Empirical evidence suggests that while people hold the capacity to control their data in high regard, they increasingly experience a loss of control over their data in the online world. The capacity to exert control over the generation and flow of personal information is a fundamental premise to important values such as autonomy, privacy, and trust. In healthcare and clinical research this capacity is generally achieved indirectly, by agreeing to specific conditions of informational exposure. Such conditions can be openly stated (...) in informed consent documents or be implicit in the norms of confidentiality that govern the relationships of patients and healthcare professionals. However, with medicine becoming a data-intense enterprise, informed consent and medical confidentiality, as mechanisms of control, are put under pressure. In this paper we explore emerging models of informational control in data-intense healthcare and clinical research, which can compensate for the limitations of currently available instruments. More specifically, we discuss three approaches that hold promise in increasing individual control: the emergence of data portability rights as means to control data access, new mechanisms of informed consent as tools to control data use, and finally, new participatory governance schemes that allow individuals to control their data through direct involvement in data governance. We conclude by suggesting that, despite the impression that biomedical big data diminish individual control, the synergistic effect of new data management models can in fact improve it. (shrink)

Although the role of emotion in socioeconomic decision making is increasingly recognised, the impact of specific emotional disorders, such as anxiety disorders, on these decisions has been surprisingly neglected. Twenty anxious patients and twenty matched controls completed a commonly used socioeconomic task (the Ultimatum Game), in which they had to accept or reject monetary offers from other players. Anxious patients accepted significantly more unfair offers than controls. We discuss the implications of these findings in light of recent models of anxiety, (...) in particular the importance of interpersonal factors and assertiveness in an integrated model of decision making. Finally, we were able to show that pharmacological serotonin used to treat anxious symptomatology tended to normalise decision making, further confirming and extending the role of serotonin in co-operation, prosocial behaviour, and social decision making. These results show, for the first time, a different pattern of socioeconomic behaviour in anxiety disordered patients, in addition to the known memory, attentional and emotional biases that are part of this pathological condition. In a recent paper Berto introduces a semantic system for a logic of imagination, intended as positive conceivability, and aboutness of imaginative acts. This system crucially adopts elements of both the semantics of conditionals and the semantics of analytical implications in order to account for the central logical traits of the notion of truth in an act of imagination based on an explicit input. The main problem left unsolved is to put forward a complete set of axioms for the proposed (...) system. In the present paper I offer a solution to this problem by providing a complete axiomatization of a generalization of the original semantics. The difficulty in proving completeness lies in the fact that the modalities that capture the notion of truth in an act of imagination are neither standard nor minimal, so that the construction of the canonical model and the proof of the truth lemma are to be substantially modified. Within the author’s long-term project of updating John Rawls’s paradigm of “political liberalism” to a historical context different from the original one, this paper focuses on how political liberalism can help us understand populism and help liberal democracy survive the populist upsurge. In the first section, political liberalism is argued to be of help in directing our attention to three constitutive aspects of all sorts of populism: the conflation of “the people” with the electorate and the electorate with the nation, (...) the attribution of constituent power to the electorate, and a penchant for so-called “justified intolerance.” In the second section, enfeebled democracies and postliberal democracies are discussed as two distinctly dangerous outcomes of populist contagion. On one influential view, metaphysical fundamentality can be understood in terms of joint‐carving. Ted Sider has recently argued that (i) some first order quantifier is joint‐carving, and (ii) modal notions are not joint‐carving. After vindicating the theoretical indispensability of quantification against recent criticism, I will defend a logical result due to Arnold Koslow which implies that (i) and (ii) are incompatible. I will therefore consider an alternative understanding of Sider's metaphysics to the effect that (i) some first order quantifier is (...) joint‐carving, and (iii) intensional notions are not joint‐carving. Another result due to Koslow entails that (i) and (iii) are also incompatible. I will argue that this second result is inconclusive. Nevertheless, (iii) is incompatible with another tenet of Sider's metaphysics, namely that (iv) ‘being joint‐carving’ is itself joint‐carving. In order to resolve the inconsistency, I will tentatively argue that condition (iv) should be renounced. (shrink)

