The epistemic basic structure of a society consists of those institutions that have the greatest impact on individuals’ opportunity to obtain knowledge on questions they have an interest in as citizens, individuals, and public officials. It plays a central role in the production and dissemination of knowledge and in ensuring that people have the capability to assimilate this knowledge. It includes institutions of science and education, the media, search engines, libraries, museums, think tanks, and various government agencies. This article identifies (...) two demands of justice that apply specifically to the institutions that belong to it. First, the epistemic basic structure should serve all citizens fairly and reliably. It should provide them with the opportunity to acquire knowledge they need for their deliberations about the common good, their individual good, and how to pursue them. Second, the epistemic basic structure should produce and disseminate the knowledge that various experts and public officials need to successfully pursue justice and citizens need to effectively exercise their rights. After arguing for these duties, I discuss what policies follow from them and respond to the worry that these duties have illiberal implications. (shrink)

: The corpus of fatwa named as Bostānu Shaqā’iq al-Nuʿmān, recorded in the Veliyuddin Efendi section under the number 1414 at Beyazıd State Library. It has been ignored so far. Because of its name, it may be thought that it is a part of Tashkoprulüzāde’s book Shaḳā’iḳ-i Nuʿmāniyya, but it is a nuqullu fatwa collection of Babakūshī ʿAbdurrahmān Efendi. In the famous Shaqā’iq appendix Atā’ī, which gives information about the biography of Abdurrahmān Efendi does not mention the book with this (...) name. Abdurrahman Efendi who was from a family in Plovdiv region worked in different positions in Istanbul and Edirne. Then, he was appointed as a mufti to Kefe, Crimea. He died in 983/1576. There is no information about his scholarly identity in ‛Aṭā‛ī except being the intern of Abū l-Suʿūd Efendi. In this essay, first of all, the place of Babakūshī in Ottoman Islamic Law tradition will be determined, and the features of the manuscripts and some notes on the postscript will be studied. In assessment section, especially because of the notes on the manuscripts, it has to be studied in terms of Islamic Law literature and its place should be figured out in fatwa literature. Summary: Nuqullu Fatwa collections that included citations were the books that were created for people to have access to the ruling on legal issues of scholars who were appointed as Muslim judges or muftis together with their sources and background. Although there are several studies in the literature about fatwa collections with citations Babakūshī ʿAbd al-Raḥmān Efendi's book titled Bostânu Shaqā'iḳ al-Nuʿmān was not included in the literature. ‛Aṭā‛ī provides information about the life of Babakūshī Abdurrahman Efendi. Atâ'î explains that he climbed the stairs with the help of Baba Efendi and joined the special group of people with aptitude at the level of apprenticeship. Then he raised also to the level of being the intern of Abū l-Suʿūd Efendi. Later, Babakūshī ʿAbd al-Raḥmān started to teach. He taught as a teacher for three years in Istanbul and then became the Mufti of Kefe replacing Molla Akmal al-Dīn. Molla Ekmeleddin, who was better known as Ekmel Efendi, just like ʿAbd al-Raḥmān Efendi, was an apprentice of Abū l-Suʿūd Efendi and would later be transferred to Cyprus after the island was conquered. According to Aṭā‛ī, ʿAbd al-Raḥmān Efendi remained in that position which he was appointed as Ṣahn teacher until his death and died in Zilqāda 983/February 1576. The highest position that Babakūshī took among the religious scholars organization in the Ottoman Empire was being the Mufti of Kefe. As stated by ‛Aṭā‛ī, he was appointed as the Mufti of Kefe with the title of Ṣahn teacher. Instead of giving information about his teachers, ‛Aṭā‛ī mostly concentrated on Baba Efendi who was one of his relatives. Therefore we do not have information about his mentors/teachers. We can say that he belonged to the Ottoman school of scholars since he was an apprentice of Abū l-Suʿūd Efendi. The copy which is the subject matter of this study is registered as Veliyüddin Efendi with number 1414 at Bāyezıd State Library. According to our research, the copy which has 237 sheets is the only copy of the book. From the expressions of Babakūshī in the preface, it is concluded that the book was written close to his death. There are several notes written with different pens as footnotes of the book. Here, four of them which are considered to be more important will be identified.First: Notes written with the same pen as the main text. These are generally citations from books such as Tatarkhāniyye, Hidāya, ‛İnâya, Kashf al-Asrâr Sharḥu Manār.Second: are 'maṭlabs' i.e. important matters. Third: are relatively inelaborate notes. These were written by someone who we thought was not a copyist/calligrapher when compared with the general style of the book. Fourth: Warning notes which included some questions. These are generally in Turkish. The preface of the book, provides sufficient information about who the author was and the nature of the book. ʿAbd al-Raḥmān Efendi, with the intention of writing a collection, started to research taking into account imams' and shaykhs' nāsikh and mensūkh and he also considered sheikhs' explanations about what was definite and what needed caution and taqwa in practice. He recorded that this search lasted for 3 years and he referred especially to Fatāwa-yi Qādikhān and Fatāwa-yı Tatarkhāniyya within this period and additionally reviewed and studied Islamic Law books that he found in the Ottoman Empire. He described that he divided these into chapters and inserted subject matters in the footnotes. Then he described how he gave the title, Bostānu Shaqā'iḳ al-Nuʿmān to the book emphasizing especially bostan.This could be seen in the expression, Masīratan li'l-Qudāt. No reference was made to Shaqā'iḳ al-Nuʿmān in the title of the book. Probably he had his intentions