Automatic summarization of legal case judgements, which are known to be long and complex, has traditionally been tried via extractive summarization models. In recent years, generative models including abstractive summarization models and Large language models (LLMs) have gained huge popularity. In this paper, we explore the applicability of such models for legal case judgement summarization. We applied various domain-specific abstractive summarization models and general-domain LLMs as well as extractive summarization models over two sets of legal case judgements – from the (...) United Kingdom (UK) Supreme Court and the Indian Supreme Court – and evaluated the quality of the generated summaries. We also perform experiments on a third dataset of legal documents of a different type – Government reports from the United States. Results show that abstractive summarization models and LLMs generally perform better than the extractive methods as per traditional metrics for evaluating summary quality. However, detailed investigation shows the presence of inconsistencies and hallucinations in the outputs of the generative models, and we explore ways to reduce the hallucinations and inconsistencies in the summaries. Overall, the investigation suggests that further improvements are needed to enhance the reliability of abstractive models and LLMs for legal case judgement summarization. At present, a human-in-the-loop technique is more suitable for performing manual checks to identify inconsistencies in the generated summaries. (shrink)

Summarization of legal case judgement documents is a practical and challenging problem, for which many summarization algorithms of different varieties have been tried. In this work, rather than developing yet another summarization algorithm, we investigate if intelligently ensembling (combining) the outputs of multiple (base) summarization algorithms can lead to better summaries of legal case judgements than any of the base algorithms. Using two datasets of case judgement documents from the Indian Supreme Court, one with extractive gold standard summaries and the (...) other with abstractive gold standard summaries, we apply various ensembling techniques on summaries generated by a wide variety of summarization algorithms. The ensembling methods applied range from simple voting-based methods to ranking-based and graph-based ensembling methods. We show that many of our ensembling methods yield summaries that are better than the summaries produced by any of the individual base algorithms, in terms of ROUGE and METEOR scores. (shrink)

In what follows, I attempt to show that a look at some curious examples of translations from European texts makes us think about issues in translation theory and post-colonial theory from a slightly different angle. The metaphor of translation can very well be employed for understanding the relation between European texts, and some texts and some social and political practices in India in the colonial period, and this in turn helps us look critically at what I shall call our fuzzy (...) post-colonialism. I also argue that Walter Benjamin's metaphor of translation as the after-life of a work can be extended to posit two basic modes of after-life. (shrink)

Resumo: O estudo das ideias de Ibn Taymiyyah sobre o haram e o halal, no Islã, continua a ser relevante para a compreensão da jurisprudência islâmica, da ética, da identidade cultural e das questões contemporâneas. O objetivo do artigo é analisar as obras de Ibn Taymiyyah e identificar seus conceitos mais importantes para a comunidade muçulmana. Os métodos de análise das fatwas escritas por Ibn Taymiyyah e os métodos de interpretação e comparação dos conceitos de proibido e permitido, no Islã, (...) foram usados para atingir o objetivo do estudo. A principal conclusão da pesquisa é que Ibn Taymiyyah era conhecido por suas pesquisas em lei islâmica, teologia e moralidade. Ele tinha visões conservadoras e, devido às suas próprias ideias reformistas, foi repetidamente condenado. Apesar disso, ele criticou os ensinamentos tradicionais sobre o Islã e apoiou a necessidade de reformar alguns aspectos da prática islâmica. Ibn Taymiyyah atribuiu grande importância ao exame do Alcorão e da Sunnah do Profeta Muhammad, a fim de entender o que é proibido e permitido, em várias áreas da vida muçulmana. Ele enfatizou a importância de uma dieta saudável, a necessidade de seguir os princípios islâmicos em questões financeiras e a preservação da dignidade e do comportamento respeitoso, em todos os aspectos da vida. In the modern world, about 1 billion people in Asian and African, partly European and American countries, who in their thinking and daily practice turn to the sacred texts about the Prophet Muhammad, his Sunnah, to find acceptable answers not only to questions of a domestic nature, but also to solve problems related to the sphere of socio-political development, as well as