From 1989 through September 2017, Chile’s highly restrictive abortion laws exposed women to victimisation and needlessly threatened their health, freedom and even lives. However, after decades of unsuccessful attempts to decriminalise abortion, legislation regulating pregnancy termination on three grounds was recently enacted. In the aftermath, an aggressive conservative drive designed to turn conscientious objection into a pivotal new obstacle, mounted during the congressional debate, has led to extensive, complex arguments about the validity and legitimacy of conscientious objection. This article offers (...) a critical review of the emergence of conscientious objection and its likely policy and ethical implications. It posits the need to regulate conscientious objection through checks and balances designed to keep it from being turned into an ideological barrier meant to hinder women’s access to critical healthcare. This article reconstructs Badiou’s oeuvre from the vantage point of the last volume of his Being and Event trilogy. It determines the perspective and task of The Immanence of Truths and demonstrates in what way an “absolute ontology” is the result of an act of forcing that serves as the measure for a truth’s truthness. This allows to argue that Badiou’s is and always was a philosophy of freedom.

While the question of whether selected-effects accounts of function or causal-role accounts of function provide the ‘true' functional analysis has given way to a general pluralistic consensus, Philip Kitcher has suggested that different functional accounts allow for unification. I argue that Kitcher's attempt to unify the two functional analyses fails because he adopts the environment-centered perspective on selection as a premise. The premise is undermined by the role niche construction is likely to play in the context of evolution. In capitalism human beings act as if they are mere animals. So we hear repeatedly in the history of modern philosophy. Indifference and Repetition examines how modern philosophy, largely coextensive with a particular boost in capitalism’s development, registers the reductive and regressive tendencies produced by capitalism’s effect on individuals and society. Ruda examines a problem that has invisibly been shaping the history of modern, especially rationalist philosophical thought, a problem of misunderstanding freedom. Thinkers like Descartes, Kant, Hegel, and Marx claim (...) that there are conceptions and interpretations of freedom that lead the subjects of these interpretations to no longer act and think freely. They are often unwillingly led into unfreedom. It is thus possible that even “freedom” enslaves. Modern philosophical rationalism, whose conceptual genealogy the books traces and unfolds, assigns a name to this peculiar form of domination by means of freedom: indifference. Indifference is a name for the assumption that freedom is something that human beings have: a given, a natural possession. When we think freedom is natural or a possession we lose freedom. Modern philosophy, Ruda shows, takes its shape through repeated attacks on freedom as indifference; it is the owl that begins its flight, so that the days of unfreedom will turn to dusk. (shrink)

De acuerdo con la postura dominante sobre la laicidad, ésta debe ser concebida en relación con el reconocimiento del pluralismo y prestando atención a no reprodu- cir sesgos antirreligiosos. El artículo defiende una propuesta alternativa: la laicidad como anticlericalismo, cuyo elemento distintivo consiste en instaurar un arreglo institucional de separación estricta y de exclusión de los contenidos religiosos de las instituciones del Estado. Se argumenta que esta forma de concebir la laicidad responde adecuadamente a la pregunta por el lugar de (...) la religión en la esfera pública en el contexto de los Estados liberales y democráticos latinoamericanos. Depois da viragem do século, podemos dizer que a noção de responsabilidade social está muito em voga no mundo empresarial, muito embora, como é evidente, o conceito possui uma história muito mais ampla e profunda. Tendo isso em conta, o presente artigo procura, antes de mais, mostrar a evolução mais recente do conceito de responsabilidade social, ao mesmo tempo que demonstra como um tal conceito não seña mais do que um efeito de cosmética caso não estivesse fundado numa verdadeira ética (...) empresarial Nesse sentido, a autora oferece-nos alguns dos elementos filosóficos subjacentes a uma tal ética, elementos esses que se destinam a permitir uma avaliação de três dos principais modelos de empresa que identifica, a saber: o modelo economicista, o modelo institucional, e, finalmente, o modelo centrado na globalidade dos afectados pela actividade empresarial. O objectivo, naturalmente, é mostrar as razões pelas quais, numa perspectiva filosófica, a opção correcta é aquela que tem em vista o último dos três modelos mencionados. The concept of social responsibility has been much in vogue in the entrepreneurial world after the turn of the century, though the concept has a much larger and profound history. Taking this into account, the paper seeks to present, first of all, the most recent evolution of the concept of social responsibility and, simultaneously, demonstrates how such a concept would be nothing more than a cosmetic effect, if it were not based on a true entreprenewrial ethics. Thus, the author presents some of the philosophical elements underlying such an ethics; these elements intend to allow an evaluation of the three main enterprise models, which she identifies, namely the economicist model, the institutional model, and, finally, the model centred on all those affected by the entrepreneurial activity. Obviously, the aim of the paper is to present the reasons why, in a philosophical perspective, the right choice is the one which opts for the last of the tree mentioned models. (shrink)

