Law and Order: Special Victims Unit (SVU) (1999–present) is a popular primetime drama that spotlights the use of genetic information to solve crimes. Despite the show’s heavy reliance on the forensic use of DNA evidence, the role of genetics in defining family and identity arises in complex ways. Many episodes wrestle with social, ethical, and legal questions that reflect assumptions about genetic essentialism and genetic determinism, but counterarguments about the importance of non-biological relationships, social factors, and legal entitlements are given (...) equal or greater weight. For this study, we identified and viewed 38 episodes from SVU’s first twenty seasons centered on genetic themes in non-forensic contexts. Two recurring themes emerged: (1) that the role DNA plays is only one factor in a complex web of biological and social considerations that shape our understanding of kinship; and (2) that genetic predispositions to behavioral traits such as mental illness or violence should not be seen as obscuring the responsibility of personal choice. By treating genetics as a complex source of information requiring social context to be understood, SVU allows audiences to play an active role in interpreting its meaning. (shrink)

In this paper the author presents two different modes of relationship between phenomenological psychopathology and philosophy. The dominant mode conforms to the medical-psychiatric discourse which takes pathological time experiences as negative deviations from the ‘normal’ and ‘adequate’ equivalent. In this mode phenomenological description of ‘disturbed’ time experiences requires philosophy to provide an insight into the ‘essence’ of time and an essentially adequate experience of time. Only such a philosophical insight can deliver a valid reference point for investigating what is really (...) missing in pathological time experiences. This philosophical reference point can either consist in a metaphysical-normative concept of time and time experiences, or in a transcendental concept of how normal and abnormal time experiences are constituted in the inner consciousness of time. There is another mode of relationship which conforms to Freud’s discovery that pathological symptoms are not just negative alterations of the ‘normal’ but hide an own ‘meaning’. The author makes the case for the use of philosophy to unveil the specific kind of meaning in pathological experiences of time. She refers to existential philosophy in this respect, and in particular to its concept of Angst as a fundamental philosophical experience. This allows for a hermeneutic approach to ‘disturbed’ time experiences. What looks from a pure psychiatric perspective to be a mere ‘disorder’ of the ‘normal’, becomes understandable as a specific form of ‘suffering from one’s own temporality’. She argues that people with disturbed time experiences are especially sensitive to anxiety-laden experiences of what it means to be temporal, whilst ‘normal’ people can screen them out in favor of a ‘mentally undisturbed’ everyday life. The UK Government's Higher Education (Freedom of Speech) Bill is currently progressing through Parliament. The bill is designed to strengthen free speech and academic freedom in higher education, in response to what former Education Secretary Gavin Williamson describes as ‘the rise of intolerance and cancel culture upon our campuses’. But is there really a crisis of academic freedom in British universities?To see that there is, say Judith Suissa and Alice Sullivan, we need only look at the contemporary reality of (...) suppression of debate on sex and gender. The evidence they catalogue of suppression of research, of blacklisting, harassment and smear campaigns, of no-platforming, disinvitations and shutting down of events, is incontrovertible. The recent experience of scholars and students wishing to discuss the material reality and political salience of sex makes complacency about academic freedom a luxury we cannot afford.Suissa and Sullivan set out a powerful argument for the role of academic freedom in pursuing truth within the academy and developing democracy beyond it. They effectively counter attempts to narrow the scope of academic freedom so as to render it compatible with no-platforming. And they lay out a series of practical steps administrators can take to ensure that universities are places where an expansive and pluralistic intellectual climate prevails.This is a timely and compelling intervention in a vexed but urgent public debate. For their clear-sighted diagnosis of where and how academic freedom has been eroded in our universities, and for their judicious account of what must be done to rebuild it, Suissa and Sullivan deserve a wide and attentive hearing. In areas of land conflict, fear and the threat of violence work to reproduce imaginaries of land as a resource that powerful people can grab. An urgent question for agrarian scholars and activists is how people can overcome fear so that alternative imaginaries might flourish. In this article, we argue for attention to the affective dimension of imaginaries; ideas of what land is and should be are co-constituted through the material and social, imbued with powerful emotions that enable imaginaries to (...) be reproduced, to be challenged, and even to be transformed. We draw from long-term research projects in Cambodia—a country known for plantation-fuelled dispossession—where the Prime Minister’s surprise announcement of a land titling campaign in 2012 ruptured the wave of land grabbing, creating openings to imagine different outcomes that are rooted in the potential for legal recognition of smallholder claims. Although the campaign was an uncertain rupture in land imaginaries, these moments matter. Land claimants sought to create affective ties with volunteer land surveyors that embedded hopeful land imaginaries in rural areas and into the national cadastral system. The land title in this context is the material bearer of a land imaginary that centres on rural people’s connection to the land, and also reinforces rural people’s connection to the Cambodian state and the potential to gain the state’s protection. We contribute to an emerging literature that locates the formative effects of hope as an orientation and as a method by exploring the possibilities inherent in rupture. (shrink)

