BackgroundInnovations in technology have contributed to rapid changes in the way that modern biomedical research is carried out. Researchers are increasingly required to endorse adaptive and flexible approaches to accommodate these innovations and comply with ethical, legal and regulatory requirements. This paper explores how Dynamic Consent may provide solutions to address challenges encountered when researchers invite individuals to participate in research and follow them up over time in a continuously changing environment.MethodsAn interdisciplinary workshop jointly organised by the University of Oxford (...) and the COST Action CHIP ME gathered clinicians, researchers, ethicists, lawyers, research participants and patient representatives to discuss experiences of using Dynamic Consent, and how such use may facilitate the conduct of specific research tasks. The data collected during the workshop were analysed using a content analysis approach.ResultsDynamic Consent can provide practical, sustainable and future-proof solutions to challenges related to participant recruitment, the attainment of informed consent, participant retention and consent management, and may bring economic efficiencies.ConclusionsDynamic Consent offers opportunities for ongoing communication between researchers and research participants that can positively impact research. Dynamic Consent supports inter-sector, cross-border approaches and large scale data-sharing. Whilst it is relatively easy to set up and maintain, its implementation will require that researchers re-consider their relationship with research participants and adopt new procedures. (shrink)

Personalized medicine aims to tailor disease prevention, diagnosis, and treatment to individuals on the basis of their genes, lifestyle and environments. Patient and interest organizations may potentially play an important role in the realization of PM. This paper investigates the views and perspectives on PM of a variety of PIOs. Semi-structured telephone interviews were conducted among leading representatives of 13 PIOs located in Europe and North-America. The data collected were analysed using a conventional content analysis approach. The PIO representatives supported (...) the realization of PM but feared that many financial, structural and organizational challenges may delay its realization. They encouraged strategies to modernize drug licencing mechanisms, develop research and data sharing infrastructures, and educate patients and health care professionals in PM. Notably, they emphasized the importance of developing PM in an equitable way and taking into consideration the patients’ needs, values and personal situation. Despite varying levels of awareness regarding PM, the PIO representatives expressed willingness to engage in the PM agenda and recommended that PIOs work closely with policy-makers to design PM in a way that truly addresses the needs and concerns of patients. PIOs have the potential to become central drivers of the PM agenda. Collaborations should be further developed between PIOs, researchers, drug developers and health care authorities. (shrink)

Henry Allison is one of the foremost interpreters of the philosophy of Kant. This new volume collects all his recent essays on Kant's theoretical and practical philosophy. All the essays postdate Allison's two major books on Kant, and together they constitute an attempt to respond to critics and to clarify, develop and apply some of the central theses of those books. Two are published here for the first time. Henry E. Allison presents an analytical and historical commentary on Kant`s transcendental deduction of the pure concepts of the understanding in the Critique of Pure Reason. He argues that, rather than providing a new solution to an old problem, it addresses a new problem, and he traces the line of thought that led Kant to the recognition of the significance of this problem in his 'pre-critical' period. In addition to the developmental nature of the account of Kant`s views presented (...) here, two distinctive features of Allison's reading of the deduction are a defense of Kant`s oft criticized claim that the conformity of appearances to the categories must be unconditionally rather than merely conditionally necessary and an insistence that the argument cannot be separated from Kant`s transcendental idealism. In his new book the eminent Kant scholar Henry Allison provides an innovative and comprehensive interpretation of Kant's concept of freedom. The author analyzes the concept and discusses the role it plays in Kant's moral philosophy and psychology. He also considers in full detail the critical literature on the subject from Kant's own time to the present day. In the first part Professor Allison argues that at the centre of the Critique of Pure Reason there is the foundation (...) for a coherent general theory of rational agency. The second part employs this account of rational agency as a key to understanding Kant's concept of moral agency and associated moral psychology. Is volitional conceptual change feasible? Answering that question requires a theory of semantic change, which is sometimes thought elusive. Fortunately, much is known about semantic change as it occurs in the wild. While usage is chaotic and complex, changes in a word’s use can produce changes in its meaning. There are several under-appreciated empirical constraints on how meanings change that stem from the following observation: word use finely reflects equilibrium between various communicative pressures. Much of the relevant work in linguistics (...) has employed the methods of empirical pragmatics and diachronic semantics. In this way, the study of meaning change can be brought to bear on the conceptual engineer’s normative project. The picture that emerges tells against the sorts of engineering projects most likely to appeal to philosophers. Some may stand to succeed, but they have significantly different contours than the typical ones. (shrink)

In this discussion I respond to some of the criticisms raised by Béatrice Longuenesse and Hannah Ginsborg to my account of Kant's aesthetic theory presents in Kant's Theory of Taste.

