Two decades of research on euthanasia in the Netherlands have resulted into clear insights in the frequency and characteristics of euthanasia and other medical end-of-life decisions in the Netherlands. These empirical studies have contributed to the quality of the public debate, and to the regulating and public control of euthanasia and physician-assisted suicide. No slippery slope seems to have occurred. Physicians seem to adhere to the criteria for due care in the large majority of cases. Although euthanasia and assisted suicide in people with psychiatric disorders is relatively rare, the increasing incidence of EAS requests has given rise to public and political debate. This study aimed to explore support of the public and physicians for euthanasia and assisted suicide in people with psychiatric disorders and examine factors associated with acceptance and conceivability of performing EAS in these patients. A survey was distributed amongst a random sample of Dutch 2641 citizens and 3000 physicians. Acceptance and conceivability of (...) performing EAS, demographics, health status and professional characteristics were measured. Multivariable logistic regression analyses were performed. Of the general public 53% were of the opinion that people with psychiatric disorders should be eligible for EAS, 15% was opposed to this, and 32% remained neutral. Higher educational level, Dutch ethnicity, and higher urbanization level were associated with higher acceptability of EAS whilst a religious life stance and good health were associated with lower acceptability. The percentage of physicians who considered performing EAS in people with psychiatric disorders conceivable ranged between 20% amongst medical specialists and 47% amongst general practitioners. Having received EAS requests from psychiatric patients before was associated with considering performing EAS conceivable. Being female, religious, medical specialist, or psychiatrist were associated with lower conceivability. The majority of the psychiatrists were of the opinion that it is possible to establish whether a psychiatric patient’s suffering is unbearable and without prospect and whether the request is well-considered. The general public shows more support than opposition as to whether patients suffering from a psychiatric disorder should be eligible for EAS, even though one third of the respondents remained neutral. Physicians’ support depends on their specialization; 39% of psychiatrists considered performing EAS in psychiatric patients conceivable. The relatively low conceivability is possibly explained by psychiatric patients often not meeting the eligibility criteria. (shrink)

Modern medicine provides unprecedented opportunities in diagnostics and treatment. However, in some situations at the end of a patient’s life, many physicians refrain from using all possible measures to prolong life. We studied the incidence of different types of treatment withheld or withdrawn in 6 European countries and analyzed the main background characteristics.

The Netherlands is one of the few countries where euthanasia is legal under strict conditions. This study investigates whether Dutch newspaper articles use the term ‘euthanasia’ according to the legal definition and determines what arguments for and against euthanasia they contain. We did an electronic search of seven Dutch national newspapers between January 2009 and May 2010 and conducted a content analysis. Of the 284 articles containing the term ‘euthanasia’, 24% referred to practices outside the scope of the law, mostly (...) relating to the forgoing of life-prolonging treatments and assistance in suicide by others than physicians. Of the articles with euthanasia as the main topic, 36% described euthanasia in the context of a terminally ill patient, 24% for older persons, 16% for persons with dementia, and 9% for persons with a psychiatric disorder. The most frequent arguments for euthanasia included the importance of self-determination and the fact that euthanasia contributes to a good death. The most frequent arguments opposing euthanasia were that suffering should instead be alleviated by better care, that providing euthanasia can be disturbing, and that society should protect the vulnerable. Of the newspaper articles, 24% uses the term ‘euthanasia’ for practices that are outside the scope of the euthanasia law. Typically, the more unusual cases are discussed. This might lead to misunderstandings between citizens and physicians. Despite the Dutch legalisation of euthanasia, the debate about its acceptability and boundaries is ongoing and both sides of the debate are clearly represented. (shrink)

Background Studies describing physicians’ experiences with sedation at the end of life are indispensible for informed palliative care practice, but they are scarce. We describe the accounts of physicians from the USA and the Netherlands, two countries with different regulations on end-of-life decisions regarding their use of sedation.Methods Qualitative face-to-face interviews were held in 2007–2008 with 36 physicians , including primary care physicians and specialists. We applied purposive sampling and conducted constant comparative analyses.Results In both countries, the use of sedation (...) was described in diverse terms, especially in the USA, and was often experienced as emotionally challenging. Respondents stated different and sometimes multiple intentions for their use of sedation. Besides alleviating severe suffering, most Dutch respondents justified its use by stating that it does not hasten death, while most American respondents indicated that it might hasten death but that this was justifiable as long as that was not their primary intention. While many Dutch respondents indicated that they initiated open discussions about sedation proactively to inform patients about their options and to allow planning, the accounts of American respondents showed fewer and less-open discussions, mostly late in the dying process and with the patient's relatives.Conclusions The justification for sedation and the openness with which it is discussed were found to differ in the accounts of respondents from the USA and the Netherlands. Further clarification of practices and research into the effect and effectiveness of the use of sedation is recommended to enhance informed reflection and policy making. (shrink)

