This essay works towards a rough explication of the ontic-ontological difference as it emerges in the early chapters of Heidegger’s Being and Time. It then goes on to use that difference to open up a possible ontology of culture. If the cultural disciplines are both ontically oriented and cannot “see” the ontic–ontological difference—and Heidegger tells us this in so many words—what alternative version of culture becomes available to an ontologically-oriented investigation that is aware of the difference?

The aim of this paper is to consider the vicissitudes of “area studies” from the Second World War to the present focusing eventually on the normative imperative to develop a new paradigm of “planetary thinking.” First an overview of the history of “area studies” will be given from the start in the U.S. during the Second World War in response to the geostrategic imperative for America to know its new geopolitical responsibilities in a world divided by war. This security imperative (...) morphed into the postwar requisite to develop a counterhegemonic strategy against soviet communism in the hot spot parts of Asia, Latin American, and later Africa. The latter military-oriented strategy was added to with research into development and modernization in the third-world through to the boundary displacement of areas studies at the end of the Cold War into the current era of globalization. At this very historical moment of transition a new rationale for area studies emerged in the form of a geoeconomic imperative – both in the U.S. and, with a different gloss, in South Korea in the late 1990s. Second, on the basis of this historical apercu, the argument will be proposed that, given the problem of global warming and the issue‐area of global inequality lurking behind the United Nation’s Millennium Development Goals, a pressing contemporary task for philosophy is to make a critical contribution to developing a new planetary perspective for area studies informed by a constitutive philosophical anthropology attendant to the species being of human beings. The arbitral world is at a crucial point in its historical development, poised between two conflicting conceptions of its nature, purpose, and political legitimacy. Formally, the arbitrator is an agent of the contracting parties in dispute, a creature of a discrete contract gone wrong. Yet, increasingly, arbitrators are treated as agents of a larger global community, and arbitration houses concern themselves with the general and prospective impact of important awards. In this paper, I address these questions, first, from the standpoint (...) of delegation theory. In Part I, I introduce the basic “Principal-Agent" framework [P-A] used by social scientists to explain why actors create new institutions, and then briefly discuss how P-A has been applied to the study of courts. Part II uses delegation theory to frame discussion of arbitration as a mode of governance for transnational business and investment. In Part III, I argue that the International Center for the Settlement of Investment Disputes is presently in the throes of judicialization, indicators of which include the enhanced use of precedent-based argumentation and justification, the acceptance of third-party briefs, and a flirtation with proportionality balancing. Part IV focuses on the first wave of awards rendered by ICSID tribunals pursuant to Argentina's response to the crushing economic crisis of 2000-02, wherein proportionality emerged, adapted from the jurisprudence of the Appellate Body of the World Trade Organization. But there is a deep disanalogy between suspected terrorists and captured enemy soldiers. Soldiers cannot be held accountable for the use of force , whereas terrorists normally can. The advent of the general theory of relativity was so entirely the work of just one person - Albert Einstein - that we cannot but wonder how long it would have taken without him for the connection between gravitation and spacetime curvature to be discovered. What would have happened if there were no Einstein? Few doubt that a theory much like special relativity would have emerged one way or another from the researchers of Lorentz, Poincaré and others. But where would (...) the problem of relativizing gravitation have led? The saga told here shows how even the most conservative approach to relativizing gravitation theory still did lead out of Minkowski spacetime to connect gravitation to a curved spacetime. Unfortunately we still cannot know if this conclusion would have been drawn rapidly without Einstein's contribution. For what led Nordström to the gravitational field dependence of lengths and times was a very Einsteinian insistence on just the right version of the equality of inertial and gravitational mass. Unceasingly in Nordström's ear was the persistent and uncompromising voice of Einstein himself demanding that Nordström see the most distant consequences of his own theory. © 1992 Springer-Verlag. The inaugural title in the new, Open Access series BSPS Open, The Material Theory of Induction will initiate a new tradition in the analysis of inductive inference. The fundamental burden of a theory of inductive inference is to determine which are the good inductive inferences or relations of inductive support and why it is that they are so. The traditional approach is modeled on that taken in accounts of deductive inference. It seeks universally applicable schemas or rules or a single (...) formal device, such as the probability calculus. After millennia of halting efforts, none of these approaches has been unequivocally successful and debates between approaches persist. The Material Theory of Induction identifies the source of these enduring problems in the assumption taken at the outset: that inductive inference can be accommodated by a single formal account with universal applicability. Instead, it argues that that there is no single, universally applicable formal account. Rather, each domain has an inductive logic native to it. Which that is, and its extent, is determined by the facts prevailing in that domain. Paying close attention to how inductive inference is conducted in science and copiously illustrated with real-world examples, The Material Theory of Induction will initiate a new tradition in the analysis of inductive inference. I contrast two roles for environmental philosophers—“applied philosophy” and “practical philosophy”—and show that the strategy of applied philosophy encourages an axiological and monistic approach to theory building. I argue that the mission of applied philosophy, and the monistic theory defended by J. Baird