Within emotion theory, envy is generally portrayed as an antisocial emotion because the relation between the envier and the rival is thought to be purely antagonistic. This paper resists this view by arguing that envy presupposes a sense of us. First, we claim that hostile envy is triggered by the envier's sense of impotence combined with her perception that an equality principle has been violated. Second, we introduce the notion of â hetero-induced self-conscious emotionsâ by focusing on the paradigmatic cases (...) of being ashamed or proud of somebody else. We describe envy as a hetero-induced self-conscious emotion by arguing that the impotence felt by the subject grounds the emotion's self-reflexivity and that the rival impacts the subject's self-assessment because the rival is framed by the subject as an in-group member. Finally, we elaborate on the asset at stake in envy. We contend that this is esteem recognition: The envier covets the esteem that her reference group accords to the rival. Because, in envy, the subject conceives of herself as member of a group to which the other is also understood to belong, we conclude that envy is a social emotion insofar as it presupposes a sense of us. Massive amounts of data are collected and stored on a routine basis in virtually all domains of human activities. Such data are potentially useful to biomedicine. Yet, access to data for research purposes is hindered by the fact that different kinds of individual-patient data reside in disparate, unlinked silos. We propose that data cooperatives can promote much needed data aggregation and consequently accelerate research and its clinical translation. Data cooperatives enable direct control over personal data, as well as more democratic (...) governance of data pools. This model can realize a specific kind of data economy whereby citizens and communities are empowered to steer data use according to their motivations, preferences, and concerns. Policy makers can promote this model by recognizing citizens’ rights to access and to obtain a copy of their own data, and by funding distributed data infrastructures piloting new data aggregation models. Affective information can be retrieved simply by measuring words co‐occurrences in linguistic contexts. Lenci and colleagues demonstrate that the affective measures retrieved from linguistic occurrences predict words’ concreteness: abstract words are more heavily loaded with affective information than concrete ones. These results challenge the Affective grounding hypothesis, suggesting that abstract concepts may be ungrounded and coded only linguistically, and that their affective load may be a linguistic factor.

Ted Sider has famously argued that existence, in the unrestricted sense of ontology, cannot be vague, as long as vagueness is modeled by means of precisifications. The first section of Chapter 9 exposes some controversial assumptions underlying Sider’s alleged reductio of vague existence. The upshot of the discussion is that, although existence cannot be vague, it can be super-vague, i.e. higher-order vague, for all orders. Mood profiling has a long history in the field of sport and exercise. Several novel mood profile clusters were identified and described in the literature recently ( Parsons-Smith et al., 2017 ). In the present study, we investigated whether the same clusters were evident in an Italian-language, sport and exercise context. The Italian Mood Scale (ITAMS; Quartiroli et al., 2017 ) was administered to 950 Italian-speaking sport participants (659 females, 284 males, 7 unspecified; age range = 16–63 year, M = (...) 25.03, SD = 7.62) and seeded k -means clustering methodology applied to the responses. Six distinct mood profiles were identified, termed the iceberg, inverse iceberg, inverse Everest, shark fin, surface, and submerged profiles, which closely resembled those reported among English-speaking participants ( Parsons-Smith et al., 2017 ). Significant differences were found in the distribution of specific mood profiles across gender and age groups. Findings supported the cross-cultural generalizability of the six mood profiles and offer new research avenues into their antecedents, correlates and behavioral consequences in Italian-language contexts. In his 1923 work, Roman Catholicism and Political Form, Carl Schmitt claims that representation is a complexio oppositorum and incarnates a hierarchical form of political authority, which is alternative to liberalism. This article shows that Carl Schmitt’s interpretation of the political theology of representation is based on a misreading. Schmitt selectively overlooks some meanings of the theology of repraesentatio to build his decisionistic political agenda. An investigation of the original conceptual meanings of representation in Tertullian, the first Christian author who (...) theorized representation and established many of its subsequent theological meanings, shows a different picture. At its inception, representation already included mechanisms of plurality and participation, which anticipated, and perhaps motivated, the absorption of the representation vocabulary within democratic discourse and practice. Evaluativists hold that psychiatric disorders have a factual and evaluative dimension and recognize that psychiatric patients have an active role in shaping their symptoms, influencing the development of their disorders, and the outcome of psychiatric therapy. This is reflected in person-centered approaches that explicitly consider the role of values in psychiatric conceptualization, classification, and decision-making. In this respect, in light of the recent partnership between Fulford’s value-based practice (VBP), and Stanghellini’s phenomenological-hermeneutic-dynamical (P.H.D) psychotherapy method, this paper presents a comparative analysis (...) of two person-centered approaches to psychiatric care currently discussed within the literature. I claim that while these approaches share some core ideas, they also present important divergences concerning their axiological underpinnings, which could potentially compromise their partnership. In particular, by exploring their theoretical, practical, and ethical dimensions, I show that these models have different conceptions of what values are, which, in turn, affect their understanding of how values relate to the person and how clinicians can identify them. Finally, I argue that although Fulford’s and Stanghellini’s approaches are prima facie compatible and complementary, developing a “combined analytic-plus-phenomenological form of values-based practice” should address fundamental conceptual issues if it is to become a consistent and coherent method for psychiatric care. In recent years a certain emphasis has been put by some scholars on Leibniz’s concern about empirical sciences and the relations between such concern and the development of his mature metaphysical system. In this paper I focus on Leibniz’s interest for the microscope and the astonishing discoveries that such instrument made possible in the field of the life sciences during the last part of the Seventeenth century. The observation of physical bodies carried out by the “magnifying glasses” revealed a matter (...) swarming everywhere with life and activity, contrary to the cartesian and atomistic view of matter as something sterile and passive. Moreover, the discovery of uncountable complete “animalcula” living in the smallest drop of water provided evidence for the idea of the preformation of every organism. During his lifetime, Leibniz was extremely watchful about the new microscopical discoveries and came into contact with some of the major “observers” of his time, such as Hooke, Leeuwenhoek, Swammerdam and Malpighi. Relying both on some passages in Leibniz’s texts and on recent critical studies, I will argue that important aspects of his metaphysics have been strongly affected by the empirical observation of the “invisible world” which the microscope made possible. In the last part of the paper I show how the concept of “preformation”, originally drawn from the context of the life sciences, comes to play in Leibnizʼs philosophy a very general role, going far beyond the scope of biology and shaping important aspects of his overall philosophical system. The present paper is an inventory and a description of the known manuscripts of the Nyāyamañjarī, meant as a tool for philological research on Bhaṭṭa Jayanta’s magnum opus. The inventory is gradually built through a systematic analysis of archival data found in catalogi catalogorum, bibliographies of catalogues, individual catalogues, unpublished lists, and editions of the Nyāyamañjarī. The list is followed by a concise description of each manuscript, including an external description, an outline of the contents, and historical information.

