I came to the subject by attempting to reinterpret the well-known legend of the labyrinth and the status of its main characters: Theseus, Ariadne, Dedalus and the Minotaur. The conflict between the two invincible entities is a reminiscence, degraded by literaturisation of the first conflict - in the 'zero moment' of the mythical history of the Universe - between the principle of the Cosmos and the principle of the Chaos. From a hermeneutical perspective, the god's overcoming of the monster is (...) an act of ordering the Chaos, and thus of cosmogenesis. The ordered Chaos becomes Cosmos. (shrink)

Social conventions are those arbitrary rules and norms governing the countless behaviors all of us engage in every day without necessarily thinking about them, from shaking hands when greeting someone to driving on the right side of the road. In this book, Andrei Marmor offers a pathbreaking and comprehensive philosophical analysis of conventions and the roles they play in social life and practical reason, and in doing so challenges the dominant view of social conventions first laid out by David (...) Lewis. Marmor begins by giving a general account of the nature of conventions, explaining the differences between coordinative and constitutive conventions and between deep and surface conventions. He then applies this analysis to explain how conventions work in language, morality, and law. Marmor clearly demonstrates that many important semantic and pragmatic aspects of language assumed by many theorists to be conventional are in fact not, and that the role of conventions in the moral domain is surprisingly complex, playing mostly an auxiliary and supportive role. Importantly, he casts new light on the conventional foundations of law, arguing that the distinction between deep and surface conventions can be used to answer the prevalent objections to legal conventionalism. Social Conventions is a much-needed reappraisal of the nature of the rules that regulate virtually every aspect of human conduct. (shrink)

We propose that human reasoning relies on an inherence heuristic, an implicit cognitive process that leads people to explain observed patterns (e.g., girls wear pink) in terms of the inherent features of their constituents (e.g., pink is an inherently feminine color). We then demonstrate how this proposed heuristic can provide a unified account for a broad set of findings spanning areas of research that might at first appear unrelated (e.g., system justification, nominal realism, is–ought errors in moral reasoning). By revealing (...) the deep commonalities among the diverse phenomena that fall under its scope, our account is able to generate new insights into these phenomena, as well as new empirical predictions. A second main goal of this paper, aside from introducing the inherence heuristic, is to articulate the proposal that the heuristic serves as a foundation for the development of psychological essentialism. More specifically, we propose that essentialism—which is the common belief that natural and social categories are underlain by hidden, causally powerful “essences”—emerges over the first few years of life as an elaboration of the earlier, and more open-ended, intuitions supplied by the inherence heuristic. In the final part of the paper, we distinguish our proposal from competing accounts (e.g., Strevens' K-laws) and clarify the relationship between the inherence heuristic and related cognitive tendencies (e.g., the correspondence bias). In sum, this paper illuminates a basic cognitive process that emerges early in life and is likely to have profound effects on many aspects of human psychology. (shrink)

According to traditional Judeo-Christian-Islamic theism, God is an omniscient, omnipotent, and morally perfect agent. This volume shows that philosophy of religion needs to take seriously alternative concepts of the divine, and demonstrates the considerable philosophical interest that they hold.

