Los estados normativos solo pueden ser percibidos a partir de su frustración. Partiendo de esta premisa, el presente artículo propone una definición filosófica de la inseguridad social, basada en la reciente revisión de la función práctica y cognitiva de dos emociones tradicionalmente entendidas como negativas: el resentimiento y la ansiedad. Se analizará el resentimiento como un potencial generador de vínculos políticos en la memoria de un pasado de protección arrebatada, y la ansiedad como un indicador epistémico en condiciones de incertidumbre (...) objetiva. Se colige una definición de la inseguridad acotada entre la retención resentida del pasado y la proyección preventiva del futuro. Normative states can only be experienced from their frustration. Based on this premise, this article proposes a philosophical definition of social insecurity, based on the recent review of the practical and cognitive function of two emotions traditionally understood as negative: resentment and anxiety. Resentment will be analyzed as a potential generator of political links in the memory of a past of rapt protection, whereas anxiety wil be understood as an epistemic indicator in conditions of objective uncertainty. A definition insecurity will be set between the resentful retention of the past and the preventive projection of the future. (shrink)

Bioethicists involved in end‐of‐life debates routinely distinguish between ‘killing’ and ‘letting die’. Meanwhile, previous work in cognitive science has revealed that when people characterize behaviour as either actively ‘doing’ or passively ‘allowing’, they do so not purely on descriptive grounds, but also as a function of the behaviour’s perceived morality. In the present report, we extend this line of research by examining how medical students and professionals (N = 184) and laypeople (N = 122) describe physicians’ behaviour in end‐of‐life scenarios. (...) We show that the distinction between ‘ending’ a patient’s life and ‘allowing’ it to end arises from morally motivated causal selection. That is, when a patient wishes to die, her illness is treated as the cause of death and the doctor is seen as merely allowing her life to end. In contrast, when a patient does not wish to die, the doctor’s behaviour is treated as the cause of death and, consequently, the doctor is described as ending the patient’s life. This effect emerged regardless of whether the doctor’s behaviour was omissive (as in withholding treatment) or commissive (as in applying a lethal injection). In other words, patient consent shapes causal selection in end‐of‐life situations, and in turn determines whether physicians are seen as ‘killing’ patients, or merely as ‘enabling’ their death. Despite continuing controversies regarding the vital status of both brain-dead donors and individuals who undergo donation after circulatory death (DCD), respecting the dead donor rule (DDR) remains the standard moral framework for organ procurement. The DDR increases organ supply without jeopardizing trust in transplantation systems, reassuring society that donors will not experience harm during organ procurement. While the assumption that individuals cannot be harmed once they are dead is reasonable in the case of brain-dead protocols, we argue that the DDR (...) is not an acceptable strategy to protect donors from harm in DCD protocols. We propose a threefold alternative to justify organ procurement practices: (1) ensuring that donors are sufficiently protected from harm; (2) ensuring that they are respected through informed consent; and (3) ensuring that society is fully informed of the inherently debatable nature of any criterion to declare death. This book brings together the most current thinking about the Anthropocene in the field of Environmental Political Theory ('EPT'). It displays the distinctive contribution EPT makes to the task of thinking through what 'the environment' means in this time of pervasive human influence over natural systems. Across its chapters the book helps develop the idea of 'socionatural relations'--an idea that frames the environment in the Anthropocene in terms of the interconnected relationship between human beings and their surroundings. Coming from both (...) well-established and newer voices in the field, the chapters in the book show the diversity of points of view theorists take toward the Anthropocene idea, and socionatural relations more generally. However, all the chapters exemplify a characteristic of work in EPT: the self-conscious effort to provide normative interpretations that are responsive to scientific accounts. The Introduction explains the complicated interaction between science and EPT, showing how it positions EPT to consider the Anthropocene. And the Afterword, by a pioneer in the field, relates all the chapters to a perspective that has been deeply influential in EPT. This book will be of interest to scholars already engaged in EPT. But it will also serve as an introduction to the field for students of Political Theory, Philosophy, Environmental Studies, and related disciplines, who will learn about the EPT approach from the Introduction, and then see it applied to the pressing question of the Anthropocene in the ensuing chapters. Background Consent policies for post-mortem organ procurement (OP) vary throughout Europe, and yet no studies have empirically evaluated the ethical implications of contrasting consent models. To fill this gap, we introduce a novel indicator of governance quality based on the ideal of informed support, and examine national differences on this measure through a quantitative survey of OP policy informedness and preferences in seven European countries. -/- Methods Between 2017–2019, we conducted a convenience sample survey of students (n = 2006) in (...) Austria (AT), Belgium (BE), Denmark (DK), Germany (DE), Greece (GR), Slovenia (SI) and Spain (ES), asking participants about their donation preferences, as well as their beliefs and views about the policy in place. From these measures, we computed indices of informedness, policy support, and fulfilment of unexpressed preferences, which we compared across countries and consent systems. -/- Results Our study introduces a tool for analyzing policy governance in the context of OP. Wide variation in policy awareness was observed: Most respondents in DK, DE, AT and BE correctly identified the policy in place, while those in SI, GR and ES did not. Respondents in opt-out countries (AT, BE, ES and GR) tended to support the policy in place (with one exception, i.e., SI), whereas those in opt-in countries (DE and DK) overwhelmingly opposed it. These results reveal stark differences in governance quality across countries and consent policies: We found a preponderance of informed opposition in opt-in countries and a general tendency towards support–either informed or uninformed–in opt-out countries. We also found informed divergence in opt-in countries and a tendency for convergence–either informed or uninformed–among opt-out countries. -/- Conclusion Our study offers a novel tool for analyzing governance quality and illustrates, in the context of OP, how the strengths and weaknesses of different policy implementations can be estimated and compared using quantitative survey data. A key issue in the business ethics field is the design of effective measures for assessing the ethical culture of organizations. The Corporate Ethical Virtues Model (CEV), developed by Kaptein in 2008, is an instrument for measuring ethical culture, and has been applied, adapted and validated in different contexts. In 2013, DeBode, Armenakis, Field and Walker developed the CEV–S, a shortened version of the original scale. Both the CEV and CEV–S assess eight dimensions based on corporate ethical virtues: clarity, congruency (...) of supervisors, congruency of senior management, feasibility, supportability, transparency, discussability and sanctionability. The objective of this study is to present a Spanish version of the CEV–S and its validation process. The scale was applied to two samples of 114 and 193 Colombian employees from two companies operating in the services sector. The confirmatory factor analyses revealed a good fit for the eight-factor structure of the Spanish CEV–S and the statistical tests applied showed good levels of reliability and validity for this scale. The adequate psychometric properties shown by the Spanish CEV–S may support its use in future research to measure organizational ethical culture in Spanish-speaking settings. (shrink)

