Neuroscientists keep telling us that the brain produces consciousness and consciousness does not survive brain death because it ceases when brain activity ceases. Research findings on near-death-experiences during cardiac arrest contradict this widely held conviction. They raise perplexing questions with regard to our current understanding of the relationship between consciousness and brain functions. Reports on veridical perceptions during out-of-body experiences suggest that consciousness may be experienced independently of a functioning brain and that self-consciousness may continue even after the termination of (...) brain activity. Data on studies of near-death-experiences could be an incentive to develop alternative theories of the body-mind relation as seen in contemporary neuroscience. (shrink)

This book analyzes the implementation of CSR reporting and codes of business conduct and ethics in the legal systems of the USA, Austria and China and their enforcement in international supply chain arbitrations. The book demonstrates that long-term profit maximization is increasingly intertwined with corporate ethics and CSR policies. In order to prevent window-dressing and greenwashing, certain control mechanisms and legal standards are required along the entire supply chain. This book introduces an ethics and CSR system recommending a reward-based whistleblowing (...) mechanism, internal oversight by a CSR and Ethics Committee comprised of independent board members and at least one sustainability expert, and an external, independent and comprehensive assurance of CSR reports provided by auditing firms or newly formed governmental agencies consisting of certified CSR experts. The author emphasizes the significance for supply chain leaders to ensure contractual enforcement of their codes of business ethics and conduct along the supply chain. Against this background, the author created a comprehensive fictitious case scenario covering a supply chain dispute arising from the breach of the supply chain leader’s code of business conduct and ethics by a lower-tier supply chain member. The author acknowledges the fact that in most of the cases the governing law of international supply chain contracts is English law or law based on English law. Thus, the author discusses potential contractual claims for damages arising from a loss of profits caused by a loss of reputation resulting from violations of core provisions of the chain leader’s supplier code of conduct pursuant to English law. As international supply chain disputes usually involve more than two parties, and international arbitration is the ideal means for the resolution of these disputes, the book compares the arbitration rules for consolidations and joinders of some of the most significant international arbitration institutions: SIAC, ICC, AIAC, ICDR, VIAC, CIETAC and HKIAC. The book is directed at legal practitioners, legislators of various jurisdictions, board members of corporations, ethics and compliance officers, academics, researchers and students. University mathematics education and civic education through mathematics emphasise different aspects of the mathematical worldview. The present study qualitatively analyses 21 mathematics students’ mathematics-specific intrinsic motivation for choosing a mathematics study programme referring to different aspects of their mathematical worldview before the beginning of their study. The results show that many preservice teachers enjoy schematic aspects of mathematics, which does neither correspond to the type of mathematics taught at universities nor to civic education through mathematics. These findings contribute to explaining (...) demotivation and frustration of preservice teachers with university mathematics as well as challenges for implementing civic education through mathematics in classrooms. In my 1984 book on The Foundations of Psychoanalysis, I addressed two main questions: Are the analyst’s observations in the clinical setting reliable as ‘data,’ and if so, can they actually support the major hypotheses of the theory of repression or psychic conflict, which is the cornerstone of the psychoanalytic edifice, as we know? In the book, I argued for giving a negative answer to both of these questions. Clearly, if the evidence from the couch is unreliable from the outset, (...) then this defect alone suffices to jeopardize the very foundations of the clinical theory. But, as I strongly emphasized, even if clinical data were not contaminated by the analyst’s influence, the inability of the psychoanalytic method of clinical investigation by free association to warrant the required sort of causal inferences leaves the major pillars of the theory of psychic conflict ill-supported. Thus, I see a two-fold threat to the psychoanalytic case-study method as a means of scientific inquiry.It is an immediate corollary of my challenge that it applies not only to Freud’s own original hypotheses, but also to any and all post-Freudian versions of psychoanalysis that rely on his clinical methods of validating causal inferences, though the specific content of their theories of psychic conflict is different. After all, the alteration in the content of the hypotheses hardly makes their validation more secure. Therefore, as Morris Eagle documented in a recent publication, those analysts who have objected to my critique as anachronistic have simply not come to grips with it. For example, such inadequate engagement is present, in my view, in the recent Freud Anniversary Lecture ‘Psychoanalysis as a Science: A Response to the New Challenges,’ given by Robert Wallerstein, the current president of the International Psychoanalytical Association. As he tells us, ‘The Freud Anniversary Lecture was intended primarily as a response to Grünbaum.’ Yet he does not come to grips at all with the gravamen of my challenge: Even if clinical data could be taken at face value as being uncontaminated epistemically, the inability of the psychoanalytic method of clinical investigation by free association to warrant causal inferences leaves the major pillars of the clinical theory of repression ill-supported. According to some cosmologists, the big bang cosmogony and even the (now largely defunct) steady-state theory pose a scientifically insoluble problem of matter-energy creation. But I argue that the genuine problem of the origin of matter-energy or of the universe has been fallaciously transmuted into the pseudo-problem of creation by an external cause. A fortiori, it emerges that the initial "true" and "false" vacuum states of quantum cosmology do not vindicate biblical divine creation ex nihilo at all.