due to the famous book titled Şeḳ' āiḳ-i Nuʿmaniye and his pupils). In the chapter which started with Fasl right after the preface the author said that fatwa would be issued based on the opinions of three imams, namely Abū Ḥanīfa, Abu Yūsuf and Imām Muhammed that their madhap was followed and their good morals were observed. Then, it was stated that the Mufti could issue fatwas according to the opinions of first, Abū Ḥanīfa, then Abu Yūsuf and finally Imam Muḥammed. It was also stated that if he could not find their opinions and had himself muctehid, he could give his ictihad. The Fatwa collection, Bostān, is an important work among the 16th century Ottoman books since it is an important scholar's book who had witnessed Islamic knowledge in the central Ottoman Empire and Crimean region. My goal in this paper is to see the extent to which judgment aggregation methods subsume meta-analytic ones. To this end, I derive a generalized version of the classical Condorcet Jury Theorem, the aggregative implications of which have been widely exploited in the area of rational choice theory, but not yet in philosophy of science. I contend that the generalized CJT that I prove below is useful for modelling at least some meta-analytic procedures.

This study analyzes Siyāsatnāma tradition in Sunnī political thought in terms of exploring the problem of just ruling. In the relevant literature, the dominant approach considers Siyāsatnāmas as ethical advice in general and regards them as ineffective against an unjust ruler who has no ethical concern. This study criticizes this dominant view by claiming that in addition to the religious/ethical argument to promote a just rule, the Siyāsatnāma tradition develops a second argument designed specifically for an unjust ruler who ignores (...) ethical advice. This second argument is ignored by the dominant position about the Siyāsatnāma tradition. I have called it self-interest argument in this study. An unjust ruler’s self-interest is to maintain, empower, and hand down his power to his descendants. The self-interest argument tries to convince a ruler who dismisses ethical advice to adopt just ruling by revealing that even for an unjust ruler the best strategy is just ruling to reach for his worldly aims. Summary: Earlier civilizations generated a Siyāsatnāma tradition to provide ethical and practical advice to rulers about a just and efficient ruling in a society. This tradition played an important role in classical Islamic political thought. Muslim rulers and thinkers who are acquainted with this tradition as a result of early Islamic conquests. In the beginning, some Siyāsatnāmas were translated into Arabic but later Muslim administrators and thinkers wrote original Siyāsatnāmas by including their experiences and other Islamic sources. The Siyāsatnāmas put forward both ethical advice and practical methods for rulers to rule justly and efficiently their states. While ethical advises are mainly derived from religious sources and individuals considered to be holy, practical methods are gathered from experiences of rulers who became successful in establishing just, efficient, and strong states in history. The Siyāsatnāma tradition does not seek theoretical, abstract, and philosophical models of just ruling. Rather it relies on experimental reason, common sense, historical wisdom, and ethical reasoning. This tradition is called “Mirrors for Princes” in Western political thought. In the relevant literature, the Siyāsatnāma tradition is seen as ethical advice in essence. This approach argues that this tradition simply relies on ethical and religious arguments to promote just ruling without devising any institutional measures such as a check and balance system to constraint the authority of the ruler. In the absence of any institutional control over the power of the ruler, the ethical argument means that: If the ruler rules justly, he would be awarded in the afterlife, while if he rules unjustly he would be punished in the afterlife. According to this approach, without any institutional measure, the Siyāsatnāma tradition, in reality, leaves the problem of just ruling to personal preference and the conscious of the ruler. It is up to the ruler whether he rules justly or unjustly, for there is not any external constraint over his power, given that he does not care about the afterlife. If he has a concern about his salvation in the afterlife, ethical advice would be effective, otherwise, those advice would not have any influence over him. As a result, according to this approach, the ethical argument fails in the final analysis against the unjust ruler who has no ethical concern. This dominant view ignores a second approach developed in the Siyāsatnāma tradition specifically to convince the ruler who has not any ethical concern to rule justly. I call it self-interest argument in this study. Unlike the dominant approach’s claim, the Siyāsatnāma tradition takes the problem of unjust ruler seriously and appeals to his self-interest to convince him to rule justly. The self-interest argument is clearly aware of the limits of the ethical argument against the ruler who does not care about the afterlife. An unjust ruler’s self-interest is to maintain, empower, and then hand down his dynasty to his descendants. The self-interest argument tries to convince a ruler ignoring ethical advice to adopt the just ruling by revealing that even for an unjust ruler the best strategy is just rule to reach for his worldly aims. Many historical examples are given to make it clear that unjust rules are short-lived.The essence of the self-interest argument is that: The just rule creates trust both among individuals and the state and society, then this widespread trust awakens the desire of attaining a comfortable life in human nature. The efforts of the individuals with the purpose of attaining a comfortable life lead to social and economic development in society, which in turn increases the financial sources of the state. That is why a just rule is the only solution to create a strong state as well as a developed society. The unjust ruling on the other hand, leads to distrust