Objectives—While clinical practice is complicated by many ethical dilemmas, clinicians do not often request ethics consultations. We therefore investigated what triggers clinicians' requests for ethics consultation. Design—Cross-sectional telephone survey.Setting—Internal medicine practices throughout the United States.Participants—Randomly selected physicians practising in internal medicine, oncology and critical care.Main measurements—Socio-demographic characteristics, training in medicine and ethics, and practice characteristics; types of ethical problems that prompt requests for consultation, and factors triggering consultation requests. Results—One hundred and ninety of 344 responding physicians (55%) reported requesting ethics (...) consultations. Physicians most commonly reported requesting ethics consultations for ethical dilemmas related to end-of-life decision making, patient autonomy issues, and conflict. The most common triggers that led to consultation requests were: 1) wanting help resolving a conflict; 2) wanting assistance interacting with a difficult family, patient, or surrogate; 3) wanting help making a decision or planning care, and 4) emotional triggers. Physicians who were ethnically in the minority, practised in communities under 500,000 population, or who were trained in the US were more likely to request consultations prompted by conflict. Conclusions—Conflicts and other emotionally charged concerns trigger consultation requests more commonly than other cognitively based concerns. Ethicists need to be prepared to mediate conflicts and handle sometimes difficult emotional situations when consulting. The data suggest that ethics consultants might serve clinicians well by consulting on a more proactive basis to avoid conflicts and by educating clinicians to develop mediation skills. (shrink)

The effects of aging on the cognitive and affective dimensions of theory of mind , and on the latter’s links with other cognitive processes, such as information processing speed, executive functions and episodic memory, are still unclear. We therefore investigated these effects in young , middle-aged and older adults , using separate subjective and objective assessment tasks. Furthermore, a novel composite task probed participants’ abilities to infer both cognitive and affective mental states in an interpersonal context. Although age affected the (...) objective ToM tests, results revealed a direct aging effect on the second-order ToM, but an indirect one on the first-order cognitive ToM, mediated mainly by age-related declines in executive functions. This study supports the notion of an age-related distinction between subjective and objective assessments of ToM, and confirms that ToM is a complex mental ability with several characteristics reliant to some extent on executive processes. Current debates surrounding Aristotle's Politics involve attempts to explain the role of political participation in the pursuit of Aristotle's human telos, eudaimonia. Many argue that political participation is crucial to eudaimonia, equating the good man with the good citizen. Often this argument is based on Aristotle's labelling of humans as zoon politikon, or ‘political animal’, and the misleading translation of eudaimonia as ‘happiness’. We provide supported explanations of eudaimonia and zoon politikon which do not force us to equate the good (...) man and the good citizen. We illustrate Aristotle's analogy between the eudaimon man and the eudaimon polis and emphasize the role political participation sometimes plays in the pursuit of eudaimonia. On the basis of this evidence, we argue that Aristotle did not equate the good man with the good citizen necessarily, nor did he find political participation essential to eudaimonia. We then demonstrate that even without political participation, the polis plays a unique role in the pursuit of eudaimonia. (shrink)

The conclusions of Barbey & Sloman (B&S) crucially depend on evidence for different representations of statistical information. Unfortunately, a muddled distinction made among these representations calls into question the authors' conclusions. We clarify some notions of statistical representations which are often confused in the literature. These clarifications, combined with new empirical evidence, do not support a dual-process model of judgment.

Language is a complex intentional, syntactical and referential system involving a left-hemispheric specialization of the brain in which some cerebral regions such as Broca’s and Wernicke’s areas play a key-role. Because nonhuman primates are phylogenetically close to humans, research on our primate cousins might help providing clues for reconstructing the features of our ancestral communicative systems. In the present paper, after emphasising the tight relation between gestures and language in humans, we underlie the specific significance of communicative gestures and of (...) the progressive control of the oro-facial system and the vocal tract in the course of the language evolution. For this purpose, we will then review the findings related to the features, the lateralization and brain correlates of both vocal and gestural systems in nonhuman primates. (shrink)

