This article examines communication between a human being and God in the Jewish philosophy of Hermann Cohen (1842–1918). The article focuses on two distinct forms of biblical communication: lyrical psalms and a godly revelation in a still small voice. It investigates Cohen’s Jewish philosophy in light of communication theories to deepen the philosophical and theoretical discussion. The article examines previously unexplored ideas in Cohen’s writings, analyzes his religious perceptions in terms of communication, and at the same time expands the concept (...) of communication. We give a complete characterization of the class of upward monotone generalized quantifiers Q1 and Q2 over countable domains that satisfy the scheme Q1 x Q2 y φ → Q2 y Q1 x φ. This generalizes the characterization of such quantifiers over finite domains, according to which the scheme holds iff Q1 is ∃ or Q2 is ∀ (excluding trivial cases). Our result shows that in infinite domains, there are more general types of quantifiers that support these entailments.

An analysis of this lecture shows that Strauss hadn't fully mastered the art of writing he'd discovered in others: his secrets are too exposed. In the context of "German Nihilism," it becomes clear that "Persecution and the Art of Writing" is about liberal persecution of authoritarianism, no the reverse, as liberals would assume. The German Stranger provides a guide to Leo Strauss that situates his thought in the context of National Socialism; by destroying any middle ground between 'Athens' and 'Jerusalem, ' Strauss undermined modernity's secular bulwark against political theology. Once National Socialism is understood as an atheistic religion re-enacted by post-Revelation 'philosophers, ' the German avatar of Plato's Athenian Stranger can be recognized as its principal theoreticia.

This book argues that Cicero deserves to be spoken of with more respect and to be studied with greater care. Using Plato’s influence on Cicero’s life and writings as a clue, Altman reveals the ineffable combination of qualities—courage, originality, intelligence, sparkling wit, subtlety, deep respect for his teacher, and deadly seriousness of purpose—that enabled Cicero not only to revive Platonism, but also to rival Plato himself.

Most ethics guidelines for distributing scarce medical resources during the coronavirus pandemic seek to save the most lives and the most life‐years. A patient’s prognosis is determined using a SOFA or MSOFA score to measure likelihood of survival to discharge, as well as a consideration of relevant comorbidities and their effects on likelihood of survival up to one or five years. Although some guidelines use age as a tiebreaker when two patients’ prognoses are identical, others refuse to consider age for (...) fear of discriminating against the elderly. In this paper, I argue that age is directly relevant for maximizing health benefits, so current ethics guidelines are wrongly excluding or deemphasizing life‐stage in their triage algorithms. Research on COVID‐19 has shown that age is a risk factor in adverse outcomes, independent of comorbidities. And limiting a consideration of life‐years to only one or five years past discharge does not maximize health benefits. Therefore, based on their own stated values, triage algorithms for coronavirus patients ought to include life‐stage as a primary consideration, along with the SOFA score and comorbidities, rather than excluding it or using it merely as a tiebreaker. This is not discriminatory because patients ought to have equal opportunity to experience life‐stages. The equitable enforcement of that right justifies unequal treatment based on age in cases when there is a scarcity of life‐saving resources. A consideration of life‐stage would thus allow healthcare workers to responsibly steward public resources in order to maximize lives and life‐years saved. (shrink)

This article foregrounds the great translation movement (GTM), initially mobilised on X (formerly Twitter) in response to the Russian invasion of Ukraine, as an example of activist journalism countering China's 'mainstream' narrative of the war and its broader implications. Using Fairclough’s dialectical-relational approach, adapted to the specifics of social media communication, we examine GTM postings throughout the first calendar year of the war, highlighting how the GTM evolves into a broader activist-journalistic initiative that challenges the party-state beyond its involvement in (...) the war. This paradigm of intervention unfolds as GTM activists report on evidential events within China that bear the potential to spark public contention outside of the party-state’s censorship reach. By examining the dialectical relations between reportage and advocacy, this analysis demonstrates how activist journalism constitutes an emerging cross-border civic engagement, challenging a Southern authoritarian regime from the outside. A critical evaluation of activist journalism and its broader societal impacts is also provided, highlighting its progressive potential and future development in the Chinese context and beyond. Using the concept of purposeful action, I define the necessary and sufficient aspects of any property. These qualities are derived though noticing that property is those things which are the object of a set of past, present, and future actions of individuals. The result is that property is the result of a change in the physical world which lends itself to control and is expected to grant a future value to the actor. By deconstruction, these qualities are used to show (...) that aggression upon another actor is equivalent to a property claim in that other actor, enforcement of a property claim may involve an aggression, and conflicting aggressions may only be compared subjectively. Thus the novel concept of net coercion is introduced to delineate which actors are making an over-reaching property claim. This incorporates the common term of aggression as used by modern libertarian theorists, but allows for a further analysis when there are conflicts of possible or perceived aggressions; certainly attempting to minimize the net coercion of a system of actors is equivalent to the special case of striving for zero-aggression. After establishing the value-free concepts that entail property regimes I define the seeking of justice as trying to minimize the net coercion of any system. From this single necessary definition of justice, a number of problems are analyzed including the stereotypical commons, a construction equivalent to hostile encirclement, and claims of property in intellectual creations. The ultimate conclusion of this analysis is that property regimes with a positive net coercion are unjust and equivalent to property claims in the individual actors subject to the more aggressive actors, in essence, that they are the chattel slaves of the dominant actors in proportion to the amount of net coercion used against them. From these foundations, a philosophical system by which to analyze particular property claims is created and a suggestion of how law and economics should treat property claims is implicit. (shrink)