international relations. The purpose of this article is to study rare types of hadith by studying the works of (...) modern and classical theologians of Islam. The novelty of this study is that it attempts a contextual and comparative analysis of rare types of hadith. Aliy is the Hadith in which the number of transmitters in the chain is smaller, and unfortunately it is its antonym. Maukuf is a hadith whose chain reaches the companions, but whether it is speech or action, it does not reach the Prophet. A hadith mursal is a hadith in which the name of a companion is omitted. The hadith of a mushroom is a hadith narrated by one transmitter. The hadith of munkati is a hadith in which there is no transmitter in the chain. Two transmitters are missed in the chain of hadith modal. There are two types of hadith maklub: replacing the location of one transmitter instead of another, and replacing the chain of one hadith with the circuit of another. Other rare types of hadiths have also been studied. The importance of a correct understanding of these catches is emphasized, so as not to get lost in the system of the hadith hierarchy as a whole. Ignorance of the subtleties of hadith studies can lead to unforgivable errors in the interpretation of hadiths. And, unfortunately, extremist sects have become widespread in our age, which misinterpret and mislead hadiths, illustrating the above-mentioned ignorance. (shrink)

Cognitive neuroscience aims to map mental processes onto brain function, which begs the question of what “mental processes” exist and how they relate to the tasks that are used to manipulate and measure them. This topic has been addressed informally in prior work, but we propose that cumulative progress in cognitive neuroscience requires a more systematic approach to representing the mental entities that are being mapped to brain function and the tasks used to manipulate and measure mental processes. We describe (...) a new open collaborative project that aims to provide a knowledge base for cognitive neuroscience, called the Cognitive Atlas, and outline how this project has the potential to drive novel discoveries about both mind and brain. Self-injury is a perilous and increasingly common behavior that is particularly prevalent among youth. Nonetheless, there is a deep-rooted public stigma towards people who self-injure. Consequently, people who engage in self-injury are reluctant to seek professional help or disclose their experiences to others. This article aims to combat stigma and promote help-seeking behavior by debunking the common myths surrounding self-injury in the Malaysian context. Specifically, this article aims to serve as an eye-opener for Malaysian counselors and other mental health professionals (...) to improve their multicultural knowledge, skills, and attitudes when working with those who self-injure. This article challenges scholarly understanding of an 1837 mutiny in the First West India Regiment. In the Anglo-Trinidadian narrative, African-born soldiers acted out of blind rage, failing in their rebellion because they lacked skill with rifles and bayonets and did not understand either the terrain of Trinidad or its location in the Atlantic littoral. This article’s counterargument is that the rebels, led by a former slave-trader, Dâaga, who had been kidnaped by Portuguese traders at either Grand-Popo or Little Popo, was, (...) with other African-born soldiers, well familiar with military weapons and, after time in the Caribbean, the ecosystem, society, and topography of Trinidad. Dâaga aimed at escape from eastern Trinidad for either Tobago or nearby South America, but was thwarted after English officers captured some mutineers, while the soldiers who remained on the run clashed with a mixed-race Spanish-speaking militia on the only road to an east-coast point of escape. Local reports from different international societies have considered the achievement of the successful Glocalized architecture model in line with the 2030 UN Sustainable Development Goals (SDGs). The Aga Khan Cultural Foundation’s International Program for Islamic Architecture has also prioritized the understanding of the success drivers in architectural projects. This study aimed to detect the potentials of the common global indicators to access qualitative design assessment through analyzing the Aga Khan Award’s reports. The selected methodology in the present study is a (...) quantitative approach using the systematic content analysis and coding techniques for qualitative data obtained from the technical. The physical, non-physical, modern, and traditional factors that have contributed to the success of the works as well as their combinations were extracted and analyzed using Sensible and Abstract international, national, and local indications. There is a relative superiority for Sensible indications (A combination of modern and physical factors). The hybrid data distribution provides the ground to assess the works, and this can be used to manage the globalization challenges in the contemporary architecture of Muslim societies. (shrink)

