Pezzimenti orders his argument most through the lens of limits. Limits for Pezzimenti stem from distinct elements of a society competing for finite power ordered toward action. Many of our political and social problems, both past and present, stem from denying limitations or misordering their interactions. The presentism that tempts democracy must be tempered by the limits the past places on it. Institutions are one helpful means for this interaction, which helps guard against a "utopianism which wants to solve everything immediately, deceiving itself that it can perform miracles." Law itself involves limits, placing boundaries on the action of private persons and public entities. So does pluralism and "polyarchy," whereby we recognize the limits particular persons and communities place on politics' universalism as well as how politics restrains these other elements from descending into intolerant, selfish particularity. Important to this point is Pezzimenti's discussion of sovereignty, which must not be reduced to a mere question of who rules and where but to the question of rightly pursuing a common good respectful of individual rights. True freedom inheres in the proper cohering of these elements.Pezzimenti turns to the distribution of powers within a community as part of the discussion of limits. He argues that "the traditional tripartition, theorized by Polybius and on to Montesquieu, today appears certainly insufficient." To define all political power as legislative, executive, and judicial, then to distribute them among competing institutions, does not fully account for the contemporary political landscape. Legislative power must account for claims that its representative systems either are oligarchic in practice or lead to crass populism, and that they fail to account for group identities as opposed to class ones. Comparative study of wall paintings in churches dedicated to St Clement in Stará Boleslav and Rome reveals the wide international networking of contemporary agents in artistic transfer. The importance of late twelfth-century wall paintings in St Clement’s in Stará Boleslav – among Bohemia’s foremost medieval monuments – is underscored by their close proximity to the place of the martyrdom and the center of the cult of the country’s patron, St Wenceslas. The Bohemian church’s consecration echoes the Cyril and Methodius (...) mission, resonating with the transfer of St Clement’s relics from the Crimea to Central Europe, then to the Basilica of San Clemente in Rome. The frescoes in the Roman basilica’s lower church have been recognized as an important source for the concept of the paintings. The extensive, and iconographically exceptional, image cycle of St Clement’s life was commissioned by a high-ranking cleric, possibly the Salzburg archbishop, Adalbert of the Přemyslid family. The recent fresco restoration survey has yielded insights into the painting technique and will become the basis for the future rescue and rehabilitation of the Romanesque church’s wall decoration. Of the many accounts of the Battle of the Milvian Bridge ina.d.312 written soon after the conflict, only those of Eusebius of Caesarea have Maxentius cross the Tiber on a bridge of boats to face the forces of Constantine. This detail, it is here argued, suggests that Maxentius may be seen as a latter-day Xerxes, the Persian emperor who, in preparation for his invasion of Greece in 480b.c., famously spanned the Hellespont with a pair of boat-bridges. The article first reviews (...) the seminal accounts of Xerxes’ feat in Aeschylus’Persiansand Herodotus’Histories, and next discusses the story's long afterlife in subsequent Greek (and Latin) authors, including those of Late Antiquity. Close analysis of Eusebius’ battle narratives in hisEcclesiastical History(9.9.3–8) and in hisLife of Constantine(1.38) reveals that their vocabulary echoes the distinctive language used by Aeschylus, Herodotus and later writers in reference to Xerxes’ achievement. The article concludes by exploring the implications of this identification of Maxentius with Xerxes. It exemplifies two venerable tactics in Roman political propaganda: that of portraying a native rival as a foreign enemy and that of mapping the Persian Wars onto contemporary events. The recent proposal by the Independent Expert Panel of the Stop Ecocide initiative to include the crime of ecocide in the International Criminal Court's Rome Statute has raised expectations for preventing and remedying severe environmental harm through international prosecution. As alluring as this image is, we argue that ecocide prosecutions may be the most difficult, perhaps even impossible, in precisely the cases that the ICC would need to be concerned with; namely, the gravest global incidents of environmental harm, including (...) those associated with planetary climate change. We explore a series of questions about the panel's formulation of ecocide that resonate with longer debates around criminalizing environmental harm but take on new dimensions amid the Anthropocene and after twenty years of ICC trials. Ecocide must contend with the hard lessons learned concerning the ICC's limitations in realizing justice in a fraught international political context and also with fundamental challenges to knowledge and legitimacy arising from the uncertainty and dynamic socioenvironmental context of the Anthropocene. The proposed amendment, if adopted, risks ineffective prosecutions or even perverse outcomes for the environment itself. This risk, however, may characterize any effort to prosecute ecocide internationally in the Anthropocene unless the terms of international criminal law are fundamentally rethought. (shrink)