It is a commonplace in the analytic geometry of physical space-time that an extended straight line segment, having positive length, is treated as “consisting of” unextended points, each of which has zero length. Analogously, time intervals of positive duration are resolved into instants, each of which has zero duration.

This paper will be concerned with Pindar's often-discussed innovations in the Pelops-Tantalos myth of the first Olympian, where Pindar explicitly rejects the traditional story of Tantalos' cooking his son Pelops and serving him up to the gods, one of whom inadvertently ate from the cannibalistic dish. Does Pindar really alter traditional features of a story from religious considerations only, as the communis opinio takes him to do? D. C. Young has recently drawn attention to the astonishing formal symmetry of the (...) ode. As to the contents, however, the old charges against Pindar's poetry, inconsistency and irrelevance, still remain. (shrink)

The scientific conception of change and motion raises two fundamental questions: Is there any evidence that the temporal order of events cannot legitimately be postulated to be continuous in Cantor's sense? Is it possible to account for such distinguishing properties of time as its possession of an "arrow" on the basis of assuming that events constitute a continuous type of order in Cantor's sense, and providing a coordinating definition for the ordering relation "later than"? We must raise these questions, since (...) at least four philosophers of the present century have denied the compatibility of the temporal structure of actual events with the order defined by Cantor's linear continuum and have held that a description of physical change which is based on the latter type of order is incompetent to account for the "arrow" of time and for such features of actual events as the latter involves. The philosophers in question are Henri Bergson, William James, Alfred North Whitehead and Paul Weiss. Each of these thinkers makes reference to Zeno's paradoxes of motion in setting forth his arguments. (shrink)

On October 18-19, 2002, the Center for Philosophical Education at Santa Barbara City College hosted a symposium honoring Professor Adolf Grünbaum’s contributions to contemporary philosophy. This work, an outgrowth of that symposium, contains essays by leading philosophers on Grünbaum's vast influence on philosophy of religion and philosophy of science. The symposium participants have either significantly reworked their original papers or written entirely new ones for this special publication. A reprint of Grünbaum’s "The Poverty of Theistic Cosmology" further enriches the (...) book. A highlight of the present volume is an extended "Autobiographical-Philosophical Narrative" in which Grünbaum traces his intellectual journey, beginning with a poignant account of his early experiences with anti-Semitism in Nazi Germany and his initial queries about religious belief, continuing through the major milestones of his career, and concluding with his current interests. Also of great value is a complete bibliography of Grünbaum's published works. Besides Grünbaum, the contributors include Nancy Murphy, Bas C. van Fraassen, Michael Tooley, Steven Humphrey, Nancy Cartwright, and Edward Erwin. (shrink)