Background: The intensive and critical care units are high-dependency areas, with patients requiring complex care. The intubated status of the intensive and critical care patients makes them dependent on healthcare providers not only for acute care, but also for intimate care, imposing a threat to their dignity. Nurses, being the central care providers, become the stakeholders for dignity promotion. The incorporation of dignity in patient care improves the quality of care, and promotes the health and well-being of intubated patients. Objective: (...) The purpose of the study was to explore nurses’ perceptions about the dignity of intubated patients in the intensive and critical care units. Research design: A qualitative descriptive exploratory study design was used to explore the nurses’ perceptions about the dignity of intubated patients. Participants and research context: The intensive and critical care nurses of a tertiary care hospital were recruited using the purposive sampling technique. The data were collected through in-depth individual interviews, using a semi-structured interview guide. The findings were manually analyzed into themes and categories through content analysis. Ethical consideration: The study was conducted after the approval from the Ethical Review Committee of the Aga Khan University. Findings: Four major themes emerged from the data analysis: (1) two sides of the contemporary nursing practice; (2) benefits of dignified nursing care; (3) challenges to the dignity of intubated patients; and (4) strategies for promoting the dignity of intubated patients. Discussion: Dignity incorporates both the science and the art of nursing. The provision of dignified care is the core component of the quality nursing care and patient well-being in the high-dependency units. Conclusion: This is the first exploratory and descriptive study conducted in Pakistan that explored the nurses’ perceptions about the dignity of intubated patients, and also generated contextual understanding about the phenomenon. Mīr Dāmād, in Qabasāt argues that existence cannot be a real property for essences. If existence, he argues, were a real property of an essence, there would remain no distinction between simple-if and compound-if questions. It is well-known that Mullā Sadrā has given three different accounts in order to explain essence’s being existent: first that existence is an analytical property for essence; second that none of existence or essence is a property of the other one; and third that essence is (...) a property of existence. In this paper, I will argue that the first account would be defeated by Mīr Dāmād’s argument. The second account concedes the conclusion of the argument and then it would be in contrary with Mullasadra’s own view on the reality of existence, unless this account is augmented with the third one. The third account, however, can evade the argument. But it should be noted that the third account is based on Mullasadra’s own view on the reality of existence and the primacy of existence to essence. Keywords: existence, to be existent, simple-if question, compound-if question, property. 1. Introductıon In al-’Ufuq al-Mubīn Mīr Dāmād claims that not all predicates of a subject manifest a real property for that subject. A real property of a subject is something which is superadded to the subject. Examples include a body’s being red or a body’s being above another body. In such cases, the predicates correspond with some feature of the subjects which are not the same as those subjects, in reality. This is opposed to the body’s being itself, for example. In this case, the body itself is not something which is superadded to the body. 2. Mīr dāmād agaınst the realıty of exıstence The controversial example is essence’s being existent. Is the existence of an essence something superadded to the essence? In Mīr Dāmād’s words, is existence a real property for essence? Mīr Dāmād, in Qabasāt argues that existence cannot be a real property for essences. For this end, he notifies that there is a distinction between propositions that is parallel to the distinction between real and non-real properties. If P is a real property for a, then the proposition that a is P is a compound-if proposition. On the other hand, it is a commonplace that the only example of simple-if propositions is one that contains existence as its predicate. Now, he continues, suppose that existence is a real property. Then, the proposition that a exists would become a compound-if proposition. But this contradicts the well-established premise that the proposition that a exists is a simple-if proposition. Consequently, he argues, if existence were a real property of an essence, there would remain no distinction between simple-if and compound-if questions. The major problem that Mīr Dāmād is dealing with is how to explain essence’s being existent. His view is that, in reality, essence’s being existent is nothing but the essence itself. He, then, goes a step forward and claims that existence is nothing in reality. We only have the concept of existence in our minds. With these moves Mīr Dāmād, in some sense, resolves the problem of the relationship between essence and existence, in reality. 