Many studies have been done in non-Western academia that raise the issue of indigenousness, holding that it should be taken into consideration as an important element in explaining human behaviour. It is within this context that one can regard the studies and discussions on the notion of Islamic psychology. An investigation into the literature on Islamic psychology shows that although a good number of studies on the subject have been done, sufficient attention has not been paid to its epistemological foundations, (...) e.g., its nature, origin, and scope. With regard to Islamic psychology, this study is intended to analyse the relationship between science and religion, the borders of religion and science, and the possibility of Islamic psychology as a nascent social discipline. Gayretimin bir kısmı bilim dünyasına hizmet, ama diğer çok mühim bir gayesi ise; koskoca bir İslam aleminin yitirmiş olduğu kendine hürmeti, güveni ve insanlık tarihindeki yerini hatırlatmak, kaybettiklerini inşa etmek içindir. Prof. Dr. Fuat Sezgin Prof. Dr. Fuat Sezgin anısına ithaf ettiğimiz Felsefe ve Din Bilimleri Özel Sayımıza hoşgeldiniz. Prof. Dr. Fuat Sezgin, 24 Ekim 1924 tarihinde Bitlis’te dünyaya gelen Fuat Sezgin, il-kokulu Doğubayazıt’ta, ortaokul ve liseyi ise Erzurum’da bitirdikten sonra 1943 yılında İstanbul’a geldi. İstanbul Üniversitesi şarkiyat (Doğu bilimi) Araştırmaları (...) Enstitüsü’nde ünlü Alman şarkiyatçı Prof. Dr. Hellmut Ritter’in (1892-1971) öğrencisi olan Sezgin, Ritter’in tavsiyesi üzerine İslâm bilimlerine yöneldi. 1951’de İstanbul Üniversitesi Edebiyat Fakülte-si’den mezun olduktan sonra Arap Dili ve Edebiyatı alanında “Buhârî’nin Kaynakları Hakkın-da Araştırmalar” başlıklı teziyle doktorasını tamamladı. Bu çalışmasıyla, hadis kaynağı olarak İslâm kültüründe önemli bir yere sahip olan Buhârî’nin sözlü kaynaklar yerine yazılı kaynaklara dayandığı tezini ortaya attı. Doçent unvanını 1954 yılında alan Sezgin, 1960 askeri darbesinin ardından üniversi-telerden uzaklaştırılan 147 akademisyen arasında kendi adının da bulunması üzerine 1961’de Türkiye’den ayrıldı ve çalışmalarına Goethe Üniversitesi’nde (Frankfurt) devam etti. Câbir bin Hayyân hakkında hazırladığı ikinci tezini 1965’te Goethe Üniversitesi Doğa Bilimleri tarihi Enstitüsü’ne sunan ve bir yıl sonra profesörlüğe yükseltilen Sezgin, aynı yıl kendisi gibi şarkiyatçı olan Ursula Sezgin ile Evlendi. Alanında şimdiye kadar yazılan en kapsamlı eser kabul edilen Geshichte des arabisc-hen Schrifttums (Arapça Yazma Eserler Literatürü Tarihi) başlıklı kapsamlı eserinin ilk cildini 1967’de yayımlayan Sezgin, 1978’de Kral Faysal İslâmi İlimler Ödülü’ne lâyık görüldü. Bu ödül nedeniyle kendisine takdim edilen maddi desteği değerlendirerek 1982’de Goethe Üniversitesi Arap-İslâm Bilimleri Tarihi Enstitrüsü’nü, ertesi yıl ise bu enstitü bünyesinde, tarih boyunca Müslüman bilim insanlarının icat ettiği 800’den fazla bilimsel alet ve düzene-ğinin modellerinin sergilendiği İslam Bilim ve teknoloji Müzesi’ni kurdu. Bu müzenin bir benzerini 2008 yılında istanbul’da kuran Sezgin, 2010 yılında Prof. Dr. Fuat Sezgin İslam Bilim Tarihi Araştırmaları Vakfı’nın kuruluşuna öncülük etti. Kahire Arap Dili Akademisi, Şam Arap Dili Akademisi, Fas Rabat Kraliyet Akademisi, Bağdat Arap Dili Akademisi, Türkiye Bilimler Akademisi şeref üyeliği de dâhil olmak üzere çok sayıda ödül ve nişana layık görülen Sezgin’e; Erciyes Üniversitesi, Atatürk Üniversitesi, Süleyman Demirel Üniversitesi ve İstanbul Üniversitesi tarafından fahri doktora unvanları verildi. Frankfurt am Main Goethe Plaketi, Almanya Üstün Hizmet Madalyası, İran İslâmi Bilimler Kitap Ödülü ve Cumhurbaşkanlığı Kültür ve Sanat Büyük Ödülü ile taltif edildi. Prof. Sezgin’in öncülüğünde kurulan İstanbul İslâm Bilim ve teknoloji tarihi Müzesi, Kültür ve Turizm bakanlığı 2016 özel Ödülü’ne lâyık görüldü. Arapça, Süryanice, İbranice, Latince ve Almanca başta olmak üzere 27 dil bilen Prof. Dr. Fuat Sezgin, 30 Haziran 2018’de İstanbul’da vefat etti ve Gülhane Parkı’ndaki İstanbul İslâm Bilim ve teknoloji tarihi Müzesi’nin bahçesine defnedildi. Vefatının ardından, 2018/6 sayılı Cumhurbaşkanlığı genelgesi ile 2019 yılı “Prof. Dr. Fuat Sezgin Yılı” olarak ilân edildi. Cumhurbaşkanlığı genelgesinde "İslam kültür ve medeniyetinin daha iyi anlaşılmasını sağlamak ve onu yeni nesillere en doğru şekilde aktarmak amacıyla yapılacak söz konusu çalışmalara ilgili tüm kamu kurum ve kuruluşlarınca her türlü destek ve katkının sağlanması hususunda gereğini rica ederim." İfadelerine yer verilerek Fuat Sezgin’in ülke sathında anlatılması ve düşüncelerinin anlaşılması için