Die Frage nach gemeinsamen Wurzeln der Religions- und Philosophielehrerausbildung steht im Zentrum der Uberlegungen von deutschen, franzosischen und schweizerischen Religionspadagogen, Philosophen, Historikern und Theologen. Der vorliegende Band unternimmt eine erste Bestandsaufnahme der Situation in den drei Landern, die sich durch vielfaltige Bezeichnungen der Facher (Religionsunterricht, Religionslehre, Religionskunde, Philosophie, Geschichte) sowie unterschiedliche didaktische Varianten (konfessionell, konfessionell-kooperativ, religionskundlich, "fait religieux") auszeichnet. The predominant view is that a study using health data is observational research and should require individual consent unless it can be shown that gaining consent is impractical. But recent arguments have been made that citizens have an ethical obligation to share their health information for research purposes. In our view, this obligation is sufficient ground to expand the circumstances where secondary use research with identifiable health information is permitted without explicit subject consent. As such, for some studies the Institutional (...) Review Board/Research Ethics Committee review process should not assess the practicality of gaining consent for data use. Instead the review process should focus on assessing the public good of the research, public engagement and transparency. (shrink)

The concept of ‘ownership’ is increasingly central to debates, in the media, health policy and bioethics, about the appropriate management of clinical data. I argue that the language of ownership acts as a metaphor and reflects multiple concerns about current data use and the disenfranchisement of citizens and collectives in the existing data ecosystem. But exactly which core interests and concerns ownership claims allude to remains opaque. Too often, we jump straight from ‘ownership’ to ‘private property’ and conclude ‘the data (...) belongs to the patient’. I will argue here that private property is only one type of relevant relationship between people, communities and data. There are several reasons to doubt that conceptualising data as private property presents a compelling response to concerns about clinical data ownership. In particular I argue that clinical data are co-constructed, so a property account would fail to confer exclusive rights to the patient. A non-property account of ownership acknowledges that the data are ‘about the patient’, and therefore the patient has relevant interests, without jumping to the conclusion that the data ‘belongs to the patient’. On this broader account of ownership, the relevant harm is the severing of the connection between the patient and their data, and the solution is to re-engage and re-connect patients to the data research enterprise. The future of health research will be characterised by three continuing trends: rising demand for health data; increasing impracticability of obtaining specific consent for secondary research; and decreasing capacity to effectively anonymise data. In this context, governments, clinicians and the research community must demonstrate that they can be responsible stewards of health data. IRBs and RECs sit at heart of this process because in many jurisdictions they have the capacity to grant consent waivers when research is judged to be of (...) particular value. However, several different terms are used to refer to this value, indicating a lack of conceptual clarity regarding the appropriate test for access to health data for research without consent. In this paper we do three things. First we describe the current confusion and instability in terminology relating to public interest in the context of consent waivers. Second we argue for harmonisation of terminology on the grounds of clarity, transparency and consistency. Third we argue that the term ‘public interest’ best reflects the normative work required to justify consent waivers because it is the broadest of the competing terms. ‘Public interest’ contains within its scope positive and negative implications of a study, as well as welfare, justice and rights considerations. In making this argument, we explain the normative basis for consent waivers, and provide a starting place for further discussion about the precise conditions in which a given study can be said to advance the public interest. There is an alleged tension between undue inducement and exploitation in research trials. This paper considers claims that increasing the benefits to research subjects enrolled in international, externally-sponsored clinical trials should be avoided on the grounds that it may result in the undue inducement of research subjects. This article contributes to the debate about exploitation versus undue inducement by introducing an analysis of the available empirical research into research participants' motivations and the influence of payments on research subjects' behaviour and (...) risk assessment. Admittedly, the available research in this field is limited, but the research that has been conducted suggests that financial rewards do not distort research subjects' behaviour or blind them to the risks involved with research. Therefore, I conclude that research sponsors should prioritise the prevention of exploitation in international research by providing greater benefits to research participants. (edited). (shrink)

