Typologia źródeł ma charakter zespołu opozycji dychotomicznych, które zawierają takie kategorie, jak lingwistyczne vs. językowe, eksplicytne vs. implicytne, naturalne vs. sztuczne itd. Specjalną uwagę poświęca się czynnikom odmienności źródeł lingwistycznych, a mianowicie takim jak: 1) wewnętrzna dyferencja dyscyplin lingwistycznych; 2) dynamika paradygmatów lingwistyczno-filozoficznych; 3) specyfika stylów naukowych w tradycjach narodowych i geokulturowych.

a This is an outline of a coherence theory of law. Its basic ideas are: reasonable support and weighing of reasons. All the rest is commentary.a (TM) These words at the beginning of the preface of this book perfectly indicate what On Law and Reason is about. It is a theory about the nature of the law which emphasises the role of reason in the law and which refuses to limit the role of reason to the application of deductive logic. (...) In 1989, when the first edition of On Law and Reason appeared, this book was ground breaking for several reasons. It provided a rationalistic theory of the law in the language of analytic philosophy and based on a thorough understanding of the results, including technical ones, of analytic philosophy. That was not an obvious combination at the time of the booka (TM)s first appearance and still is not. The result is an analytical rigor that is usually associated with positivist theories of the law, combined with a philosophical position that is not natural law in a strict sense, but which shares with it the emphasis on the role of reason in determining what the law is. If only for this rare combination, On Law and Reason still deserves careful study. On Law and Reason also foreshadowed and influenced a development in the field of Legal Logic that would take place in the nineties of the 20th century, namely the development of non-monotonic (a defeasiblea (TM)) logics for the analysis of legal reasoning. The books’ goal is to answer the question: Do the weaknesses of value-free economics imply the need for a paradigm shift? The author synthesizes criticisms from different perspectives (descriptive and methodological). Special attention is paid to choices over time, because in this area value-free economics has the most problems. In that context, the enriched concept of multiple self is proposed and investigated. However, it is not enough to present the criticisms towards value-free economics. For scientists, a bad paradigm is better (...) than no paradigm. Therefore, the author considers whether value-based economics with normative approaches such as economics of happiness, capability approach, libertarian paternalism, and the concept of multiple self can be the alternative paradigm for value-free economics. The goal of this article is to show that instrumental rationality and utility that have been used in economics for many years does not work well. What is presented in the article is how significant the influence of utilitarianism has been on economics and why the economists get rid of humans’ goals and motivations. It is shown in the article that the human who decides in present is absolutely different from the human who decides over time. Many economists neglected this (...) problem because they wanted to have an effective and simple model. Becker’s economic method is presented as a dead end to which economics has been brought to. It is impossible to connect different selves of one human being by using the utility measure. The works of Schelling and J.S. Mill are used to explain this impossibility. The conclusion of this article is that instrumental rationality and utility have affected economics significantly. But, this simplified view on human nature is no longer valid. Hence, economics needs to think not only about the means but also about the human goals. Economics needs to rebuff relativism and show people how to achieve well-being. If we want to help people with their self-governance, we will have to choose reason over emotions. (shrink)