çeşitli faaliyetlerin yürütülmesi istenmişti. Koordinasyon Merkezi olarak da Kırıkkale Üniversitesi seçildi Dünyanın önde gelen bilim tarihçilerinden olan, İslam Bilim Tarihi alanındaki çalışmaları bulunan Prof. Dr. Fuat Sezgin’i gelecek nesillere tanıtmak, fikirlerini anlatmak amacıyla Sivas Cumhuriyet Üniversitesi tarafından da birçok faaliyet yapıldı. Dünyanın önde gelen bilim tarihçilerinden Prof. Dr. Fuat Sezgin’e, İslam Bilim Tarihi alanındaki çalışmalarından dolayı Üniversitemiz tarafından “Fahri Bilim Doktoru” unvanı verildi. Prof. Dr. Sezgin’e fahri bilim doktoru unvanı verilmesi dolayısıyla Üniversitemiz Kül-tür Merkezi’nde düzenlenen tören İstiklal Marşımızın okunması ve saygı duruşuyla başladı. Programa Rektörümüz Prof. Dr. Alim Yıldız, Sivas Belediye Başkan Yardımcısı Ah-met Özaydın, Fatih Sultan Mehmet Üniversitesi Rektörü Prof. Dr. Musa Uzun, öğretim elemanları ve öğrenciler katıldı. Rektörümüz Prof. Dr. Alim Yıldız yaptığı açış konuşmasında, "İnsanlara İslam bilimlerinin gerçeğini tanıtmak, benlik duygularını olumsuz etkileyen yanlış yargılardan onları kurtarmak ve ferdin ehemmiyetine olan inancı kazandırmak amacıyla İslam Bilimi Tarihi araştırmalarına adanmış bir ömürdür Prof. Dr. Fuat Sezgin Hocamız. Öyle büyük bir otoritedir ki onu anmadan, onun hazırladığı eserlere bakmadan, bilim tarihiyle, İslam tarihiyle ilgili ortaya bir şeyler sunabilmek çok zordur. Bilim tarihinin en çalışkan, en birikimli bilim insanlarından biridir. İslam tarihine, İslam düşüncesine, İslami eserlere ve bilim dünyasına vermiş olduğu katkılarıyla bir medeniyet kâşifi, eşi bulunmaz bir değer ve ‘darbeler neden kötüdür’ sorusunun mücessem cevabıdır Prof. Dr. Sezgin. Bizim medeniyet ve kültürümüzde kültür, sanat ve beşerin, Yaratıcının her eserinde müşahede ettiği güzellikleri, çeşitli yol ve yöntemlerle ortaya koymasının vasıtasıdır. Bilgiyi hikmetle taçlandırıp irfana ulaştırmadıkça hiçbir şeyi yerli yerine oturtamayız." dedi. Konuşmanın ardından Rektör Yıldız, 93 yaşındaki Prof. Dr. Fuat Sezgin’e cübbe giydirdi. Daha sonra Sezgin katılımcılara ‘Arap İslam Tarihinden Bazı İzlenimler’ konulu ders verdi. Prof. Dr. Fuat Sezgin, “İnsanların bilgi tarihi ile ilgili verileri yazılı olarak kaydetme gayreti, politik tarihe olana nispetle tesadüflere ve keyfi değerlendirmelere göre çok geri zamanlarda oldu. İslam bilim tarihi yüksek ve kaliteli görüşleri yansıtır. Bunları burada sunamayacağım. Birçoğunu Arap-İslam tarihi adlı kitabımın bugüne kadar çıkmış olan 17. cildinde kaydetmeye çalıştım. Onu İstanbul’da Gülhane Parkı’nda İslam Tarihi Araştırmaları Vakfı yayınları arasında bulabilirsiniz.” dedi. Prof. Dr. Sezgin “Bilimler tarihinin verilerini değerlendirmekte, yaşanılan zamanın etüt şartını gözden kaçırılmasının esas olması gerektiğini anladım ve henüz kitabımı yazma-ya başlamadan rastladığım Fransız Coğrafya tarihçisi Joseph Toussaint Renaud (1795-1867)’un şu sözleri beni çok etkilemişti. “Tesadüf teknik ve sanatın ilerlemesinde çok büyük bir rol oynamaz. İnsanlar buluşlarında devamlı bir şekilde birden bir sıçrayışla değil, adım adım hareket eder. Her zaman aynı hızda değil, fakat devamlı olarak insan icat etmez. Olanı ilerletir.” ifadelerine yer verdi. Konuşmasının sonunda Prof. Dr. Sezgin, “Benim 65 yıldır yaymaya çalıştığım Arap İslam bilimleri tarihi hemen hemen her gün beni hayata bağladı. İslam dünyasında büyük bir hızla ilerleyen bilimler MS. 8. yüzyıldan itibaren Fransa ve İngiltere’ye diğer taraftan 10 ve 11. yüzyıldan itibaren Sicilya’ya ve İtalya’ya 9. yüzyıldan itibaren Bizans’a ulaştılar. Avrupa-lılar teknik bilimleri diğer bilimlere nazaran daha kolay anlıyor ve alabiliyorlardı. Bu anlam-da onlar 16. yüzyılda bazı yönlerde Müslümanlara ulaşmaya hatta onları geçmeye başladılar.” ifadelerini kullandı. Programın sonunda Rektörümüz ve Fatih Sultan Mehmet Üniversitesi Rektörü Prof. Dr. Musa Duman, Prof. Dr. Fuat Sezgin’e tezhipli bir tablo hediye ettiler. 2019 Prof. Dr. Fuat Sezgin Yılı kapsamında Sivas Cumhuriyet Üniversitesi Merkezî Kütüphanesi’ne Prof. Dr. Fuat Sezgin’in ismi verildi. Ayrıca Üniversitemiz Rektörlüğü tarafından düzenlenen 5’inci Hazan Şiir Dinletisi Sezgin anısına ithaf edilmiştir. 