Yet “many others” did not fit into those two groups, for a large contingent of bishops favorable to religious liberty nonetheless sought to undergird the juridical reasoning for the right with an ontological foundation.David L. Schindler and Nicholas Healy promote these other voices in Freedom, Truth, and Human Dignity. Indeed, they argue that the other voices—the “French” or “ontological” school comprised of bishops such as Alfred Ancel and Karol Wojtyła—provide the true key to DH’s meaning and significance. The book thus responds from the perspective of Communio theology to Murray-ite political theologies that are critical of John Paul II’s emphasis on truth as the basis for freedom. Accompanying Schindler’s and Healy’s essays are conciliar texts charting the origin and influence of this ontological school: the six conciliar drafts, the oral and written interventions of Wojtyła, and an oral intervention of Ancel. These texts, transcribed from the Acta Synodalia Sacrosancti Concilii Oecumenici Vaticani II (AS), have been translated by Patrick T. Brannon, S.J., and Michael Camacho. Also included is a side-by-side comparison of the third and sixth drafts that displays the changes made to the juridical position in response to the ontological school.Schindler’s 170-page essay, “Freedom, Truth, and Human Dignity: An Interpretation of Dignitatis Humanae on the Right to Religious Freedom,” is the heart of the work. Schindler recapitulates in a fresh way themes from his prior analyses of liberalism and Murray. In section 1, he summarizes how Wojtyła’s interventions influenced the evolution of DH such that Murray’s juridical approach became subordinated to an emphasis on truth as the foundation and telos of freedom. He conveys Wojtyła’s concern that DH not divide reason and revelation, but that reason be presented as capable of knowing that religion is “nature’s crown and summit” (50). Section 2 outlines Murray’s postconciliar objections to DH’s final version, namely, that it assumes that the American juridical approach leads to relativism and that its insistence on truth as religious liberty’s foundation undermines the universality of the right by degrading the liberty of those in error. To the first, Schindler replies (in section 3) that Murray’s juridical approach necessarily entails what Servais Pinckaers, O.P., called the “freedom of indifference,” Murray’s denials of relativism notwithstanding. The juridical approach leads to the conception of civil space as something neutral to truth-claims about God, but finally results in a state-enforced indifferentism that limits the religious liberty of those who hold that all of existence, prior to human freedom, is intrinsically ordered to God. “The human act, considered from the perspective of the juridical order, is first empty; and truth thus becomes, from that same juridical perspective, adventitious, something that, as such, cannot but logically burden the free-intelligent human act by arbitrarily limiting and closing what is considered by government, for legal purposes, to be simply open, or abstracted from all (metaphysical-religious) content... Two questions guide this article. First, according to Fischer and Ravizza (jointly and otherwise), what epistemic requirements for being morally responsible for performing an action A are not also requirements for freely performing A? Second, how much progress have they made on this front? The article's main moral is for philosophers who believe that there are epistemic requirements for being morally responsible for A-ing that are not requirements for freely A-ing because they assume that Fischer (on his own or otherwise) (...) has shown that this is so. In showing that this assumption is false, I reopen an important question for these philosophers: How are epistemic requirements for being morally responsible for A-ing related to requirements for freely A-ing? It is commonly assumed that praiseworthiness should form part of the analysis of supererogation. I will argue that this view should be rejected. I will start by arguing that, at least on some views of the connection between moral value and praiseworthiness, it does not follow from the fact that acts of supererogation go beyond what is required by duty that they will always be praiseworthy to perform. I will then consider and dismiss what I will call the Argument from (...) Stipulation in favour of holding that acts of supererogation are always praiseworthy. Next, I will examine what I will call the Necessary Connection Argument, which posits a necessary connection between supererogation and praiseworthiness. I will argue that the intuitions used to motivate this argument are best explained by a debunking explanation. (shrink)

Ordinary usage supports both a relatively strong belief requirement on intention and a tight conceptual connection between intention and intentional action. More specifically, it speaks in favor both of the view that "S intends to A" entails "S believes that he (probably) will A" and of the thesis that "S intentionally A-ed" entails "S intended to A." So, at least, proponents of these ideas often claim or assume, and with appreciable justification. The conjunction of these two ideas, however, has some (...) highly counterintuitive implications. This suggests that a certain skepticism about the coherence of ordinary usage of "intention" may be salutary. Fortunately, the skeptic need not abandon the quest for understanding. Much can be gleaned from a careful investigation of the functions attributed to intention in the literature. In this paper, I argue that the capacity of intention to do the work that the literature assigns it does not depend upon intentional A-ing's entailing intending to A, nor upon there being a strong belief constraint on intention, nor even a certain relatively weak belief constraint. I also develop an account of the features of intention in virtue of which it is capable of doing this work. This account provides the core of an adequate conception of intention. Toward the end of the paper, I briefly motivate acceptance of a modest belief requirement on non-functional grounds. (shrink)

Typical incompatibilists about moral responsibility and determinism contend that being basically morally responsible for a decision one makes requires that, if that decision has proximal causes, it is not deterministically caused by them. This article develops a problem for this contention that resembles what is sometimes called the problem of present (or cross-world) luck. However, the problem makes no reference to luck nor to contrastive explanation. This article also develops a solution.