Using ethnographic data gathered at a mandated, community-based drug treatment program for women offenders, this article analyzes how gendered notions of the self and of autonomy shape penal governance. This study examines how psychological models of women's deviance, racialized visions of motherhood, and therapeutic techniques of the self come into tension with expectations of responsible, autonomous citizenship. The program prioritized therapeutic ways of governing its clients over those that emphasized economic self-reliance, rational decision making, and normalizing gender. This is because (...) staff attributed criminal and addictive behaviors to women's inadequate self-understanding and lack of emotional autonomy in personal relations. Staff discouraged women's motherhood and paid labor because they saw these external obligations as a threat to women's autonomous selfhood. This research complicates claims that contemporary forms of penal treatment manage offenders through rational incentives and personal responsibility by pointing to the ways that subject formation is a gendered process. Recently, bioethicists and the UNCRPD have advocated for supported medical decision-making on behalf of patients with intellectual disabilities. But what does supported decision-making really entail? One compelling framework is Anita Silvers and Leslie Francis’ mental prosthesis account, which envisions supported decision-making as a process in which trustees act as mere appendages for the patient’s will; the trustee provides the cognitive tools the patient requires to realize her conception of her own good. We argue that supported decision-making would be better understood (...) as a collaborative process, giving patients with intellectual disabilities the opportunity to make decisions in a respectful relationship with trusted others. We offer an alternative account of supported decision-making where the primary constraint is to protect the patient from domination by the trustee. This is advantageous in its preservation of the prospects for genuine collaboration, for the mental prosthesis approach ultimately reinforces a problematic ideal of isolated patient self-determination. In section 24 of The Antichrist, Nietzsche notes a problem namely “the origin of Christianity.” He offers two propositions toward its solution: the first is that “Christianity can only be understood on the soil where it grew:” and the second is that “the psychological type of the Galilean is still recognizable, but it had to assume a completely degenerate form (simultaneously mutilated and full of alien features) before it came to be used as a redeemer of humanity” (A 24). Significantly (...) this passage suggests that the origins of Christianity rest on a reinterpretation of the type of the redeemer. This paper seeks to clarify the nature of such a modification and to identify some of its key ramifications. After clarifying the type, the paper argues that the type, thus understood, serves as a link between the texts On the Genealogy of Morality and The Antichrist and, as such, reveals the connection between Nietzsche's genealogical methods and the wider project of reevaluation. Though this reading is not the standard interpretive strategy, the paper argues that it is the strategy that Nietzsche himself recommends. (shrink)

Despite the fact that the requirement to obtain informed consent for medical procedures is deeply enshrined in both U.S. moral and legal doctrine, empirical studies and anecdotal accounts show that women's rights to informed consent and refusal of treatment are routinely undermined and ignored during childbirth. For example, citing the most recent Listening to Mothers survey, Marianne Nieuwenhuijze and Lisa Kane Low state that "a significant number of women said they felt pressure from a caregiver to agree to having an (...) intervention that they did not want during birth". The American Institute of Certified Public Accountants (AICPA) is responsible for the Code of Professional Conduct that governs the actions of CPAs. In 1988, the Code was revised by the AICPA, but a number of issues still remain unresolved or confounded by the new Code. These issues are examined in light of the profession''s stated commitment to the public good, a commitment that is discussed at length in the new Code.Specifically, this paper reviews the following issues: (1) client confidentiality and (...) whistleblowing, (2) limited liability, and (3) auditor independence. We argue that, in each of these areas, the AICPA promotes a position that is potentially harmful to the public good. (shrink)

