A naturalistic theory of rationalization is defended against a fundamental objection. The theory claims that: The rationalizing relation can be fully analysed in causal explanatory terms. However, is rendered problematic by the fact that: Rationalizations exhibit a higher degree of intensionality than ordinary physical causal explanations. To show that can be maintained in the face of , I develop an account of on which and may be reconciled. ;The opening chapter gives an account of the intensionality of ordinary physical causal (...) explanations by developing a counterfactual analysis of causal relevance. Chapter II examines the nature and intensionality of rationalizations. It is argued that despite , a rationalization partly involves a causal relevance relation between its explanans and explanandum. ;In Chapter III, I consider an argument which implies that is false: Davidson's argument that there can be no psychophysical laws. An attempt is made to give a clear and compelling representation of this argument. As I interpret it, the argument depends on the alleged insolubility of the problem of causal deviance in action. ;Chapter IV develops a general theory of deviance according to which any functional system may produce output in a deviant way, and applies this theory to agents. A negative consequence of the theory is that an action may be performed in a deviant way even if the agent's intention causally explains the action . A positive consequence of the theory is that an action is performed in a non-deviant way just in case there is an appropriate causal explanation of why the agent's intention causes him to act. My specific suggestion is that an agent performs an action in a non-deviant way when and only when his intention causes him to act because he "knows how" to act in that way. ;In the last chapter, it is argued that our solution to the problem of deviance can be adapted to account for in causal explanatory terms. This book comprises two long chapters. The first chapter, entitled “The China syndrome, logical form, translation,” is a treatise on linguistic relativism with specific reference to Chinese language. It is not directly related to the title of the book, “Aristotle in China,” except by what it calls “the Aristotelian principle” implied in the “guidance and constraint hypothesis” of linguistic relativism. The writing of this chapter is motivated as a critical response to Angus Graham’s Disputers of the Tao, characterized by (...) Robert Wardy as adhering itself to the “ guidance and constraints hypothesis,” which means that the linguistic structure of a particular language is either guiding or giving constraint to a certain way of philosophical thinking. Chapter 1 traces this position back to B. Worf’s Language, Thought and Reality, which, on the basis of the Hopi language, propounds something similar to the guidance and constraint hypothesis. Then it shows the historical connection of this position to Levi-Bruhl’s Mentalité primitive and Von Humbolt’s monograph Lettre à M. Abel-Rémusat sur la nature des formes grammaticales en générale, et sur le genie de la langue chinois en particulier. For Robert Wardy, this hypothesis could be found also in philosophy of language, for example in Quine’s notion of “radical translation” and Davidson’s critique of it. It is also extended to sinology as in the case of French sinologists such as Granet and Gernet, who were under the influence of Humboldt’s legacy. (shrink)

Donald Davidson has prepared a new edition of his classic 1980 collection of Essays on Actions and Events, including two additional essays. In this seminal investigation of the nature of human action, Davidson argues for an ontology which includes events along with persons and other objects. Certain events are identified and explained as actions when they are viewed as caused and rationalized by reasons; these same events, when described in physical, biological, or physiological terms, may be explained by (...) appeal to natural laws. In this book, Arnold Davidson elaborates a method for considering the history of concepts and the nature of scientific knowledge, a method he calls "historical epistemology." He applies this to the history of sexuality, with consequences for our understanding of desire, abnormality, and sexuality.

In "Amazing Grace," the best-loved of all hymns, John Newton's allusions to the drama of his life tell the story of a youth who was a virtual slave in Sierra Leone before ironically becoming a slave trader himself. Liverpool, his home port, was the center of the most colossal, lucrative, and inhumane slave trade the world has ever known. A gradual spiritual awakening transformed Newton into an ardent evangelist and anti-slavery activist. Influenced by Methodists George Whitefield and John Wesley, Newton (...) became prominent among those favoring a Methodist-style revival in the Church of England. This movement stressed personal conversion, simple worship, emotional enthusiasm, and social justice. While pastoring a poor flock in Olney, he and poet William Cowper produced a hymnal containing such perennial favorites as "Glorious Things of Thee Are Spoken" and "God Moves in a Mysterious Way." Later, while serving a church in London, Newton raised British consciousness on the immorality of the slave trade. The account he gave to Parliament on the atrocities he had witnessed helped William Wilberforce obtain legislation to abolish the slave trade in England. Newton's life story convinced many who are "found" after being "lost" to sing Gospel hymns as they lobbied for civil rights legislation. His close involvement with both capitalism and evangelicalism, the main economic and religious forces of his era, provide a fascinating case study of the relationship of Christians to their social environment. In an afterword on Newtonian Christianity, Phipps explains Newton's critique of Karl Marx's thesis that religious ideals are always the effect of what produces the most profit. Phipps relies on accounts Newton gives in his ship journal, diary, letters, and sermons for this most readable scholarly narrative. (shrink)

