In these writings by one of our most creative legal philosophers, Meir Dan-Cohen explores the nature of the self and its response to legal commands and mounts a challenge to some prevailing tenets of legal theory and the neighboring moral, political, and economic thought. Are colors relational or non-relational properties of their bearers? Is red a property that is instantiated by all and only the objects with a certain intrinsic (/non-relational) nature? Or does an object with a particular intrinsic (/non-relational) nature count as red only in virtue of standing in certain relations - for example, only when it looks a certain way to a certain perceiver, or only in certain circumstances of observation? In this paper I shall argue for the view that color (...) properties are relational (henceforth, relationalism), and against the view that colors are not relational (henceforth, anti- or non-relationalism). This paper links two domains of recent interest in science and technology studies, complexity and ignorance, in the context of knowledge practices observed among synthetic biologists. Synthetic biologists are recruiting concepts and methods from computer science and electrical engineering in order to design and construct novel organisms in the lab. Their field has taken shape amidst revised assessments of life’s complexity in the aftermath of the Human Genome Project. While this complexity is commonly taken to be an immanent property of (...) biological systems, this article presents an epistemological view of complexity according to which complexity relates to a specific scientific theory or model and refers to that which exceeds the theory or model’s explanatory power. This epistemological view allows us to narrate a particular story about the changing relationship between biology and synthetic biology in the last decade and accounts for early knowledge practices in synthetic biology that “ignored” biology. This article further argues that while the failure of ignorance to produce clear-cut results for synthetic biologists has led practitioners back to biology, the entanglements between different pragmatic orientations and ways of knowing trouble the implications of this return for assessments of the complexity of biological systems. “de-extinction” refers to the process of resurrecting extinct species by genetic methods. This science-fiction-sounding idea is in fact already in early processes of scientific implementation. Although this recent “revival of the dead” raises deep ethical questions, the ethics of de-extinction has barely received philosophical treatment. Rather than seeking a verdict for or against de-extinction, this paper attempts an overview and some novel analyses of the main ethical considerations. Five dimensions of the ethics of de-extinction are explored: (a) the possible contribution (...) of de-extinction to promoting ecological values, (b) the deontological argument that we owe de-extinction to species we rendered extinct, (c) the question of “playing God” through de-extinction, (d) the utilitarian perspective, and (e) the role of aesthetic considerations in the ethics of de-extinction. A general feature arising from the paper’s discussion is that, due to de-extinction’s special character, it repeatedly tests the limits of our ethical notions. (shrink)

A terrible ambivalence grips us when it comes to our genes. We want to respond to the Socratic call to know ourselves by learning (...) what lies on the minute threads of the chromosomes spun into the nuclei of our cells. At the same time, we fear obtaining that information, for it seems functionally equivalent to the oracle at Delphi, revealing a distinct and dangerous knowledge we would rather not have.What is it about genetic knowledge that creates such ambivalence in us? Genetic knowledge is empowering. It offers us the freedom to shape the contours of our lives and those of our families. At the same time, genetic knowledge is disempowering. It bears a peculiar mark of inevitability, telling us that we have no control over our present or future in important respects. Better to hide from such overbearing information than to suffer the assaults on our freedom it seems to create.We can see this ambivalence about genetic knowledge appearing again and again as the field of genetics has grown. Initially, genetics emerged as a tool for understanding how traits and diseases are passed from generation to generation. We used genetic testing mostly to enhance our personal decision making about reproductive matters. It was at this time that our hesitancy about pursuing such testing first arose, for we feared being put into a position of asking such painful questions as, “Knowing what we do about our genes, should we have children?” As the scope of genetic information expanded, we learned to test for genes that could signal the development of such terrible conditions as Huntington’s disease. The possibility of gaining access to such disturbing information exacerbated our fear of genetic knowledge—to some, the certainty of knowing seemed worse than the uncertainty of not knowing. As genetic research has disclosed genes associated with conditions that might, but not necessarily will occur, the uncertainty of knowing, to some, seems worse than that of not knowing. Among the extraordinary Polish philosophers of the past one hundred years, Zygmunt Zawirski deserves to be given particular attention for his fusion of analytic and historical scholarship. Strikingly versatile, and con tributing original work in all his fields of competence, Zawirski thought through issues in the philosophical aspects of relativity theory, on the claims of intuitionalistic foundations of mathematics, on the nature and usefulness of many-value Logics, and on the calculus of probability, on the axiomatic method in science and in (...) the philosophy of science, on the genesis and development of scientific and philosophical concepts, and in his crowning achievement, the conceptual history of notions of time. His work has been too little known in English despite the respect which has been so clearly shown by his Polish COlleagues and students. In this generous selection from his papers and from his great critical study L' Evolution de la Notion du Temps, Dr. Irena Szumilewicz-Lachman has provided a clear account of Zawirski's achievement; and she has written a fine comprehensive introductory essay which provides both the personal and historical context of his work and a systematic survey of his principal publications. We offer a novel theory of information that differs from traditional accounts in two respects: (i) it explains information in terms of counterfactuals rather than conditional probabilities, and (ii) it does not make essential reference to doxastic states of subjects, and consequently allows for the sort of objective, reductive explanations of various notions in epistemology and philosophy of mind that many have wanted from an account of information.