The epistemology of śabda is one of the main themes in Bhaṭṭa Jayanta’s Nyāyamañjarī, and, in the hypotheses explored in this paper, also the conceptual basis of Jayanta’s textual re-use. The sixth chapter of the Nyāyamañjarī contains a debate between Vaiyākaraṇas and Mīmāṃsakas who, respectively, advocated an holistic or atomistic theory of language. Selected Jayanta’s re-uses from Vyākaraṇa, Mīmāṃsā, and Nyāya sources are here surveyed and analyzed, with a focus on their meaning and on the context. The method of analysis (...) is partially following Moravcsik’s scheme for a classification of citations, as well as Small’s classification by symbolic functions. By re-using texts Jayanta not only imparted authority to his own arguments, but also reassessed the relation of his tradition with other ones. Re-used ideas and words stand for symbols of those authors’ tenets, and those authors represent symbols of their respective traditions. Moreover, by quoting a certain author Jayanta often anointed him with a symbolic status of trustworthy authority, and his statement with a status of śabdapramāṇa. (shrink)

The Nyayamanjari was composed in Kashmir, in the ninth century CE, by Bhatta Jayanta. It is a compendium of theses concerning ontological, epistemological and linguistic issues developed in the classical period of Indian philosophy. Jayanta's approximate date is confirmed by both internal and external evidences, so the Nyayamanjari has become a landmark in the historiography of Indian philosophy. Despite its relevance, however, the history of the textual transmission of the Nyayamanjari is in many respects still unknown. This new critical edition (...) is based on a comprehensive inventory of all the known sources, on a detailed description of the manuscripts, on a textual bibliography of the printed editions, on a genealogical study of the textual transmission, and on a rich apparatus of the indirect transmission. An important result of this research has been the development of a new, rigorous, and yet pragmatic method to edit Nyayamanjari passages, without the demand of formidable resources in terms of time, man-power, and funds. The first part of this publication includes all the propaedeutic steps in view of the critical edition. More specifically, it consists of the recensio of the known Nyayamanjari sources, including their inventory, their description, the collation of their variants, and the study of their genealogy, resulting in a fully documented stemma codicum which guides the editorial choices during the reconstruction of the edited text. The second part contains the critical edition, which covers the first of the three sections composing the sixth book of the Nyayamanjari. This particular section consists of a discussion on semantics and epistemology from the perspective of the Vyakarana, Mimansa and Nyaya traditions, hinging around the holistic theory of the sphota. The phenomenon of experienced agency is related to perceptual‐motor coordination, and Solfo and van Leeuwen discuss two ways that context can change this relationship. One is that agency is experienced only in contexts where environmentally‐coupled actions are stitched together over time to form long‐range correlations. The other is that the locus of agency depends on the temporal relationship between actions and events in the environment.