Procrastination as putting off until tomorrow what one had intended to do today is well-known tendency in everyday life. In an attempt to understand the character of procrastination in different life-domains, a large body of research has been accumulated over the last decades. This article was aimed to evaluate a specific decisional procrastination of school-to-work transition that is treated as maturity postponement. Two studies are reported examining SWT procrastination defined as career indecision among Polish students graduating universities. In Study 1, (...) attitudinal and identity statuses were analyzed as correlates of career procrastination. A path analysis conducted for the model, which was aimed to explain the influence of career self-efficacy and occupational commitment on career indecision, revealed its very good fitness. Those two independent variables explain 10% of career indecision variance. Stepwise multiple regression analyses conducted to ascertain relationship of five identity statuses to procrastination measure showed that Commitment Making and Ruminative Exploration are strongest predictor variables. In study 2, the stepwise multiple regression analyses conducted to ascertain the independent relationship of each of Big Five personality factor revealed that Neuroticism and Extraversion accounts of the most of explained variance of school-to-work transition procrastination. Christopher Arciszewski, Arian mercenary and man of many facets, conducted a journal in which, it is suspected, he described military campaigns, the state of the colony and other interesting phenomena he was able to observe during his time of service in Brazil. In 1641, Gerard Vossius was completing his magnum opus De theologia. In Chapter 8 of the first volume, Vossius discusses the “cult of the demon” among various peoples. As an example the Netherlander erudite provides a colorful description of (...) such a cult among the Brazilian Tapuya tribe. Since the author never traveled to Brazil, he makes use of the observations of Christopher Arciszewski. How does an Arian, brought up in an atmosphere of intense pluralism and far-reaching tolerance towards other belief systems, react when he encounters, first-hand, a culture utterly different, and completely alien to him? His presentation of a hierarchically constructed morality existent among various cannibalistic tribes is, in a sense, an intellectual breakthrough. Instead of treating the nativescollectively as one homogenous culture, as simply “savages”, Arciszewski distinguishes between various cultural units, and treats them individually. The nobleman attempts to convey their own views of morality not on the basis of European ethical systems, but on the local ones in place. In his day, such ideas were nearly unthinkable for most educated Europeans. Cannibalism of any kind was perceived as godless behavior, a sort of devilry, which would eventually be abolished with coming of the “light of Christianity” to the New World and the inevitable Europeanization of the natives. The reader can marvel at the extent to which Arciszewski is willing go in his relativism, to the point of sympathizing with the Tapuya. He allows them to explain to the reader the functioning of theirendo-cannibalistic culture. Arciszewski adds to the rationalization of cannibalism a detailed description of the death-rite among the Tapuya, presenting these ceremonial customs in accordance with their own beliefs, as something potentially interesting for humanistic intellectuals back in the Old World. Vossius’ book also discusses the question of the tribe’s spiritual beliefs: their conceptions of good and evil, deities, etc. The reader once again witnesses Arciszewski’s readiness to accept beliefs and deities completely unknown to European religion. The author does not prima facie discount the possibility that the “universal laws” operating in the Old World have no place in the Brazilian wilderness. His philosophical outlook, demonstrated by his rationalization of what had before been considered “magical” or “irrational”, is surely a foreshadowing of the rationalism of Enlightenment, whose modes of thinking constitute the core-foundation for alllater philosophical and scientific inquiry. Arciszewski, as an Arian brother par excellence, essentially operated with such conceptual tools as relativism, toleration and universalism, and his intellectual arsenal did not altogether differ from our own. As such, Arciszewski, and Europeans like him, helped free the Western worldview of its mediaeval philosophically limited conceptions of the cosmos, and propelled it in new directions of inquiry. This led eventually to a decided shifting of the European worldview away from superstition towards reason: the most definitively crucial moment in European intellectual history. (shrink)

This paper relates to a formal statement of the mechanisms that are thought minimally necessary to underpin consciousness. This is expressed in the form of axioms. We deem this to be useful if there is ever to be clarity in answering questions about whether this or the other organism is or is not conscious. As usual, axioms are ways of making formal statements of intuitive beliefs and looking, again formally, at the consequences of such beliefs. The use of this style (...) of exposition does not entail a claim to provide a mathematically rigorous formal deductive system. Conventional mathematical notation is used to achieve clarity, although this is elaborated with natural language in an attempt to reduce terseness. In our view, making the approach axiomatic is synonymous with building clear usable tests for consciousness and is therefore a central feature of the paper. The extended scope of this approach is to lay down some essential properties that should be considered when designing machines that could be said to be conscious. In the broader discussion about the nature of consciousness and its neurological mechanisms, it may seem to some that axiomatisation is premature and continues to beg many questions. However, the approach is meant to be open- ended so that others can build further axiomatic clarifications that address the very large number of questions which, in the search for a formal basis for consciousness, still remain to be answered. Of course, in discussions about consciousness many will also argue that the subject is not one that may ever be formally addressed by means of axioms. The view taken in this paper is 'let's try to do it and see how far it gets'. (shrink)