This article presents a model of the structure of emotion developed primarily from a consideration of neuropsychological evidence and behavioural data which have bearing on neuropsychological theories. Valence is first considered and highlighted as a defining characteristic of emotion. Next, the use of facial behaviour and autonomic nervous system patterns as defining characteristics of discrete emotions is questioned on empirical and conceptual grounds. The regulation of emotion is considered and proposed to affect the very structure of emotion itself. If there (...) is an invariant pattern of biological activity across different instantiations of the same emotion, it is likely to be found in higher-order associative networks of central nervous system activity, the very same networks that subserve goal-directed behaviour and other cognitive functions. Drawing upon evolutionary considerations, it is argued that what is basic about emotion are the dimensions of approach and withdrawal. The nature of the linkage between such action tendencies and emotion is discussed. (shrink)

Extending the work of Davidson and Worrell, we further investigate the stock market''s reaction to announced corporate illegalities. We examine a sample of 535 announcements of corporate crime and obtain an overall insignificant stock market reaction. However, when the sample is divided by type of crime, we find that the stock market reacts significantly to announcements of bribery, tax evasion, and violations of government contracts. We also find a significantly negative reaction to announcements of corporate crime when the company (...) had been previously accused of other illegal activity. For companies accused of crime in the 1970s, 51% of them were accused again in the 1980s. (shrink)

The subjective experience of schizophrenia, its cause, and its course have been consistent topics of interest within the phenomenological tradition since its inception. After 80 years of study and the efforts of many investigators, however, phenomenological contributions have so far had only a modest impact on current understandings of this disorder. In this article, the author reviews the methodological and theoretical issues involved in the development of a phenomenological approach to understanding schizophrenia. Drawing examples from his own empirical research, the (...) author illustrates the three steps of description, understanding, and explanation required by an application of the phenomenological method to this empirical domain. He then considers obstacles to the acceptance of insights generated through this method by the mainstream psychiatric community. In conclusion, he suggests that the promise offered by a phenomenological approach will most likely be fulfilled when investigators appeal to the phenomenological conviction in intentionality to provide the guidelines for an empirical science of subjective life. The last in a series of examinations, this paper articulates Husserl's mature position on the nature of a phenomenologically informed human science. Falling between the naïve positivity of a naturalistic approach to psychology and the transcendental view of consciousness at the base of phenomenological philosophy, we argue that a human scientific psychology—while not itself transcendental in nature needs to re-arise upon the transcendental ground as an empirical—but no longer transcendentally naïve—discipline through Husserl's notion of the "return to positivity." This notion (...) of the return allows us to avoid "transcendental psychologism," differentiating psychological from transcendental subjectivity but from a transcendental, rather than naïve perspective. In this way, the return to positivity reclaims psychology as a worldly, but no longer naïve, discipline. To facilitate an understanding of the different perspectives in question, and the process of leaving the naturalistic perspective in order to return to it once armed with a transcendental understanding and its associated tools, we continue to develop the illustrative example of anorexia provided in the first part of this series. In conclusion, we discuss the implications of this framework for transcendental reforms both of clinical practice and of psychological research. (shrink)

The adaptive landscape is one of the most widely used metaphors in evolutionary biology. It is created by plotting fitness against phenotypes or genotypes in a given environment. The shape of the landscape is crucial in predicting the outcome of evolution: whether evolution will result in populations reaching predictable end points, or whether multiple evolutionary outcomes are more likely. In a more applied sense, the landscape will determine whether organisms will evolve to lose ‘costly’ resistance to antibiotics, herbicides or pesticides (...) when the use of the control agent is stopped. Laboratory populations of microbes allow evolution to be observed in real time and, as such, provide key insights into the topology of adaptive landscapes. Over the last thirty years, personal debt loads have increased dramatically. Lower income earners borrow money to purchase basic goods and services, so their debt is frequently non-discretionary. The impact of non-discretionary personal debt on debtors can be as, if not more, harmful than government regulations that have been declared unconstitutional. In this regard, the impact of personal debt is tantamount to the impact of a civil rights violation. What separates the impact of unconstitutional state action from that of personal (...) debt is the assumption that only the latter are the result of consensual transactions. Consent, however, is not a dyadic phenomenon, it exists in gradations. The quality of consent is weakened when the agent is making choices in response to pressures, and the empiricalquestion of the extent to which a consent transaction is unforced is distinct from the normative question of whether a transaction is legitimate, or fair. It is necessary to devise a new taxonomy of language to clearly distinguish the empirical and normative questions. This elucidates the fact that lower income people are under more pressure to borrow money than are upper income individuals to pay progressive rates of income tax. To argue that the latter are ‘coerced,’ is to admit that the low income individual’s decision to borrow is similarly forced. This admission suggests that a significant portion of citizens of market-based economies (notably Canada and the U.S.) are being forced to endure harms tantamount to civil rights violations. The admission also suggests that free markets harbour forces that undermine individual autonomy, and the absence of corrective state regulation exacerbates the problem. (shrink)

