justification and the values embodied in it. However, emerging so-called polycentric systems are increasingly successful at addressing the challenges of global climatic change, according to economist Elinor Ostrom. The aim of this (...) chapter is to discuss the possibility of applying the integrity approach to polycentric systems, which comprise a multitude of institutional, corporate and individual agents not all of which have a clear public institutional justification.