In their response to ‘Public interest in health data research: laying out the conceptual groundwork’, Grewal and Newson critique us for inattention to the law and putting forward an impracticably broad conceptual understanding of public interest. While we agree more work is needed to generate a workable framework for Institutional Review Boards/Research Ethics Committees, we would contend that this should be grounded on a broad conception of public interest. This broadness facilitates regulatory agility, and is already reflected by some current (...) frameworks such as that found in the guidelines approved under Australia’s Privacy Act. It remains unclear which elements of our broad account Grewal and Newson would reject, or indeed where the substantive disagreement with our position lies. (shrink)

The question which this paper examines is that of the correct scope of the claim that extra-linguistic factors (such as gender and social status) can block the proper workings of natural language. The claim that this is possible has been put forward under the apt label of silencing in the context of Austinian speech act theory. The ‘silencing’ label is apt insofar as when one’s ability to exploit the inherent dynamic of language is ‘blocked’ by one’s gender or social status (...) then one might justly be said to be silenced. The notion that factors independent of any person’s linguistic competence might block her ability to exploit the inherent dynamic of language is of considerable social as well as theoretical significance. I shall defend the claim that factors independent of a person’s linguistic competence can indeed block her ability to do things with words but I will show that the cases that have been previously considered to be cases of illocutionary failure are instances of rhetic or locutionary act failure instead. I shall refine the silencing claim as previously advanced in the debate in at least one fundamental respect. I also show that considering the metaphysics of speech acts clarifies many of the issues previously appearing as thorny bones of contention between those who hold that the only notion of silencing that is coherent is that of physically preventing someone from speaking or writing and those who hold the opposite sort of claim sketched above. There is increasing global pressure to ensure that pregnant women are responsibly and safely included in clinical research in order to improve the evidence base that underpins healthcare delivery during pregnancy. One supposed barrier to inclusion is the assumption that pregnant women will be reluctant to participate in research. There is however very little empirical research investigating the views of pregnant women. Their perspective on the benefits, burdens and risks of research is a crucial component to ensuring effective recruitment. The (...) Research In Pregnancy Ethics study set out to ascertain the views of pregnant women about research participation using an inductive thematic analysis. We conducted semi-structured interviews with 20 women who had participated in a double-blind randomised placebo controlled trial in Wellington while pregnant. Our results show that at least some pregnant women recognise the value and importance of research during pregnancy. The women we interviewed were deeply invested in the research process and outcomes. Key motivations for participating were altruism, playing a valuable civic role and the importance of research. The main perceived burdens related to inconvenience and time commitment. For some women, possible randomization to the placebo arm was regarded as a burden or disadvantage. (shrink)