Teleological explanations of human actions are explanations in terms of aims, goals, or purposes of human agents. According to a familiar causal approach to analyzing and explaining human action, our actions are, essentially, events (and sometimes states, perhaps) that are suitably caused by appropriate mental items, or neural realizations of those items. Causalists traditionally appeal, in part, to such goal-representing states as desires and intentions (or their neural realizers) in their explanations of human actions, and they take accept-able teleological explanations (...) of our actions to be causal explanations. Some proponents of the view that human actions are explained teleologically resist this. They regard the causal approach as a rival. I dub this position “anticausalist teleologism,” or AT, for short. I favor the causal approach, but I will not directly argue for it here. My aim is more modest. I will develop a serious problem for AT that strongly suggests that teleologists need causalism; and I will rebut a style of objection to the project of providing a causal analysis of acting in pursuit of a goal that recently resurfaced in the literature on teleological explanations of action, a style of objection featuring a certain kind of causal deviance. My topic is God's activity in the ordinary course of nature. The precise mode of this activity has been the subject of prolonged debates within every major theistic intellectual tradition, though it is within the Catholic tradition that the discussion has been carried on with the most philosophical sophistication. The problem, in its simplest form, is this: Given the fundamental theistic tenet that God is the provident Lord of nature, the First Efficient Cause who creates the universe, sustains it in (...) being, and exists in all things by His essence, presence, and power,1 how exactly do the actions of secondary (i.e., created) causes fit in with God's own activity in the ordinary course of nature? Or, to put it a bit more neutrally, how exactly is God's own action as the First Cause in nature related to the causal activity, if any , of His creatures? (shrink)

Luis de Molina was a leading figure in the remarkable sixteenth-century revival of Scholasticism on the Iberian peninsula.

This paper defends two claims. First, we will argue for the existence of aesthetic demands in the realm of everyday aesthetics, and that these demands are not reducible to moral demands. Second, we will argue that we must recognise the limits of these demands in order to combat a widespread form of gendered oppression. The concept of aesthetic supererogation offers a new structural framework to understand both the pernicious nature of this oppression and what may be done to mitigate it.

Originally published in 1928 this book was an attempt to acquaint the general public with the fundamentals of Individual Psychology. The arguments against the existence of Īśvara that are advanced by Śālikanātha’s Prakaraṇapañcikā are quite peculiar and cryptic, due to both the idiosyncratic nature and opaque style of Śālikanātha’s writing. This has contributed to the difficulty in identifying the actual nature of the views that Śālikanātha opposes. This article analyses the framework by which Śālikanātha interrogates the concept of Īśvara and discusses the possible sources of his arguments. It shows, contrary to the conclusions of past scholarship, that considerations of both (...) Nyāya and Vaiśeṣika sources are certainly apparent in Śālikanātha’s formulation of his critique of Īśvara. This paper also discusses the possible sources from which Śālikanātha derives the notion of Īśvara as the creator of the Vedas. It concludes that rather than any Nyāya or Vaiśeṣika sources, it is most likely that Śālikanātha derives this notion of Īśvara from Kumārila, who potentially has Yoga opponent in mind. (shrink)

What limits should there be on the areas of life that are governed by market forces? For many years, no one seriously defended the buying and selling votes for political elections. In recent years, however, this situation has changed, with a number of authors defending the permissibility of vote markets. One popular objection to such markets is that they would lead to a tyranny of wealth, where the poor are politically dominated by the rich. In a recent paper, Taylor :313–328, (...) 2017. doi: 10.1007/s11158-016-9327-0) has argued that this objection can be avoided if certain restrictions are placed on vote markets. In this paper we will argue that this attempt to rebut an argument against vote markets is unsuccessful. Either vote markets secure their purported benefits but then they inevitably lead to a tyranny of wealth, or they are restricted so heavily that they lack the features that have been claimed to make vote markets attractive in the first place. Using Taylor’s proposal as a test case, we make the more general claim that vote markets cannot avoid the tyranny of wealth objection and bring about their supposed benefits at the same time. Globalization is a part of modern life. Sharing a common set of professional nursing values is critical in this global environment. The purpose of this research was to examine the professional values of nursing students from two distinct cultural perspectives. Nurse educators in Taiwan partnered with nurse educators in the United States to compare professional values of their respective graduating nursing students. The American Nurses Association Code of Ethics served as the philosophical framework for this examination. The convenience sample comprised (...) 94 Taiwanese students and 168 US students. Both groups reported high scores on an overall measure of values. They did differ substantially on the relative importance of individual items related to advocacy, competence, education, self-evaluation, professional advancement, and professional associations. Global implications for the collaborative practice of nurses from different cultures working together can be improved by first recognizing and then attending to these differences in value priorities. Why It's OK to Be a Sports Fan wrestles with a range of arguments against fandom and counters with its own arguments on why being a fan is very often (...) a good thing. It looks at the ethical issues fans face, from the violent or racist behavior of those in the stands, to players' infamous misdeeds, to owners debasing their own clubs. In response to these moral risks, the book argues that by being critical fans, followers of a team or individual can reap the benefits of fandom while avoiding many of the ethical pitfalls. What is integrity and why is it valuable? One account of the nature of integrity, proposed by John Cottingham amongst others, is The Integrated Self View. On this account integrity is a formal relation of coherence between various aspects of a person. One problem that has been raised against this account is that it isn’t obvious that it can account for the value of integrity. In this paper I will respond to this problem by providing an account of the value (...) of an integrated self. I will do so by first looking closely at two examples from literature: John Sassal in John Berger’s A Fortunate Man and Tetrius Lydgate in George Eliot’s Middlemarch. Based on my comparison of these two case studies I will argue that an integrated self is valuable as it makes people more likely to act in line with their moral judgements. (shrink)