A survey was conducted in a naturalistic setting, within wine tasting rooms, to explore how consumers' sustainability attitudes and subjective norms influence their decision to purchase wines from wineries which have adopted an environmental management program. The results indicate that both are significant predictors of intentions and explain over half of the variation in intentions to purchase. In addition, identifying environmental organization members is a useful approach in identifying a segment of consumers having stronger levels of these antecedents and, therefore, (...) more likely to purchase from wineries using sustainable grape growing practices (than non-members) Consumers who are environmental organization members are more likely to be interested in organic products, as well. Information on sustainable grape growing practices is relevant and influential for a specific segment of consumers, those consumers more passionate about the environment, and increases their intentions to purchase from wineries who have adopted these practices. Este texto trata de uma experimentação na formação de professoras da educação infantil e dos anos iniciais do ensino fundamental de uma escola pública da região metropolitana de Porto Alegre (RS), por meio de práticas de leitura, escrita e conversação, as quais se desdobram em experimentações com as crianças. Tal processo é pensado nas companhias de Sêneca (2018), com seu conceito de leitura e escrita, de Kopenawa (Kopenawa; Albert, 2015), a partir do conceito de palavra, e de Foucault (2004, 2011), (...) considerando-se o conceito de subjetivação. Tal experimentação, que se deu no encontro entre a escrita e a oralidade, foi tomada para pensar nas contribuições para os estudos que compõem a filosofia com crianças. Nesse sentido, a leitura, a escrita e a contação de histórias teriam menos a ver com informações, e mais com o que estamos nos tornando, com a agilidade do nosso pensamento, com nossa sabedoria. Desse modo, conceitos da antiguidade greco-romana e das comunidades ameríndias brasileiras são tomados como ferramentas potentes para pensar a escola contemporânea como possibilidade, ainda, de formação humana. Para tanto, defende-se a conversação entre os vivos e os mortos via texto na escola, espaço público e coletivo, o que poderia ser tomado como uma perspectiva de subjetivação para um pensamento e uma vida mais afirmativos em tempos de tanta pobreza narrativa. Childhood trauma is associated with many interpersonal and psychosocial problems in adulthood. The aim of this study was to explore the associations with a spiritual area of personality, namely religious and spiritual struggles (R/S struggles). A nationally representative sample of 1,000 Czech respondents aged 15 years and older participated in the survey. All types of CT were associated with an increased level of all six types of R/S struggles, with the highest values for demonic struggles. Thus, the findings of this (...) study might be important for clinical practice and pastoral care as well as a further research. (shrink)

We place agency front-and-centre in the aesthetics of science via an analysis of experimental design and performance. This first involves developing an account of scientific agency relevant to experiment. We do this via an analogy between experiments and games (as understood by Suits and Nguyen): both involve artificial practical environments designed to enable participants to exercise particular forms of agency. Second, we consider how this account of agency might underwrite an aesthetics of experiment. Experiments are well-designed not only when they (...) generate clear, elegant results, but also when they actively confront the experimenter with experimental phenomena, afford the exercise of agency throughout experimental runs and in iterative design and tweaking, and underlie stable, intersubjective experiences across agents. We apply the account to Newton’s optical work, and contrast this with contemporary experimental practices, where significantly more ‘experimental distance’ holds between the experimenter and the result. Taking the agency of experimental practice seriously enables a richer account of the role of aesthetic values, sensibilities, and judgments in science. (shrink)