between the state and society and among individuals. This distrust and fear from the state lead to deterioration of the economic situation, for the desire embedded in human nature to attain a comfortable life would not awaken in such a society. As a result, the ruler could not have the necessary financial resources, which would weaken his power. That is why the just ruling is the only solution that serves to the interest of a ruler who only wants worldly power. This study analyzes Mâwardî’s and Ghazâlî’s political theories to reveal the self-interest argument in the Siyāsatnāma tradition. This self-interet argument could be seen in Hobbes’ political theory also. Hobbes, as one of the founders of modern political thought, takes the civil wars created by different religious sects and ideologies in the 17th century Europe as his starting point to formulate his model of the state. Hobbes thinks that without social peace and order, there would not be a society. He offers a strong monarchy which relies on the unity of powers as a solution to establish a peaceful society. The only responsibility of Leviathan as a strong and effective state is to establish and maintain peace and order in society. Any restriction over individuals is acceptable to reach that goal according to Hobbes. The source of the authority of the ruler is not just rule but social peace and order. Yet, after securing peace and order, Hobbes argues, it is the best policy for the ruler to rule justly, for a just rule leads to both social and economic development and increases financial sources of the state. The Hobbesian argument is also self-interest argument that we could find within the Siyāsatnāma tradition. He tells the ruler that even though he does not have to rule justly, it is the best policy to serve his self-interest. (shrink)

In the era Islam emerged, Arabs were calling Jews and Christians as Ahl al-Kitāb, respecting them and affected by them in many ways. When they failed in their debates against the Prophet, they were referring to the scholars of Ahl al-Kitāb and relying on the information they got from them, they were trying to force and beat the Prophet intellectually by their questions. In the Meccan period, no clashes had happened between the Muslims and Ahl al-Kitāb. Jewish scholars had been (...) admitting that they knew the similarity in the topics of Qurʾān and Tawrāt, the Qurʾān were telling the truth and the Prophet was conveying the message of the truth. In some of the verses, these right attitudes of the scholars of Ahl al-Kitāb are used as a reference against Mus̲h̲riks. In the verses said, those scholars are praised and indicated as a source of information for the Prophet as well. The verses related with the topic were understood in parallel with the context and direct meaning of the Nass by some scholars, yet, they were explained not taking the Nuzul environment and process into consideration by some other scholars. It is mentioned that ʿAbdallāh b. Salām and his friends who became Muslims in Medina period have been told in these verses. In this study, level of validity for these interpretations will be evaluated based on Qurʾān –relationship and the fact that some of the asbab al-nuzul (circumstances of revelation) are known to be jurisprudential; and it will be argued that the true meaning of the naṣṣ is overshadowed.Summary: Tafsir is an effort to understand the divine address, and also to understand the relationship between Muslim, polytheist, and People of the Book (Ahl al-kitāb) in the revelation and experience in this context. Since these issues are not explained in a wide and clear manner in the Qur’ān, the hadīths, prophetic biography, narratives of asbâb al-nuzul and the opinions of the companions and the views of the Companions and Tābi‘īn gain importance in understanding the verses. As the narrations of asbâb al-nuzul contain some problems, it is proposed to evaluate this information based on sigas and hadīth method in classical Qur'ānic sciences studies. Although this approach is effective in solving many problems, it does not solve all problems.The question of whether the narrators of asbâb al-nuzul is the real reason for the verse has been discussed from the very beginning. According to Ibn Taymiyya (d. 728/1328) al-Zarkashī (d. 794/1392) and al-Dihlawī (d. 1176/1762), the expression that “This verse has been revealed on this particular event” does not mean that the verse is revealed particularly and only for this event but rather that it is revealed for an event which is similar to that event, and that, subject verse also covers this provision. A. Nedim Serinsu and A. Rıza Gül also drew attention to this fact and the narratives were divided into two as the real cause of nuzul and virtual cause of nuzul. When this issue is not known, it may become inexorable to analyze and make observations, and there may be problems regarding the interlocutors, date of births, being Meccan or Medinan.Those who want to learn the first-hand meaning of the verses, their interlocutors and the environment of nuzul are facing difficulties to choose between the contradictory narrations especially in narrative-weighted commentaries. It is necessary to pay attention to some points to evaluate the narrations correctly and make the right choice. These points are prophetic biography, the stages of nuzul, information about being Meccan or Medinan, the stages of development of relations between polytheists and Muslims, and tafsīr explanations about nuzul. One of the issues with contradictory narratives and interpretations is ʿAbdallāh b. Salām. As one of the notables of the Medina Jews, he came to him when the Prophet arrived in Kuba, he asked some questions, and when he got the right answers, he became a Muslim saying that they could only be known by a prophet. It is claimed that he believed in the period of Mecca and the eighth year of the Hijr, but this information was not well accepted.Although it was not very intense in Mecca, there were certain relations between Jews and Christians and Muslims. Since there was no conflict between Muslims and the People of the Book, these verses are often praised