Las herramientas más utilizadas en las últimas décadas han sido los tratados de libre comercio que, además de la desgravación total o parcial y progresiva, implican cambios en las condiciones internas relativas a la normatividad aplicada, con el ánimo de facilitar las relaciones de comercio, la búsqueda de un lenguaje aduanero común, así como la estandarización de las operaciones (...) aduaneras. Es una exigencia cada vez mayor que obliga a que se hagan ajustes a los procesos y procedimientos internos; aunado a ello, están los organismos multilaterales a los que cada vez se unen más países, con el propósito de buscar mejores condiciones económicas, políticas y sociales para sus administrados, pero es necesario prestar atención a las afectaciones que tales exigencias e implementaciones presuponen no solo en el ordenamiento interno, sino en la aplicación misma de las normas. The relationship between dementia and criminal behavior perplexes legal and health care systems. Dementia is a progressive clinical syndrome defined by impairment in at least two cognitive domains that interferes with one's activities of daily. Dementia symptoms have been associated with behaviors that violate social norms and constitute criminal actions. A failure to address a gap in policies that support appropriate management of individuals with dementia reflects a failure in our social obligation to care for those who are most vulnerable (...) amongst us. Categorical protections, informed by precedent models applied to juveniles and individuals with psychiatric illness, could help meet a social obligation to provide protections to individuals with dementia. We propose an approach that integrates affirmative defenses to mitigate criminal liability and sentencing restrictions to prevent cruel and unusual punishment. (shrink)

This article examines post-9/11 efforts by Western governments to instill respect for human rights among the world’s Muslim populations. The article argues that Western discourses on human rights are best conceptualized as a hegemonic Bourdieusian distinction strategy. In a dynamic strategy of this type, new human rights norms are continually produced and subverted by liberal elites in the West. Because these norms are constantly evolving, Muslim social practices can never “catch up” to them. This produces a perpetual distinction between a (...) progressive liberal Occident and a backwards illiberal Orient, justifying the perpetual hegemony of the former over the latter. In developing its analysis, the article gives special attention to right-wing nationalist movements in Europe and the USA and US foreign policy in the Middle East. These developments are situated in relationship to liberal imperialism in the Colonial era, the Global War on Terrorism, and recent concerns over immigration. (shrink)

In his influential work on the cognitive science of religion, Pascal Boyer argues that the spread of religious ideas involves a tradeoff between their “intuitiveness” and their interest-provokingness/memorability. For Boyer, religious ideas are “intuitive” insofar as they are easy to understand and learn. However, other CSR studies suggest that religious ideas are “intuitive” insofar as they are easy to believe. In analyzing the spread of religious ideas, no study has considered the tradeoff between interest-provokingness/memorability and intuitiveness in the sense of (...) being easy to believe. The present article takes up this task by considering several religious concepts that are intuitively easy to believe. It is argued that, in typical religions, such concepts are incorporated into myths. Through incorporation, these concepts lose some of their intuitive believability but gain interest-provokingness/memorability. (shrink)