Modern science, based on the laws of physics, claims validity for all events in space and time. However, it also reveals its own limitations, such as the indeterminacy of quantum physics, the limits of decidability, and, presumably, limits of decodability of the mind-brain relationship. At the philosophical level, these intrinsic limitations allow for different interpretations of the relation between human cognition and the natural order. In particular, modern science may be logically consistent with religious as well as agnostic views of (...) humans and the universe. These points are exemplified through the transcript of a discussion between Kurt Gödel and Rudolf Carnap that took place in 1940. Gödel, discoverer of mathematical undecidability, took a proreligious view; Carnap, one of the founders of analytical philosophy, an antireligious view. By the time of the discussion, Carnap had liberalized his ideas on theoretical concepts of science: he believed that observational terms do not suffice for an exhaustive definition of theoretical concepts. Then, responded Gödel, one should formulate a theory or metatheory that is consistent with scientific rationality, yet also encompasses theology. Carnap considered such theories unproductive. The controversy remained unresolved, but its emphasis shifted from rationality to wisdom, not only in the Gödel-Carnap discussion but also in our time. -/- . (shrink)

A central feature of being a celebrity is experiencing a divide between one's public image and private life. By appealing to the phenomenology of Sartre and Merleau-Ponty, we analyze this experience as paradoxically involving both a disconnection and alienation from one's public persona and a sense of close connection with it. This ‘uncanny’ experience presents a psychological conflict for celebrities: they may have a public persona they feel alienated from and that is at the same time closely connected to them (...) and shapes many of their personal interactions. We offer three ways in which a celebrity might approach this conflict: (i) eradicating the divide between their public and private selves, (ii) splitting or separating their private and public selves, or (iii) embracing the arising tension. We argue that it is only this third approach that successfully mitigates the negative effects of the alienation felt by many celebrities. (shrink)

How can we make sense of God’s moral goodness if God cannot be subject to moral obligations? This question is troubling for divine command theorists, as if we cannot make sense of God’s moral goodness then it seems hard to see how God’s commands could be morally good. Alston argues that the concept of supererogation solves this problem. If we accept the existence of acts that are morally good but not morally required then we should accept that there is no (...) need for an act to fulfill a moral obligation in order for it to be morally good. This view has been criticized by both Stump and Lombardi :313–326, 2005), who claim that it is impossible for an agent who has no obligations to perform acts of supererogation. Young attempts to defend Alston’s solution by offering a new analysis of supererogation. In this paper I will argue first that Young fails to provide an adequate response to Lombardi’s objection. I will then provide my own defence of Alston’s proposal. (shrink)

Some psychologists working in the psychology and law field feel that the profession does not provide them with adequate ethical guidance even though the field is arguably one of the oldest and best established applied fields of psychology. The uncertainty psychologists experience most likely stems from working with colleagues whose professional ethics differs from their own while providing services to demanding people and the many moral questions associated with the administration of law. I believe psychology’s ethics does, however, provide adequate (...) moral guidance. It has a sound historical basis, has face validity and emphasizes those social moral principles that allow psychologists to best serve individuals and society. Psychologists may nevertheless be confronted with conflicting demands because there are other norm systems that also regulate their behavior as researchers and practitioners, and they, like all people, are influenced by their conscience. Ultimately, psychologists working in the psycholegal field will be best served if they have good knowledge of, and have internalized, the ethical principles of psychology. (shrink)

Prompted by a recommendation of the two Christian hospital associations in Germany, the Neu-Mariahilf Hospital in Goettingen set up a health ethics committee in autumn 1998. It is the committee's task to give support to staff members, patients and their relatives in individual cases where ethical dilemmas arise. The following article descibes the committee's work by means of three cases.

I will argue that some changes of mind about what it is best to do are akratic occurrences and that the associated overt actions are derivatively akratic, and I will explain how akratic episodes of this kind are possible. Even if Socrates is mistaken in denying the reality of strict akratic action, he has identified an important phenomenon that deserves more attention than it has received.