This article brings together the history of the social sciences and the history of social thought in Socialist Romania. It is concerned with the development of ideas about the social beyond collectivism, especially about the relationship between individual and society under socialism, from the early 1960s to the end of the 1970s. The analysis speaks to three major themes in the current historiography of Cold War social science. First, the article investigates the role of disciplinary specialization in the advancement of (...) new ideas about the social in the postwar period. Specifically, it asks how the debate over the relationship between sociology and Marxism-Leninism has challenged ideas about collectivism from Stalinist social science. Second, the article shows how social practice, individual and collective agency, and people's subjectivities became theoretically relevant in the 1960s, and how they were integrated, via empirical sociological research, into the reworked conceptual apparatus of post-Stalinist Marxism-Leninism. This complicates accounts about the role of quantification and theorization in postwar social science by foregrounding the intense reflection on the role of empirical research in sociology under state socialism. Third, the article shows how the relationship between individual and society became a topic of interest across social sciences in the 1960s and 1970s. The Marxist humanist approach to the social, although it never achieved the institutional status of a distinct discipline, adds an important perspective from East Central Europe to the existing historiography of the ‘thinning’ of the social in social sciences and social thought beginning in the 1950s. The nineteen-nineties saw the so-called “deliberative turn in democracy”, which was taken up by a large number of democracy theorists. This paper sets out: 1) to analyse why this turn took place; 2) to classify the different proposals of deliberative democracy into two models (D1 and D2), in view of their epistemological effectiveness (model D1 assumes the pattern of Rawls’ political liberalism, and model D2, Habermas’ Theory of Discourse); 3) to display the superiority of D2 over D1; 4) to point (...) out certain shortcomings in Habermas’ deliberative-discursive politics and to propose a model of democracy which will enable these to be improved on, to be known as “communicative democracy”. The present issue of Filozofski Vestnik starts from a concatenation – science and thought – that at first sight is the radical opposite to Heidegger’s diagnosis. The title of this issue, “Science and Thought”, already suggests that there is or at least there can be such a relation. With regard to Heidegger, this implies two options here: either Heidegger was wrong in his criticism of metaphysics or he was wrong with his equation of Ge-Stell (as the essence of technology) and (...) science. Simply put: either metaphysics still contains some sort of valuable thought (and hence there could be some sort of metaphysical science that thinks) or science is simply not reducible to the metaphysics or to the being of a mere technology in the sense that Heidegger criticized. Then the (metaphysical) question of being could be separated from technology and metaphysics, but perhaps it still finds its locus rather within science. Heidegger’s claim about metaphysics and technology then would find itself inverted through the suggested relation of science and thought. Such an inversion of Heidegger’s critique of the very status of science is itself conditioned by the recent developments in philosophy that we take as the starting point for the present issue of Filozosfki Vestnik. The Times Literary Supplement of November 8, 1917, contained, under the title of Socrates recognitns, a review of Plato's Biography of Socrates, a lecture delivered by Professor A. E. Taylor to the British Academy in the early part of last year. The opening sentence of the review is as follows: ‘Next to the problem of the Gospels ranks that of the Platonic dialogues amongst those most vital to the history of the human spirit.’ A little further down the reviewer says: (...) ‘It is much to the credit of British scholarship—and especially to that of the University of St. Andrews—that it should have attacked these problems with untiring energy, and propounded solutions which, although they run counter to most of the traditional tendencies of historical and philosophical criticism, have not only challenged attention, but are carrying conviction even to unlikely quarters.’ And again, at the end of the article, we read this passage: ‘It is scarcely to be thought that the ground won by the scholars of St. Andrews will be held without counter-attack; but this is slow to mature, and in the meanwhile such essays as the subject of this notice, with which we may couple the paper recently read to the British Academy by Professor Burnet on the Socratic doctrine of the soul, serve to buttress and consolidate the position.’. Bioethics faces the challenge of collaborating in building a just and sustainable world. This article analyzes the birth of bioethics as a civic bioethics of pluralistic societies in the context of applied ethics, its evolution to become a global bioethics, its current structure, the challenges it faces, and finally the kind of practical reasoning that should guide its task if bioethics is to achieve its goals.