3. Mullā sadrā on the relatıonshıp between exıstence and essence It is well-known that Mullā Sadrā, Mīr Dāmād’s pupil, was in disagreement with the teacher with respect to the reality of existence. He believes that existence is a real entity in the world as opposed to essence. So, he should explain how essence is existent. Actually, he has given three different accounts in order to explain essence’s being existent. Mullā Sadrā’s first account is that existence is an analytical property for essence. He defines analytical property as the following: P is an analytic property for a iff a cannot be but not has P. Mullā Sadrā’s second explanation is that none of existence or essence is a property of the other one. His third thesis is that essence is a property of existence. 4. Mullā sadrā v.s. mīr dāmād My major concern in this paper is this problem: which of these three accounts for essence’s being existent offered by Mullā Sadrā can overcome Mīr Dāmād’s seminal argument? The first account would be defeated by Mīr Dāmād’s argument, since, any kind of real property, whether it is analytical or not, are associated with a compound-if proposition. This causes essence’s being existent to be manifested by a compound-if proposition. The second account concedes the conclusion of the argument. As we saw, Mīr Dāmād claims that the conclusion of his argument guarantees that existence is nothing in the world. This cannot be swallowed by Mullā Sadrā whose own view is that existence is real. The third account, however, can evade the argument, insofar as existence is not a property of essence. But it should be noted that the third account is based on Mullasadra’s own view on the reality of existence and the primacy of existence to essence. 5. Concluding remarks If the arguments rendered above are sound, we reach to a criterion in order to interpret Mullā Sadrā’s view on the relationship between existence and essence: his thesis that existence is real is more fundamental than his explanation for the problem of essence’s being existence. Global era is an era of acculturation which may surface difficulties due to the tendency of becoming global chaos that may influence people’s thought. Everyonehas their own views and has made changes with their own worldview perception; hybrid and heterodox. Changes without wisdom will eliminate local elements.This phenomenon has influenced myriad forms of visual composition and architecture of Bali Madya dwelling. Balinese culture has gone through various changes since Rsi Markandeya in the 9th century, Empu Kuturan in the 10th century (...) and Danghyang Nirartha in the 14th century. They changed many dwelling arrangements in architecture. Changes do not mean that one has to demolish the local indigenous elements but, instead, should attempt to develop various indigenous elements with the intention that the visual interior and architectural compositions have their own distinctive characters. In relation to that, aesthetic image and traditional space concept will be arranged in various kinds of acculturation in global visual forms. The dwelling space of Bali Madya concept was acculturated from the Bali Aga’s space concept during the era of Majapahit. This research is based on aesthetic and historical approach that stressed on the artistic aspects and design that are associated with aesthetic appeal. The analysis was done using observations of form and function including the meaning of space composition which was arranged to produce a proportionate composition with local images. (shrink)

Artiklis arendatakse alternatiivset kontseptsiooni niihästi traditsioonilisele füüsikakesksele teadusliku teooria käsitlusele kui ka seisukohale, et füüsikateooriat ei saa teadusfilosoofias mõista teadusliku teooria mudelina, sest erinevates teadustes on teooriad oma loomult erinevad. Ollakse seisukohal, et teaduslik teooria on ikkagi teadusfilosoofia kategooriana teadusliku distsipliini eripärast sõltumatu. Käsitletakse põhiliselt kahte punkti: (1) miks on teadusfilosoofias põhjust kritiseerida traditsioonilist, füüsika põhjal saadud ettekujutust teaduslikust teooriast? (2) miks ei ole põhjendatud seisukoht, et nt keemias on teaduslik teooria (nt klassikaline keemilise struktuuri teooria) oma loomult füüsikateooriast (nt (...) klassikalisest mehhaanikast) erinev? Traditsioonilise füüsikakeskse lähenemisviisi puhul ei ole piisavalt uuritud, miks õieti füüsikateooria on saanud teadusliku teooria etaloniks. Teoreetilise