2019 yılının Haziran ayı içerisinde ise Üniversitemiz Rektörlüğü öncülüğünde ve İlahiyat Fakültesi Dekanlığınca ile Sivas Merkez Ulu Cami’de merhum Prof. Dr. Sezgin için Kur’an-ı Kerim tilaveti ve Mevlid-i Şerif programı gerçekleştirilmiştir. Son olarak üniversitemiz rektörlüğü tarafından desteklenen ve Sivas Cumhuriyet Üniversitesi İlahiyat Fakültesi tarafından yayımlanan Cumhuriyet İlahiyat Dergisi’nin 23. Cilt 3. Sayısı (Felsefe ve Din Bilimleri Özel Sayısı) Prof. Dr. Fuat Sezgin anısına ithaf edilmiştir. Welcome to the 23rd volume 2nd issue of Cumhuriyet Theology Journal which left behind 22 years of academic publication journey. It is important to carry out valuable scientific studies in academic life as well as to reach a wide audience. Our journal has achieved great progress in both national and interna-tional academic publication. Today, almost all scientific knowledge can be reached through online access. Cumhuriyet Theology Journal has gained a very rapid acceleration in the last five years by meeting the international publication criteria with its format and publication principles and has managed to attract the attention of the scientific world. The Isnad Citation Style developed within our journal and workshops con-ducted under the leadership of our journal are examples of the Theology Field Journals. We are pleased to announce two important news in this issue. The first is that the 2nd Edition of the Isnad Citation System is available to you, and the second is the addition of the Arabic language option to our journal. The articles that are marked with a result above %15 are returned to the authors with a plagiarism report. It might be right to note here that we have been getting more attention from scholar-ly world day by day with our mission and standards. The journal has received 73 articles between July 1- Sptember 15, 2019 from the academic world. All articles went through the pre-review process to check the referencing and transliteration style before testing them using a plagiarism checker. We then have forwarded the articles that successfully passed the plagiarism check to our reviewers. Following this process, we have been able to offer to you 40 articles, a bookreview and a symposium review at two our issues. We are delighted to offer you the various ranges of themes and topics with this new issue. This study examined the validity and reliability of a Turkish version of the Modified Moral Sensitivity Questionnaire for Student Nurses. After obtaining permission to adapt the MMSQSN into Turkish, the translation/back-translation method was used with expert opinions to determine content validity. Factor analysis was conducted to examine the construct validity and test–retest was performed on the questionnaire to determine reliability. Cronbach’s alpha coefficients were calculated to assess for internal consistency. Participants included 272 baccalaureate degree student nurses who took ethics lessons (...) prior to their clinical internship. The factor analysis revealed that even though the factor structure in the original scale was the same, relevant items were categorized with similar components, and factor loads were sufficient. The correlation coefficient in the analyses of test–retest scores was.66 for the total scale and the Cronbach’s alpha was.73 for the total scale. The translated MMSQSN is a valid and reliable measure of ethical sensitivity in student nurses in Turkey. (shrink)

1980 sonrası dönemde evrimci iktisat yükselişe geçmiş ve ana akım iktisadı tek başına değiştirme gücü vurgulanmıştır. Fakat evrimci iktisadın ne olduğuna yönelik disiplin içinde bir anlaşmazlık ve karışıklık mevcuttur. Bu karışıklığa bağlı olarak evrimci iktisat disiplinde altı farklı yaklaşımla ifade edilmektedir. Bu çalışma ise Veblen’e atıfla gelişen ve 1980’lerden günümüze Hodgson tarafından güçlü bir şekilde sürdürülen evrimci-kurumsal iktisatla ilgilidir. Hodgson, iktisadın etkin bir sosyal bilim olabilmesi için Veblen’in düşüncelerini ve Veblen’le bağlantılı Darwinizmi benimsemesi gerektiğini vurgulamaktadır. Bu öneri Veblen’in post-Darwinist iktisat (...) önerisini genelleştirilmiş Darwinizm olarak sunmaktadır. Hodgson’ın Veblen’e yaslanarak geliştirdiği genelleştirişmiş Darwinizm önerisi, fizik özelinde başlayan iktisattaki bitmeyen doğa bilimi arayışının heterodoks iktisatta da güçlü bir şekilde karşılık bulduğunu göstermektedir. Burada yapılan veya yapılmak istenen doğacılık temelinde bir sosyal teori inşasıdır. 