In a well-known passage of the Preface to On the Genealogy of Morals Nietzsche makes audible a “new demand”: namely, that “we need a critique of moral values, the value of these values themselves must be called into question—and for that there is needed a knowledge of the conditions and circumstances in which they grew, under which they changed and evolved”.1 Here Nietzsche is relatively clear. We need an understanding of the historical conditions under which our moral values have changed (...) in order to call into question the value of our moral values and to subject such valuations to critique. This paper defends a hylomorphic version of animalism according to which human persons survive as immaterial, bodiless animals after death. According to the hylomorphism under consideration, human persons have souls that survive death, and according to the animalism under consideration, human persons are necessarily animals. One might think this implies that human persons don't survive their deaths since if they were to survive their deaths, they would be immaterial animals after death, but necessarily animals are material. This paper shows that (...) the hylomorphic animalist can overcome this problem in a way that respects the intuition that animals are material. In addition, the paper defends the hylomorphic animalist survivalist from the objection that her view introduces an insoluble mereological puzzle. (shrink)

When I classify Fluffy as a cat, I appear to do so out of an appreciation of a prior metaphysical fact, namely, that she has a nature or essence common to creatures we classify as cats. Locke turns this picture on its head. Our actual practices of naming and sorting individuals into kinds proceed according to ideas in the mind. As Locke puts it, species (kinds) are ‘the Workmanship of the Understanding,’ not the workmanship of nature, because their essences consist (...) in abstract ideas, or ‘nominal essences,’ we make. Many take Locke to mean that the observable similarities and differences between things leave it undetermined how we are to group and distinguish them, so that classification is, and must be, a matter of convention. And while Locke never denies that individuals have real essences, it is argued that knowledge of them would not reveal natural boundaries, either. On this influential reading, nature does not draw boundaries between kinds, and she makes this fact apparent to us. I argue that Locke’s claim that nature does not determine the ‘Boundaries of the Species of Things’ should be understood as the claim that nature does not draw the variable boundaries set out in the nominal essences we make. Differences in our nominal essences reflect differences in speakers’ knowledge of external ‘standards,’ which we latch on to by way of their ‘leading’ qualities, which present the mind with a limited number of unique and highly salient bases for classification. On my reading, nature may very well draw boundaries of her own. (shrink)

