A growing body of empirical research examines the effects of the so-called “social determinants of health” on health and health inequalities. Several high-profile publications have issued policy recommendations to reduce health inequalities based on a specific interpretation of this empirical research as well as a set of normative assumptions. This article questions the framework defined by these assumptions by focusing on two issues: first, the normative judgments about the fairness of particular health inequalities; and second, the policy recommendations issued on (...) this basis. We argue that the normative underpinnings of the approach are insufficiently supported and that the policy recommendations do not necessarily follow from the arguments provided. Furthermore, while many of the policies recommended—such as improving people's living conditions and reducing inequalities in wealth and power—are justified in their own right, the way these recommendations are tied to health is problematic. This paper argues that a putative conflict between negative rights and positive rights is not a genuine conflict. The thought that they might conflict presupposes, I argue, that the two rights are valid. This is the first assumption of my argument. The second is that general rights impose duties on everyone, not just the party who faces a conflict of correlative duties. These two assumptions yield the conclusion that positive rights impose enforceable duties on the holder of the negative right; (...) no right is thus infringed if this duty is enforced so no conflict occurs. If this is correct, it means that we can include welfare or socio-economic rights in a set of general rights without generating conflicts with negative rights to non-interference; this might clear some space for arguments that favour egalitarian redistribution although it does not show that general positive rights do exist. A recurring concern about luck egalitarianism is that its implementation would make some individuals, in particular those who lack marketable talents, experience shame. This, the objection goes, undermines individuals’ self-respect, which, in turn, may also lead to unequal respect between individuals. Loss of (self-)respect is a concern for any egalitarian, including distributive egalitarians, inasmuch as it is non-compensable. This paper responds to this concern by clarifying the relationship between shame and (self-)respect. We argue, first, a luck egalitarian society and ethos (...) would be radically different from the current one and incompatible with shame over lack of talent, and, second, that while shame may still occur in a less than ideal luck egalitarian society, this kind of shame does not undermine egalitarian commitments. On some theories of rights, such as the Choice theory, only agents can have moral rights. The realm of right-holders thus excludes several potential candidates, among which are young children, mentally incapacitated persons, and groups since these are thought to lack the required degree of agency. This paper argues that groups can be right-holders. The argument comes in three steps: first, it is argued that full-blown or autonomous agency is not required for the possession of Choice theory rights, second, that (...) groups can be seen as agents, albeit in a limited sense, and third, that groups can make irreducibly collective choices in spite of their limited agency. The upshot of this argument is that groups can have rights, provided that they are organized around a coherent decision-making procedure; furthermore, this account can be employed to argue that other creatures of limited agency are possible right-holders. Some theorists, especially egalitarians, seek to ‘apply’ theories of justice to a specific area or good, such as health, and assess the distribution of that good at the bar of justice. On the one hand, this is understandable, given that egalitarians are often interested in making policy recommendations and these would have to be area-specific. On the other hand, it is surprising in light of the fact that theories of justice normally envisage the ‘total package of goods’ or an overall (...) good as the distribuendum. In his analysis of the concept of causality, Hume finds that all events accounted causes and effects are contiguous and successive. No object can act efficaciously upon another so long as the objects are at a distance from each other. It may sometimes appear that “distant objects are productive of one another,” but on examination it is discovered that they are linked together by a series of intermediate causes which are contiguous among themselves; and even where examination does not directly (...) disclose the intermediate causal chain, it is still presumed that it exists. Also the cause is temporally prior to the effect. If I throw a stone through a window, the smashing of the glass follows the act of throwing the stone. It is only after the realization of the cause that the effect appears. Thus a cause is an object that is precedent to and contiguous with another object that is called the effect. (shrink)

The paper argues, against Davidson, that metaphorical utterances involve meaning other than literal meaning. The kind of meaning is a particular case of contextual meaning. It is argued that metaphorical meaning is not a case of speaker's meaning , nor is it occasion meaning . I offer an explanation of why those metaphors that are not paraphrasable cannot be paraphrased.