19. yüzyıl düşünsel kodlarına bir dönüş çağrısıdır. The vast majority of Islamic scholars have claimed that the miraculousness of the Quran stems from its own structure; its fluency, eloquence and verse characteristics. They have also regarded the science of rhetoric as the basic tool for revealing the literary superiority of the Quran and understanding it properly. The objective of this research is to determine the views of the students of theology and sharia faculties on the rhetoric course and present them comparatively. To understand how rhetoric is taught (...) in different cultural and educational contexts, how it is perceived by students, and how the course contributes to their academic and personal development matters in terms of improving the rhetoric course. The method used in the study is qualitative research and the study was conducted in the phenomenological design. The study group of the research consists of the students studying at Cumhuriyet University Faculty of Theology, Batman University Faculty of Islamic Sciences and The University of Jordan- School of Sharia. The data were collected from the students selected by criterion sampling method using a semi-structured interview form in the second semester of the 2023-2024 academic year. The main criterion used was that the participants' native language was not Arabic and that they were taking a rhetoric course. Descriptive analysis technique was used to analyze the collected data. At the end of the research, it was concluded that the rhetoric course was important for the fields of the students at theology and sharia faculties. The vast majority of the students of faculty of theology stated that the rhetoric course contributed to the improvement of their Arabic, and a significant portion of them stated that the course was an important tool in understanding the Quran, other religious texts, and Arabic literature. Almost all of the students of the faculty of sharia stated that the course contributed to the understanding of the Quran in general, especially its literary i‘jâz. It was also concluded that a significant portion of both student groups had difficulty in the rhetoric course. According to the students of the faculty of theology, the most important issue that makes rhetoric difficult is their weak Arabic background, while according to the Sharia faculty students, it is their first encounter with rhetoric topics. The results reveal that the rhetoric course is effective in understanding the Quran and other religious texts and in developing students' thinking and expression skills, but the content and teaching method of the course needs to be updated. Within the framework of the findings and results of the research, it is suggested that the content of the rhetoric course should be organized in a way to center the literary aspect of the Qur'an in accordance with the theology program and more participatory teaching methods should be used. Habib Baba (ö.1847), Erzurum halkı üzerinde kalıcı izler bırakan önemli şahsiyetlerden biridir. Halk arasında son derece geniş bir şöhrete sahip olmasına rağmen, hayatı ve tasavvufî yönü hakkında kaynaklarda yeterli bilgi bulunmamaktadır. Hakkında anlatılan rivayetler ve menkıbeler şahsiyeti ile ilgili bazı bilgiler içerse de hayatı ve tasavvufî kişiliğine yönelik yeterli bilgi vermemektedir. Bu sebeple de böyle önemli bir zât hakkında yeni bilgiler ortaya koyabilmek çalışma açısından önem arz etmektedir. Bu makalede Habib Baba’ya dair zihinleri meşgul eden, “onun tarîkat şeyhi olup olmadığı, (...) şayet bir tarîkat şeyhi ise Erzurum yöresinde bir dergâhının bulunup bulunmadığı, kendisinden sonra yerine birinin geçip geçmediği” gibi bazı sorulara arşiv belgeleri ışığında cevap aranacaktır. T.C. Devlet Arşivleri Başkanlığı Belgeleri üzerinde yapılan tetkikler neticesinde Habib Baba’nın Kâdirî tarîkatı şeyhi olduğu, Erzurum’da kendisine tahsis edilen bir dergâhta postnişin olarak görev yaptığı, kendisinden sonra Ahmet Müsref isminde halife bıraktığı öğrenilmiştir. Background There have been different ethical approaches to the issues in the history of philosophy. Two American philosophers Beachump and Childress formulated some ethical principles namely 'respect to autonomy', 'justice', 'beneficence' and 'non-maleficence'. These 'Four Principles' were presented by the authors as universal and applicable to any culture and society. Mawlana, a great figure in Sufi tradition, had written many books which not only guide people how to worship God to be close to Him, but also advise people how to (...) lead a good life to enrich their personality, as well as to create a harmonious society and a peaceful world. Methods In this study we examined the major works of Mawlana to find out which of these 'Four Principles of Bioethics' exist in Mawlana's ethical understanding. Results We have found in our study that all these principles exist in Mawlana's writings and philosophy in one form or another. Conclusions We have concluded that, further to Beachump and Childress' claim that these principles are universal and applicable to any culture and society, these principles have always existed in different