In the period between Turing’s 1950 “Computing Machinery and Intelligence” and the current considerable public exposure to the term “artificial intelligence ”, Turing’s question “Can a machine think?” has become a topic of daily debate in the media, the home, and, indeed, the pub. However, “Can a machine think?” is sliding towards a more controversial issue: “Can a machine be conscious?” Of course, the two issues are linked. It is held here that consciousness is a pre-requisite to thought. In Turing’s (...) imitation game, a conscious human player is replaced by a machine, which, in the first place, is assumed not to be conscious, and which may fool an interlocutor, as consciousness cannot be perceived from an individual’s speech or action. Here, the developing paradigm of machine consciousness is examined and combined with an extant analysis of living consciousness to argue that a conscious machine is feasible, and capable of thinking. The route to this utilizes learning in a “neural state machine”, which brings into play Turing’s view of neural “unorganized” machines. The conclusion is that a machine of the “unorganized” kind could have an artificial form of consciousness that resembles the natural form and that throws some light on its nature. (shrink)

This paper compares the capability approach (CA) and libertarian paternalism (LP) to see whether they are compatible. The comparison focuses on rationality, wellbeing, and freedom. The main theoretical framework is Sen’s ‘reason to value’ (RtV). The relevance of this to CA, and LP is analysed, and whether the primacy that CA and LP both accord to reason leads to paternalism is examined. Although the principal focus is on Sen’s, Sunstein’s and Thaler’s original ideas, their key concepts are analysed in the (...) context of the contemporary critical literature on the topic. This critical analysis not only makes it possible to assess whether CA and LP are compatible, but also to see how they perceive rationality, wellbeing, and freedom. The critical analysis further differentiates the various interpretations of RtV in the literature and explains how CA and LP function. (shrink)

The goal of the article is to substantiate that despite the criticism the paradigm in economics will not change because of the axiomatic assumptions of value-free economics. How these assumptions work is demonstrated on the example of Gary Becker’s economic approach which is analyzed from the perspective of scientific research programme. The author indicates hard core of economic approach and the protective belt which makes hard core immune from any criticism. This immunity leads economists to believe that they are objective (...) scientists and, consequently, it results in epistemological hubris. Due to its tautological nature, economic approach is considered to be a degenerative programme. This conclusion is extended on value-free economics. In spite of these problems, many economists still believe in positive economics and they dismiss normative approaches. It has a negative influence on people. The conclusion of the article is that thanks to axiomatic assumptions economists do not have objective and ironclad methodology and they should accept normative values in their research. (shrink)