Objective To assess whether the frequency of end-of-life decisions for children under 1 year of age in the Netherlands has changed since ultrasound examination around 20 weeks of gestation became routine in 2007 and after a legal provision for deliberately ending the life of a newborn was set up that same year. Methodology This was a recurrent nationwide cross-sectional study in the Netherlands. In 2010, a sample of death certificates from children under 1 year of age was derived from the (...) central death registry. All 223 deaths that occurred in a 4-month study period were included. Physicians who had reported a non-sudden death (n=206) were sent a questionnaire on the end-of-life decisions made. 160 questionnaires were returned (response 78%). Findings In 2010, 63% of all deaths of children under 1 year of age were preceded by an end-of-life decision—a percentage comparable to other times when this study was conducted (1995, 2001, 2005). These end-of-life decisions were mainly decisions to withdraw or withhold potentially life-sustaining treatment. In 2010, the percentage of cases in which drugs were administered with the explicit intention to hasten death was 1%, while in 1995 and 2001, this was 9% and in 2005, this was 8%. Discussion and conclusion There has been a reduction of infant deaths that followed administration of drugs with the explicit intention to hasten death. One explanation for this reduction relates to the introduction of routine ultrasound examination around 20 weeks of gestation. In addition, the introduction of legal criteria and a review process for deliberately ending the life of a newborn may have left Dutch physicians with less room to hasten death. (shrink)

BackgroundAn important principle underlying the Dutch Euthanasia Act is physicians' responsibility to alleviate patients' suffering. The Dutch Act states that euthanasia and physician-assisted suicide are not punishable if the attending physician acts in accordance with criteria of due care. These criteria concern the patient's request, the patient's suffering (unbearable and hopeless), the information provided to the patient, the presence of reasonable alternatives, consultation of another physician and the applied method of ending life. To demonstrate their compliance, the Act requires physicians (...) to report euthanasia to a review committee. We studied which arguments Dutch physicians use to substantiate their adherence to the criteria and which aspects attract review committees' attention.MethodsWe examined 158 files of reported euthanasia and physician-assisted suicide cases that were approved by the review committees. We studied the physicians' reports and the verdicts of the review committees by using a checklist.ResultsPhysicians reported that the patient's request had been well-considered because the patient was clear-headed (65%) and/or had repeated the request several times (23%). Unbearable suffering was often substantiated with physical symptoms (62%), function loss (33%), dependency (28%) or deterioration (15%). In 35%, physicians reported that there had been alternatives to relieve patients' suffering which were refused by the majority. The nature of the relationship with the consultant was sometimes unclear: the consultant was reported to have been an unknown colleague (39%), a known colleague (21%), otherwise (25%), or not clearly specified in the report (24%). Review committees relatively often scrutinized the consultation (41%) and the patient's (unbearable) suffering (32%); they had few questions about possible alternatives (1%).ConclusionDutch physicians substantiate their adherence to the criteria in a variable way with an emphasis on physical symptoms. The information they provide is in most cases sufficient to enable adequate review. Review committees' control seems to focus on (unbearable) suffering and on procedural issues. (shrink)