by their scholars, and they were also cited as a reference for the Prophet and idolaters Some Meccan verses mention the following: Jews who are righteous; the fulfilment of the requirements of the book, and the prayers of the Muslims that will not be wasted; the fact that the scholars of the Israelites know the truths in the Qur'an should be a proof for the idolaters; The Ahl al-kitāb know that the Qur'ān is a divine book; if he has doubts about the verses revealed to the Prophet, he should ask the Jewish scholars; Jews witnessed and believed the truth of the prophethood of the Prophet; the fact that Ahl al-kitāb were delighted with the Qur'ān. In the exegesis of these verses, it has been commented that the interlocutors are ʿAbdallāh b. Salām and his friends, Prophet Muhammad's companions, Selman al-Fârisî, Ali and the kitāb who believed in the Prophet.Since the commentators did not consider the process experienced with the Ahl al-kitāb sufficiently, the verses that were written before becoming Muslim were associated with ʿAbdallāh b. Salām. However, Masrūk (d. 63/683), Sha'bî (d. 104/722) and Said b. Jubayr (d. 94/713 [?]) refused to relate the Meccan verses to ʿAbdallāh b. Salām because they had considered the process of nuzul. When the revelations are evaluated on the basis of the Qur'ān and prophetic biography relationship and the process of nuzul, it is understood that the interlocutors are the scholars of Ahl al-kitāb who know and acknowledge that the Qur'ān and the prophethood are right, as some commentators have indicated. In this case, it is understood that the commentators make comments that are not appropriate to the context, wording and nuzul process of the verses based on the narratives that are not true and that they use the name of ʿAbdallāh b. Salām as a kind of filling material since the information about the interlocutors is limited. It is not acceptable to praise one of them in the revelations when we evaluate the Ahl al-kitāb by generalizing the truth, their hostility towards Islam and the wars. However, there were no clashes with Jews and Christians in Mecca and there were scholars who expressed the truth. They were praised when necessary, and also cited as a reference source for the Prophet and idolaters. In addition, in the verses that criticize the Ahl al-kitāb in the verses Medinan, those who make the mistakes in question are not criticized as a whole. As in these examples, we need to evaluate the verses in the context of the individual process, not with the influence of our established perceptions and with a wholesale mind. Otherwise, unintentional results can be reached. It can be claimed that the Predecessors fell to an anachronism in their explanations about ʿAbdallāh b. Salām which did not conform to the date and time. However, when we consider the views of Ibn Taymiyya, al-Zarkashī and al-Dihlawī, it is understood that the Predecessors expressed views in terms of exegesis, opinion-based sampling rather than an anachronism. These interpretations of the Predecessors also depict that the information available to the interlocutors of the verses is insufficient. The fact that the historical information errors in Predecessors’ illustrations and explanations show that the information transferred from them should be examined carefully and that one must not surrender him/her without investigation. It is a clear fact that those who accept interpretations based on ijtihâd as an actual asbâb al-nuzul fall into anachronism. In this respect, it is understood that asbâb al-nuzul narrations should be evaluated in accordance with the principles mentioned and it is necessary to distinguish between those who tell the real reason and those who do not and make a preference among them. After the tragic events in New York, Madrid, Istanbul, and London, one has every reason to think that Islam is somehow a part of the problem. Ethics and morality, fundamental concepts in human society, are expected to be upheld by individuals and effectively taught by teachers to new generations. This study delves into the perceptions of preservice teachers regarding ethics and good within the framework of an ethics and morality course in education. It also explores the ethical and unethical behaviors these teachers most commonly encounter in their school experiences. Utilizing a qualitative case study methodology, the research provides an in-depth analysis of ethics, the concept of (...) good, ethical and unethical behaviors within the Turkish context. Through thematic analysis of data collected over various weeks, the findings reveal that participants perceive ethics as actions, individuals, and ideas that embody values such as justice, respect, and honesty. Their decision-making is influenced by diverse ethical filters aligned with normative ethical theories. For instance, an act is deemed ethical if it does not limit freedom and harm others, conforms to societal norms, benefits others, adheres to laws and rules, instills a sense of righteousness, and stems from good intentions. Furthermore, the study identifies six key qualities defining the concept of good: evoking happiness, being beneficial, proper, pure, preferred, and encompassing both moral and ethical dimensions. The experiences of ethical and unethical acts among participants predominantly relate to themes of inequality versus justice, harshness versus love, ineffective versus effective teaching, inconsistency versus role model behaviors, undesired versus desired relationships with school stakeholders, and the breach versus balance between professional and private life. Overall, this research highlights significant aspects of how preservice teachers perceive the concepts of ethics and good along with unethical behaviors, offering valuable insights for teacher education. One of the most important issues that distinguishes the Baghdādī branch of the Muʿtazila from the Baṣran branch is their view on ʿAlī b. Abī Ṭālib (d. 40/661). Basra branch accepts the order of virtue of the first four caliphs as their order of coming to office, while the Baghdad branch considers the first three caliphs legitimate, but considers Ali more