Prompted by the "Panel Discussion of Grünbaum's Philosophy of Science" (Philosophy of Science 36, December, 1969) and other recent literature, this essay ranges over major issues in the philosophy of space, time and space-time as well as over problems in the logic of ascertaining the falsity of a scientific hypothesis. The author's philosophy of geometry has recently been challenged along three main distinct lines as follows: (i) The Panel article by G. J. Massey calls for a more precise and more (...) coherent account of the Riemannian conception of an intrinsic as opposed to an extrinsic metric, which the author has invoked as his basis for the distinction between non-conventional and convention-laden ascriptions of metrical equality and inequality; (ii) the latter distinction has been claimed to suffer from the liabilities of the so-called "standard conception" of scientific theories [36]; and (iii) pursuant to H. Putnam's "An Examination of Grünbaum's Philosophy of Geometry" [56], J. Earman [16, 17] and R. Swinburne [65] have contended that the difference between intrinsic and extrinsic metrics is scientifically unilluminating, and that the associated distinction between non-conventional and convention-laden metrical comparisons does not have the kind of relevance to extant scientific theories that the author has claimed for it. The essay consists of two installments. The present installment, comprising the Introduction and Part A, is devoted to the clarification, correction and further development of the author's prior writings on the philosophy of geometry. Its main objective is constructive elaboration rather than offering polemics. But rebuttals to Earman, [16, 17], Swinburne [65] and Demopoulos [13] are included, because their inclusion conduced to clarity in giving the new exposition. Part B is to appear in a subsequent issue and will be devoted to replies to critiques contained in the Panel Discussion and in other recent literature. It will range over issues in the philosophy of geometry and in the logic of ascertaining the falsity of a scientific hypothesis. By way of merely elliptical anticipation of much more precise statements given in Part A, section 3(ii), the Introduction dissociates the notion of convention-ladenness developed in Part A from the quite different notion integral to the so-called "standard conception" of scientific theories. Thereby, the Introduction prepares the ground for seeing, as a corollary to Part A, section 3(ii), that the notion advocated in the present essay has nothing to fear from the following fact, noted by C. G. Hempel ([36]; cf. also his 1970 Carus Lectures): "even though a sentence may originally be introduced as true by stipulation, it soon joins the club of all other member-statements of the theory and becomes subject to revision in response to further empirical findings and theoretical developments." Part A, which begins with a fairly detailed table of contents, endeavors to meet the aforementioned three-fold challenge to the author's philosophy of geometry. Massey's call for the provision of clear and detailed characterizations of intrinsic and extrinsic metrics is answered with the invaluable aid rendered personally by Massey himself. These characterizations are shown to permit a precise explication of the portions of Riemann's Inaugural Dissertation relevant to (1) Riemann's brilliant anticipation of Einstein's dynamical conception of physical geometry, and (2) the author's philosophical characterization of the metrics and geometries of space, time, and space-time {section 2(c)}. A byproduct of the analysis is to raise two major philosophical doubts concerning Clifford's sketch of a so-called "space-theory of matter" as elaborated in J. A. Wheeler's relativistic geometrodynamics. That theory's vision of understanding matter as a manifestation of empty curved space is questioned in regard to (1) the existence of an intra-geometrodynamic basis for individuating the metrically homogeneous world points of its space-time manifold {section 1(a)}, and (2) the compatibility of the theory with the Riemannian metrical philosophy apparently espoused by its proponents {section 2(c)(i)}. This book critically examines Freud's own detailed arguments for his major explanatory and therapeutic principles, the current neorevisionist versions of psychoanalysis, and the hermeneuticists' reconstruction of Freud's theory and therapy as an alternative to what they claim was a “scientistic” misconstrual of the psychoanalytic enterprise. The clinical case for Freud's cornerstone theory of repression – the claim that psychic conflict plays a causal role in producing neuroses, dreams, and bungled actions – turns out to be ill-founded for two main reasons: (...) Even if clinical data were valid, the method of free association has failed to support the psychoanalytic theory of unconscious motivation; Clinical data tend in any case to be artifacts of the analyst's self-fulfilling expectations, thus losing much of their evidential value. The hypothesis that psychoanalytic treatment is in reality a placebo poses a serious challenge to the assumption that insight is a key causal factor when therapy is successful. This challenge has yet to be met by psychoanalysts. Similar conclusions undermine the neorevisionist versions of psychoanalysis. The most influential hermeneuticists, on the other hand, are shown to have imposed an alien philosophy on psychoanalysis, partly through their reliance on gross misconceptions of the natural sciences. Karl Popper's criticism of the Freudian corpus as empirically untestable has misjudged its evidential weaknesses, which are more subtle. If there exists empirical evidence for the principal psychoanalytic doctrines, it cannot be obtained without well-designed extraclinical studies of a kind that have for the most part yet to be attempted. At a time when the formerly strictly separated roles of citizen and consumer are arguably blurry, and when once powerful social institutions increasingly must yield to new social forces based on heightened knowledgeability and historically unprecedented wealth, it is likely that the economy of modern society is also subject to implicit changes. In this article, we argue that traditional theories of the market are increasingly losing their basis for analysing economic relationships as purely rational acts of exchange and utility maximization. (...) Instead, what can be witnessed is an increase in the influence of values and norms on markets, guiding our attention to how deeply embedded economic action is in modern culture. We put forward the idea of a moralization of markets, which has begun to change our conceptions and theories regarding what is at stake in a modern economy fundamentally. We conclude that in the future, production processes and standards, codes of conduct and consumer reasoning will become all the more important for doing business in Western knowledge societies.