moral traditions in different ways, of which Mawlana's teaching might be presented as a good example. The validity of the prayer which is accepted as the most basic worship of Islam has been tied to a set of rules. These rules which must be followed before and during the prayer are called conditions and pillars in the fiqh language. The recitation performed while standing during the prayer is one of the most significant of these rules and is accepted one of the pillars of the prayer. Therefore, in order for the prayer to be valid, it is (...) required to make enough recitations. If it is not done, the prayer is considered invalid. For this reason, the topic of recitation in prayer has been discussed in detail by the jurists, and different opinions have been submitted what, when and how much to recite. The jurists have suggested three basic views on this issue. Ḥanafīs have stated that a person who follows the imām in prayer should not recite, and they have accepted the recitation of ma’mūm as makruh regardless of whether the recitation is loud or silent. The Shāfiʿīs who uphold the opposite view of the Ḥanafīs have said that the ma’mūm have to recite in all the prayers in which the qirā'āt is loud and silent, and that it is obligatory for the ma’mūm to recite. According to Shāfiʿīs the prayer of a ma’mūm without recitation is not valid. Malikīs and Ḥanbalīs who have explained their opinions by taking into account that the recitation is loud and silent have stated that the ma’mūm should recite during prayers in which the recitation is silent. In the prayers where the recitation is loud the Ḥanbalīs have said that the ma’mūm should recite when the imām takes a break from recitation, while the Malikīs have said that the recitation is not required for the ma’mūm. However the jurists of both sects have not considered that the recitation is obligatory to ma’mūm. And they have acknowledged that the prayer of the ma’mūm was valid even if he has not recite. There is intra-sectarian disagreement in all of these three basic views which are presented as the general opinion of the sects. Although we are talking about the intra-sectarian disagreement, it is understood that the jurists except the Ḥanafīs have determined their views on the recitation of the ma’mūm within the context of whether the ma’mūm hear or do not hear the recitation of the imām. It can be said that this understanding is at the basis of the views put forward by the Shāfiʿīs who take into account that the recitation is loud and silent about the ma’mūm’s recitation of the sūrat after the Fātiḥa. Likewise it is possible to say that this understanding is at the basis of the perceptives brought forward by the Malikī and Ḥanbalī jurists about the prayers in which the recitation is sound. The jurists who expressed different opinions about the recitation of the ma’mūm similarly brought evidence from the Qurʾān, the Sunnah, opinions of the Companions and qiyās to justify their views. Although the jurists have grounded their views on similar evidence, they have reached different conclusions. The reason for this difference it can be shown that the direction of the verse (āyat) to be taken as evidence, their different approaches when evaluating the narrations transmitted from the Prophet (pbuh) and the fact that the arguments of qiyās are different. Bu araştırmada örgün eğitimle birlikte hafızlık eğitiminin öğrencilerin sosyal ve özgüven gelişimlerine etkisi incelenmiştir. 2014 yılında uygulamaya konulan örgün eğitimle birlikte hafızlık, başta okul merkezinde olması ve akademik eğitimle bir arada yürütülmesi gibi farklılıklar olmak üzere geleneksel hafızlık eğitiminden ayrılmaktadır. Araştırma nitel bir yaklaşımla ve durum çalışması desenine dayalı olarak görüşme yöntemiyle gerçekleştirilmiştir. Çalışma grubu olarak İstanbul, Konya, Sivas ve Rize illerinden olmak üzere toplam 4 hafızlık proje okulu seçilmiş, katılımcılar ise bu okullarda hafızlık yapan öğrenci, hafızlık öğreticisi, veli ve (...) öğretmenlerden seçilen toplam 35 kişidir. Araştırmada örgün eğitimle birlikte hafızlığın okul ortamından kaynaklı öğrencilerin sosyal gelişimlerine genel olarak olumlu yansıdığı, ancak yatılı olarak bu eğitimi gerçekleştirenlerde durumun olumsuz geliştiği, hafızlığı bitirebilme veya yarım bırakma durumuna göre özgüven gelişiminin değiştiği, hafızlığı tamamlama süresinin yetersizliğinin sosyal ve özgüven gelişimine etkide bulunduğu gibi bulgulara ulaşılmıştır. Sonuçta örgün eğitimle birlikte hafızlık eğitiminde okul ortamı öğrencilerin sosyal ve özgüven gelişimlerine geleneksel hafızlık ortamlarına