The following text seeks to identify the origins of what has come to be called the Sokal hoax. It appears that these origins remain problematic insofar as they cannot be thought without engaging into intrinsically duplicitous thinking. Thus, « originally », the gesture of the hoax is indeed « productive and conflictive, and no self-identity, no unity, and no inherent simplicity can possibly precede it », as « he » said, but « he » was disseminating, as we say. But (...) that is precisely the « strength » of the « form » of the Sokal hoax. With the delicate question of origins as its stumbling block—a stumbling block which may also be the question of irony—, the present text takes its cue from an passage from La Barbarie à visage humain and proposes to reveal the constructive consequences of the affair triggered by the hoax, while constantly paying tribute to its performance. Whether my argument will make it possible to distinguish the consequences from the origins remains moot : post hoc ergo propter hoc. One must remember that this is a sophism. (shrink)

Leo Strauss (1899-1973) est certainement un penseur majeur du XXe siècle. Lui qui a rouvert des procès jugés depuis longtemps - la querelle des Anciens et des Modernes, ou encore l'opposition entre la raison et la révélation - fait l'objet de commentaires contradictoires, le présentant comme un penseur tantôt fondamentalement apolitique, uniquement soucieux de redonner sens à la vie philosophique, tantôt secrètement politique, servant les forces les plus conservatrices des Etats-Unis. Ce livre entreprend d'abord de retrouver en Strauss un des (...) philosophes politiques les plus stimulants de son siècle, c'est-à-dire un philosophe soucieux de comprendre et d'éclairer les phénomènes politiques. Il faut toutefois convenir qu'abordée sous cet angle, son oeuvre présente un singulier paradoxe. Car si Strauss plaide avec force pour un retour à la compréhension classique des régimes politiques, il se montre en même temps très réticent à analyser les différents régimes et clivages du monde moderne. Plus étonnant encore, alors qu'il en appelle à une science politique qui soit fidèle à l'appréhension citoyenne des phénomènes, il ne cesse de relativiser, à propos de son époque, les différences entre communistes, progressistes et conservateurs. En somme, entre sa conception de la bonne science politique, et sa manière presqu'apolitique de traiter de la modernité, il existe un déroutant hiatus. C'est ce problème plus spécifique que nous explorons ici. (shrink)

There are two main approaches within classical cognitive science to explaining how humans can entertain mental states that integrate contents across domains. The language-based framework states that this ability arises from higher cognitive domain-specific systems that combine their outputs through the language faculty, whereas the language-independent framework holds that it comes from non-language-involving connections between such systems. This article turns on its head the most influential empirical argument for the language-based framework, an argument that originates from research on spatial reorientation. (...) Clinical Study Agreements can have profound effects both on the protection of human subjects and on the independence of investigators to conduct research with scientific integrity. Sponsors, institutions, and even investigators may fail to give adequate attention to these issues in the negotiation of CSAs. Despite the key role of CSAs in structuring ethically important aspects of research, they remain largely unregulated and unreviewed for adherence to ethical norms. Academic institutions routinely enter into research contracts that fail to meet adequate (...) ethical standards. This is a failing that can have serious consequences.Accordingly, it is necessary that some independent body have the authority both to review research contracts for compliance with norms of subject protection and ethical integrity, and to reject studies that fail to meet ethical standards. Such review should take place prior to the start of research, not later. Because of its expertise and authority, the institutional ethics review board is the appropriate body to undertake such review. Much recent commentary has focused on contractual restrictions on the investigator’s freedom to publish research findings. The Olivieri experience, and that of other investigators, has brought freedom of publication issues into sharp focus. Clinical study agreements also raise a number of other ethical issues relating to human subjects and research integrity, however, including disclosures relating to patient safety, data analysis and reporting, budget, confidentiality, and premature termination of the study. This paper describes the ethical issues at stake in structuring such agreements and suggests ethical standards to guide institutional ethics review. (shrink)

Deep learning and other black-box models are becoming more and more popular today. Despite their high performance, they may not be accepted ethically or legally because of their lack of explainability. This paper presents the increasing number of legal requirements on machine learning model interpretability and explainability in the context of private and public decision making. It then explains how those legal requirements can be implemented into machine-learning models and concludes with a call for more inter-disciplinary research on explainability.