virtuous than them. The Baghdādī Muʿtazilīs who outspokenly defended this idea were Abū Jaʿfar al-Iskāfī (d. 240/854), Abū al-Qāsim al-Kaʿbī (...) (d. 319/931) and Ibn Abī al-Ḥadīd (d. 656/1258). Among them, Ibn Abī al-Ḥadīd was renowned as “the greatest scholar of the Muʿtazila” and was considered one of the last representatives of this school. He ardently defended ʿAlī's superiority in his commentary on Nahj al-Balāgha, the famous collection of Ali’s sermons, letters and wisdom sayings. In his defense, he rebutted some criticisms about ʿAlī’s political decisions from his school’s point of view. Many items of Ibn Abī al-Ḥadīd’s rebuttal are worthy of analysis in terms of their content, style and approach. This article aims to present a detailed account of Ibn Abī al-Ḥadīd’s aforementioned refutations. In addition to the descriptive method, the interpretative method was also employed in the article. Although Ibn Abī al-Ḥadīd did not consider Ali's infallibility necessary (wājib), unlike Imamiyya, he accepted it. Therefore, he responded to the criticisms directed at Ali, starting from the point of Ali's innocence. According to Ibn Abī al-Ḥadīd: (a) After the death of the Prophet, ʿAlī insisted on becoming the new leader of the Muslim community. He did not act hastily to assume the caliphate because he was not expecting any opposition to that. However, when the events took a different turn, he did not escalate the situation, rather accepted the status quo. (b) ʿAlī also did the right thing by participating in ʿUmar b. Al-Khaṭṭāb’s (d. 23/644) electoral shūrā. This was an opportunity for him to become the next caliph, and reinstitute a system in accordance with the Qurʿānic principles and sunna of the Prophet. (c) It was also not an error when ʿAlī decided to stay in Medina during the events of ʿUthmān’s murder (d. 35/656). He played an active role in dissuading the rebels from their attempt to kill ʿUthmān, but he was in no position to know that his activity would be used against him later by the Umayyads who accused ʿAlī of being complicit in ʿUthmāns’s murder. (d) ʿAlī took the caliphate after ʿUthmān because of his popularity among the people. In this way, he managed to prevent an unqualified person to occupy the seat of the caliphate. (e) When the Battle of Camel broke out, those who demanded justice and opposed ʿAlī were in error. (f) When ʿAlī became the new caliph, his decision to remove Muʿāwīya (d. 60/680) from the governorship of Syria was correct. This is because Muʿāwīya would have refused to accept ʿAlī’s leadership even had he stayed in office as a governor. ʿAlī understood that the conflict would end only through fighting, so he did not lose time in marching against Muʿāwīya. (g) During the battle he abided by the sharīʿa and allowed the Syrian army to access water. (h) It was not ʿAlī, but those defectors in his army who obliged him to end the fighting through arbitration. (i) When ʿAlī agreed to sign the Ṣiffīn ceasefire agreement and did not use his title amīr al-muʾminīn, he followed the Prophet's example since the latter also refrained from using his title during the Ḥudaybiyya agreement. (j) ʿAlī also cannot be blamed for those among his supporters, such as the poet al-Najāshī, who defected and joined the ranks of Muʿāwīya. The motivations for the defectors were either to attain worldly gains or to escape from punishment for the crimes which they had committed. (k) When Muʿāwīya managed to conquer Egypt, ʿAlī’s governors of the province, Qays b. Saʿd (d. 60/680) or Muḥammad b. Abī Bakr (d. 38/658), did nothing for which they could be blamed. (l) And finally, ʿAlī never had guards to protect him because he was never afraid of being assassinated. Although Ibn Abī al-Ḥadīd took Ali's innocence as a basis while presenting these views, he did not make inconsistent comments in general and did not say things contrary to historical facts. The main problem of this text is as follows: While identifying the status of education systems related to moral education with the title of industrial education, the situation is identified through the problems of the morality of education or moral education. Then, a proposal on the education of morality is made through the system evaluation. This point is for the text. These problems are dealt with by using an in-depth and holistic evaluation method together with description and identification. The text (...) primarily focuses on the founding meaning through which time manifests. Because education is both built by this meaning and fulfills a task that perpetuates it. As a part of an entirety/ground reflecting the spirit of the time, education carries/overflows its nuclei and aims. The expression “industrial education” is crucial in that it expresses both its roots, the entirety to which it belongs, and the network of values it has. Here, the term industrial refers to the ground in question, and industrial education refers to the educational understanding of that ground. It is unthinkable that the network of values it possesses is contrary to the whole in question. In the text, the identification of this situation is described through the “ethics of education”. This process that humanity has experienced is new. Therefore, industrial education should be interpreted with its conceptual network. Thus, concepts such as "environment", "context", "transformation", "change" have been redefined. This is essential to make sense of the situation. It identifies that the final solutions sought can be possible not with the “morals of education” but with the "education of morals". This means proposing a reinstallation of the system/environment. M. Hayri Kırbasoglu is researcher who studies in the field of ḥadīth. Kırbasoglu’s latest work was on the famous orientalist Ignaz Goldziher, and in his book Understanding Goldziher, he claimed that Goldziher, who was criticized by Muslim researchers, was not understood correctly, a hate and smear campaign was carried out against him, and he suffered a great injustice. The reason for writing this article is to analyze the defense of Goldziher put forward by Kırbasoglu in the aforementioned study and to (...) evaluate whether he is right in his opinions and determinations. As a result of our research, it was seen that there was no other study that was critical of Kırbasoglu’s defense of Goldziher, and it was decided to write this article. The article is limited to Kırbasoglu’s aforementioned work, and it is aimed to introduce both him and Goldziher correctly, based on Kırbasoglu’s views here. At the end of the article, it was concluded that Kırbasoglu’s evaluations about the Jewish orientalist Goldziher were subjective, one-sided, biased, reactive, far from objectivity and superficial, in addition, it was concluded that most of his analyzes related to Goldziher do not correspond to the facts. Sartre’s phenomenology of the image in L’Imaginaire includes analytical distinctions between the mind’s comportments towards perceptual objects, images, and signs, which he refers to as different forms of consciousness. Sartre denies any possible convergence between imaging and sign consciousness, arguing that there are essential differences in the way they relate to the notions of resemblance, positionality, and affect. This essay argues against his phenomenological distinctions by stressing the continuity of imaging with sign consciousness: between images and words. In particular, it (...) argues that his understanding of the sign as affectless is questionable and that there is no reason to believe that images and signs cannot elicit similar affects or perform the same functions. Consequently, it is possible to interpret Sartre’s physical images or “analoga” as pictorial signs: his phenomenological descriptions of physical images may indeed be recast in the language of the sign and reformulated as acts of consciousness that involve pictorial signs. Tolerance is an ambivalent attitude. It allows living in plurality but not in equality. The tolerant tradition of the Ottoman Empire, for example, is based on a very clear political and social hierarchy between different religions. Dominants boast of their tolerant tradition. Tolerance is also about imposing limits on the other in a unilateral way. In Republican Turkey where theoretically all citizens are equal, the majority of Turkish-speaking Sunnis tolerate non-Muslim minorities, Alevis, Kurds. It is the ‘liberal’ currents of this (...) ethno-religious majority that pronounce themselves tolerant of others. However, minorities do not demand tolerance but equality because the history of Turkey for more than a century with the genocide of Armenians, pogroms, massacres, deportations have shown those who say they are tolerant can switch to each moment in extreme violence against those whom they now consider intolerable. The rephrasing of meanings (maʿnā) and use of different words (lafẓ) in the Qurʾān are dealt with under the rubric of the theme “Qurʾānic style.” The stylistic variations in the Qurʾān are expressed as takrār al-Qurʾān, tasrīf (Affix and Paraphrase), ʿudūl (inversion), and tafannun (stylistic variation). However, when compared with other terms of exegesis, “tafannun” remained in the background and its conceptualization was thwarted. The first chapter of this study deals with the etymology of tafannun, its historical background and conceptualization as well as the relationship between iʿjāz (inimitability) and tafannun in the history of tafsīr, while the second one identifies and illustrates the kinds of tafannun to expound on the true nature of this concept.According to the result of this research, iftinān means following various styles and genres (types), while tafannun denotes variations in styles and genres (types). In vernacular, these two terms are considered the same. The term iftinān was dealt with in some works under the subject of muhassināt al-maʿnaviyya within the framework of badīʿ. In the Arabic literature, when the definition of the term iftinān was given, the term tafannun was not defined under any section of any book or any other place in the rhetoric of science. Tafannun is used to express the way any action is carried out, as it is mentioned in the definition of iftinān.The word tafannun was used to demonstrate the expertise, depth and mastery of Islamic scholars in one or various fields of Islamic studies in the early works of Islamic literature. In later times, the term iftinān was used to show rhetorical and oracy skills of a person. Abū Hilāl al-ʿAskarī (d. 400/1009) define tafannun as “the variation in words while two paragraphs bear the same meaning.” His definition proved to be a turning point in the conceptualization process of the word tafannun. Al-Zamakhsharī (d. 538/1144) was the first Islamic scholar to refer to the word tafannun in the interpretation of the Qurʾān. He used the words iftinān and tafannun in the same sense in his works. He mostly regarded examples of iltifāt as iftinān. Abū Bakr al-Rāzī (d. 666/1268), establishing a connection between tafannun and repetition, stated that the term tafannun was used to avoid boredom of repetitive diction.Among other authors who used the term tafannun in their works, Bayḍāwī, (d. 685/1286), Nīsābūrī (d. 730/1329), Ibn Cemāʿa (d. 733/1333), Abū Ḥayyān (d. 745/1344), Samīn al-Ḥalabī (d. 756/1355), Zarkashī (d. 794/1392), Suyūṭī, (d. 911/1505), Ḥaṭīb al-Shirbīnī (d. 977/1570), Shihāb al-Dīn al-Khafājī (d. 1069/1659), Ālūsī, (d. 1270/1854), Muḥammad ʿAbduh (1849-1905)-Rashīd Riḍā (1865-1935) and Ibn Āshūr are the notable ones. Rather than merely defining the term tafannun, the majority of these commentators emphasized the function, benefit and aim of this word. Thanks to the use of this word by these commentators, a distinction was made between tafannun called iftinān as a literary device in the science of badīʿ and tafannun gaining a new meaning used to express stylistic variations. As a result, two words with the same dictionary definition were distinguished from each other during the conceptualization process. Among the authors using the word tafannun, Ibn Āshūr clearly defined the term and contributed significantly to its conceptualization. He defines the word tafannun as the uniqueness of the Qurʾān in employing stylistic variations by offering