Introduction by Ralph McInerny The essays in this volume, indebted in great part to Jacques Maritain and to other Neo-Thomists, represent a contribution to an understanding of beauty and the arts within the Aristotelian-Thomistic tradition. As such they constitute a different voice in present-day discussions on beauty and aesthetics, a voice which nonetheless shares with many of its contemporaries concern over questions such as the relationship between beauty and morality, public funding of the arts and their educational role, objective and (...) universal standards of what is beautiful. In the tradition in which the contributors of this volume reflect, beauty manifests itself in the order of the universe, an order that provides human reason with a window onto the transcendent. For Aristotle and Aquinas the natural order grounds both art and morality, and yet it is this very order which has been called into question by modern science and philosophy. Instead of pointing us to a suprahuman order, the beautiful then points to the order of human freedom and creativity. Reflection on the beautiful since the modern philosopher Immanuel Kant has thus often taken a subjectivistic turn. Because of the importance of beauty and art in human existence, in man's education and life as a moral and political being, an alternative should be sought to any reduction of the beautiful to a purely subjective experience or cultural construct. The Aristotelian-Thomistic tradition, in dialogue with modern and contemporary conceptions of the beautiful, provides us with just that alternative, and thus the essays herein represent a decisive step in the "journey for Thomistic aesthetics." Philosophers of science have typically focused on “beauty”, “simplicity”, and “elegance” in their accounts of aesthetic values in science. But this is too narrow: other properties ought to be considered when thinking about aesthetics in science. In this chapter, Alice Murphy expands the discussion by asking: What makes a scientific experiment “profound”? To address this question, she draws on two accounts of profundity as developed in the philosophy of art to consider them in the scientific context. On the first (...) view, profound experiments are those which, due to their design, bring about understanding of some profound subject matter. On the second view, profound experiments are those which resist a straightforward interpretation, and can even prompt the development of new theories and concepts. To flesh out these two aspects of profundity, Murphy brings together theories from philosophy of art and topics in the epistemology of experiment. The chapter ends by demonstrating how broadening our class of aesthetic values to include profundity puts pressure on the scope of a central view brings together the epistemic and aesthetic by associating aesthetic experiences with “feelings of fluency”. Is there a role for aesthetic judgements in science? One aspect of scientific practice, the use of thought experiments, has a clear aesthetic dimension. Thought experiments are creatively produced artefacts that are designed to engage the imagination. Comparisons have been made between scientific (and philosophical) thought experiments and other aesthetically appreciated objects. In particular, thought experiments are said to share qualities with literary fiction as they invite us to imagine a fictional scenario and often have a narrative form (Elgin 2014). (...) But philosophical discussions of aesthetics in science have focused mainly on the epistemic role of beauty and elegance when it comes to theories and mathematical proofs, and thought experiments have been widely overlooked. My aim in this chapter is to address how the aesthetic choices scientists make in the design of a thought experiment contribute to its function: to communicate, convince, or explain a theory or phenomenon. A key issue is whether any aesthetic features in science provide anything beyond catching our attention, or are at best, a mere heuristic aid. I respond to accounts that argue this way and show how formulation is important in scientific thought experiments and, similarly to literary fictions, there is more than one way of interpreting a thought experiment scenario. I end by considering which literary examples are most appropriate when making comparisons with thought experiments. As a result, the difference between representations in art and science raised in current discussions is not as stark as it has been made out to be, and science is a more heterogeneous practice than has been allowed. Part of the value of thought experiments in scientific practice includes the qualities they share with literary works. (shrink)

In this paper, I take issue with the widespread philosophical consensus that only victims of wrongdoing are in a position to forgive it. I offer both a defense and a philosophical account of third-party forgiveness. I argue that when we deny this possibility, we misconstrue the complex, relational nature of wrongdoing and its harms. We also risk over-moralizing the victim's position and overlooking the roles played by secondary participants. I develop an account of third-party forgiveness that both demonstrates how successful, (...) morally legitimate, acts of third-party forgiveness are possible and simultaneously highlights the particular moral risks that would-be third-party forgivers face. I conclude insofar as they are appropriately grounded and cautiously bestowed, at least some acts of third-party forgiveness contribute significantly to post-conflict repair. (shrink)