Článek má za cíl ukázat podobnosti mezi Humovou a Madisonovou politickou filozofií v oblasti politiky náboženské tolerance. Humův kritický postoj k církvím a k náboženství je dnes v interpretační literatuře velmi známý. Často se však zapomíná na důsledky, které z tohoto postoje plynou pro jeho politickou filozofii. Hume se totiž na mnoha místech svého rozsáhlého filozofického díla (kam je třeba řadit i jeho Dějiny Anglie a mnohé eseje) zamýšlel nad otázkou, jak řídit stát nábožensky roztříštěný do církví a sekt. Podobně (...) se i jeden z nejvýznamnějších otců zakladatelů, James Madison, obával názorově roztříštěné společnosti; přičemž co do důvodů i řešení tohoto problému je patrná podobnost mezi jeho a Humovými myšlenkami. Hume i Madison shodně považovali za zdroj lidské tendence ke stranictví lidskou přirozenost a řešení této stranickosti spatřovali jednak v ustavení státu na co nejširším území, a jednak v co největší míře tolerance rozličných názorů i v náboženských otázkách. Oba argumentovali tím, že se v dějinách prakticky ukázalo jako nejúčinnější právě zavedení co nejširší náboženské tolerance. Kromě toho Madison používá stejné metafory a výrazy ve stejném kontextu jako Hume. Humův vliv na Madisona v otázce náboženské tolerance tak nelze při interpretaci intelektuálních zdrojů Jamese Madisona dále přehlížet. (shrink)

Workplaces around the world have experienced extraordinary changes to the composition of their workforces and the nature of work. Few studies have explored workers from multiple countries of birth, with multiple religious orientations, working together within a single country of residence. Building on and extending the Work Values Ethic (WVE) literature, we examine 1,382 responses from employees working in three manufacturing companies. Differences were found in the mean WVE scores of groups of respondents from 42 countries of birth. Their WVE (...) scores were strongly associated with their birth countries’ per capita Gross National Product (GNP), and the means of these scores did not change with variations in the respondents’ length of residence in a different country. These results have implications for developing cross-cultural management practices and for improving relationships with employees, with opportunities for increased commitment and, potentially, productivity. Hoy en día, el «giro aplicado » sufrido por la filosofía afecta en primer término a la ética y le pide orientaciones, aunque mediatas como es propio de la filosofía, para organizar la vida en las distintas esferas de la vida social. Este cambio exige ante todo aclarar cuál debe ser el proceder de la ética aplicada , si existen principios comunes a sus (...) distintos ámbitos o constituyen reinos de taifas, cuáles son los principios, hábitos y valores que cada esfera exige para moralizarse, en el sentido de Ortega, qué métodos son adecuados para la toma de decisiones.Estas exigencias están ya en la calle y piden interdisciplinariedad. No intentar responder a ellas es reconocer, frente a la pretensión originaria, que a la filosofía no le importa la vida, no le importa sí los seres humanos viven bien. (shrink)