Ageist attitudes have been discovered in children as early as 3 years. However, so far very few studies, especially during the last decade, have examined age-related stereotypes in preschool children. Available questionnaires adapted to this population are scarce. Our study was designed to probe old age-related views in 3- to 6-year-old children ( n = 126) using both an open-ended Image-of-Aging question and a new pilot tool, called Young Children’s Views of Older People (YCVOP), based on a visual analog scale (...) illustrated by cartoons. Parental views of older people were also collected. The YCVOP was easy to use and internally consistent. Both that scale and the Image-of-Aging question showed globally favorable views of older people in preschool children, especially regarding warmth and smartness traits. However, assessment of physical capacity and independence tended to be negative. The overall results were in line with the low-competence, high-warmth stereotype of older people that is common in young adults and school-age children and was found in parents in the current study (Stereotype Content Model). Strikingly, children’s views did not correlate with those of their parents’: The children’s responses appeared more personal and emotional, while the parents tended to adopt global stereotypes. The preschoolers’ views of older people were much more positive in those who spontaneously evoked their grandparents when asked to think of an old person. In conclusion, this study, introducing a new visual tool to assess age-related stereotypes, suggests ambivalent views of older adults start in preschool children and are influenced by grandparents relationships. Although only one aspect of Gotthold Ephraim Lessing's diverse oeuvre, his religious thought had a significant influence on thinkers such as Kant, Hegel, Kierkegaard, and present-day liberal Protestant theologians. His thought is particularly difficult to assess, however, because it is found largely in a series of essays, reviews, critical studies, polemical writings, and commentary on theological texts. Beyond these, his correspondence, and a few fragmentary essays unpublished during his lifetime, we have his famous drama of religious toleration, Nathan the Wise, (...) and his philosophical-historical sketch, The Education of the Human Race. In these scattered texts, Lessing challenged the full range of theological views in the Enlightenment, from Protestant orthodoxy, with its belief in Biblical inerrancy, to a radical naturalism, which rejected both the concept of a divine revelation and the historically based claims of Christianity to be one, as well as virtually everything in between. Since he refused to identify himself with any of these parties, Lessing was an enigmatic figure, and a central question from his time to today is where he stood on the issue of the truth of the Christian religion. Now back in print, and with the addition of two supplementary essays, Henry E. Allison's book argues that, despite appearances, Lessing was not merely an eclectic thinker or intellectual provocateur, but a serious philosopher of religion, who combined a basically Spinozistic conception of God with a sophisticated pluralistic conception of religious truth inspired by Leibniz. ISBN 9781982190217.Kristen R. Ghodsee has written a wide-ranging, highly readable, and commendably radical vindication of utopian thought and experimentation. Everyday (...) Utopia is aimed at the educated lay reader—itself, perhaps, a utopian projection—rather than specialists. Nevertheless, all but the most erudite and cosmopolitan of scholars will encounter unfamiliar and compelling utopiana within its pages. While her earlier book, Why Women Have Better Sex Under Socialism: And Other Arguments for Economic Independence (2018), concentrated on "state-sponsored solutions" to the deprivations of capitalism and patriarchy, the present volume sets its sights squarely on the private sphere, and utopian visions "for rearranging our domestic lives" (17).Ghodsee situates this turn to the domestic in two contexts. The first is the COVID-19 pandemic, which revealed the frangibility of the international commitment to gender equality. "Women around the globe woke up and realized that decades of feminism had done little to reverse the social expectation that mothers, sisters, wives, and daughters should provide care for young children, elderly parents, and sick relatives, as well as perform the emotional labors that hold families together in times of crisis," she laments (xii). Everyday Utopia's second context is the spate of recent works of "popular neo-utopianism," including Rutger Bregman's Utopia for Realists (2017), Aaron Bastani's Fully Automated Luxury Communism (2019), and Peter Diamandis and Steven Kotler's Abundance: The Future is Better Than You Think (2012) (14). What Ghodsee finds wanting in this discourse is its myopic focus on the public sphere, and its unspoken presupposition that our private and domestic lives have no such need of utopian renovation. But it is just this presupposition [End Page 285] that the COVID-19 lockdown discredited, although many other indicators (runaway housing and childcare costs, the environmental crisis, the epidemic of loneliness) already suggested as much. Ghodsee rightly insists that "where we reside, how we raise and educate our children, our personal relationship to things, and the quality of our connections to friends, families, and partners impact us as much as tax policies, the price of energy, or the way we organize formal employment" (14). As utopian thinkers from Plato forward have understood, moreover, it is short-sighted to suppose that sweeping economic and political transformations are possible without a concomitant rethinking of the "intimate worlds" that subtend these public domains (15).Accordingly, Everyday Utopia devotes its succeeding chapters to examining alternatives to the dominant institutions of the contemporary private sphere, including the single-family household, the monogamous couple paradigm of childrearing and mating, and the institution of private property. In each case, Ghodsee plumbs the past and limns the present to highlight utopian alternatives to contemporary norms. Among this book's greatest strengths is its consistently international range of examples and admirably sustained commitment to feature "experiments that have received relatively less attention" in the extant literature (xv).Take, for example, the chapter on communal alternatives to single-family homes. Ghodsee includes many of the usual (and eminently worthy) suspects: Buddhist and Christian cenobite monasteries, Fourierist phalansteries, Israeli kibbutzim, and the Corbusier-inspired "microdistricts" of the former Eastern bloc (47). But we also learn of less canonical phenomena, such as the Neolithic proto-city of Çatalhöyük, "one of the first major settlements in the world," where as many as eight thousand people lived in an essentially contiguous structure, in highly egalitarian and likely non-consanguineous households (32). Or consider the Beguine nuns, a lay order founded in 1190 that survived, albeit in attenuated form, into the twentieth century. The Beguine lived communally in urban areas, enjoying liberties unthinkable not only to their cloistered counterparts, but to virtually all their female contemporaries: they brewed beer, made lace, taught school—and traversed the streets unchaperoned. Animalism in its basic form is the view that we are animals. Whether it is a thesis about anything else – like what the conditions of our persistence through time are or whether we're wholly material things – depends on the facts about the persistence conditions and ontology of animals. Thus, I will argue, there are different varieties of animalism, differing with respect to which other theses are taken in conjunction with animalism in its basic form. The different varieties of (...) animalism vary in credibility: some varieties are supported by arguments that are irrelevant to others, and some varieties are susceptible to objections that others can resist. Adequately distinguishing between varieties of animalism is thus an important preliminary to assessing them. In this paper, I'll present and argue for a taxonomy of the most distinctive varieties.