With both the Roman Empire and contemporary scholarship as backdrop, this book contrasts the Imperial Platonism of Plotinus with Plato's own by distinguishing one as a master enlightening disciples, and the other as an Athenian teacher who taught students to discover the truth for themselves in the Academy.

In this chapter, Altman gives two separate arguments that, in conjunction, support a mixed theory of punishment. First, he shows that consequentialism is insufficient on its own because it cannot capture the condemnatory function of the law as an expression of the community’s resentment. Second, he shows that retributivism is insufficient on its own because any plausible legal arrangement must be committed to some non-retributivist values. He then argues that the institution of punishment is justified by its costs and (...) benefits, and the distribution of punishment—who is punished and how much—is justified by what offenders deserve. This two-tiered model of punishment makes more sense than an alternative scheme, according to which retributivist reasoning informs criminal lawmaking and consequentialist reasoning informs criminal judgments and sentencing. This paper’s main aim is to illuminate how climate activism—which seeks to address the collective existential crisis that is climate change—uniquely intersects with the individual existential crisis that is one’s own death. Addressing climate change seems to minimally require more cooperation and less environmentally unfriendly behavior. However, in virtue of the way discussions on climate change can make nature’s vulnerability—and, relatedly, our own mortality—psychologically salient, climate discourse is capable of engendering existential anxiety. This poses problems for climate activism, as attenuating (...) existential anxiety often relies on forms of self-esteem striving capable of undermining cooperation and exacerbating environmentally unfriendly behavior. I take these problems to have implications for a certain style of discourse made famous by Greta Thunberg: climate shaming. Because of shame’s potential to induce moral maturation/motivational revision, some take climate shaming to be a justified strategy for promoting climate activism. Yet empirical research suggests that climate shaming may often catalyze various self-esteem striving behaviors that lead to the exact opposite of climate shaming’s intended effect(s). In my view, this is because of climate shaming’s problematic potential to engender existential anxiety. If so, climate activists have good reason to abandon the climate shaming strategy. (shrink)

"This book argues for a mixed view of punishment that balances consequentialism and retributivism. He has published extensively on philosophy and applied ethics. A central question in the philosophy of law is why the state's punishment of its own citizens is justified. Traditionally, two theories of punishment have dominated the field: consequentialism and retributivism. According to consequentialism, punishment is justified when it maximizes positive outcomes. According to retributivism, criminals should be punished because they deserve it. This book defends a mixed (...) view that recognizes the strength of both of these intuitions. By this account, the legislature should develop institutional policies and statutory penalties that maintain the social order, that is, consequentialism. It establishes punishment policies to deter criminal activity. By contrast, the criminal judiciary should give individual defendants what they deserve, that is, retributivism and thus expressing the community's appropriate sense of resentment at being wronged. The book justifies the two-tiered model by showing how it accords with our moral intuitions, our assumptions about how what we know affects our moral obligations, and a commonly held theory of freedom. This approach is developed by engaging classic and contemporary work in the philosophy of law, and shows its advantages over competing approaches from contemporary retributivists and other mixed theorists. The work also defends consequentialism against a longstanding objection that the social sciences give us little guidance regarding which policies to adopt. It draws on cutting-edge criminological research to show how punishment theory can help us to address some of our most pressing social issues, including the death penalty, drug laws, and mass incarceration. Parents resemble trustees, conservators, and other fiduciaries; they exercise broad discretion while making choices for vulnerable people. Like other fiduciaries, parents can be tempted to neglect their duties or pursue self-interest at the expense of those they should protect. This article argues against treating parents as fiduciaries for three reasons. First, the scope of parental fiduciary duties cannot be narrowed enough to make them tolerable. Arguments limiting fiduciary duties to cases where parents exercise delegated powers or act within parenting roles (...) fail. Most parental decisions involve dual powers or roles. Efforts to address these dual-role cases produce principles that are unduly demanding, complex, arbitrary, and morally unappealing. Second, we could limit parental fiduciary duties by designing parental roles to benefit children. Since children need devoted, happy, well-rounded parents, the principle of designing parental roles to benefit children would produce rules that leave room for parents to flourish. However, this principle does not justify specific legal or moral fiduciary norms. Third, we could redefine fiduciary duties so parents can balance their interests against children’s interests, making fiduciary duties less burdensome. However, expanding the definition of fiduciary threatens to encompass many duties within the fiduciary category, rendering the description almost meaningless. (shrink)