Many philosophers have adopted epistemic expressivism in recent years. The core commitment of epistemic expressivism is that epistemic claims express conative states. This paper assesses the plausibility of this commitment. First, we raise a new type of problem for epistemic expressivism, the epistemic motivation problem. The problem arises because epistemic expressivists must provide an account of the motivational force of epistemic judgment (the mental state expressed by an epistemic claim), yet various features of our mental economy seem to show that (...) they can’t do so. Second, we develop what we take to be the most promising response to that problem for expressivists. We end by noting that this response faces an important challenge pertaining to the psychology of epistemic criticism and praise. (shrink)

The practice of nonphysician ethicist-consultants giving ethics advice concerning the appropriate medical treatment of patients in hospitals is a relatively recent development. Although only a minority of hospitals make substantial use of any formal ethics consulting service, the number is growing and apparently will continue to do so. Indeed, at least among urban teaching hospitals, some sort of ethics consulting service is increasingly commonplace.

Spelke convincingly argues that we should posit six innate modular systems beyond the periphery (i.e., beyond low-level perception and motor control). I focus on the case of spatial navigation (Ch. 3) to claim that there remain powerful considerations in favor of positing additional innate, nonperipheral modules. This opens the door to stronger forms of nativism and nonperipheral modularism than Spelke's.

The massive increase of data generated by heterogeneous sources requires the development of computer tools enabling their semantic interoperability. Applied ontologies aim at fulfilling such needs. We will show in this article the central role that philosophical ontology can play for applied ontology, with a focus on biomedical ontologies; and reciprocally, how applied ontology can enlighten some classical issues in philosophical ontology, by considering the following question: Is disease a natural kind?

Este trabalho apresenta uma pesquisa sobre a religiosidade em Mazagão Velho, expressa por meio das festas devocionais que ali ocorrem, buscando compreendê-las como um elemento histórico de coesão social. Para tanto, parte-se do estudo da mentalidade formada no Brasil colônia com sua ideologia de expansão da fé cristã. É nesse contexto que toma forma o catolicismo popular. A localidade escolhida como base para este estudo apresenta especificidades que a tornam um caso único. Ela traz a memória das antigas lutas entre (...) cristãos e mouros ainda no Marrocos, onde foi primeiramente fundada, sendo posteriormente transferida para o Brasil no século XVIII. Além disso, apresenta um rico processo de interação com os indígenas e africanos, caracterizando-a como uma sociedade multicultural. Essa história ainda é marcada pela degradação social ocorrida no final do século XVIII. Contudo, mesmo passando por diversos reveses, a comunidade subsistiu e mantém-se viva até os dias atuais. Como principal prática social, destacam-se as festas devocionais, que são eventos coletivos que congregam elementos, como as crenças e os rituais que expressam a vida em sociedade. Também fazem parte dessas festas as manifestações culturais surgidas a partir do encontro das culturas ali presentes. Para entender essa longa história, a ideia de coesão social foi essencial. Neste sentido, a pesquisa buscou mostrar que essa comunidade manteve sua existência graças à coesão social ali formada e sustentada pela religiosidade que se manifesta, de maneira mais efetiva, por meio das festas em devoção aos santos católicos em um ciclo que se renova a cada ano. Para tanto, o trabalho foi realizado por meio de uma abordagem interdisciplinar, com uma análise que compreende tanto uma perspectiva histórica quanto uma abordagem sociológica. Para isso, houve a observação de algumas festas in loco, a pesquisa documental e a pesquisa bibliográfica. Conclui-se que as festas devocionais são eventos sociais fortemente marcados pela tradição histórica do local. Ademais, a continuidade histórica dos acontecimentos mostra que, diante dos problemas passados pela localidade, a sociedade encontrou forças na união de seus moradores, nas tradições e na memória de seus antepassados, fortalecendo-se por meio da realização das festas devocionais. Les individus, comme les constellations de jugement qu’ils forment, sont passés au crible d’une écriture digressive qui démonte les mécanismes idéologiques de l’agir. Les institutions écclésiales sont mises à mal, cela va de soi, en raison des atteintes qu’elles portent à la liberté individuelle. Pourtant, Diderot (...) dépasse une visée polémique, par trop démonstrative, pour faire de l’écriture dialogique, construite sur deux niveaux, le lieu d’une exploration des conditions d’application de la « loi naturelle » dans le champ de la morale et, partant, du politique.