füüsika keskne teadusekontseptsioon on olnud ühekülgselt orienteeritudmatemaatikale ja loogikale. Kui aga lähtuda teooriast kui mudelite populatsioonist, nagu Ronald Giere on seda teinud ka klassikalise mehhaanika - füüsikakeskse teooriakäsituse traditsioonilise näite - korral, siis osutub see teooriakäsitus tõepoolest invariantseks teatavale tunnetustüübile, mida on alust nimetada teaduslikuks ja mis on selgesti omane ka nt keemiale. In this paper an alternative conception is proposed both to (1) the traditional physics-based conception of scientific theory, and (2) the view that a physical theory cannot be regarded as the model for scientific theory in philosophy of science in general because scientific theories are discipline-dependent. It is argued that scientific theory as a category of philosophy of science is independent of a particular scientific discipline. The main focus of the paper is on two questions: (1) Why is the traditional physics-based conception of scientific theory subject to criticism in philosophy of science? (2) Why is it unjustified to consider a scientific theory in chemistry (e.g., the classical chemical structure theory, which is probably the most characteristic theory of chemistry) to be different in character from a physical theory (e.g., classical mechanics, which is a prototypical example of a theory in the philosophy of science)? In case of the traditional physics-based approach not enough research has been done as to why theories of physics have become the etalon of scientific theory. The accepted view of science, centered on theoretical physics, has been one-sidedly oriented towards mathematics and logic. But when proceeding from a conception of a scientific theory as a population of models, as Ronald Giere has done for the case of classical mechanics - the traditional example of a physical theory -, this conception of a theory really does prove the invariance of a certain type of cognition that can justifiably be called scientific and that is clearly characteristic of, e.g., chemistry as well. Muhammed es-Semerkandî'nin (öl. 701/1301) "Risâle fî ḥaḳîḳati’l-‘âlemi’l-kebîr ve’s-ṣağîr/Büyük ve Küçük Âlemin Hakikati Hakkında Bir Risâle" adlı eserini tahkîk etmeyi, müellifin hayatı ve eserin içeriğini incelemeyi amaçlamaktadır. Rükneddin es-Semerkandî'nin müteahhir/geç dönem Mâtürîdî ve Hanefî âlimlerinden biri olduğu; kelâm, tasavvuf, tefsir, fıkıh usulü, hadis ve diğer alanlardaki eserleriyle İslâm medeniyeti tarihinde belirgin izler bıraktığı belirtilmelidir. Semerkandî'nin eserlerinde de görüldüğü gibi o, sûfî kelâmcılardan veya kelâmcı sûfîlerinden biridir. Üslubu, kelâm, tasavvuf ve - zaman zaman geniş anlamıyla - felsefe (...) ile karışık olan bir sentezdir. Bu da şaşırtıcı bir şey değildir. Zira Semerkandî, ilimlerin iç içe geçtiği ve kelâm ile tasavvufun felsefe boyasıyla boyandığı (Gazâlî (öl. 505/1111) ve Fahreddin er-Râzî (öl. 606/1210) sonrası) bir dönemde yaşamıştır. Elimizdeki risâlesi aracılığıyla, Rükneddin es-Semerkandî'nin kelâmcı ve mutasavvıf olmasının yanı sıra felsefeden de etkilendiğini görüyoruz. Zira insan ile büyük âlem arasındaki benzetme veya insan ve âlem arasında bir bağ kurma meselesi, kökleri eski felsefelere dayanan eski bir bakış açısıdır; daha sonra İslâm felsefesi ve İslâm düşüncesi bütünüyle bu felsefî perspektiften etkilenmiş ve insanı küçük bir âlem olarak görmüşlerdir. Rükneddin es-Semerkandî, insanı küçük bir âlem olarak veya kendi ifadesiyle büyük âlemin fihristi olarak gören Müslüman düşünürler veya âlimlerden biridir. Görünüşe göre, müellif bu konuya özel bir ilgi göstermiş ve bu nedenle bu konuda müstakil bir risâle yazmıştır. Söz konusu risâlesini, girişten sonra on iki kısa ve öz bölüm halinde kaleme almıştır. Müellif eserinde, büyük âlem ve küçük âlemin yaratılma amacına - ki bu risâlesini yazma hedefidir - değinmiştir. Ayrıca âlemlerin kısımları, dört kavram "duyu, akıl, kalp ve ruh" ve ruhun en yüce ve en erdemli olduğu, "Allah, Âdem'i kendi suretinde yarattı" hadisinin anlamı, insan ruhunun en üstün/erdemli varlık olduğu, bir mürebbî şeyhin/eğiten hocanın bilmesi gereken ilimler, eğiten hocası olmayan birinin ne yapması gerektiği gibi tasavvufî konuları ele almış; Allah'ın sıfatlarının kısımları, insan, cin ve melek gibi diğer kelamî konuları da işlemiştir. Müellif, risâlesinde konu bağlamında ayetleri ve hadisleri aktarma ve âlimlerin sözlerini nakletme yöntemini izleyerek kendi görüş veya ifadesini belirtmektedir. Müellif genellikle Cüneyd-i Bağdâdî (öl. 297/909) ve Hakîm et-Tirmizî (öl. 320/932) gibi sûfî âlimlerden alıntı yapar, bu da ilmî kaynaklarının - en azından ilgili risâlesi bağlamında - sûfî eserler ve âlimler olduğunu yansıtır. Bu çalışmanın önemi, söz konusu risâlenin ilk kez tahkîk ve incelenmesi yapılıp, risâlenin hâlâ kütüphanelerde el yazması olarak bulunmasında yatmaktadır. Araştırmamız neticesinde, Türkiye kütüphanelerinde bulunan toplam sekiz nüsha tespit edilmiştir.