Two of the major arguments against performance-enhancing drugs (PEDs), appealing to fairness and the protection of athletes’ health, have serious flaws. First, there is no relevant moral distinction between the use of PEDs and the use of other performance enhancers that introduce unfairness and that we accept nonetheless. Second, prohibiting PEDs for athletes’ own good ignores the fact that adult athletes are constantly making tradeoffs to improve performance and pursue excellence, including sacrificing their health. We should not paternalistically impose our (...) values on them. On the other side, arguments to allow ‘safe’ PEDs provide no normative criterion to determine the acceptable level of risk, thus begging the question. The reasonable athlete argument solves both sets of problems: it justifies a ban on some performance-enhancing drugs based on health and fairness, while avoiding paternalism, and it also establishes a non-arbitrary standard to determine which drugs ought to be allowed. First, if unsafe PEDs were allowed, some athletes would refuse to take them out of concern for their health. This is a reasonable decision even though it would put them at a competitive disadvantage against athletes who choose to use unsafe PEDs. It would be unfair for clean athletes to suffer a competitive disadvantage for acting reasonably. Therefore, PEDs that pose significant health risks should be prohibited for all athletes. Second, it would be unreasonable for athletes to refuse, on principle, relatively safe and effective PEDs, so a blanket prohibition is also unjustified. Which drugs and which doses to allow should be determined not by athletes’ actual choices but by the hypothetical choices of the reasonable athlete. The resulting sport-specific drug policy would carve a justifiable middle path between complete prohibition and complete permission. (shrink)

In his theoretical philosophy, Immanuel Kant argues that experience comes from two sources that are radically different but equally necessary: the rule-governed activity of thinking and the givenness of sensations. He supposes that both could be traced to some common root but concludes that whatever it is, is in principle unknowable. Kant's idealist successors, J.G. Fichte and F.W.J. Schelling, each attempt to provide a unified account of experience by identifying the ultimate basis of subject and object—Fichte by referring to the (...) I's activity and Schelling by referring to the Absolute. Because we can know only appearances, an implication of Kant's transcendental inquiry, Fichte and Schelling have difficulty... (shrink)

When examined critically, Kant's views on sex and marriage give us the tools to defend same-sex marriage on moral grounds. The sexual objectification of one's partner can only be overcome when two people take responsibility for one another's overall well-being, and this commitment is enforced through legal coercion. Kant's views on the unnaturalness of homosexuality do not stand up to scrutiny, and he cannot (as he often tries to) restrict the purpose of sex to procreation. Kant himself rules out marriage (...) only when the partners cannot give themselves to one another equally – that is, if there is inequality of exchange. Because same-sex marriage would be between equals and would allow homosexuals to express their desire in a morally appropriate way, it ought to be legalized. (shrink)

This article offers a timely, critical analysis of the male gaze upon sportswomen in male Chinese fans’ consumption of sporting megaevents. We use the most popular Chinese-language sports fandom platform, Hupu, as the data repository and scrutinise the threads of male Hupu users’ postings about two elite sportswomen at the Tokyo 2020 Olympics as the case studies. Drawing on feminist critical discourse analysis (FCDA), we elucidate the discursive strategies that male Chinese fans adopt to sexualise sportswomen and trivialise their accomplishments. (...) There are two well‐known ways of doing arithmetic with ordinal numbers: the “ordinary” addition, multiplication, and exponentiation, which are defined by transfinite iteration; and the “natural” (or “Hessenberg”) addition and multiplication (denoted ⊕ and ⊗), each satisfying its own set of algebraic laws. In 1909, Jacobsthal considered a third, intermediate way of multiplying ordinals (denoted × ), defined by transfinite iteration of natural addition, as well as the notion of exponentiation defined by transfinite iteration of his multiplication, which we denote. (...) (Jacobsthal's multiplication was later rediscovered by Conway.) Jacobsthal showed these operations too obeyed algebraic laws. In this paper, we pick up where Jacobsthal left off by considering the notion of exponentiation obtained by transfinitely iterating natural multiplication instead; we shall denote this. We show that and that ; note the use of Jacobsthal's multiplication in the latter. We also demonstrate the impossibility of defining a “natural exponentiation” satisfying reasonable algebraic laws. During the coronavirus pandemic, communities have faced shortages of important healthcare resources such as COVID-19 vaccines, medical staff, ICU beds and ventilators. Public health officials in the U.S. have had to make decisions about two major issues: which infected patients should be treated first, and which people who are at risk of infection should be inoculated first. Following Beauchamp and Childress’s principlism, adopted guidelines have tended to value both whole lives and life-years. This process of collective moral reasoning has revealed (...) our common commitment to both Kantian and utilitarian principles. For Kant, respecting people’s rights entails that we ought to value whole lives equally. Therefore we ought to allocate resources so as to maximise the number of patients who survive to discharge. By contrast, the principle of utility has us maximise life-years so that people can satisfy more of their considered preferences. Although people are treated impartially in the utilitarian calculus, it does not recognise their equal worth. Subjecting Kantian ethics and utilitarianism to the process of reflective equilibrium lends support to the idea that we need a pluralistic approach that would accommodate our moral intuitions regarding both the equal value of whole lives and the additive value of life-years.
