This book presents a comprehensive defence of legal positivism on the basis of a novel account of social conventions. Marmor argues that the law is founded on constitutive conventions, and that consequently moral values cannot determine what the law is.

When Aristotle limits the manifestation of true courage to the military context only, his primary target is an overly inclusive conception of courage presented by Plato in the Laches. At the same time, Aristotle explicitly tries to demarcate his ideal of genuine courage from the paradigmatic examples of courageous actions derived from the Homeric epics. It remains questionable, though, whether Aristotle is truly earnest in his efforts to distance himself from Homer. It will be argued that Aristotle's attempt to associate (...) with Homer the two forms of specious courage—courage of the citizen troops and spirit-caused courage—fails to provide sufficient criteria for the demarcation in question. All the essential elements of the Aristotelian account of courage, such as a voluntary choice, a noble goal, and a thumos-driven reaction guided by reason are exemplified by a number of Homeric characters as well. It is thus likely that the philosopher's account of courage largely incorporates the poetic tradition at a new level, rather than supersedes it. (shrink)

This Element focuses on some core conceptual and ontological issues related to pantheistic conceptions of God by engaging with recent work in analytic philosophy of religion on this topic. The conceptual and ontological commitments of pantheism are contrasted with those of other conceptions of God. The concept of God assumed by pantheism is clarified and the question about what type of unity the universe must exhibit in order to be identical with God receives the most attention. It is argued that (...) the sort of unity the universe must display is the sort of unity characteristic of conscious cognitive systems. Some alternative ontological frameworks for grounding such cognitive unity are considered. Further, the question of whether God can be understood as personal on pantheism is explored. (shrink)

The book builds on recent work in pragmatics and speech-act theory to explain how, and to what extent, legal content is determined by linguistic considerations. At the same time, the analysis shows that some of the unique features of communication in the legal domain - in particular, its strategic nature - can be employed to put pressure on certain assumptions in philosophy of language. The purpose of this paper is to discuss two phenomena related to the semantics of definite descriptions: that of incomplete uses of descriptions, and that of the underdetermination of referential uses of descriptions. The Russellian theorist has a way of accounting for incomplete uses of descriptions by appealing to an account of quantifier domain restriction, such as the one proposed in Stanley and Szabó (2000a). But, I argue, the Russellian is not the only one in a position to appeal to (...) such an account of incomplete uses of descriptions. Proponents of other theories, such as the Fregean, which does not treat descriptions as quantifiers, might benefit from this account of domain restriction. In the second part of the paper I discuss referential uses of incomplete definite descriptions. Relative to such uses, Wettstein (1981) and others have argued that the Russellian theory faces a problem of underdetermination of semantic content. Neale (2004) has replied to this objection showing why it does not pose a threat to the Russellian theory. Again, I argue that not only the Russellian, but also the Fregean can subscribe to Neale’s (2004) suggestion. (shrink)

Even though Hegel rejects Kant’s criticism of the classical proofs for God’s existence, he is far from joining the followers of St. Anselm.What is needed, he suggests, is the rational account of the transition from the final notion to the infinite Being. The Lectures in its central treatment of the Cosmological proof present us with an explanation in rational terms of the fact of religion, i.e., the elevation of the finite spirit to infinite God, rather than with a proof in (...) a narrow logical sense. Hegel is not so much asking the question ‘Does Godexist?’ but rather ‘How is the elevation of the finite spirit to God possible?’ The Hegelian ‘proof,’ I argue, consists in a demonstrationof the necessity of movement from finiteness to infinity, that is, the demonstration of the necessity of religion itself. Religious faith in this context is not juxtaposed to reason, but appears as a mode of imperfect knowledge, which is superseded by the further development of the rational concept. (shrink)

In the first part of this paper I consider the Gricean account of communication, as structured by the Cooperative Principle and the four maxims. Several authors, including Jean Goodwin [10], Fred Kauffeld [17], Michael Gilbert [7], Ernie Lepore and Mathew Stone [22], among others, argue that the Gricean view of communication fails in as much as it pretends to offer an account of all such human interactions. As Goodwin and Kauffeld suggest, a more promising starting point is to consider the (...) variety of contextually determined presumptions that we make about speakers and that we rely upon in interpreting utterances. These presumptions are established in various ways, and are dropped, or defeated, in certain conditions. In order to clarify these aspects we need to inquiry into the nature of presumptions. I argue that Kauffeld’s [18], [19], [20] account of presumptions is useful in this context. In the second part of the paper I look at what this account tells us about how, and in what conditions, presumptions in communication are rebutted. (shrink)

This article takes as its point of departure the view that the discovery of the mathematical formalism of quantum mechanics (QM) was not merely a discovery of a new mathematical way of dealing with physical, and specifically quantum, processes in nature. It was also a discovery of a general mathematical formalism (in part discovered in mathematics itself earlier), which, supplemented by certain additional rules, consistently described the processing of incomplete information about certain events and contexts in which these events occur. (...) This article proposes a quantum-like (QL) model of the functioning of the brain based on the (Hilbert-space) formalism of quantum mechanics, but now used as part of a QL mathematical model of neural processes in the brain, rather than for describing quantum physical processes. This model is, thus, fundamentally different from the (reductionist) quantum model of the brain and consciousness, according to which cognition arises by virtue of physical quantum processes in the brain. In the present view, the brain is an advanced biological system that developed the ability to create a QL representation of contexts, which, thus, allows one to describe a significant part of its functioning by the QM mathematical formalism. The possibility of such a description has nothing to do with the constitution and workings of the brain as a quantum system (composed of photons, electrons, protons, and so forth). The QL model offered here is based instead on conventional neurophysiological model of the functioning of the brain, even though the brain, the article suggests, does use the QL rule (given by von Neumann trace formula, used in QM) for the calculation of approximate averages for mental functions. The QL model developed in this article has a temporal basis, based on a (hypothetical) argument that cognitive processes are based on at least two time scales: a (very fine) subcognitive one and a (much coarser) cognitive one. According to traditional Judeo-Christian-Islamic theism, God is an omniscient, omnipotent, and morally perfect agent. This volume shows that philosophy of religion needs to take seriously alternative concepts of the divine, and demonstrates the considerable philosophical interest that they hold.