This study examined health professionals’ (HPs) experience, beliefs and attitudes towards brain death (BD) and two types of donation after circulatory death (DCD)—controlled and uncontrolled DCD. Five hundred and eighty-seven HPs likely to be involved in the process of organ procurement were interviewed in 14 hospitals with transplant programs in France, Spain and the US. Three potential donation scenarios—BD, uncontrolled DCD and controlled DCD—were presented to study subjects during individual face-to-face interviews. Our study has two main findings: (1) In the (...) context of organ procurement, HPs believe that BD is a more reliable standard for determining death than circulatory death, and (2) While the vast majority of HPs consider it morally acceptable to retrieve organs from brain-dead donors, retrieving organs from DCD patients is much more controversial. We offer the following possible explanations. DCD introduces new conditions that deviate from standard medical practice, allow procurement of organs when donors’ loss of circulatory function could be reversed, and raises questions about “death” as a unified concept. Our results suggest that, for many HPs, these concerns seem related in part to the fact that a rigorous brain examination is neither clinically performed nor legally required in DCD. Their discomfort could also come from a belief that irreversible loss of circulatory function has not been adequately demonstrated. If DCD protocols are to achieve their full potential for increasing organ supply, the sources of HPs’ discomfort must be further identified and addressed. (shrink)

Since the 1960s, organ procurement policies have relied on the boundary of death—advertised as though it were a factual, value‐free, and unobjectionable event—to foster organ donation while minimizing controversy. Death determination, however, involves both discoveries of facts and events and decisions about their meaning (whether the facts and events are relevant to establish a vital status), the latter being subjected to legitimate disagreements requiring deliberation. By revisiting the historical origin of the dead donor rule, including some events that took place (...) in France prior to the report by the Ad Hoc Committee of the Harvard Medical School to Examine the Definition of Brain Death, I want to recall that those who first promoted the DDR did not take into account any scientific rationale to support the new proposed criteria to determine death. Rather, through a process of factual re‐semantization, they authorized themselves to decide about the meaning of death in order to implicitly prioritize the interests of organ recipients over those of dying people. After the viral outbreak that hit populations across the planet in the first half of 2020, it has been argued that the coronavirus pandemic can be described as a quintessential phenomenon of the Anthropocene, i.e. the result of a particular stage of socionatural relations in which wild habitats are invaded and anthropogenic climate change creates the conditions for the emergence of more frequent viral pathogens. Likewise, it has also been argued that the pandemic is an event that shares structural features (...) with climate change itself and, consequently, offers some lessons about how best to fight the latter. I will consider these arguments, offering an alternative view of the relationship between the pandemic and the Anthropocene. I will argue that although the pandemic should not be primarily seen as an event of the Anthropocene, it can end up reinforcing the Anthropocene frame for several reasons. (shrink)

The ever‐increasing demand for organs led Spain, France, and other European countries to promote uncontrolled donation after circulatory determination of death (uDCDD). For the same reason, New York City has recently developed its own uDCDD protocol, which differs from European programs in some key ways. The New York protocol incorporates a series of technical and management improvements that address some practical problems identified in response to European uDCDD protocols. However, the more fundamental issue of whether uDCDD donors are dead when (...) organs are procured remains problematic for the New York City protocol and, indeed, for all uDCDD protocols. In the United States, two amendments to the legal criteria of death have been suggested to avoid a formal violation of the dead donor rule in DCDD protocols: first, replacing the requirement “irreversible” with the weaker term “permanent,” and second, using the term “circulatory” instead of “cardiac” to identify the key function that must be lost to declare death. While intended to facilitate controlled DCDD, these modifications create a problem for uDCDD protocols: if extracorporeal membrane oxygenation is introduced to preserve the organs, then circulation is restored after death is declared. In this issue of the Hastings Center Report, Kevin Munjal and colleagues call for a new ethical construct and policy so that uncontrolled and controlled DCDD can coexist. (shrink)

Since 1968, the irreversible loss of functioning of the whole brain, called brain death, is assimilated to individual’s death. The almost universal acceptance of this neurological criterion of death had decisive consequences for the contemporary medicine, such as the withdrawal of mechanical ventilation in these patients and organ retrieval for transplantation. The new criterion was successfully accepted in part because the assimilation of brain death state to death was presented by medicine --and acritically assumed by most of societies-- as a (...) scientific and objective fact. Nevertheless, many people do not think that the patients suffering brain death are actually dead. We show here that those people are not necessarily wrong. It can be argued that, in fact, the justification of the neurological criterion is not scientific but moral. We outline the thesis that the problem surrounding the vital status of brain dead patients is due to a confusion between factual and normative questions. Furthermore, we claim that the donation of organs and the withdrawal of life-support could be ethically acceptable even if the patients suffering brain death are considered as alive. As an alternative to the dead donor rule, we propose a justification for organ donation of brain-dead patients based on the (moral) concepts of harm and consent : what truly justifies the procurement of organs on those patients is not that they are dead, but that they wish to donate their organs and that, since they have irreversibly lost their brain, they cannot be harmed.