In this paper, we present and defend the theoretical framework of an empirical model to describe people’s fundamental moral attitudes (FMAs) to animals, the stratification of FMAs in society and the role of FMAs in judgment on the culling of healthy animals in an animal disease epidemic. We used philosophical animal ethics theories to understand the moral basis of FMA convictions. Moreover, these theories provide us with a moral language for communication between animal ethics, FMAs, and public debates. We defend (...) that FMA is a two-layered concept. The first layer consists of deeply felt convictions about animals. The second layer consists of convictions derived from the first layer to serve as arguments in a debate on animal issues. In a debate, the latter convictions are variable, depending on the animal issue in a specific context, time, and place. This variability facilitates finding common ground in an animal issue between actors with opposing convictions. (shrink)

This article focuses on the impact of globalization on international law and the discourse of sovereignty. It challenges the claim that we have entered into a new world order characterized by transnational governance and decentered global law, which have replaced “traditional” international law and rendered the concepts of state sovereignty and international society anachronistic. We are indeed in the presence of something new. But if we drop the concept of sovereignty and buy into the idea that transnational governance has upstaged (...) international treaty organizations, we will misconstrue the nature of contemporary international society and the political choices facing us. In the contemporary context where there is a powerful imperial project afoot (on the part of the United States) that seeks to develop a useful version of global (cosmopolitan) right to justify its self-interested interventions, proposals to abandon the default position of sovereignty and its corollary, the principle of nonintervention in international law, are both premature and dangerous. Instead, we should rethink the normative dimensions of the concept of sovereignty in light of the new principle of sovereign equality articulated in the UN Charter, and show how it can complement cosmopolitan principles such as human rights and collective security. The task is to strengthen, not abandon, international law and supranational institutions, and to foster a global rule of law that protects both the sovereign equality of states, based on a revised conception of sovereignty, and human rights. To understand private property, it is generally assumed, we must recognize the contribution objects make to human life. On the prevailing view, ownership is valuable only insofar as its subject matter is of value. In the order of valuation, objects come first, owning them comes second. But despite its air of obviousness, the assumption does not suit our ordinary concept of ownership. Ownership can be valuable quite apart from the value of the owned object, and it can be the source (...) of an object’s value as well as derive from the latter its own value. At its core, our ordinary concept of ownership does not describe a normative but an ontological relationship to objects, analogous to our relationship to our bodies, and best revealed by attending to our self-referential use of first person pronouns, personal and possessive. The result is a non-reductive and non-consequentialist account of property, or, more accurately, of the idea of ownership. (shrink)

Within psychology, philosophy, and cognitive science, theory of mind refers to the cognitive ability to reason about the mental states of other people, thus recognizing them as having beliefs, knowledge, intentions and emotions of their own. In this project, we construct a natural language inference (NLD) dataset that tests the ability of a state of the art language model, RoBERTa-large finetuned on the MNLI dataset, to make theory of mind inferences related to knowledge and belief. Quantum entanglement is a key resource, which grants quantum systems the ability to accomplish tasks that are classically impossible. Here, we apply Feynman's sum-over-histories formalism to interacting bipartite quantum systems and introduce entanglement measures for bipartite quantum histories. Based on the Schmidt decomposition of the matrix comprised of the Feynman propagator complex coefficients, we prove that bipartite quantum histories are entangled if and only if the Schmidt rank of this matrix is larger than 1. The proposed approach highlights the utility (...) of using a separable basis for constructing the bipartite quantum histories and allows for quantification of their entanglement from the complete set of experimentally measured sequential weak values. We then illustrate the nonclassical nature of entangled histories with the use of Hardy's overlapping interferometers and explain why local hidden variable theories are unable to correctly reproduce all observable quantum outcomes. Our theoretical results elucidate how the composite tensor product structure of multipartite quantum systems is naturally extended across time and clarify the difference between quantum histories viewed as projection operators in the history Hilbert space and those viewed as chain operators and propagators in the standard Hilbert space. This is an examination of Aristotle's notion of an "accidental being" -- something intermediate between a substance and a property. An accidental being (sometimes called "accidental compound" or "kooky object") is an ephemeral object, typically the compound of a substance and a property, that exists for only as long as its components are united. I set out the role that accidental beings play in Aristotle's solutions to several philosophical problems. I also investigate the similarity between these beings and the individual (...) non-substances of Aristotle's Categories. Finally, I propose that accidental beings can be assimilated into a more contemporary conceptual scheme as events -- the states or conditions that substances are in or undergo. (shrink)

Jonah N. Schupbach and Jan Sprenger have proposed conditions of adequacy for measures of explanatory power. They derive and defend a measure of explanatory power satisfying their conditions of adequacy. This article furthers the development of their measure. The requirement that the measure be multidimensional analytic is avoided. Several proofs are simplified, and gaps in proofs are filled.