Although Nicholas of Cusa occasionally discussed how the universe must be understood as the unfolding of the absolutely infinite in time, he left open questions about any distinction between natural time and historical time, how either notion of time might depend upon the nature of divine providence, and how his understanding of divine providence relates to other traditional philosophical views. From texts in which Cusanus discussed these questions, this paper will attempt to make explicit how Cusanus understood divine providence. The (...) paper will also discuss how Nicholas of Cusa’s view of the question of providence might shed light on Renaissance philosophy’s contribution in the historical transition in Western philosophy from an overtly theological or eschatological understanding of historical time to a secularized or naturalized philosophy of history. This paper looks closely at previously enunciated axioms that specifically include phenomenology as the sense of a self in a perceptual world. This, we suggest, is an appropriate way of doing science on a first-person phenomenon. The axioms break consciousness down into five key components: presence, imagination, attention, volition and emotions. The paper examines anew the mechanism of each and how they interact to give a single sensation. An abstract architecture, the Kernel Architecture, is introduced as a starting point for (...) building computational models. The thrust of the paper is to relate the axioms to the kernel architecture and indicate that this opens a way of discussing some first-person issues: tests for consciousness, animal consciousness and Higher Order Thought. Although neoclassical economics faces frequent criticism, it remains the dominant paradigm, largely due to its immunisation strategies that rely on unfalsifiable concepts of utility and rationality. In this paper, I use Karl Popper’s philosophy to assess whether these strategies are justified. Firstly, I reconstruct Popper’s ideas on immunisation strategies, situational analysis, the rationality principle, and the metaphysical research programme. Next, I examine how neoclassical economics’ immunisation strategies counter critiques from behavioural economics. I conclude that neoclassical economics’ method does not produce (...) empirical conjectures. I assess and evaluate this finding in relation to the “rationality principle”, as it parallels neoclassical economics’ optimisation axiom. Furthermore, I explore Popper’s relevance in the context of neoclassical economics’ recent incorporation of behavioural economics’ insights to show that my analysis is not purely historical. Epistemicism associates vagueness with ignorance produced by semantic plasticity: the shiftiness of intensions in our language resulting from small changes in usage. The recent literature (Caie 2012; Magidor 2018; Yli-Vakkuri 2016) points to a missing piece in the epistemicist theory of vagueness, namely a clear account of the semantics of the definiteness operator Δ. The fundamentals of the epistemicist theory are well understood. However, the technical work of defining the definiteness operator has proven difficult. There are several desiderata that we (...) would like Δ to satisfy. For instance, we would like the epistemicist notion of ‘definiteness’ to interact well with modal operators and validate intuitive principles like ‘necessarily, if φ is definitely true, then φ is true’. Providing an account that would meet all such desiderata has eluded the epistemicists so far. In this paper, I present a novel version of a multidimensional model inspired by the work of Robert Stalnaker and David Kaplan. Using this model, I provide an account of epistemicist definiteness that meets our desiderata. (shrink)

The State and the nation belong to the ideas created by the common consciousness, and at the same time, as a true forma formans, have connotations to the world of predominance, influencing the reality. There exist such strong connections, that their understanding is an intellectual duty of those who research nowadays the social links and try to explain them to the contemporary audience.

The main stream of legal theory tends to incorporate unwritten principles into the law. Weighing of principles plays a great role in legal argumentation, inter alia in statutory interpretation. A weighing and balancing of principles and other prima facie reasons is a jump. The inference is not conclusive.To deal with defeasibility and weighing, a jurist needs both the belief-revision logic and the nonmonotonic logic. The systems of nonmonotonic logic included in the present volume provide logical tools enabling one to speak (...) precisely about various kinds of rules about rules, dealing with such things as applicability of rules, what is assumed by rules, priority between rules and the burden of proof. Nonmonotonic logic is an example of an extension of the domain of logic. But the more far-reaching the extension is, the greater problems it meets. It seems impossible to make logical reconstruction of the totality of legal argumentation. (shrink)