In this paper, we discuss how existentialism was criticized, disseminated, and gradually autochthonized in the main philosophical journals of Socialist Romania. We show that the early critique of existentialism was both a statement against contemporary bourgeois philosophy in general and a condemnation of the local philosophical production of the interwar period. In the 1950s, this kind of critique was attuned to the growing fame of several Romanian authors who had emigrated to the West (e.g., Emil Cioran, Mircea Eliade) and targeted (...) both past and contemporary irrationalism. Following a period of critique of existentialism without existentialists (i.e., without reference to individual authors), the 1960s discussions of existentialism were mainly driven by interest in a small number of existentialist authors. In particular, the evolution of Jean-Paul Sartre’s work and politics was analyzed as it straddled existentialism and Marxism. The 1970s saw the integration of selected existentialist concepts and themes, in an attempt to offer a Marxist alternative to existentialism in the form of philosophical anthropology. This led to a period of engagement with existentialists without existentialism across an increasing number of separate disciplines within the humanities and social sciences. In the 1980s, following the failure of Marxist philosophical anthropology and at the height of national communism, existentialism could also be autochthonized through the recovery of selected philosophers from the interwar period whose work had been previously criticized as irrationalist. La Neuroética necesita un marco de ética filosófica desde el que interpretar, integrar y criticar el progreso neurocientífico en el ámbito moral. Este artículo intenta: 1) Mostrar en qué medida este marco es necesario. 2) Abordar la cuestión del método adecuado para construirlo. 3) Compilar los principales tópoi de las neurociencias que el marco debería interpretar e integrar. 4) Mostrar cómo la ética del discurso puede ser un marco adecuado para la neuroética. 5) Señalar algunas insuficiencias de ese marco y (...) sugerir para superarlas una ética de la razón cordial. Sin duda la revolución 4.0 es ya el mundo en el que vivimos y proporciona instrumentos muy valiosos para construir una sociedad que pueda servir mejor a los seres humanos y al cuidado de la naturaleza desde las nuevas posibilidades. Pero para emprender ese camino es preciso optar por una ética que reconozca que lleva la intersubjetividad entrañada en su seno, porque es consciente de que no somos individuos aislados, sino que devenimos personas desde el reconocimiento recíproco como interlocutores válidos, (...) como seres dotados de dignidad y no un simple precio, como quienes son carne de la misma carne y hueso del mismo hueso. The article attempts to develop a diagonal towards classical readings of the humanism of early Marx. Traditionally, referring to early Marx meant to either affirm a substantialist conception of human beings or to criticize the same conception by insisting on a break between early and late Marx. By presenting a lecture badiousienne of early Marxian texts, the article shows how an affirmative reference to man as species-being and as part of a ‘generic humanity’ can be thought without falling back into (...) the substantialist traps of classical humanism. In a systematic and forced construction of the Marxian idea of the evental character of actual communist action and of universal production, the article shows how Marx’s concept of human species life can be understood as the central source of a transformed thinking of humanism. Consequently, neither Badiou nor Marx will be rendered as classical humanists or pure anti-humanists, rather the early Marxian thought will be presented as a philosophical armoury of in-humanism that is still of great use for sharpening one’s conceptual tools. SEBASTIÁN RUDAS | : Moralized secularism is the view that “secularism” is defined in relation to certain moral values. Jocelyn Maclure and Charles Taylor’s “liberal pluralism” is an influential version of moralized secularism, for it states that freedom of conscience and equal respect are the fundamental moral values of secularism. I present the objection that secularism is a redundant category because it carries no distinctive normative content that cannot be found in the more general, and less divisive, terminology of liberalism (...) and democracy. In order to avoid this objection, I argue for conceiving secularism in a nonmoralized way. According to my view, secularism refers solely to the institutional arrangements that a state can put in place in order to address conflicts with organized religion that might emerge at the moment of advancing its ideological political project. Through this interpretation, it is possible to conceptualize expressions of secularism that are either not liberal or not motivated by the acknowledgment of new forms of pluralism as being the prime challenge a state faces for advancing its political project. As the redundancy objection shows, this is a possibility that moralized accounts of secularism preclude. | : Les versions moralisées de la laïcité définissent la « laïcité » par rapport à des valeurs morales. Le « pluralisme libéral » de Jocelyn Maclure et Charles Taylor est un exemple influent de la laïcité moralisée, car il affirme que la liberté de conscience et l’égal respect sont les valeurs morales fondamentales de la laïcité. Je propose l’objection selon laquelle la laïcité est une catégorie redondante, car elle ne comporte aucun contenu normatif distinctif qui ne peut être trouvé dans la terminologie plus générale et moins controversée du libéralisme et de la démocratie. Pour répondre à cette objection, je soutiens qu’il faut concevoir la laïcité de manière non moralisée. Selon moi, la laïcité se réfère seulement aux arrangements institutionnels qu’un État peut mettre en place pour répondre aux conflits avec les religions organisées qui pourraient surgir au moment de faire avancer son projet politique idéologique. Dans cette interprétation, il est possible de conceptualiser des expressions de laïcité qui sont non libérales, ou qui ne sont pas motivées par la reconnaissance de nouvelles formes de pluralisme à titre de principal défi auquel un État est confronté pour faire avancer son projet politique. Comme le montre l’objection de redondance, c’est une possibilité que la laïcité moralisée exclut. (shrink)