synonymous words in case of iʾtirāz (discursive), tanzīr, (resemblance), tazyīl (appendix) and takrār (repetition), creating the most comprehensive definition until that time.Tafannun is also defined as expression of the same meaning through re-signifying, stylistic variation in two verses, difference in the repetition of parables, variations in choice of diction and synonymous words, and avoidance of repetition. As a result of its definition, the word tafannun also denotes providing stylistic variations, using vivid language, avoiding prosaic diction, using denotative and connotative language, helping readers to grasp shades of meaning and read between the lines in the most clear and economic way.In the related literature, there are a lot of references to the word tafannun when demonstrating iʿjāz of the Qurʾān. When looked at the historical development of the relationship between iʿjāz and tafannun, it is observed that tafannun was accepted to be an element of iʿjāz. Defined as providing stylistic variation, tafannun is employed in various ways. The literary devices used to carry out tafannun are through ʿudūl, iltifāt, taqdīm and taʾhīr, change of utterances, use of synonymous words, objection, resemblance, and addition. In the proper interpretation of the Qurʾān, tafannun has a comprehensive usage, making many more academic studies a necessity with a view to making a significant contribution to a deeper and better grasp of words and shades of meanings employed in the Qurʾān. Seemingly a minor part of L’Imaginaire, Sartre’s literary examples therein are of great significance especially in the way they highlight the implicit yet crucial role of linguistic signs and words in his psychology of the image. While commenting on the act of reading a novel, he views literary words practically as images, endowing them with both an affective and representative status and illustrating the word-image through the figure of a drawing or dessin. The novel’s word-images or dessins solve an important (...) problem in his phenomenology: in order to represent, they do not need an original perception as other, more typical images do. While the dessin suggests the opportune possibility of representation without presentation, it also introduces ambiguity in meaning, running counter to Sartre’s demand that linguistic signification be clear and transparent. Sartre attempts to contain such ambiguity by ascribing the image-like, representative use of words to poetry in What’s Literature? but I argue that the dessin indeed allows for a more comprehensive understanding of the linguistic sign and representation that covers both poetry and prose. This article aims at examining the limits of change in the field of worship through a study on the origins of the ḥukm[religious ruling] of Shawwāl fasting that is widely practiced in the different parts of Muslim world. The study, firstly, deals with the evolution of the ḥukm of Shawwāl fasting chronologically among four sunnī schools of law, then analyzes the solitary reports on the topic. It concludes that in Mālikīand Ḥanefīschools, the ḥukm of this specific worship changed within the (...) limits of karāha [reprehensibility], ibāha [permissibility], and nadb [recommendation]. This ḥukm was constructed based on solitary reports which later became a paradigmatic source of religious legitimacy in the Ḥanbalīschool beginning with the eponymous Imām and in the Shāfiʿīlong after the founding authorities. It also claims that it is strongly probable that the solitary reports on the topic go back to a deduced opinion in the age of companions, but then reached to a form of prophetic solitary report in the corpus of hadīth reports. Ultimately, this specific worship that has restricted number of fasting was established with the paradigmatic effect of the approach to solitary reports as the only authentic way of transmitting the sunna, even though it is at odds with the fact that this worship had not been implemented in the first two centuries after hijra, i.e. contrary to the established practice [ʿamal]. Summary: The issue of change of rulings in Islamic law comes up frequently on various occasions, and an increasing number of academic studies are trying to determine the characteristics and limits of this change in numerous books, articles and papers. These studies mostly seem to focus on bringing together the arguments that can be compiled under the title of ‘the flexibility of Islamic law in response to the challenges of modernity’. Although the change of rulings in Islamic law is an undeniable fact, reading it only from the lens of the change in Islamic law depending on the requirements of time is an inadequate reading. The change of rulings in Islamic law has different motives; and the change of time, more precisely the change of custom, is only one of them.On the other hand, another issue that comes up in relation to the change of rulings is the claim that this change can only take place in terms of the rulings regulating the interpersonal relations, i.e. muʿāmalāt. In fact, this claim relies on the abovementioned approach that limits the change in Islamic law with the change of custom. Hence, because other two main areas of Islamic law, worships (ʿibādāt) and punishments (ʿuqūbāt) are not open to change through custom, their rulings will not change at all. This article will try to reveal that the change in rulings might reside in a sort of another change emerged in relation to the sources of these rulings, which is a neglected point. Thus, by exposing that the field of worships which is mostly considered as a closed area for change in rulings is actually open to it, this article will examine the limits of this change.For this analysis, the article deals with the fasting of six days in the month of Shawwāl as an example, which is widely practiced in various parts of the Islamic world. The main evidence on which this fasting is based on is a report transmitted in the considerably authentic hadith sources of Ahl al-Sunnah, which reads as follows “Whoever fasts the Ramaḍān and adds six days from Shawwāl, will get reward of the entire year”. This fasting, which is the