The epistemicist theory aims to explain ignorance due to vagueness by semantic plasticity: the shiftiness of intensions across close possible worlds resulting from shiftiness in usage. This explanation is challenged by the Omniscient Speaker Puzzle (Sennet in Philos Stud 161(2):273–285, 2012). Suppose that an omniscient speaker, Barney, who knows all the facts about usage and how these facts determine the intensions of expressions, cooks up a scheme to stabilise the intension of a normally semantically plastic term like ‘rich’. It seems (...) that ‘rich’ would display all the phenomena associated with vagueness without being semantically plastic, thus making the epistemicist explanation of ignorance due to vagueness insufficient. Although one would not wish to classify Copernicus’ own intentions as belonging to the late-medieval and Renaissance tradition of nominalist philosophy, if we are to turn our consideration to what was responsible for the eventual success of the Copernican Revolution, we must also attend to other features of the dialectical context in relation to which the views of Copernicus and his followers were articulated, interpreted, and evaluated. In this paper I accomplish two goals: first, I briefly reconstruct Hans-Georg Gadamer’s views on language, included foremost in Truth and Method. I discuss if and how can we analyse language in the hermeneutic way; what is Gadamer’s view on philosophy of language and linguistics; what is the hermeneutic priority of the question and why choosing the logic of question may lead to a conflict between philosophical hermeneutics and analytic philosophy. Then, on such base I show correlations, which can be (...) traced between hermeneutic philosophy and other contemporary language research disciplines – generally understood linguistics, analytic philosophy of language and interdisciplinary discourse research. Taking a closer look at each of the mentioned disciplines I focus on trying to answer the question regarding their ideological and methodological connections with the hermeneutic way of thinking. The article ends with a conclusion, that interdisciplinary discourse analysis produces the highest hopes to analyse language in a non-objective matter, which is the way that Gadamer favoured. The aim of this paper is to show the main thesis concerning the theory of cognition of the eminent neo-Kantian Heinrich Rickert, as presented in his work “Der Gegenstand der Erkenntnis”. On the one hand, Rickert finds out that thinking is fated to “clash with nothingness”, thus creating a temptation to reject all rigours and to yield to complete discretion. On the other hand, he attributes axiological status to nothingness which subjects thinking to a particular kind of “ought”. In his (...) view, the cognizing subject is faced with an axiological choice: either discretion or truth and argues that it is worth opting for truth. His argumentation could be an interesting point of reference for contemporary culture gradually moving away from the type of thinking rooted in objectively existing principles. (shrink)

The author adopts a coherentist approach to legal argumentation.Ceteris paribus, the degree of coherence of argumentation depends on answers to such questions as: How many statements belonging to the justification are supported by reasons, that is, not arbitrary?, How profound is the justification, that is, how long are the chains of reasons it contains?, How closely interconnected are the reasons, for example in such a way that the same conclusion follows from various independent reasons?, How relevant are the reasons in (...) the context in question?, etc.A reasonable legal argumentation is a special case of a reasonable moral argumentation. Both contain moral substantive reasons and legal authority reasons. On the other hand, some particularities of legal argumentation must be noticed, as well. Among other things, the lawyers take for granted that legal reasoning is based on valid law and that some sources of law, such as statutes, are binding.There exist various juristic roles and corresponding types of argumentation, e.g., judicial and doctrinal ones. Yet, all kinds of legal argumentation must use weighing and balancing in order to make the law coherent and morally acceptable. Consequently, all general principles and criteria of coherence are applicable to all these types but their weight varies between them. (shrink)

It is proved that the following conditions are equivalent: (a) there exists a complete, atomless, σ-centered Boolean algebra, which does not contain any regular, atomless, countable subalgebra, (b) there exists a nowhere dense ultrafilter on ω. Therefore, the existence of such algebras is undecidable in ZFC. In "forcing language" condition (a) says that there exists a non-trivial σ-centered forcing not adding Cohen reals.

Legal doctrine in Continental European law (scientia iuris) consists of professional legal writings, e.g., handbooks, monographs, etc., whose task is to systematize and interpret valid law. By production of general and defeasible theories, legal doctrine aims to present the law as a coherent net of principles, rules, meta‐rules, and exceptions, at different levels of abstraction, connected by support relations. The argumentation used to achieve coherence involves not only description and logic but also evaluative (normative) steps. However, sceptics criticise juristic doctrine (...) for its normative character, ontological obscurity, vagueness, fragmentation, and locality. The author answers this criticism pointing out the following. Normative reason is possible. Liberal ontology, admitting such entities as morally justified law, is possible as well. The vagueness of legal doctrine can be construed as defeasibility. Defeasibility is inevitable in the law and in human thinking in general. Fragmentation of legal doctrine is not absolute. Its theories are linked to overarching moral theories. Finally, locality is not absolute either. Though sometimes restricted to a given state, theories of legal doctrine display relevant similarities to corresponding theories in other states. (shrink)
