We argue that Brandon and Carson's (1996) "The Indeterministic Character of Evolutionary Theory" fails to identify any indeterminism that would require evolutionary theory to be a statistical or probabilistic theory. Specifically, we argue that (1) their demonstration of a mechanism by which quantum indeterminism might "percolate up" to the biological level is irrelevant; (2) their argument that natural selection is indeterministic because it is inextricably connected with drift fails to join the issue with determinism; and (3) their view that experimental (...) methodology in botany assumes indeterminism is both false and incompatible with the commitment to discoverable causal mechanisms underlying biological processes. We remain convinced that the probabilism of the theory of evolution is epistemically, not ontologically, motivated. (shrink)

When the benefits of surgery do not outweigh the harms or where they do not clearly do so, surgical interventions become morally contested. Cutting to the Core examines a number of such surgeries, including infant male circumcision and cutting the genitals of female children, the separation of conjoined twins, surgical sex assignment of intersex children and the surgical re-assignment of transsexuals, limb and face transplantation, cosmetic surgery, and placebo surgery.

Leslie Graves, Barbara Horan and Alex Rosenberg (1999) have argued that the process of evolution is really deterministic, so we should be instrumentalists about our probabilistic evolutionary theory. I criticize the consistency of their view. I argue that because they are realists towards multiple theories (quantum mechanics and macrophysics) their arguments against realism for another scientific theory fail. The main point of this paper is critical, but in order to set up this criticism I explore the ramifications of (...) realism for multiple theories. Finally, I offer a brief metaphysical justification for realism about multiple theories. This view justifies realism for evolutionary theory, which has been defended by Robert Brandon and Scott Carson (1996). (shrink)

The Complaint Model is an interpretation of Scanlon’s contractualism which holds that (1) an individual can reasonably reject a distribution of well-being when her complaint against that distribution is larger than any other person’s complaint against any other distribution. The Complaint Model further holds that (2) the size of an individual’s complaint against a distribution is a function of (2a) her absolute level of well-being under that distribution, with the size of her complaint increasing as her absolute level of well-being (...) decreases, and (2b) the size of her loss in well-being under that distribution relative to the level of well-being she could have enjoyed under the distribution most favourable to her, with the size of her complaint increasing as her loss increases. In this paper, I argue that the Complaint Model should be rejected, because the way in which it takes individuals’ losses into account leads to strongly counterintuitive results. In particular, I show that the Complaint Model may sacrifice the well-being associated with the least-well-off, secondleast-well-off, etc. positions for the sake of minimizing the largest complaint. I also argue that revisions to element (1) to allow for the aggregation of complaints must either leave the Complaint Model vulnerable to this objection or lead it to collapse into prioritarianism. The failure of the Complaint Model may lead us to search for an alternative way of taking losses into account. I conclude by arguing that the attractiveness of the Anonymous Pareto principle poses a challenge to any such alternative. (shrink)

David Rosenthal couples his higher-order thought theory of consciousness with a theory of “mental qualities”, properties of mental states. The first thesis of this paper is that there are no mental qualities as Rosenthal conceives of them. The second thesis is that Rosenthal’s residual insights are significant. They naturally lead to a simple first-order theory of consciousness.

In a diverse and complex world, the notion of ‘cultural competence’ is offered by some as an ethical solution to health care work which is culturally naïve or inappropriate. Notions of cultural competence, however, may obscure the fact that many clinicians, regardless of background, may feel ill equipped to deal with difference in their daily work. Drawing largely on South African examples, I suggest that issues of cultural incompetence, linked both to personal anxieties and to the ways in which health (...) care systems are structured, may be important to explore — personally, professionally, and politically. Through examining the difficulties of our own work and recognizing these, we may learn more only by learning a set of skills about the ‘other’. (shrink)