McShea asks what current value theories "authorize us to say, or do, against the child abuser, the racist, the terrorist, the oppressor and the exploiter, the liar and the cheat?" and finds that they provide insufficient grounds for ordinary moral judgments and for social and political criticism. He rejects the standard, "superficial" bifurcated schemes for classifying available positions--deontological versus teleological, Gemeinschaft versus Gesellschaft, classical versus modern, and so on--and claims that "all possible bases for value thinking" fall under one or (...) more of the following five headings: skepticism, individualism, transcendentalism, culturalism, or human nature theory. He rejects skepticism, individualism, transcendentalism, and culturalism, and asserts that "our feelings are the only basis on which we can make value judgments.... There is no conceivable good for us but the maximum satisfaction of our strongest and most enduring feelings". He maintains that our "common genetic feeling pattern" authorizes values and that value theory should "begin with human feelings, with the study of the feelings, with the understanding of feelings not as words but as experiences had similarly by all, or almost all, of us". He defends "traditional human nature theory" as the only account that can ground the prescriptivity of value judgments and provide "an unsentimental, transcultural basis for human solidarity and interpersonal sympathy". ABSTRACTThere are many different ethical arguments that might be advanced for and against childhood vaccinations. In this paper I explore one particular argument that focuses on the idea that such vaccinations are justifiable because they are held to be in the best interests of a particular child. Two issues arise from this idea. The first issue is how best interests are to be determined in this case. The second issue is what follows from this to justify potential interventions within the (...) family in relation to such vaccinations. I argue that best interests must be characterised objectively in such situations and that this means that, in at least some cases, parental decision‐making about vaccinating their children may be overridden. Background: The debate over the ethical implications of care robots has raised a range of concerns, including the possibility that such technologies could disrupt caregiving as a core human moral activity. At the same time, academics in information ethics have argued that we should extend our ideas of moral agency and rights to include intelligent machines. Research objectives: This article explores issues of the moral status and limitations of machines in the context of care. Design: A conceptual argument is developed, (...) through a four-part scheme derived from the work of Alasdair MacIntyre. No empirical data are used. Ethical consideration: No primary data were gathered for this study. Secondary sources and authorship have been acknowledged throughout. Findings / discussion: Certain kinds of social experience, including the narrative unity of a life, and the giving and receiving of care, are essential for moral development. Machines, no matter how advanced, cannot participate in such experiences in key respects, and thus cannot develop as practical reasoners. Conclusion: It follows that they cannot be moral agents and that they cannot care. There are, it seems, no such things as care robots. In view of the institutional power of tech companies and commissioning bodies, care practitioners need to take more of a lead in developing new assistive technologies which are appropriate to their practice. It is argued that reliance on the testimony of others cannot be viewed as reliance on a kind of evidence. Speech being essentially voluntary, the speaker cannot see his own choice of words as evidence of their truth, and so cannot honestly offer them to others as such. Rather, in taking responsibility for the truth of what he says, the speaker offers a guarantee or assurance of its truth, and in believing him the hearer accepts this assurance. The application of semiotics in trade mark law is an interdisciplinary endeavour in its infancy. The author traces its genesis in recent years and situates it within the context of general theoretical approaches, in particular of an interdisciplinary kind, appearing in the trade mark law literature in the past. The purposes for which such theories are applied, and questions of methodology arising from this, are examined. In particular, it is observed that semiotic theory has, by and large, been used for (...) the purpose of debating legal policy in trade mark law (especially in the United States), and that this has given rise to argument about the extent to which semiotic theory can exert any normative force of its own upon the law. This article offers a different perspective. It is sought to demonstrate the usefulness of theoretical semiotics in solving trade mark law questions in practice. The author emphasises that this involves no threat to orthodox legal problem-solving methodology (whatever one may think of the orthodoxy), and in particular does not require the normative use of semiotic theory. Taking as a starting point the concept of ‹trade mark use’, and having regard to trade mark law and literature in Europe, the United States and Australia, the author proceeds to demonstrate the proposed approach by reference to some current problems in trade mark infringement.