O Transtorno do Espectro Autista (TEA) é caracterizado pela presença de déficits persistentes na comunicação e interação social, além de padrões restritos e repetitivos de comportamentos, interesses e atividades. Como forma de viabilizar a inclusão das crianças autistas no ambiente escolar, a orientação dos professores que atuam com este público é de suma importância. O objetivo do estudo é apresentar a experiência de orientação feita para os professores que lecionam para alunos autistas, acompanhados pelo Núcleo de Atenção ao TEA, da (...) cidade de Monte Alto-SP, no período de junho de 2022 a junho de 2023. Trata-se de um estudo descritivo, do tipo relato de experiência, embasado na ciência ABA (Análise do Comportamento Aplicada) e relacionado às vivências com os professores em orientações, realizadas mensalmente. Como resultado, observou-se a dificuldade dos docentes em acolher estes alunos, direcionar atividades, lidar com comportamentos disruptivos e no manejo das atividades de vida diária. Discute-se a importância de uma ferramenta de apoio para proporcionar aos docentes maior respaldo teórico à prática com alunos autistas, para contribuir na inclusão, aprendizagem e socialização no ambiente escolar. Esta experiência ampliou as vivências sobre a perspectiva do professor na inclusão escolar de crianças com TEA, lançando luz sobre a necessidade de formação teórica e instrumentalização dos docentes, considerando as particularidades de neurodesenvolvimento e comportamento desta população e contribuindo para a maior eficácia da assistência educacional inclusiva. We can observe a connection between some serious environmental problems caused by the overexploitation of environmental resources and the particular conceptions of property rights that are claimed to hold with regard to these resources. In this paper, I investigate whether Kant’s conception of property rights might constitute a basis for justifying property regimes that would overcome some of these environmental problems. Kant’s argument for the right to property, put forward in his Doctrine of right, is complex. In Section 2, I (...) attempt an interpretation. Section 3 works out the defining characteristics of the conception of property rights that Kant’s argument establishes and investigates their implications for determining property regimes in environmental resources. Kant proposes a minimalist notion of the right to property as a triadic relation between persons with regard to an object, justified only on the condition that it is universalizable in the given circumstances. I argue that this notion offers a promising account for determining property relations with regard to environmental resources. By way of illustration, in Section 4, I focus on an example of Kantian property rights in one type of environmental resource: the marine fisheries. (shrink)

Over 60% of all epidemics have a zoonotic origin, that is, they result from the transmission of infectious diseases from animals to humans. The spill-over of diseases often happens because humans exploit and use animals. In this article, I outline the four most common interfaces that favour the emergence and spread of zoonotic infectious diseases: wildlife hunting, small-scale farming, industrialised farming practices and live animal markets. I analyse which practices serve human food security – and thus have a non-trivial purpose (...) – and which predominantly have an economic purpose or serve as a symbol of wealth. I conclude that many practices that increase the risk for zoonotic infectious disease outbreaks actually do not contribute to the survival and food security of humans. I make two arguments in turn. First, I argue that in cases where the consumption and use of animal products does not contribute to the food security of a population, then this population has a duty to abstain from them, since they impose a grave and avoidable risk to themselves as well as to innocent third-parties. However, some communities must sometimes rely on practices that increase the risk of emergence and transmission of zoonotic infectious diseases, because they have no healthy alternatives. That is, the food security of the local population depends on the consumption and use of risky animal products. The second argument I advance is that, in such scenarios, the international community has a duty to provide the communities concerned with alternative food options, as well as economic and educational opportunities and technologies, in order to reduce the spill-over risk of infectious diseases. Given that abstention from such practices contributes signifcantly to the public good and benefits the international community, the latter has a corresponding duty to provide local communities which abandon such practices with alternatives. Se lo analiza en tanto forma de voluntad e instrumento de presión política que tensiona críticamente los modos en que se organiza la vida en nuestras sociedades. Se indaga en el potencial de contra-soberanía que supone en tanto intenta desactivar el poder al que se enfrenta. Se tematiza cierta ética de la pasividad que surge en esta acción y se examina la lógica que recorre el acto de (...) darse muerte. Finalmente, el artículo contribuye a complejizar el debate en torno al suicidio hetero-referido en tanto se destacan sus límites y potencialidades, así como las paradojas que plantean a nuestras democracias liberales las diversas demandas de grupos minorizados. Un tema recurrente en aproximaciones marxistas al estudio de la relación entre subjetividad y trabajo es la cuestión de cómo el poder capitalista configura a los individuos en la coyuntura histórica actual. En este trabajo sostenemos que la vinculación entre poder y subjetivación es históricamente contingente, mientras que el poder específicamente capitalista exige necesariamente, por sus condiciones históricas, mecanismos de subjetivación. Solo en el modo capitalista de organizar el metabolismo social es necesaria la producción generalizada de sujetos con vistas a (...) dos objetivos principales: (1) auto-generar las condiciones de existencia para su reproducción como sistema, y (2) garantizar la acumulación privada en forma de capital. Estos objetivos requieren una forma específica de poder, a saber, como dominación social a través de una lógica impersonal. Esta particularidad distingue al capitalismo de modos de producción anteriores, y se basa en la capacidad del capital para insertarse en la brecha entre la vida y sus condiciones de posibilidad. Por tanto, si podemos mostrar que los mecanismos de subjetivación dependen de las condiciones históricas del modo de producción capitalista, entonces es justo pensar que el modo de salir de este paradigma requiere la necesaria superación de dicha formación social. This paper uses the advent of human-animal hybrids, created though somatic cell nuclear transfer experiments in America and Australia, as a tool to deconstruct and challenge the dualistic belief that humans are morally distinct and superior to animals. The view that moral value corresponds to species membership creates a scientific and cultural environment that prohibits or restricts human embryo experimentation whilst permitting the extensive use of animals for research. The dualistic premise therefore motivates the creation of human-animal hybrids for research (...) as a way for scientists to side-step restrictive legislation. Furthermore, ethical frameworks that incorporate the dualistic assumption have been incapable of objectively assessing the moral value of hybrid embryos. This failure indicates the arbitrariness of the moral dichotomy between animals and humans. Moral dualism, based on species membership, should be replaced with a liberal ethical framework based on a consistent standard such as interests. (shrink)