The purpose of this article is twofold: to demystify the ancient concept of courage, making it more palpable for the modern reader, and to suggest the reasonably specific constraints that would restrict the contemporary tendency of indiscriminate attribution of this virtue. The discussion of courage will incorporate both the classical interpretations of this trait of character, and the empirical studies into the complex relation between the emotion of fear and behavior. The Aristotelian thesis that courage consists in overcoming the fear (...) of significant harm for a worthy cause will be further developed by exploring its relevance for military professionals today. Specific criteria will be offered in order to restrict the application of the term?courageous? to a certain type of action, as well as to demarcate this virtue from the related vices, such as recklessness. The normative aspect of our study aims to make sense of what could qualify as a worthy goal of a fearless action in the modern world. It will be argued that a courageous agent aims at alleviating or preventing harm for others in a situation of potential risk for the agent himself, while respecting the factual conditions that determine the probability of success. In the first part of this paper I consider the Gricean account of communication, as structured by the Cooperative Principle and the four maxims. Several authors, including Jean Goodwin [10], Fred Kauffeld [17], Michael Gilbert [7], Ernie Lepore and Mathew Stone [22], among others, argue that the Gricean view of communication fails in as much as it pretends to offer an account of all such human interactions. As Goodwin and Kauffeld suggest, a more promising starting point is to consider the (...) variety of contextually determined presumptions that we make about speakers and that we rely upon in interpreting utterances. These presumptions are established in various ways, and are dropped, or defeated, in certain conditions. In order to clarify these aspects we need to inquiry into the nature of presumptions. I argue that Kauffeld’s [18], [19], [20] account of presumptions is useful in this context. In the second part of the paper I look at what this account tells us about how, and in what conditions, presumptions in communication are rebutted. (shrink)

Generic statements (e.g., “Birds lay eggs”) express generalizations about categories. In this paper, we hypothesized that there is a paradoxical asymmetry at the core of generic meaning, such that these sentences have extremely strong implications but require little evidence to be judged true. Four experiments confirmed the hypothesized asymmetry: Participants interpreted novel generics such as “Lorches have purple feathers” as referring to nearly all lorches, but they judged the same novel generics to be true given a wide range of prevalence (...) levels (e.g., even when only 10% or 30% of lorches had purple feathers). A second hypothesis, also confirmed by the results, was that novel generic sentences about dangerous or distinctive properties would be more acceptable than generic sentences that were similar but did not have these connotations. In addition to clarifying important aspects of generics’ meaning, these findings are applicable to a range of real-world processes such as stereotyping and political discourse. (shrink)

The paper intends to study the possibility of evading the relativist dilemma: when you compare cultural forms belonging to different traditions, you either impose the result from outside, or you give up comparisons altogether as dependent on the arbiter’s parochial choices. In this paper one argues that, apart from this kind of comparison, which is called extrinsic, there is another type, called intrinsic, which is not dependent on arbiter’s choices. The essence of the intrinsic comparison is the role played by (...) the “second option” of the representatives of different traditions: it is decisive what these representatives prefer in the second place, when their first options have to be abandoned. Two old stories provide the historical paradigm of the intrinsic comparison: how Volga Khazarians are said to have converted to Judaism in the 8th century, and how the Athenian general Themistocles was voted the best general by the confederate Greek representatives. An example of contemporary intrinsic comparison between three contemporary trends – relativism, fundamentalism, rationalism – is also presented. Contrary to what Ernest Gellner believes, these trends are not incommensurable; rationalism takes precedence while being the second option of the other two trends, as soon as they want to enter a public debate. Paradox of the Evil and "Family Ressemblances". The paper tackles the problem of Matter and evil in Plotinus. monistic metaphysics, especially in theperspective of the following aparent inconsistency: if there is no other principle but the Good, then the Good creates the Matter which is the absolute evil. Itfollows that the Good is bad, according to a certain axiom of Proclus, which states that the creator is to a higher degree all what the creature is. The authorshows that, despite what (...) Proclus and then many modern critics believed, Plotinus is consistent within his system. He relies on the axiom that the creature is not all what the creator is, i.e. that the creator also gives what he has not. Therefore, the One gives the Intellect multiplicity and thought which He is deprived of and also gives the Matter the evil which He is also deprived of. The paper also shows that Plotinus developed a logic of ontological procession which is not Aristotelian. This logic does not work by formind classes, but chains of partially intransitive ressemblances. So, the Intellect ressembles the One (the Good), the Soul ressembles the Intellect and the Matter ressembles the Soul; yet the Matter resembles the One no more. Yet, the unity of the world is assured, because of the continuity of the chain. The extreme terms are contrary, though not in the Aristotelian sense of sharing in the same genus. A certain similarty with Wittgenstein's logic of "family resemblances" is striking, which means that not only Wittgenstein, but Plotinus also went beyond the Platonic-Aristotelian Vulgata, even while he was sticking to its linguage. The Heng Xian is one of the recently discovered paleographic materials that disclose a heretofore unknown richness of the cosmogonic thought of early China and contribute to our understanding of the elaboration of a uniform cosmogonic discourse during the late Warring States period. Focusing on the structure and vocabulary of the Heng Xian account, the present paper attempts to explore the conceptual core of its cosmogonic vision. Based on the idea of the spontaneous self-generation of the world out of some (...) primary state of simplicity, or nothingness, the cosmogony of the Heng Xian is quite close to the approach of the Laozi and other related texts. Nevertheless, many of its conceptual terminological features disclose an original understanding of the world genesis. (shrink)