göre daha fazla imkân ve fırsatlar sunmakta olmasına rağmen, bunun çocukların gelişim ihtiyaçları bakımından yeterli düzeyde olduğunu söylemek mümkün gözükmemektedir. Judaism is one of the oldest surviving religious traditions in the world. The Jews, who base their history on Abraham and his son Isaac, began to be called religion with Moses. The Jews, who lived their golden age in and around Jerusalem during the David and Solomon periods, also built the Temple, which was at the center of their religious life. The Jews, who rebuilt the Temple during the Babylonian exile and subsequently Ezra's reign, lived in these lands until the (...) destruction of the temple by the Romans in 70 AD. The statelessness that started after the destruction of the temple had an important place in the Jewish identity. The exile life, which continued for two thousand years, caused the Jews to go to different parts of the world and live there. In this period, which is expressed as the period of exile, Jews lived in many regions such as Africa, Anatolia, Europe and America. The arrival of the Jews in the Americas dates back to the Columbus era. Jews were present in South America and subsequently in the British colonies. Currently, most of the Jews in the world live in the USA. Among the Jews who went to the Americas, Ashkenazi and Sephardic Jews constitute the majority. However, in the Americas, Jews have formed different groups over time. These include groups such as Conservative, Orthodox, Reformist, and Reconstructionist. Jewish groups formed by African-Americans also have a special place among these formations. These African-American Jews in the USA, are discussed within the framework of this article. In the article, firstly, a piece of brief information about Judaism in America was given, and then the relations between Blacks and Jews were discussed. Afterward, the main features of these formations, which are of African origin and consider themselves the descendants of the Israelites, are emphasized. Finally, the Jewish groups established by Black Jews were contacted and if they had different practices and beliefs from the others, they were included. The research was carried out based on the literature review and information was given about the prominent black Jewish groups. (shrink)

In this paper, we propose some transfor mations based on the centroid points between single valued neutrosophic numbers. We introduce these trans formations according to truth, indeterminacy and falsity value of single valued neutrosophic numbers. We propose a new similarity measure based on falsity value between single valued neutrosophic sets. Then we prove some properties on new similarity measure based on falsity value between falsity value between single valued neutrosophic sets. Furthermore, we propose similarity measure based on falsity value between (...) single valued neutrosophic sets based on the centroid points of transformed single valued neutrosophic numbers. We also apply the proposed similarity measure between single valued neutrosophic sets to deal with pattern recognition problems. (shrink)

In recent decades antenatal screening has become one of the most routine procedure of pregnancy-follow up and the subject of hot debate in bioethics circles. In this paper the rationale behind doing antenatal screening and the actual and potential problems that it may cause will be discussed. The paper will examine the issue from the point of wiew of parents, health care professionals and, most importantly, the child-to-be. It will show how unthoughtfully antenatal screening is performed and how pregnancy is (...) treated almost as a disease just since the emergence of antenatal screening. Genetic screening and ethical problems caused by the procedure will also be addressed and I will suggest that screening is more to do with the interests of others rather than those of the child-to be. Mezheplerin teşekkül etmeye başladığı ilk dönemlerden itibaren istihsanın bir istidlal yöntemi olup olmadığı tartışılagelmiştir. Bu tartışmaların temelinde kavramsallaşma sürecini henüz tamamlamamış olan istihsan teriminin çağrıştırdığı keyfiliğin/sübjektivitenin etkisi çok fazladır. Bu yüzden istihsanı bir yöntem olarak benimseyenler, ağır ithamlara maruz kalmışlardır. İstihsanı benimseyenlerin başında Hanefî hukukçular gelmektedir. Öyle ki istihsan yöntemi Hanefî mezhebiyle anılır hale gelmiştir. Bununla birlikte mezhebin önde gelen temsilcilerinden biri olan ve kıyas metodunu kullanmasıyla ön plana çıkan Züfer b. Hüzeyl’in istihsana yaklaşımıyla ilgili iki farklı yaklaşım