Starting from the late Renaissance, efforts to make vocal music more expressive heightened the power of words, which, in turn, gave birth to the modern semantics of musical expression. As the skepticism of seventeenth-century science divorced the acoustic properties from the metaphysical qualities of music, the door was opened to dicern the rich links between musical perception and varied mental faculties. In Tuning the Mind, Ruth Katz and Ruth HaCohen trace how eighteenth century theoreticians of music examined anew the role (...) of the arts within a general theory of knowledge. As the authors note, the differences between the physical and emotional dimensions of music stimulated novel conceptions and empirical inquiries into the old aesthetic queries. Tracing this development, their opening chapter deals with seventeenth-century epistemological issues concerning the artistic qualities of music. Katz and HaCohen show that painting and literature displayed a comparable tendency toward "musicalization," whereby the dynamic of forms-the modalities specific to each artistic medium-rather than subject matter was believed to determine expression. Katz and HaCohen explore the ambiguities inherent in idealization of an art form whose mimetic function has always been problematic. They discuss the major outlines of this development, from Descartes to Vico through Condillac. Particular emphasis is placed on eighteenth-century British thinkers, from Shaftesbury to Adam Smith, who perceived these problems in their full complexity. They also explore how the French and the Germans dealt differently with questions that preoccupied the British, each nation in accordance with their own past tradition and tendencies. The concluding chapter summarizes the parallel development of abstract art and basic hypotheses concerning the mind and explores basic theoretical questions pertaining to the relationship between perception and cognition. In addressing some of the most complex problems in musical aesthetics, Katz and HaCohen provide a unique historical perspective on the ways their art creates and develops coherent worlds, and, in so doing, contribute to our understanding of the workings of the mind. This third volume of Boston Studies in the Philosophy of Science contains papers which are based upon Colloquia from 1964 to 1966. In most cases, they have been substantially modified subsequent to presentation and discussion. Once again we publish work which goes beyond technical analysis of scientific theories and explanations in order to include philo sophical reflections upon the history of science and also upon the still problematic interactions between metaphysics and science. The philo sophical history of scientific ideas has (...) increasingly been recognized as part of the philosophy of science, and likewise the cultural context of the genesis of such ideas. There is no school or attitude to be taken as de fining the scope or criteria of our Colloquium, and so we seek to under stand both analytic and historical aspects of science. This volume, as the previous two, constitutes a substantial part of our final report to the U. S. National Science Foundation, which has continued its support of the Boston Colloquium for the Philosophy of Science by a grant to Boston University. That report will be concluded by a subse quent volume of these Studies. It is a pleasure to record our thanks to the Foundation for its confidence and funds. We dedicate this book to the memory of Norwood Russell Hanson. I critically discuss two kinds of argument in favour of ontological pluralism and argue that they fail to show that ways of being are explanatorily fruitful.

Review of Divine Substance, by Christopher Stead (Oxford, Clarendon Press: 1977).

These two volumes form a full portrait of Hans Reichenbach, from the school boy and university student to the maturing and creative scholar, who was as well an immensely devoted teacher and a gifted popular writer and speaker on science and philosophy. We selected the articles for several reasons. Many of them have not pre viously been available in English; many are out of print, either in English or in German; some, especially the early ones, have been little known, and (...) deal with subject-matters other than philosophy of science. The genesis and evolu tion of Reichenbach's ideas appeared to be of deep interest, and so we in cluded papers from four decades, despite occasional redundancy. We were, for example, pleased to include his extensive review article from the encyclo pedic Handbuch der Physik of 1929 on 'The Aims and Methods of Physical Knowledge', written at a time of creative collaboration between Reichenbach's Berlin group and the Vienna Circle of Schlick and Carnap. Reichenbach was a pioneer, opening new pathways to the solution of age-old problems in many fields: space, time, causality, induction and probability - philosophical analysis and interpretation of classical physics, relativity and quantum physics - logic, language, ethics, scientific explanation and methodology, critical appreciation and reconstruction of past metaphysical thinkers and scientists from Plato to Leibniz and Kant. Indeed, his own philosophical journey was initiated by his passage from Kant to anti-Kant. (shrink)

The Work and Lives of Teachers offers a simple but original argument: that the cultural attitudes toward the teaching profession measurably influence how students perform. Cohen uses both ethnographic portraits and personal accounts from teachers for several countries to explore the meaning and value of teaching worldwide. This study includes the ways in which teachers in these countries are educated, recruited, compensated, and perceived by parents, students, administrators, and the culture at large. Teachers' voices, so rarely heard in international (...) educational studies, are front and center here, highlighting the daily work in the classroom and the pleasures and struggles of engaging in today's teaching profession.