Some quantitative results obtained by proof mining take the form of Herbrand disjunctions that may depend on additional parameters. We attempt to elucidate this fact through an extension to first-order arithmetic of the proof of Herbrand’s theorem due to Gerhardy and Kohlenbach which uses the functional interpretation.

This book presents a comprehensive defence of legal positivism on the basis of a novel account of social conventions. Marmor argues that the law is founded on constitutive conventions, and that consequently moral values cannot determine what the law is.

Are there any prima facie reasons that democracies might have for disenfranchising older citizens? This question reflects increasingly salient, but often incompletely theorized complaints that members of democratic publics advance about older citizens’ electoral influence. Rather than rejecting these complaints out of hand, we explore whether, suitably reconstructed, they withstand democratic scrutiny. More specifically, we examine whether the account of political equality that seems to most fittingly capture the logic of these complaints – namely, equal opportunity of political influence over (...) electoral outcomes – can justify disenfranchising older citizens. We conclude that equal opportunity of influence cannot ground a blanket disenfranchisement of older people and that, taken in conjunction with other general considerations that apply to all sound electoral policies, partial disenfranchisement proposals (i.e. proposals for reducing the electoral influence of older citizens via age-weighted voting) are both quasi-inapplicable and practically unrobust across a relevant range of political contexts. The article is devoted to the study of the nature of consciousness within the framework of the information concept. The paper proposes a definition of consciousness as an informational environment in which an extended model of reality is realized. The process of realization of this extended model is defined as thinking. The result of thinking is information objects that form a system in the form of information environment. Information objects are reflections of the real world properties, not directly, but by (...) means of translation through a special object – a carrier of consciousness. In the case of human consciousness, such a carrier is a human being (represented in the form of his nervous system). As a result, consciousness can be qualified as a simulacrum of reality, i.e., a model of a model: an information model of the carrier of consciousness, which in turn is a means of physical modeling of the real "big" world. Possible mechanisms mediating thinking are considered. For this purpose, two new concepts are introduced: neural circuit and neurophysical pattern. An approach to the study of self-consciousness based on the localization of the consciousness carrier in the multidimensional space of states of initial real objects, as well as their reflections in the form of information objects is proposed. This localization is ensured by the presence of feedbacks. Summarizing the results of the study, the article states the following connection between consciousness, self-consciousness and subjectness: under certain conditions (when consciousness is localized in the state space of the carrier of consciousness), consciousness acquires the property of self-consciousness, a special case of which (when the initiator of changes determining localization is the carrier of consciousness) is self-consciousness endowed with subjectness. Law in the Age of Pluralism contains a collection of essays on the intersection of legal and political philosophy. Written within the analytical tradition in jurisprudence, the collection covers a wide range of topics, such as the nature of law and legal theory, the rule of law, the values of democracy and constitutionalism, moral aspects of legal interpretation, the nature of rights, economic equality, and more. The essays in this volume explore issues where law, morality and politics meet, and discuss (...) some of the key challenges facing liberal democracies. Marmor posits that a liberal state must first and foremost respect people's personal autonomy and their differing, though reasonable, conceptions of the good and the just. This basic respect for pluralism is shown to entail a rather skeptical attitude towards grand theories of law and state, such as contemporary constitutionalism or Dworkin's conception of 'law as integrity'. The values of pluralism and respect for autonomy, however, are also employed to justify some of the main aspects of a liberal state, such as the value of democracy, the rule of law, and certain conceptions of equality. The essays are organized in three groups: the first considers the rule of law, democracy and constitutionalism. The second group consists of several essays on the nature of law, legal theory, and their relations to morality. Finally, the collection concludes with essays on the nature of rights, the limits of rights discourse, and the value of economic equality. (shrink)