Callicott, in particular, tends to separate philosophers and their problems from real management issues because applied philosophers and moral monists insist that theoretical exploration occurs independent of, and prior to, applications in particular situations. This separation of theory (...) and practice suggests that philosophers are likely to be effective in policy discussions only to the degree that they can offer unquestioned theories that adjudicate real problems. Callicott offers his monistic, ontological approach as universal guidance to environmental activists and decision makers, arguing that ecosystems and communities are moral subjects that can “own” their own inherent value. Callicott’s theory, however, faces a crucial, unanswered theoretical dilemma which illustrates the impossibility of the dual task Callicott has set for his theory—to provide a single, ontological unification of ethics under nonanthropocentric holism and to capture the fine nuances of ethical obligations as experienced in varied communities. I also show that monistic assumptions have led to an unfortunate interpretation ofAldo Leopold’s land ethic and that a pluralist and pragmatist direction is likely to provide a more efficacious and theoretically defensible direction for further study of environmental philosophy in a more practical mode. I deny that the world is fundamentally causal, deriving the skepticism on non-Humean grounds from our enduring failures to find a contingent, universal principle of causality that holds true of our science. I explain the prevalence and fertility of causal notions in science by arguing that a causal character for many sciences can be recovered, when they are restricted to appropriately hospitable domains. There they conform to loose and varying collections of causal notions that form folk sciences of causation. This (...) recovery of causation exploits the same generative power of reduction relations that allows us to recover gravity as a force from Einstein's general relativity and heat as a conserved fluid, the caloric, from modern thermal physics, when each theory is restricted to appropriate domains. In the exuberance that followed Einstein’s discoveries, philosophers at one time or another have proposed that his theories support virtually every conceivable moral in ontology. I present an opinionated assessment, designed to avoid this overabundance. We learn from Einstein’s theories of novel entanglements of categories once held distinct: space with time; space and time with matter; and space and time with causality. We do not learn that all is relative, that time in the fourth dimension in any non-trivial sense, that (...) coordinate systems and even geometry are conventional or that spacetime should be reduced ontologically to causal, spatio-temporal or other relations. We know our own intentional actions in a distinctively first-personal way. Many accounts of knowledge of intentionally doing something, A, assume that grounds for the knowledge would have to establish or indicate that it is true that one is intentionally doing A. In this paper, I argue against this assumption, showing how it entails being in a Moore-paradoxical situation. I argue that if knowledge of intentionally doing A were such that grounds for it must be truth-indicating, then one could always (...) wonder, when doing A, whether A is for one a goal. However, just as wondering whether p is true is incompatible with thinking that one believes p, so wondering whether A is for one a goal is incompatible with thinking that one is intentionally doing A. We must allow, then, that one’s knowledge of intentionally doing A is itself a representation of A as a goal to be accomplished, apt to be grounded by reasons for doing A. I show that the first-personal character of knowledge of acting intentionally resides in its being practical rather than theoretical. (shrink)

What economic conditions are necessary for us to arrive at a post-work future, and what should a post-work future look like? This chapter argues that only through the democratization of core economic institutions can we properly experiment with post-work imaginaries. I argue, based on principles of participatory autonomy and relational equality, for the democratization of workplaces, finance and investment, and the knowledge commons. Given these necessary structural changes, the possibility of a post-work future becomes a democratic choice by placing democratic (...) decision-making power in the hands of those who are directly affected by workplace decisions, investment decisions, and the collective production of knowledge. Through this democratization process, the potential to reduce working hours, the possibility of building meaningful work, and the chance to decenter work as the mechanism for economic security and meaning-making, all become subject to democratic deliberation and decision-making. In her latest writing on the trolley problem, 'Turning the Trolley,' Judith Jarvis Thomson defends the following counter-intuitive position: if confronted with a choice of allowing a trolley to hit and kill five innocent people on the track straight ahead, or turning it onto one innocent person on a side-track, a bystander must allow it to hit the five straight ahead. In contrast, Thomson claims, the driver of the trolley has a duty to turn it from the five onto the (...) one. Thomson’s argument is fundamentally flawed in several important ways. We explain her argument and identify its major flaws. Our aims are: (a) to show that Thomson has not provided reason to think such an act is not permissible, and (b) to use the process of exposing the weaknesses in different parts of her argument to demonstrate the importance of undertaking what we call a Hohfeldian analysis of the 'mechanics' of the rights in play. A Hohfeldian 'mechanics' of rights extends the distinctions that Hohfeld first introduced to take into account the pro tanto normative 'forces' at work on an agent, the balance of which determines who in the end has what kind of right. It may be argued that Joyce's work can be seen either as the defining text of a real and historically grounded nationhood or, conversely, as the defining text of an imaginary and ahistorical nationhood. It may in other words be viewed as either epical or Utopian—and as addressing a modernist predilection for either of those forms. But it may also be argued that Joyce's work might paradoxically be seen as both of these things and that Joyce's writing is able to (...) suspend and maintain such contradictory positions in a synthetic harmony through its uses of ambiguity and irony.