Hume's approach to probability judgements in space-time may be considered a precursor to recent work on the cognitive psychology of decision-making. When it comes to the passions, Hume’s observations on the effect of distance in time in particular can be compared to discussions of temporal discounting, central in disciplines such as behavioral economics, neuroscience, psychology, environmental policy, and recent debates in experimental psychology (...) and philosophy over future bias. Sarat Colling's Animal Resistance in the Global Capitalist Era confronts an issue vastly disregarded by activists and animal advocates, an issue that ultimately leads to the constant reaffirmation of logocentrism and human exceptionalism. Assuming that other-than-human animals do not have their own voices and a main role in their struggles for liberation constitutes what Colling names "savior narratives," a very common discourse even among those who care for the more-than-human world. In this paper we argue that hermeneutics acquires additional relevance in the era of technology. In particular legal hermeneutics offers examples of how the use of specific instruments aimed at constituting legal objects (like the digital instruments used by notaries) demonstrate that legal professions will never be entirely delegated to machines. The capacity to use the instruments and the very functioning of those instruments can never be detached from comprehension, and from legal savoir.

Some mental states seem to be "of" or "about" things, or to "say" something. For example, a thought might represent that grass is green, and a visual experience might represent a blue cup. This is intentionality. The aim of this book is to explain this phenomenon. -/- Once we understand intentionality as a phenomenon to be explained, rather than a posit in a theory explaining something else, we can see that there are glaring empirical and in principle difficulties with currently (...) popular tracking and functional role theories of intentionality, which aim to account for intentionality in terms of tracking relations and functional roles. -/- This book develops an alternative theory, the phenomenal intentionality theory (PIT), on which the source of intentionality is none other than phenomenal consciousness, the subjective, felt, or qualitative aspect of mental life. While PIT avoids the problems that plague tracking and functional role theories, it faces its own challenges in accounting for the rich and complex contents of thoughts and the contents of nonconscious states. In responding to these challenges, this book proposes a novel version of PIT, on which all intentionality is phenomenal intentionality, though we in some sense represent many non-phenomenal contents by ascribing them to ourselves. This book further argues that phenomenal consciousness is an intrinsic feature of mental life, resulting in a view that is radically internalistic in spirit: Our phenomenally represented contents are literally in our heads, and any non-phenomenal contents we in some sense represent are expressly targeted by us. A number of philosophers have recently argued that we should interpret the debate over moral responsibility as a debate over the conditions under which it would be “fair” to blame a person for her attitudes or conduct. What is distinctive about these accounts is that they begin with the stance of the moral judge, rather than that of the agent who is judged, and make attributions of responsibility dependent upon whether it would be fair or appropriate for a moral judge (...) to react to the agent in various (negative) ways. This is problematic, I argue, because our intuitions about whether and when it would be fair to react negatively to another are sensitive to a host of considerations that appear to have little or nothing to do with an agent’s responsibility or culpability for her attitudes or behavior. If this is correct, then theories which make attributions of responsibility dependent upon the appropriateness of our reactions as moral judges will turn out to be fundamentally misguided. (shrink)