The normal way to establish that a person has authority over another requires a rule-governed institutional setting. To have authority is to have power, in the juridical sense of the term, and power can only be conferred by norms constituting it. Power-conferring norms are essentially institutional, and the obligation to comply with a legitimate authority's decree is, first and foremost, institutional in nature. The main argument presented in this essay is that an explanation of practical authorities is a two-stage affair: (...) the special, practical import of an authority can only be explained against the background of an institutional setting which constitutes the authority's power and the corresponding obligation to comply. However, this obligation is not an all things considered obligation, it is conditioned on reasons to participate in the relevant institution or practice. (shrink)

In “Considering Causalisms”, Andrew Sneddon critically examines causalism, the dominant position in action theory since Donald Davidson published his influential article, “Actions, Reasons, and Causes”. Sneddon’s analysis is based on a distinction he makes between two kinds of causalism. One is a minimal version of causalism, which holds only a causal view of reasons explanations. Sneddon calls it “restricted-causalism,” or causalismR.

Aleksandr Pushkin (1799-1837) occupies a special place in the development of Russian culture. He was at the same time a great poet, the reformer of Russian literary language, a historian and a political thinker. In the enormous mass of work devoted to Pushkin, a certain number of articles are concerned with his ideas on economics and the reflection of socio-economic problems in his writing. Until now, however, this theme has been studied in only a fragmentary way and less from the (...) point of view of the professional economist than from that of a literary historian. In an attempt to enlarge and complete the idea we may have of Pushkin's economic views, I propose also to show the importance the politico-economic thought of Western Europe had for his work. One person comes to the fore when we study the subject from this angle: Nikolai Turgenev, a Decembrist, one of the “masters” of the poet's youth, who played an important role in the rapprochement of Russian and Western European cultures. The nonlocality phenomena exhibited by entangled quantum systems are certainly one of the most extraordinary aspects of quantum theory. This book discusses this phe nomenon according to several points of view, i.e., according to different interpretations of the mathematics of the quantum formalism. The several interpretations of the Copenhagen interpretation, the many worlds, the de Broglie-Bohm, quantum logics, the decohering by the environment approach and the histories approach interpretations are scrutinized and criticized in detail. Recent results on cryptography, quantum bit (...) commitment, quantum erasers and teleportation are also presented and discussed. In preparing the book we benefited from discussions with many people, but we would like, in particular, to express our gratitude to Professor B. d'Espagnat for his useful comments and suggestions. Some 60 years ago chemicals that intercalate between base pairs of duplex DNA were found to amplify frameshift mutagenesis. Surprisingly, the robust induction of frameshifts by intercalators still lacks a mechanistic model, leaving this classic phenomenon annoyingly intractable. A promising idea of asymmetric half‐intercalation‐stabilizing frameshift intermediates during DNA synthesis has never been developed into a model. Instead, researchers of frameshift mutagenesis embraced the powerful slipped‐mispairing concept that unexpectedly struggled with the role of intercalators in frameshifting. It is proposed that the (...) slipped mispairing and the half‐intercalation ideas are two sides of the same coin. Further, existing findings are reviewed to test predictions of the combined “half‐intercalation into the slipped‐mispairing intermediate” model against accumulated knowledge. The existence of potential endogenous intercalators and the phenomenon of “DNA bookmarks” reveal ample possibilities for natural frameshift mutagenisis in the cell. From this alarming perspective, it is discussed how the cell could prevent genome deterioration from frameshift mutagenesis. (shrink)