Although machine intelligence is increasingly employed in healthcare, the realm of decision-making in medical ethics remains largely unexplored from a technical perspective. We propose an approach based on fuzzy cognitive maps (FCMs), which builds on Beauchamp and Childress’ prima-facie principles. The FCM’s weights are optimized using a genetic algorithm to provide recommendations regarding the initiation, continuation, or withdrawal of medical treatment. The resulting model approximates the answers provided by our team of medical ethicists fairly well and offers a high degree (...) of interpretability. The question of forgiveness in politics has attained a certain cachet. Indeed, in the fifty years since Arendt commented on the notable absence of forgiveness in the political tradition, a vast and multidisciplinary literature on the politics of apology, reparation, and reconciliation has emerged. To a novice scouring the relevant literatures, it might appear that the only discordant note in this new veritable symphony of writings on political forgiveness has been sounded by philosophers. There is a more-than-healthy cynicism directed at (...) what many philosophers see as an uncritical promotion of forgiveness, which – they fear – risks distorting and cheapening forgiveness as a moral ideal, on the one hand, and ignoring the moral and political values of justice, accountability and the cessation of harmful relationships, on the other. Are philosophical fears about the dangers of thinking about forgiveness in political terms warranted – or do they perhaps depend in part on conceptual conservatism regarding what exactly political forgiveness might be? I argue that most, if not all, standard objections to political forgiveness emerge from theoretical reliance on a picture of forgiveness I will call the Emotional Model. Once we make conceptual space for descriptions of forgiveness in performative and social terms, the concept is more easily adapted to a political account without at least some of the risks feared by philosophers. Historically left to the margins, the topics of imagination and creativity have gained prominence in philosophy of science, challenging the once dominant distinction between ‘context of discovery’ and ‘context of justification’. The aim of this chapter is to explore imagination and creativity starting from issues within contemporary philosophy of science, making connections to these topics in other domains along the way. It discusses the recent literature on the role of imagination in models and thought experiments, and their comparison with fictions. (...) It then turns to the importance of constraints on imaginings in the scientific domain, as well as whether constraints can hinder creativity. The second part of the paper focuses on the social dimensions of science. It considers imagination and creativity of scientific communities, asks whether the institution of science promotes creativity (and whether we want it to) or if it encourages conservativeness, and ends with a reflection on the politics of imagination and creativity in science. Thought experiments (TEs) are important tools in science, used to both undermine and support theories, and communicate and explain complex phenomena. Their interest within philosophy of science has been dominated by a narrow question: How do TEs increase knowledge? My aim is to push beyond this to consider their broader value in scientific practice. I do this through an investigation into the scientific imagination. Part one explores questions regarding TEs as “experiments in the imagination” via a debate concerning the epistemic (...) status of computer simulations in science. I outline how, against Hacking, TEs also have “a life of their own” and I argue against accounts that privilege experiments over simulations (and by extension TEs) in light of their capacity to surprise in a productive way. Part two develops a pluralist account of the nature of the imagination in science. At its core, my view is that when we attend to a number of examples of TEs and consider the context in which they are used, we see that TEs engage a variety of our imaginative capacities. Existing monistic views fail to recognise the richness of the imagination and its potential in science. Part three looks to the “beauty” of TEs which is currently overlooked in the aesthetics of science literature. I put forward a new account that demonstrates the epistemic value of aesthetic features in science by showing how an appropriate fit between form and content enhances the usability of a TE, and its effectiveness as a prompt for our imagination. This also enables a more nuanced take on the proposed similarities between TEs and literary fictions. In the concluding chapter, I outline ways in which the core features of my account can be extended beyond TEs to illuminate the significance of the imagination and aesthetic values in other areas of science. Forgiveness is typically regarded as a good thing - even a virtue - but acts of forgiveness can vary widely in value, depending on their context and motivation. Faced with this variation, philosophers have tended to reinforce everyday concepts of forgiveness with strict sets of conditions, creating ideals or paradigms of forgiveness. These are meant to distinguish good or praiseworthy instances of forgiveness from problematic instances and, in particular, to protect the self-respect of would-be forgivers. But paradigmatic forgiveness is problematic (...) for a number of reasons, including its inattention to forgiveness as a gendered trait. We can account for the values and the risks associated with forgiving far better if we treat it as a moral practice and not an ideal. (shrink)

Si cette opposition est bien connue dans le domaine de la logique medievale, elle n'a pas fait l'objet d'une etude systematique en philosophie naturelle. Tel est l'objectif du present ouvrage: montrer que le debat sur la (...) quantite initie par Gauthier Burley donne a cette categorie une place centrale dans l'emergence de nouvelles trajectoires doctrinales scientifiques de l'entre-deux siecles, du contexte eucharistique et de la logique aristotelicienne vers la physique. Ce livre, qui se veut une synthese accessible, fait ainsi decouvrir la richesse d'une oeuvre tres dense et peu connue. (shrink)

Ao fim, sinalizam-se alternativas práticas e possíveis para operacionalizar a (...) manutenção da pesquisa no contexto da vulnerabilidade e, ao mesmo tempo, para garantir o cumprimento das recomendações éticas vigentes.