BackgroundRelatives have no formal position in the practice of euthanasia and physician-assisted suicide (EAS) according to Dutch legislation. However, research shows that physicians often involve relatives in EAS decision-making. It remains unclear why physicians do (not) want to involve relatives. Therefore, we examined how many physicians in the Netherlands involve relatives in EAS decision-making and explored reasons for (not) involving relatives and what involvement entails.MethodsIn a mixed-methods study, 746 physicians (33% response rate) completed a questionnaire, and 20 were interviewed. The (...) questionnaire included two statements on relatives’ involvement in EAS decision-making. Descriptive statistics were used, and multivariable logistic regression analyses to explore characteristics associated with involving relatives. In subsequent interviews, we explored physicians’ views on involving relatives in EAS decision-making. Interviews were thematically analysed.ResultsThe majority of physicians want to know relatives’ opinions about an EAS request (80%); a smaller group also takes these opinions into account in EAS decision-making (35%). Physicians who had ever received an explicit EAS request were more likely to want to know opinions and clinical specialists and elderly care physicians were more likely to take these opinions into account. In interviews, physicians mentioned several reasons for involving relatives: e.g. to give relatives space and help them in their acceptance, to tailor support, to be able to perform EAS in harmony, and to mediate in case of conflicting views. Furthermore, physicians explained that relatives’ opinions can influence the decision-making process but cannot be a decisive factor. If relatives oppose the EAS request, physicians find the process more difficult and try to mediate between patients and relatives by investigating relatives’ objections and providing appropriate information. Reasons for not taking relatives’ opinions into account include not wanting to undermine patient autonomy and protecting relatives from a potential burdensome decision.ConclusionsAlthough physicians know that relatives have no formal role, involving relatives in EAS decision-making is common practice in the Netherlands. Physicians consider this important as relatives need to continue with their lives and may need bereavement support. Additionally, physicians want to perform EAS in harmony with everyone involved. However, relatives’ opinions are not decisive. (shrink)

The Dutch law states that a physician may perform euthanasia according to a written advance euthanasia directive when a patient is incompetent as long as all legal criteria of due care are met. This may also hold for patients with advanced dementia. We investigated the differing opinions of physicians and members of the general public on the acceptability of euthanasia in patients with advanced dementia.

Kant’s published arguments for the non-spatiotemporality of things in themselves have not been well received. I argue that Kant has available to himself an argument for the non-spatiotemporality of things in themselves that is premised upon a disparity between the compositional structure of the intelligible world and the structure of space and time. I argue that Kant was unwaveringly committed to the premises of this argument throughout his career and that he was aware of their idealistic implications. I also argue (...) that this argument is consistent with Kant’s restrictive mature epistemology. If my argument is successful, then even if Kant’s published arguments for transcendental idealism fail, we need not regard his ambitious metaphysical project as a failure. (shrink)

Agnes Arber's international reputation is due in part to her exceptional ability to interpret the German tradition of scholarship for the English-speaking world. The Mind and the Eye is an erudite book, revealing its author's familiarity with philosophy from Plato and Aristotle through Aquinas to Kant and Hegel; but it is not dull, because the quiet enthusiasm of the author shines through. In this book she turns from the work of a specialist in one science to those wider questions (...) which any scientist must ask at intervals. What, in short, is the relationship between the eye that sees and the mind that weighs and pronounces? An important feature of this Cambridge Science Classics reissue is the introduction provided by Professor P. R. Bell, who as a Cambridge botany student at the time that Agnes Arber was writing The Natural Philosopby of Plant Form, is uniquely able to set The Mind and the Eye in the context of contemporary biological research. Helmets from Delphi Among the votive offerings which were found in Delphi, helmets play an essential part : There are about 90 specimen kept in the museum, approximately half of which are from one of the two sanctuaries for certain, it is likely that the other helmets are from there, as well. They were made between the 8th and the second half of the 5th century. The number of helmet-consecrations, however, already decreased in the middle of the 6th century. Only (...) few helmets give us a clue on the exhibition practices: By means of the fixing holes it is to be recognized that they were once exhibited in form of a "tropaeum". Some repaired examples clearly show that used helmets were consecrated. As it also happened in other sanctuaries, a lot of examples were damaged on purpose, others were cannibalized for their material. (shrink)

BackgroundInformed consent as stipulated in regulatory human research guidelines requires that a volunteer is well-informed about what will happen to them in a trial. However researchers are faced with a challenge of how to ensure that a volunteer agreeing to take part in a clinical trial is truly informed. We conducted a qualitative study among volunteers taking part in two HIV clinical trials in Uganda to find out how they defined informed consent and their perceptions of the trial procedures, study (...) information and interactions with the research team.MethodsBetween January and December 2012, 23 volunteers who had been in the two trials for over 6 months, consented to be interviewed about their experience in the trial three times over a period of nine months. They also took part in focus group discussions. Themes informed by study research questions and emerging findings were used for content analysis.ResultsVolunteers defined the informed consent process in terms of their individual welfare. Only two of the volunteers reported having referred during the trial to the participant information sheets given at the start of the trial. Volunteers remembered the information they had been given at the start of the trial on procedures that involved drawing blood and urine samples but not information about study design and randomisation. Volunteers said that they had understood the purpose of the trial. They said that signing a consent form showed that they had consented to take part in the trial but they also described it as being done to protect the researcher in case a volunteer later experienced side effects.ConclusionVolunteers pay more attention during the consent process to procedures requiring biological tests than to study design issues. Trust built between volunteers and the research team could enhance the successful conduct of clinical trials by allowing for informal discussions to identify and review volunteers’ perceptions. These results point to the need for researchers to view informed consent as a process rather than an event. (shrink)