The rising cost of the opioid antagonist and overdose reversal agent naloxone is an urgent public health problem. The recent and dramatic price increase of Evzio, a naloxone auto-injector produced by Kaléo, shows how pharmaceutical manufacturers entering the naloxone marketplace rely on market exclusivity guaranteed by the patent system to charge prices at what the market can bear, which can restrict access to life-saving medication. We argue that 28 U.S.C. § 1498, a section of the federal code that allows the (...) government to use patent-protected products for its own purposes in exchange for reasonable compensation, could be used to procure generic naloxone auto-injectors, or at least bring Kaléo to the negotiating table. Precedent exists for the use of § 1498 to procure pharmaceuticals, and it could give meaning to the federal government's recent declaration of a public health emergency around the opioid epidemic, discourage new market entrants from charging exorbitant prices, and yield important public health benefits. A central task of climate justice is to agree upon a just distribution of the right to emit greenhouse gases. According to the equal per capita shares view, the right to emit should be divided equally between every inhabitant of Earth, since to emit is to use up the resource of atmospheric absorptive capacity, and this is a resource to which no one person has any stronger claim than any other. The fact that a significant proportion of the Earth’s ability (...) to absorb and sequester greenhouse gases actually comes not from the atmosphere, but from terrestrial climate sinks that are located within national borders, and that are therefore plausibly subject to legitimate territorial claims, poses a serious challenge to the intuitive egalitarian simplicity of the equal per capita shares view. A defence of this view, then, is tantamount to a defence of the redistribution of terrestrial sink capacity, and therefore must involve either (1) an argument against the legitimacy of territorial claims to terrestrial sink capacity, or (2) an argument for why legitimate territorial claims to terrestrial sink capacity should nevertheless be ignored in favour of an equal per capita distribution of emissions shares. One strategy for doing so involves applying Charles Beitz’s resource redistribution principle to terrestrial sink capacity. Some authors have argued that this strategy will fail due to important differences between the nature of ‘conventional’ natural resources, and the nature of a resource link climate sink capacity. In this paper, I consider five arguments to this effect that seek to establish the legitimacy of territorial claims to terrestrial sink capacity. Respectively, they appeal to attachment, identity, self-determination, improvement and fairness in order to do so. I argue that each one either fails to establish the legitimacy of territorial claims to terrestrial sink capacity, or, where they do plausibly establish legitimacy, they do so in a way that renders them vulnerable to type-(2) objections that suggest territorial claims to terrestrial sink capacity should nevertheless be ignored. I conclude that, if one is willing to adopt the resource redistribution principle, a just distribution of emissions shares need not respect territorial claims to terrestrial sink capacity. (shrink)

In this paper, I examine the development and application of codes of ethics for alternative dispute resolution practitioners, specifically mediators. I discuss thecommon vocabulary that one linds in model codes of conduct, and address the various dilemmas that arise for the "ethical" practitioner who wishes to model their practices on the standards found in such codes. I assert that some of the most intriguing and trenchant work on ethical dilemmas for mediators concerns the tension between accountability to participants, and aspirations (...) to ensure just outcomes. The latter invokes norms pertaining to social justice in society at large. I suggest that it can be helplul to conceive of such dilemmas in terms of a contrast between obligations a rising from the "role" of an ADR prolessional and the "policy" dimensions of evaluating the impacts of the work of ADR professionals on society at large. The wager fragment in Blaise Pascal’s _Penseés _opens with the phrase "_infini rien_"—"infinite nothing"—which is meant to describe the human condition. Pascal was responding to what was, even in the seventeenth century, becoming a pressing human problem: we seem to be able to know much about the world but less about ourselves. The traditional European view of human beings as creatures made in the image of God and potentially capable of a mystical union with God was increasingly confounded by the (...) difficulty of finding God in nature. Despite his own scientific work, however, Pascal argued that if one does not know whether or not God exists, one should bet that he does: if one is right the rewards are infinitely good and, if one is wrong, what one has lost is, by comparison, utterly trivial. The argument behind this wager is one of the most celebrated—and disputed—in the history of philosophy. It has been seen in terms of the calculus of probabilities, as a piece of religious apologetic, as an event in the religious and psychological life of Pascal himself, and as an event in the life of the Jansenist movement and its various expressions at Port-Royal. In this book, Leslie Armour explores the underlying logic of ideas brought to the surface by the intersection of two philosophical lines of thought. He shows that Pascal had come to philosophy by way of two particular strands of Platonism, one strongly mystical, associated with the founder of the French Oratorian order, Pierre de Bérulle, and the other the Augustinian Platonism associated with Duvergier de Hauranne and Cornelius Jansen. At the same time Pascal was engaged in an internal struggle with skepticism. While he agreed that it is difficult to find God in physical nature, he disagreed with the claim that we know nothing of nature. The problem is that the human being is both infinite and nothing. Thus, Armour locates Pascal’s wager within the confluence of a vital neo-Platonism and an intellectually powerful skepticism. He concludes that even today, "If we must act and cannot know enough, we must bet.". (shrink)