The paper discusses Merleau-Ponty’s Phenomenology of Perception as a phenomenology of art. The prevalence of examples from the arts in his text indicates that works of art possess the very same dynamic of reflexivity that the phenomenological project as a whole seeks to develop. Furthermore, by way of confrontation with works of art, the project is driven to transcend itself – or more precisely: to reflect itself. This »new style« of reflexivity may be discussed as »aesthetic incorporation.«.

En s’appuyant sur les autobiographies de douze élèves « à problèmes », l’auteure interroge deux paradigmes de la psychanalyse contemporaine. Le paradigme archéologique, cherchant à découvrir le latent derrière le manifeste, se situe du côté d’une logique orientée vers le passé. A l’opposé, le paradigme transformatif, dont le but est de développer la « musculature psychique », vise l’ouverture à une pluralité de possibles résidant dans l’avenir. L’auteure montre l’intérêt de dialectiser ces deux approches, tant dans la clinique que dans (...) l’approche des productions culturelles, autobiographie comprise. Les enjeux éthiques découlant de l’intervention de l’analyste/interprète prennent une importante centrale. (shrink)

Ce texte expose le concept de citoyenneté dans son double aspect - descriptif et prescriptif. Aux dimensions civiles, politiques et sociales de la citoyenneté il faut ajouter deux autres: l'économique et la culturelle. Ce qui fait tenir en compte le Problème du multiculturalisme et de la citoyenneté multiculturelle. II faut trouver des réponses qui permettent aux différentes éthnies une façon de vivre ensemble. Dans ce but, l'article analyse critiquement trois possibilités: le libéralisme multiculturel de Klymcka; le libéralisme intolérant de Sartori (...) et le libéralisme radical interculturel. Ce dernier est la position choisie et soutenue dans le texte qui vise souligner le caractère dynamique des différentes cultures, bien que l'influence bénéfique qu'elles provoquent les unes sur les autres. In this work, I investigate some questions pertaining to intentional actions and consciously morally reckless actions, seeking to answer the question whether it is possible to morally hold the agent responsible morally for the unwanted results arising from his intentional actions. The first conclusion reached was that the result of an action that was not the object of the agent's intention is a mere consequence of the main action, however, the action that provoked it can be characterized as a consciously (...) morally reckless action. The second conclusion is that, yes, the unwanted results arising from an intentional action are also the moral responsibility of the causative agent, therefore, it is reasonable to hold him responsible for this. The paper discusses the concept of courage, starting from the question of how it is (...) possible that a category, which seems to permeate the history of philosophy, currently loses its relevance and influence. It identifies the rea- son for this in the Aristotelian definition of courage as a male and military virtue, and subsequently confronts it with a new definition, trying to imagine what female courage could be like.