The aim of this paper is to challenge the prevailing polemic between ‘necessary’ emanation and ‘free’ creation. I begin by arguing for the presence of freedom and volition in the emanationism of Plotinus. I then move on to explore the role of necessity in the creationism of Maximus. In both cases, I rely upon a twofold schematisation of freedom and necessity to dissolve the dichotomy between them effectively. Having levelled the playing field, so to speak, I conclude that, all things (...) being equal, one does find in Maximus (and Christian thinkers generally) a heightened sense of divine volition and relationality beyond that of the pagan Neoplatonists. This greater emphasis upon the freedom of the divine will, however, has little bearing on whether Maximus's doctrine of creation is ‘emanationist’ or ‘creationist’. Instead, it stems from a biblically inspired sense of the One God as intimately involved in His creation which, though derived from God, is crucially other than God. (shrink)

Abstract‘Critique’ means the questioning judgement of human actions, particularly with reference to a criterion of judgement that is inseparable from the judged state of affairs but is dependent on a decision of the person judging. Informative judgements of a state of affairs contain two relevant components, one concerned with recognition of the objects of judgment, the other concerned with their evaluation. This evaluation is not directly extractable from that state of affairs, but the quality of the evaluation does depend in (...) part upon the quality of its explanation. Thus, when the content-description is flawed, the evaluation is affected by the flawed description. The phrase ‘the domestication of critique’ refers to the successful attempts that have been made to cause critics to neglect the truth claims of the judgement in favour of normative dominant interests. Domesticated critique is not concerned with the testing but rather with the justification or interpretation of a state of affairs. Domesticated critique does not depend on the quality of the argument but rather on whether the critique succeeds in legitimating dominant interests and immunising them against undomesticated critique. The educational relevance of the domestication of critique lies in the fact that a critical education which is domesticated will alleviate the need for overt repression on the part of dominant interests in favour of a particular view of the world and replace it with the semblance of a critical attitude that in fact reinforces the existing order through apparently rational means. Education based on domesticated critique can have no radical implications. (shrink)

The paper sketches the historical development from emotion as a mysterious entity and the source of maladaptive behaviour, to emotion as a collection of ingredients and the source of also adaptive behaviour. We argue, however, that the underlying mechanism proposed to take care of this adaptive behaviour is not entirely up for its task. We outline an alternative view that explains so-called emotional behaviour with the same mechanism as non-emotional behaviour, but that is at the same time more likely to (...) produce adaptive behaviour. The phenomena that were initially seen as requiring a separate emotional mechanism to influence and cause behaviour can also be explained by a goal-directed mechanism provided that more goals and other complexities inherent in the goal-directed process are taken into account. Historical research is always in danger of being made use of for explaining and illustrating instead of testing one’s theoretical conceptions. Since Marxist historical research has certainly not been exempt from this temptation, one has to start any debate about Marxist historiography with the demand to accord empirical research the chance to shake even the cornerstones of one’s own theoretical conceptions. In a paper that has triggered off a new discussion on ‘Political Marxism’, Samuel Knafo and Benno Teschke insist on (...) such a practice. In what follows I try to position the ongoing discussion in the wider context of theoretical concepts of Marxist historiography. (shrink)

Aspiration by Agnes Callard locates standing assumptions in the theory of rationality, moral psychology and autonomy that preclude the possibility of working to acquire new values. The book also explains what changes need to be made if we are to make room for this form of agency, which I call aspiration.

This two-part paper is about the possibility of analyzing the content of chemistry from a gender perspective. The first part provides an example of what such an analysis would look like. The second part is an outline of the theoretical perspective that makes the analysis possible. The example is the model of the ideal gas, the cornerstone of the theory of matter in chemical thermodynamics. I argue that this model is built on fundamental philosophical assumptions (Platonic idealism, hierarchy among states (...) of matter, atomism/individualism, and the negligence of interrelationships among parts and of their embodiment) that have been problematized by feminist scholarship. The same patterns are evident in the treatment of ideal and real solutions in chemical thermodynamics. I argue that it is possible to imagine a theory that utilizes different philosophical ideas and which therefore would be more compatible with feminist values. (shrink)