tespitedilmiştir. Yaptığımız (...) araştırma ve inceleme neticesinde her iki tespitinde isabetli olmadığını; Züfer b. Hüzeyl’inkıyas yapmadaki becerisinin yanı sıra istihsana müracaatta sonuna kadar kıyas taraftarı olduğunu; ancak kıyasın meselelere çözüm üretmede yetersiz kaldığı ya da doğru sonuç vermediği durumlarda ise ızdırârın da bir gereği olarak meseleyi hükümsüz bırakmama adına istihsana müracaat ettiği görülmektedir. Sonuç olarak Züfer b. Hüzeyl’in genel hatlarıyla Hanefî usulüne bağlı kalmakla birlikte istihsanı bir istidlâl yöntemi olarak kullanma hususunda çerçeveyi oldukça daralttığını; kıyasa başvurma konusunda ise sınırları mümkün olduğunca geniş tuttuğunu söylemek mümkündür. İctihad hürriyeti ve hukûkî zenginlik açısından oldukça önemli olan Hanefi mezhebindeki mezhep içi ihtilaflar, hukûkî istikrar ve emniyeti tehdit etme potansiyeli taşımakta ve ayrıca ihtilaflı meselelerde hüküm veya fetva verecek fakihlerin işini zorlaştırmaktadır. Bu nedenle mezhep içerisindeki ihtilaflı meselelerde râcih görüşü tespit etmek, diğer bir ifadeyle mezhep içi tercih, zorunlu bir ihtiyaçtır. Mezhep içi tercih, “muayyen bir mesele ile ilgili mezhepteki muhtelif kavil veya rivayetlerden daha ağır basanı, üstün olanı belirlemek” şeklinde tarif edilebilir. Tarihi süreçte bu ihtiyacı karşılamak için muhtasar ve fetva kitapları gibi farklı telif türleri; esahh-ı akvâl ve maʻrûzât gibi farklı uygulamalar ortaya çıkmıştır. Bu ihtiyacı gidermeyi hedefleyen uygulamalardan biri de Osmanlı Devleti’nin son dönemindeki kanunlaştırmalardır. Fıkha dayalı kanunlaştırmanın ilk örneği olan Mecelle-i Ahkâm-ı Adliyye ile mezhep içi tercih arasındaki ilişki ve bu bağlamda Mecelle hazırlanırken, mezhep içi tercihte nasıl bir usûl izlendiği; râcih görüşe ne oranda uyulduğu; Mecelleʼde yer alan râcih görüşe aykırı kanun maddeleri ve bunların gerekçeleri; ihtilaflı bütün konularda düzenleneme yapılıp yapılmadığı ve râcih görüşleri belirleme ihtiyacının ne kadar giderildiği, incelenmesi gereken konulardır. Mecelle-i Ahkâm-ı Adliyye gibi bir kanun metnine ihtiyaç duyulmasının temel nedenlerinden birisi, Hanefî mezhebinde mezhep içi ihtilafların çokluğudur. Buna bağlı olarak Mecelleʼnin hedefi râcih görüşler içeren oluşan bir kanun hazırlamaktır. Mecelle’nin esbâb-ı mûcibeleri mezhep içi tercih açısından incelendiğinde, esbâb-ı mûcibelerin iki temel işlevi olduğu görülür. Bunlardan ilki, kanunun büyük oranda mezhepteki râcih görüşlere uygun olarak hazırlandığını vurgulamaktır. Öyle ki, Mecelle’nin ilk on kitabının esbâb-ı mûcibelerinde bu husus mutlaka ifade edilmektedir. Esbâb-ı mûcibelerin diğer işlevi ise niçin bazı maddelerde râcih görüşe riayet edilmediğini gerekçelendirmektir. Esbâb-ı mûcibelerde on iki maddenin râcih olmayan görüş doğrultusunda hazırlandığı belirtilmektedir. Mecelleʼnin 1851 maddeden oluştuğu göz önünde tutulduğunda Mecelleʼnin muhtevasında râcih görüşlerin ne kadar etkili olduğu daha iyi anlaşılacaktır. Esasen devrin özelliği de bunu zorunlu kılmaktadır. Zira Kitâbüʼl-Havâlenin 692. maddesinde Züferʼin râcih olmayan görüşünün tercih edilmesi, başta Şeyhülislam Hasan Fehmi Efendi olmak üzere bazı çevrelerin tepkisine neden olmuş ve bu sebeple Ahmet Cevdet Paşa Divân-ı Ahkâm-ı Adliyye nâzırlığından ve Mecelle Komisyonu başkanlığından azledilmiştir. Râcih görüşe aykırı maddelerin esbâb-ı mûcibeleri incelendiğinde, bu yöndeki tercihlerde maslahat ve örfün belirleyici olduğu görülmektedir. Ayrıca bazı fakihlerin tercihlerinin de bir tercih sebebi olarak zikredildiği görülmektedir. Hanefi kaynaklarda en sık karşılaşılan tercih sebebi naslara uygunluktur. Buna karşın Mecelleʼde sefîhin hacri konusu dışında, naslara uygunluğun bir tercih sebebi olarak işletilmemesi dikkat çekicidir. Mecelle Komisyonunun bazı tercihlerine diğer kurumlarca müdahale edilmiştir. Komisyonca hazırlanan kitaplar hem Meclis-i Vükelâ hem de Meşîhat tarafından incelenmiş ve bu esnada bazı tashihlere konu olmuştur. İşte râcih olmayan görüş esas alınarak hazırlanan iki maddeye Meclis-i Vükelâ tarafından müdahale edilmiştir. Bunların birincisi hakk-ı mürur ve hakk-ı şirbin müstakil olarak satımının cevazını savunan Belh Meşâyihinin görüşü doğrultusunda yazılan 216. madde, ikincisi ise ecîr-i müşterekin tazmin sorumluluğunu düzenleyen 611. maddedir. Mecelle’nin ilk ve en hacimli kitabı olan Kitâbüʼl-Büyûʻun muhtevası mezhep içi tercih açısından incelendiğinde, ihtilaflı konularda genelde mezhepteki râcih görüşün esas alındığı görülmektedir. Kitâbüʼl-Büyûʻun esbâb-ı mûcibesinde, dört meselenin râcih olmayan görüş esas alınarak hazırlandığı ifade edilmekte ve bu tercihler örf ve maslahatla