A qualitatively new, much more liberal and efficient organisation of science is proposed and justified in connection with emerging international science structures, such as the European Research Council, and growing debates about further role and development of fundamental science. Although the ideas are expressed in terms of "common sense" arguments accessible to a "general" audience, they are based on the rigorous analysis within the recently advanced "universal concept of complexity", which can be applied, due to its universality, also to science (...) structure itself considered as a complex system. We demonstrate thus the application of this ultimate criterion of completeness of a system of knowledge (and viability of related intelligence) that should be able to derive consistent, provable, and practically relevant conclusions about its own purpose, sense, evolution, and current state. Social conventions are those arbitrary rules and norms governing the countless behaviors all of us engage in every day without necessarily thinking about them, from shaking hands when greeting someone to driving on the right side of the road. In this book, Andrei Marmor offers a pathbreaking and comprehensive philosophical analysis of conventions and the roles they play in social life and practical reason, and in doing so challenges the dominant view of social conventions first laid out by David Lewis. (...) Marmor begins by giving a general account of the nature of conventions, explaining the differences between coordinative and constitutive conventions and between deep and surface conventions. He then applies this analysis to explain how conventions work in language, morality, and law. Marmor clearly demonstrates that many important semantic and pragmatic aspects of language assumed by many theorists to be conventional are in fact not, and that the role of conventions in the moral domain is surprisingly complex, playing mostly an auxiliary and supportive role. Importantly, he casts new light on the conventional foundations of law, arguing that the distinction between deep and surface conventions can be used to answer the prevalent objections to legal conventionalism. Social Conventions is a much-needed reappraisal of the nature of the rules that regulate virtually every aspect of human conduct. (shrink)

On Ryan’s (2012) theory of wisdom as deep rationality, to believe or act wisely is to believe or act in a justified way, informed by a body of other justified beliefs about the good life. Ryan (2017) elaborates the view along evidentialist lines: one’s belief or act is justified when it is based on the best available evidence. The resulting package faces counterexamples. Transformative experiences are rational ‘leaps of faith’ (Paul 2014), so the agent’s decision to undergo one is not (...) best supported by the evidence available. Many transformative experiences (such as deciding to become a mother, or choosing a career path) often endow lives with meaning, and agents with a sense of purpose (Wolf 2010). Because so much is at stake, it is sometimes rational for agents to take on the risk involved in transforming themselves. Deciding to undergo such experiences may be wise—even if the evidence available at the time doesn’t positively support that decision. In reply to this challenge, I argue that, instead of evidentialism, Ryan’s view should include virtue theory, which helps explain the seeming counterexamples. I focus on the virtues of openness to experience, and of steadfastness in the face of experience. (shrink)

The article is devoted to the study of the nature of consciousness within the framework of the information concept. The paper proposes a definition of consciousness as an informational environment in which an extended model of reality is realized. The process of realization of this extended model is defined as thinking. The result of thinking is information objects that form a system in the form of information environment. Information objects are reflections of the real world properties, not directly, but by (...) means of translation through a special object – a carrier of consciousness. In the case of human consciousness, such a carrier is a human being (represented in the form of his nervous system). As a result, consciousness can be qualified as a simulacrum of reality, i.e., a model of a model: an information model of the carrier of consciousness, which in turn is a means of physical modeling of the real "big" world. Possible mechanisms mediating thinking are considered. For this purpose, two new concepts are introduced: neural circuit and neurophysical pattern. An approach to the study of self-consciousness based on the localization of the consciousness carrier in the multidimensional space of states of initial real objects, as well as their reflections in the form of information objects is proposed. This localization is ensured by the presence of feedbacks. Summarizing the results of the study, the article states the following connection between consciousness, self-consciousness and subjectness: under certain conditions (when consciousness is localized in the state space of the carrier of consciousness), consciousness acquires the property of self-consciousness, a special case of which (when the initiator of changes determining localization is the carrier of consciousness) is self-consciousness endowed with subjectness. The coat of arms — it is a symbol garnished with colossal endless meaning and potential withing its power. Besides this, the state coat of arms appears in numbers like mandalas: it is like this (...) archaic symbol, that combines various geometric shapes expressing the idea of order. The state coat of arms perceptively unites people of different genders, ages, social status andfaith into a united orderly community. A person contemplating the state coat of arms understands it as the center of the universe. The coat of arms is transformed into endlessness, attaining the result of uniting the macrocosm — society and state — and with the macrocosm — man. The function of political symbols exists so as to represent the “body” of a concrete political subject or society as a whole, at the same time in every part of a text “is highlighted” yet another part of the endless semantical richness of the symbol. Political symbols have important significance for the support or destruction of socio-political order. But the chief essence ofpolitical symbols — is the ability to give meaning to all political activities, and the regular “exposition” of state symbols guarantees the stability of the existing socio-political system.