This volume addresses the intriguing issue of indirect reports from an interdisciplinary perspective. This article shows that a forgotten source of Marsilius’ scientia of law-making in the Defensor Pacis is the Lucidator, the main astrological work of Peter of Abano. A compared analysis of these two works demonstrates that the theories of experientia and scientia that Marsilius considers necessary to make laws in the first dictio of the Defensor Pacis entirely draw on Peter of Abano’s views on the epistemological status of ‘the science of the stars’. It is shown that the purpose of (...) Marsilius’ reinstatement of Peter of Abano’s theory of scientia is to build a science of law-making that does not need natural law and is based on experience and certain demonstrations. (shrink)

In this paper I respond to Lois McNay’s article “The politics of exemplarity: Ferrara on the disclosure of new political worlds.” After contextualizing her appraisal of my views on exemplarity within the current debate about critical theory and postcolonialism, and after clarifying my interpretation of Kant’s notion of sensus communis, I defend the function that this concept plays within an immanent and experience-near approach to critical theory. Sensus communis is what makes of a subjective grievance a cogent critique. I then (...) elucidate how the transcontextual communicability of human flourishing can be understood, along lines still compatible with Kant’s theory of judgment. In the final section of the paper, McNay’s suggestion to reconceptualize critique in experience-near terms is integrated as a genealogical reconstruction of sensus communis as nourished by encounters with experiences of injustice. This volume highlights important aspects of the complex relationship between common language and legal practice. It hosts an interdisciplinary discussion between cognitive science, philosophy of language and philosophy of law, in which an international group of authors aims to promote, enrich and refine this new debate. Philosophers of law have always shown a keen interest in cognitive science and philosophy of language in order to find tools to solve their problems: recently this interest was reciprocated and scholars from cognitive science (...) and philosophy of language now look to the law as a testing ground for their theses. Using the most sophisticated tools available to pragmatics, sociolinguistics, cognitive sciences and legal theory, an interdisciplinary, international group of authors address questions like: Does legal interpretation differ from ordinary understanding? Is the common pragmatic apparatus appropriate to legal practice? What can pragmatics teach about the concept of law and pervasive legal phenomena such as testimony or legal disagreements? (shrink)

Wittgenstein has often explored language games that have to do with musical objects of different sizes (phrases, themes, formal sections or entire works). These games can refer to a technical language or to common parlance and correspond to different targets. One of these coincides with the intention to suggest a way of conceiving musical understanding. His model takes the form of the invitation to "hear (something) as (something)": typically, to hear a musical passage as an introduction or as a conclusion (...) or in a certain tonality. However one may ask to what extent or in what terms (literal or metaphorical) these procedures, and usually the intervention of language games, is requested by our common ways of understanding music. This article shows through the use of some examples that aspectual perception inherent to musical understanding does not require language games as a necessary condition (although in many cases the link between them seems very strong), in contradiction with the thesis of an essential linguistic character of music. At a basic level, it seems more appropriate to insist on the notion of a game: to understand music means to enter into the orbit of "music games" which show an autonomous functioning. Language games have, however, an important function when we develop this comprehension in the light of the criteria of judgment that substantiate the manner in which music is incorporated in and operates within specific forms of life. The discussion about the uses of the concept “musical object” highlights the difficulties of the project – put forward by Pierre Schaeffer (1966) – of basing its definition on the idea of “objet sonore”. Moreover, the proposal to assimilate the functions of the “objet sonore” to those fulfilled by a “musical work” turns out to be no less problematic. A new definition is proposed: a musical object is a social object resulting from the inscription of perceived sound(s), or of the (...) acoustic event(s)/object(s), in a reference system recognized as “musical” by a group of (minimally) two people.