Idealization and the Aims of Science shows just how crucial idealization is to science and why it matters. She offers case studies from a number of branches of science to demonstrate the ubiquity of idealization, shows how causal patterns are used to develop scientific explanations, and describes how the necessarily imperfect connection between science and truth leads to researchers’ values influencing their findings. This volume presents the first Italian translation with commentary of the Doric Pseudo-Pythagorean texts, which are ascribed to Archytas and Brontinus and deal with metaphysical, logical, and epistemological questions. These texts probably date from the 1st century BCE and are the product of a re-emerging dogmatic interpretation of Plato's dialogues.

Despite the recent proliferation of scientific, clinical, and narrative accounts of auditory verbal hallucinations, the phenomenology of voice hearing remains opaque and undertheorized. In this article, we outline an interdisciplinary approach to understanding hallucinatory experiences which seeks to demonstrate the value of the humanities and social sciences to advancing knowledge in clinical research and practice. We argue that an interdisciplinary approach to the phenomenology of AVH utilizes rigorous and context-appropriate methodologies to analyze a wider range of first-person accounts of AVH (...) at 3 contextual levels: cultural, social, and historical; experiential; and biographical. We go on to show that there are significant potential benefits for voice hearers, clinicians, and researchers. These include informing the development and refinement of subtypes of hallucinations within and across diagnostic categories; “front-loading” research in cognitive neuroscience; and suggesting new possibilities for therapeutic intervention. In conclusion, we argue that an interdisciplinary approach to the phenomenology of AVH can nourish the ethical core of scientific enquiry by challenging its interpretive paradigms, and offer voice hearers richer, potentially more empowering ways to make sense of their experiences. Advances in technologies and biomedical informatics have expanded capacity to generate and share biomedical data. With a lens on genomic data, we present a typology characterizing the data-sharing landscape in biomedical research to advance understanding of the key stakeholders and existing data-sharing practices. The typology highlights the diversity of data-sharing efforts and facilitators and reveals how novel data-sharing efforts are challenging existing norms regarding the role of individuals whom the data describe.

International research, sponsored by for-profit companies, is regularly criticised as unethical on the grounds that it exploits research subjects in developing countries. Many commentators agree that exploitation occurs when the benefits of cooperative activity are unfairly distributed between the parties. To determine whether international research is exploitative we therefore need an account of fair distribution. Procedural accounts of fair bargaining have been popular solutions to this problem, but I argue that they are insufficient to protect against exploitation. I argue instead (...) that a maximin principle of fair distribution provides a more compelling normative account of fairness in relationships characterised by extreme vulnerability and inequality of bargaining potential between the parties. A global tax on international research would provide a mechanism for implementing the maximin account of fair benefits. This model has the capacity to ensure fair benefits and thereby prevent exploitation in international research. (shrink)

Using data collected at two phases, this study examines why and how ethical leadership behavior influences employees’ evaluations of organization-focused justice, i.e., procedural justice and distributive justice. By proposing ethical leaders as moral agents of the organization, we build up the linkage between ethical leadership behavior and the above two types of organization-focused justice. We further suggest trust in organization as a key mediating mechanism in the linkage. Our findings indicate that ethical leadership behavior engenders employees’ trust in their employing (...) organization, which in turn promotes their justice perceptions toward the organization. The theoretical and practical implications of these findings are discussed, and some directions for future research are suggested. (shrink)