gerekçelendirilmektedir. Ancak Kitâbüʼl-Büyûʻdaki râcih görüşe aykırı maddeler bunlarla sınırlı değildir. Bizim araştırmamıza göre bunlara ilaveten üç madde daha râcih olmayan görüş tercih edilerek hazırlanmıştır. Bunlar beyʻ biʼl-vefânın menkullerde cevazına dair 118. madde, gabn-i fâhişin tanımı hakkındaki 165. madde ve şart muhayyerliğinin hükmü ile ilgili 309. maddedir. Bu üç madde, Mecelleʼdeki râcih görüşe aykırı düzenlemelerin sadece esbâb-ı mûcibelerde açıklananlardan ibaret olmadığını göstermektedir ve bu durum Mecelle hazırlanırken izlenen usûle aykırıdır. Hanefi mezhebindeki bazı ihtilaflı meselelerde hangi görüşün râcih olduğu konusunda tercih ehli fakihler ihtilaf etmişlerdir. Bu meselelerde Mecelleʼde düzenleme yapılırken nasıl bir yol izlendiği açıklanmamıştır. Bu meseleler incelendiğinde çoğunluk tarafından tercih edilme, kolaylığı temin etme ve bazı fakihler tarafından tercih edilme gibi hususların etkili olduğu söylenebilir. Mecelleʼdeki tercihler sadece şerʻî hükümler arasında gerçekleşmemiştir. Buna ilaveten tanımlar ve tanımlarda yer alan kayıtlar da tercihe konu olmuştur. Bu kapsamda Kitâbüʼl-Büyûʻdaki beyʻ akdi, mevkûf akid ve gabn-i fâhişin tanımına ilişkin tercihler örnek olarak zikredilebilir. Hanefi mezhebin içerisindeki ihtilaflı bazı meseleler Mecelleʼde düzenlenmemiştir. İhtilaflı meselelerin çokluğu ve dolayısıyla bütün bunları kapsayan bir kanun hazırlamanın zorluğu dikkate alındığında bu durum doğaldır. Ayrıca bu meselelerden bazıları sık gerçekleşmediği ve lüzumlu görülmediği için Mecelleʼde düzenlenmemiş olabilir. Ancak düzenleme yapılmayan ihtilaflı meselelerin tamamını bu sebeplerle izah etmek mümkün değildir. Zira yasal düzenleme yapılmayan ihtilaflı meselelerin bazıları temel, görece önemli meselelerdir ve muhtasarlarda yer almaktadır. Bu durum Mecelle hazırlanırken, ihtilaflı bazı meselelerde tercih yapmak yerine bu meselelere ilişkin düzenleme yapmama metodunun benimsendiğini göstermektedir. İhtilaftan ârî bir kanun metni oluşturmanın bir yolu olarak da bu usûlün benimsendiği söylenebilir. Böylece bu meselelerde râcih görüşü tespit etme işi hâkimlere bırakılmıştır. Bu durum Mecelleʼnin hedefi olan râcih görüşleri tespit etme ihtiyacını gidermeye uygunluk arz etmemektedir. Ancak bu durum bütün meseleleri kuşatan bir kanun yapmanın güçlüğünün bir sonucudur. Human actions have been one of the most discussed topics in the science of kalām since the first centuries of Hijra. Many scholars from different schools of kalām have tried to solve this problem. Efforts to solve the problem have brought different views. In this framework, three main views emerged Jabrī, Qadarī/Muʿtazilī and Salafī/Sunnī. The views of Islamic philosophers were added to these and this number was increased to four. Nevertheless, Sunnī scholars, who agree on the basic propositions, disagreed on (...) the nature of kasb. While there are differences of opinion between Ashʿarī and Māturīdī schools, there are also those who put forward different views among scholars belonging to the same school. Abū Bakr al-Bāqillānī (d. 403/1013), Abū Isḥāq al-Isfarāyīnī (d. 418/1027) and Juwaynī (d. 478/1085), Sadr al- Shrīʿa (d. 747/1346) and Ibn al-Humām (d. 861/1457) are the most obvious examples of this. These views on human actions have been mentioned in their works by scholars of kalām. One of these scholars is Gelenbevî Ismāʿil (d. 1205/1791). In this article, the views on human actions will be examined in the context of Gelenbevî’s work named Ḥāshiya ʿalā Sharḥ al ʿAqāʾid al ʿAḍudiyya. Gelenbevî makes concise or detailed explanations about the views mentioned in his work with the exception of Ibn al-Humām. In addition, he also mentions the views of al-Ghazālī (d. 505/1111). While Gelenbevî mentions these views and the discussions that took place around them, He makes use of his works Ījī’s (d. 756/1355) named Mawāqif, Taftāzānī’s (d. 792/1390) Sharḥ al Maqāṣ̣ıd and Jurjānī’s (d. 816/1413) Sharḥ al - Mawāqif. Gelenbevî states that Ashʿari’s view is middle jabr (jabr al muṭavaṣṣıṭ) and even he is accused of being pure jabr (jabr al- maḫẓ). Based on the concept of partial will (al-irādah al-juzʾiyyah), he says that the views of Bāqillānī and Māturīdī school are the same and states that this view is more successful than Ashʿari’s in explaining human responsibility. This thought indicates that he is closer to the Māturīdī view of human actions than to Ashʿarī. He points out that Isfarāyīnī’s views are open to criticism in some respects. He implicitly states that he does not agree with the idea that Juwayni agrees with the Islamic philosophers.