This chapter evaluates the defective verbal paradigms in the Hungarian language. The first section of the chapter provides an overview of the defectiveness in Hungarian, with emphasis on the systematic, phonotactically motivated defectiveness of the paradigms of some verbal stems. The aim of this section is to be as theoretically neutral and descriptive as possible to facilitate a good comparison with other types of defectiveness in other languages. The second section of the chapter discusses the results of the experiments which (...) are conducted in order to determine the various aspects of the defectiveness in the verbal paradigm. Some of the aspects tested include: the gap locations such as the occurrence and variation of forms in other designated cells of the verbal paradigm, and the correlations between the occurrence of forms in some designated cells; and the gap properties such as the differences in the classification of some verb stems into various stem-classes, and the range of variation exhibited by the forms that native Hungarian speakers accept as fill-ins for the gaps that are present in the paradigms of the defective verbs. Kant rejects the ontological argument on the grounds that the ontological argument inescapably must assume that existence is a “determination” or “real predicate,” which it is not. Most understand Kant’s argument for this claim to be premised upon his distinctive proto-Fregean theory of existence. But this leaves Kant dialectically vulnerable: the defender of the ontological argument can easily reject this as question-begging. I show that Kant relies upon two distinct arguments, both of which contend that the claim that existence is (...) a determination is inconsistent with bedrock ontological set pieces assumed by rationalist defenders of the ontological argument. This radical analysis of the role and importance of historiography interprets the philosophy and theory of history on the basis of historicity as a human condition. The book examins the norms and methods of historiography from a philosophical point of view, but rejects generalisations tht the philosophy of history can provide all the answers to contemporary problems. Instead it outlines a feasible theory of history which is still radical enough to apply to all social structures.

An incidental extension of the central domain of argumentation theory with non-classical ways of constructing arguments seems to automatically raise a question that is otherwise rarely posed, namely whether or not it is useful to consider the sex of the arguer. This question is usually posed with regard to argumentation by women in particular. Do women rely more, or differently than men do on non-canonical modes of reasoning stemming from the realm of the emotional, physical and intuitive, instead of the (...) logical? One may simply refer this question to folk-linguistics. One may also take the question seriously, given the findings on women's linguistic behaviour, and for various other reasons that will be explained below.Section 1 sums up the most frequently quoted differences in language use between women and men. This is followed by a non-exhaustive, interdisciplinary review of studies on male/female differences in verbal and written argumentation.Section 2 discusses the role of language and texts in generating and maintaining ideas on gender. These gender messages not only influence the actual argumentation behaviour of women and men, but also the way such behaviour is valued.Section 3 subsequently shows that our ideas on rationality are gendered, and therefore also our ideas on the proper central domain of argumentation theory.Section 4 briefly reflects on why this kind of wrong question about the reasoning of women should sometimes be addressed seriously anyway. Freud, Psychoanalysis and Symbolism offers an innovative general theory of symbolism, derived from Freud's psychoanalytic theory and relocated within mainstream scientific psychology. It is the first systematic investigation of the development of Freud's treatment of symbolism throughout his published works, and discovers in those writings a broad theory which is far superior to the widely accepted, narrow, 'official' view. Agnes Petocz argues that the treatment of symbolism must begin with the identification and clarification of a set of logical constraints (...) and psychological requirements which any general theory of symbolism must respect, and that these requirements have been neglected by existing accounts across a number of disciplines. Her newly proposed 'Freudian broad' theory of symbolism, by contrast, does meet these requirements, but only after it has been rehabilitated within a revised psychoanalytic context, encompassing major changes to our understanding of the concepts of unconscious and repression and the role of language. In diesem Artikel wird skizziert, wie sich mithilfe der Kuhn-Sneedschen Wissenschaftstheorie literaturwissenschaftliche Theorien ihrer logischen Struktur nach analysieren und systematisch darstellen lassen. Die systematische Darstellung läßt sich von den zentralen theoretischen Prämissen bis zu den einzelnen Verwendungen einer Literaturtheorie durchführen, wobei an das mengentheoretische Verfahren Sneeds das satzanalytische Poppers angeschlossen wird. Dabei werden zwei Fragen andeutungsweise geklärt: Erstens wird das Verhältnis von Literaturtheorie und Hypothesenbildung der literaturwissenschaftlichen Einzeluntersuchungen näher bestimmt, zweitens das Abhängigkeitsverhältnis der Hypothesen, des Gegenstandsbereichs und der Methodiken von (...) der Literaturtheorie genauer untersucht.