In Romania, the Baptist denomination includes, according to the 2002 census, about 130,000 believers, subsequent to the Pentecostal denomination. Areas having a large number of followers are Banat and some parts of Transylvania; besides these, there can be added large urban areas such as Bucharest, Timişoara, Constanţa, Cluj-Napoca, Oradea, and Arad. In terms of ethnicity, Romanians represent the majority, followed by the Hungarians (Hungarian Baptist Convention). One of the smallest minorities in Romania, that is the Czechs, also provides a number (...) of believers, in the village of Sfînta Elena (Coronini Township, Caraş-Severin County) being the only Czech Baptist community in our country. Here, besides Catholics, a Baptist community is to be found, twice as small and of fairly recent origin. In the following, we intend to outline its image, based on field observations and interviews carried out between 2005-2010 (All of these have been materialised in our book, Istorie şi memorie în comunităţile cehilor din Clisura Dunării). We paid a particular interest in the neo-Protestant group, in order to identify means of building the image of another group with a different faith, considering the double minority, ethnic and religious status. Also, we tried to capture the ratio of forces between two different faith groups that were facing the same economic and social problems, problems that have caused the depopulation of villages, by massive migration of people to the Czech Republic. After the fall of the communist regime in Romania, in the name of their shared religious faith, a series of religious NGOs from Turkey and other Islamic countries expressed their readiness to support the members of the two communities in their search for their lost religious identity after the religious constraints enforced by the communist regime had been lifted in 1989. The fieldwork undertaken as part of a research project on the two historical Muslim communities in Dobruja, the Turks and (...) the Tatars, has shown the involvement of some religious organizations in the life of these ethnic groups. The present study analyzes the feedback on the actions of the aforementioned organizations as they are depicted in oral testimonies recorded in 2013 and 2014 and in written texts. The aim of this paper is the description of the interactions between the old Muslim community of Dobruja and their co-believers who volunteered to support them through religious education and social work directed at the disadvantaged groups. Discussing their religious beliefs caused the individuals we interviewed to reflect on another version of Islam, unknown to them before 1990 and promoted today by those who read the Quran literally and follow it to the letter. The arbitral world is at a crucial point in its historical development, poised between two conflicting conceptions of its nature, purpose, and political legitimacy. Formally, the arbitrator is an agent of the contracting parties in dispute, a creature of a discrete contract gone wrong. Yet, increasingly, arbitrators are treated as agents of a larger global community, and arbitration houses concern themselves with the general and prospective impact of important awards. In this paper, I address these questions, first, from the standpoint (...) of delegation theory. In Part I, I introduce the basic “Principal-Agent" framework [P-A] used by social scientists to explain why actors create new institutions, and then briefly discuss how P-A has been applied to the study of courts. Part II uses delegation theory to frame discussion of arbitration as a mode of governance for transnational business and investment. In Part III, I argue that the International Center for the Settlement of Investment Disputes is presently in the throes of judicialization, indicators of which include the enhanced use of precedent-based argumentation and justification, the acceptance of third-party briefs, and a flirtation with proportionality balancing. Part IV focuses on the first wave of awards rendered by ICSID tribunals pursuant to Argentina's response to the crushing economic crisis of 2000-02, wherein proportionality emerged, adapted from the jurisprudence of the Appellate Body of the World Trade Organization. This paper examines the relations between, on the one hand, accounts of the distinction between an agent's identifying with, as opposed to feeling alienated from, their attitudes; and on the other, metaphysical accounts of action. It claims that a commitment to an event-causal conception of agency, which would analyse agency in terms of the causal potency of psychological states and events, appears to render mandatory a particular style of account of identification and alienation – namely, the hierarchical model offered by (...) Harry Frankfurt and Michael Bratman. It is argued that such accounts fall foul of a dilemma: the Authority Problem. The failure of attempts to avoid the Authority Problem is then used to motivate an attractive alternative style of account of the distinction, offered by Richard Moran. However, it is pressed that Moran's account rests on claims about agency which seem incompatible with the event-causal conception of agency. By making the links between the metaphysics of agency and accounts of identification and alienation more explicit, the paper allows us to better comprehend both the apparent need for and characteristic failures of some traditional accounts of identification and alienation, as well as make clear the action-theoretical debt incurred by those who would offer an alternative. The standard of proof in criminal trials in many liberal democracies is proof beyond a reasonable doubt, the BARD standard. It is customary to describe it, when putting a number on it, as requiring that the fact finder be at least 90% certain, after considering the evidence, that the defendant is guilty. Strikingly, no good reason has yet been offered in defense of using that standard. A number of non-consequentialist justifications that aim to support an even higher standard have been (...) offered; all are morally unsound. Meanwhile, consequentialist arguments plausibly support a substantially lower standard — in some cases so low as to undermine the idea that punishment is what is at stake. In this paper, I offer a new retributive justification that supports excluding the instrumental benefits of punishment from the balance that sets the standard. The resulting balance supports a standard arguably in the ballpark of the customary understanding of BARD: a standard requiring that the fact finder have a high, though not maximally high, degree of confidence that the defendant is guilty. We know our own intentional actions in a distinctively first-personal way. Many accounts of knowledge of intentionally doing something, A, assume that grounds for the knowledge would have to establish or indicate that it is true that one is intentionally doing A. In this paper, I argue against this assumption, showing how it entails being in a Moore-paradoxical situation. I argue that if knowledge of intentionally doing A were such that grounds for it must be truth-indicating, then one could always (...) wonder, when doing A, whether A is for one a goal. However, just as wondering whether p is true is incompatible with thinking that one believes p, so wondering whether A is for one a goal is incompatible with thinking that one is intentionally doing A. We must allow, then, that one’s knowledge of intentionally doing A is itself a representation of A as a goal to be accomplished, apt to be grounded by reasons for doing A. I show that the first-personal character of knowledge of acting intentionally resides in its being practical rather than theoretical. (shrink)

What might the project be of lyric poetry in late global capitalism in the early years of the new millennium which acknowledges both a post-romantic and modernist lineage, and which faces the critical challenge of postmodernist theorizing? This paper endeavors to respond to this question forwarding the Adorno-inspired viewpoint that the praxes of individual lyric poems reveal orientations of affirmation or negation be they intended or not. The thesis is stated that the “arguments” of modern poets are creative litigations posing (...) counter-worlds, constituting anti-worlds, and projecting ideal worlds. The philosophical anthropology that informs this thesis focuses on the homo duplex conception of man as a double being—as a unique human individual and as members of thehuman species socialized into the social life-world. Thus a counterworld privileges the human subject in society as homo externus, whereas an anti-world centers on the human subject as homo internus opposed, at odds, or turned away from the external social life-world. These reflections finally concentrate on Northrop Frye’s idea of a “third order of experience” that, in his words, contrasts with “an existing world and a world which may not exist but is pointed toby the articulate orders of experience... this world is frequently called… an unborn world, a world that never quite enters existence.”.