subject of a great agreement on its ruling as recommended (mustaḥāb) practice today, was actually regarded as reprehensible (makrūh) by the two great eponymous jurists of the first two schools of law in the second Hijrī century, namely Mālik b. Anas and Abū Ḥanīfa. In his al-Muwaṭṭaʾ,Mālik clearly expresses that he did not recognize any scholar who keeps this fast, and that no [authentic] report has reached him on this. The fact that both Mālik b. Anas and Abū Ḥanīfa declared an opinion on the subject shows that this practice started to appear in the first half of the second ḥijrī century as a practice or as a solitary report (khabar al-wāḥid). However, both imāms have stated that such a specific worship would be makrūh. In spite of these very sharp expressions, the schools of law, which were founded by the followers of these two eponymous scholars, abandoned their views and widely accepted Shawwāl fasting as mustaḥāb. This article examines why this sharp change occurred in a worship in the schools of law and in which way it took place.Accordingly, the fundamental motive in this change is a paradigmatic transformation in understanding and identifying the sunna as a source of normativity. Although an agreement was formed on the validity of solitary reports as a source of knowledge in the second ḥijrī century, it was not yet accepted that these narrations are identical to sunna as a source of normativity. For that reason, both Abū Ḥanīfa and Mālik did not hesitate to reject any solitary report that contradicted a stronger evidence. However, as a result of the extraordinary efforts of Ahl al-Ḥadīth, the epistemic value of solitary reports has reached to an authority equating them to the sunna with a very rapid acceleration as of the end of the second century and throughout the third century. This situation led later scholars of schools to abandon the views of the eponymous scholars of these schools on certain topics in favor of certain solitary reports. This was also the process for the change in Shawwāl fasting.This thesis will be put under two headings, a section that tries to determine the periods and processes for the Sunnī schools of law in considering this fasting as mustaḥāb; and another section that provides an evaluation of transmitted reports in relation to the Shawwāl fasting. Accordingly, in the Mālikī and Ḥanafī schools, due to the effect of the reports, the ruling of Shawwāl fasting has been transformed from makrūh into the mustaḥāb as a result of the interpretational activities that started in the fourth ḥijrī century. Shawwāl fasting was accepted as mustaḥāb in the Shāfiʿī school, although there was no transmitted opinion on the subject from the founding imāms, in the fifth ḥijrī century; and in the Ḥanbalī school directly by the founding imām Aḥmad b. Ḥanbal, whose main aim was to follow a concept of religion that puts the transmitted reports at the center. When the reports on the subject are examined, it demonstrates that the mustaḥāb ruling is mainly rooted in a report by Saʿd b. Saʿīd transmitted in the famous hadīth compilations including Muslim’s Ṣaḥīḥ.Yet, this report was criticized in its both chain and text. Combining the facts that the same report with the same chain was also transmitted as the words of the companion in some sources and the verse that declares good deed will be rewarded ten times higher than what it deserves will make the following explanation a valid one: As Mālik put it such a fasting practice was commonly unknown to the Muslim society in the first two centuries after the ḥijra. Sometime after the death of the Prophet, an inference was made probably by a companion(s) as that it would be a good deed if someone who fasted an entire month already and got used to the fasting to fast six more days in order to get a reward of fasting for the entire year according to the verse that rewards good deeds with ten times higher. Since it is a recommended practice in essence, i.e. fasting for the sake of Allah, this inference transformed into a report and easily passed through the filters of hadīth scholars who are linked to a sort of piety promoting worships among people. After the solitary reports gained an authority to the extent that they can rarely be challenged, the followers of later schools of law preferred to get in a process of re-interpreting the opinions of their imāms in order either to reconcile them with the content of report, or at least to show why these imāms actually spoke against this fasting. Eventually, the later scholars of madhhab decided for the standard opinion of the madhhab depending on the reports in favor of the Shawwāl fasting rather than following their eponymous imāms. We can find the origins of the notion of void in the Kalām tradition’s recognition of atomism. However, the main debates on the subject appeared after the Greek philosophical heritage transitioned to the Islamic world in the 3 rd century of Hijra. The literature of Kalām, just as in the metaphysical tradition, has two main types for this void being discussed. The first one is the external void (extracosmic) in which the cosmos floats. In the sources of Kalām, the question (...) of whether such a type of void exists is debated around the questions of whether anyone who might look beyond the cosmos can see anything or whether someone who stretches their hand outside the cosmos can move it. The second type of void, which occupies more of the mutakallimūn (Muslim theologians) agenda, is the internal void (intercosmic), assumed to be within the cosmos and between the body-forming atoms. This kind of void is discussed around the question of “Whether separating the two atoms is possible so that a third one can be inserted between them?” An ongoing discussion on the intercosmic void is found between the Baṣran and Baghdād Schools of Mu’tazila. Ibn Mattawayh and al-Nīsābūrī narrated the evidence presented in these discussions in their original form. The current essay discusses the debates between the two Schools and assesses the theoretical and experimental arguments both Schools present to justify their viewpoints, considering their philosophical origins.