Adam Ferguson’s imperial thought casts new light on the age-old republican dilemma of the tension between empire and liberty. Generations of republican writers had been haunted by this issue as the decline of Rome proved that imperial expansion would eventually ruin the liberty of a state. Many eighteenth-century Scottish thinkers regarded this as an insoluble conundrum and thus became critics of empire. Ferguson shared their basic views but, paradoxically, was still able to defend the British Empire in the (...) debates over the American Revolution. His argument effectively offered a viable solution to the republican dilemma, which distinguished him from his contemporaries. In light of this, I argue that political representation was the pivotal conception for Ferguson to make empire and liberty compatible. ABSTRACTFor the Scottish Enlightenment thinker Adam Ferguson and many of his time, the history of the Roman Republic furnished the best case study for discussions of internal threats to a mixed system of government. These included factionalism, popular discontent, and the rise of demagogues seeking to concentrate power in their own hands. Ferguson has sometimes been interpreted as a ‘Machiavellian’ who celebrated the legacy of Rome and in particular the value of civic discord. By contrast, this article argues (...) that he is better understood as a disciple of Montesquieu, who viewed Rome as an anachronistic and dangerous ideal in the eighteenth century, the era of the civilized and commercial monarchy. The greatest fear of Ferguson was military despotism, which he believed was the likely outcome of democratic chaos produced by the levelling instincts of the ‘common’ people and demagogues prepared to harness their discontent. In such a scenario, a legitimate order in a mixed government would be turned into a faction putting the constitutional balance at risk, undermining intermediary powers, and ending liberty for all. The parents do not only procreate their offspring, they also introduce them into the natural and social reality, that is they educate. No education is possible without a lively dialogue with history and society. Since the beginning man stands in a close relationship to others, is made for the human society.... In these our times one form of modernity is collapsing and the mood of the day is an unclear postmodernity that in some of its versions could well be a return to barbarianism. Through the influence of John Dewey, Rousseau came to inform much of the educational theory regnant in the United States, with disastrous consequences, now acknowledge by nearly all. In a valuable preface to his translation, Professor Frank, drawing upon his experience both here and abroad, not only places Emile in context, but defends Gerdil's time-transcending, classical view of education against its modern detractors. "Gerdil," Frank tells us, "addressed his Anti-Emile to elders responsible for education, be they parents, teachers, or political authorities, who might find themselves swayed by the powerful rhetoric of Rousseau's Emile." Online privacy policies or terms and conditions ideally provide users with information about how their personal data are being used. The reality is that very few users read them: they are long, often hard to understand, and ubiquitous. The average internet user cannot realistically read and understand all aspects that apply to them and thus give informed consent to the companies who use their personal data. In this article, we provide a basic overview of a solution to the problem. We (...) suggest that software could allow users to delegate the consent process and consent could thus be automated. The article investigates the practical feasibility of this idea. After suggesting that it is feasible, we develop some normative issues that we believe should be addressed before automated consent is implemented. (shrink)

Models as Make-Believe offers a new approach to scientific modelling by looking to an unlikely source of inspiration: the dolls and toy trucks of children's games of make-believe.

I argue that fallibilism, single-premise epistemic closure, and one formulation of the “knowledge-action principle” are inconsistent. I will consider a possible way to avoid this incompatibility, by advocating a pragmatic constraint on belief in general, rather than just knowledge. But I will conclude that this is not a promising option for defusing the problem. I do not argue here for any one way of resolving the inconsistency.

Mental fictionalism is the view that, even if mental states do not exist, it is useful to talk as if they do. Mental states are useful fictions. Recent philosophy of mind has seen a growing interest in mental fictionalism. To date, much of the discussion has concerned the general features of the approach. In this paper, I develop a specific form of mental fictionalism by drawing on Kendall Walton’s work on make-believe. According to the approach I propose, talk of mental (...) states is a useful pretence for describing people and their behaviour. I try to clarify and motivate this approach by comparing it to well-known alternatives, including behaviourism, instrumentalism and eliminativism. Recent philosophy of science has seen a number of attempts to understand scientific models by looking to theories of fiction. In previous work, I have offered an account of models that draws on Kendall Walton’s ‘make-believe’ theory of art. According to this account, models function as ‘props’ in games of make-believe, like children’s dolls or toy trucks. In this paper, I assess the make-believe view through an empirical study of molecular models. I suggest that the view gains support when we (...) look at the way that these models are used and the attitude that users take towards them. Users’ interaction with molecular models suggests that they do imagine the models to be molecules, in much the same way that children imagine a doll to be a baby. Furthermore, I argue, users of molecular models imagine themselves viewing and manipulating molecules, just as children playing with a doll might imagine themselves looking at a baby or feeding it. Recognising this ‘participation’ in modelling, I suggest, points towards a new account of how models are used to learn about the world, and helps us to understand the value that scientists sometimes place on three-dimensional, physical models over other forms of representation. Much of contemporary metaethics revolves around the issue of “naturalism.” However, there is little agreement on what “naturalism” is or why it should be of significance. In this paper, I aim to rectify this situation by providing a set of necessary conditions on what positions ought to count as “naturalistic.” A metaethical view should count as an instance of naturalism only if it claims that there can be evidence for normative claims that is both public and spatiotemporal. I argue that, (...) unlike other characterizations of “naturalism,” this view shows a clear difference between many metaethical positions and the sciences. The view thereby renders debates about naturalism philosophically significant: the division between naturalists and non‐naturalists is that between philosophers who hold that ethics is relevantly similar to the sciences and those who deny this. Many traditional attempts to show that nonhuman animals are deserving of moral consideration have taken the form of an argument by analogy. However, arguments of this kind have had notable weaknesses and, in particular, have not been able to convince two kinds of skeptics. One of the most important weaknesses of these arguments is that they fail to provide theoretical justifications for why particular physiological similarities should be considered relevant. This paper examines recent empirical research on pain and, in particular, (...) explores the implications of the dissociation between the sensory and the affective pain pathways. It is argued that these results show that the belief that nonhuman animals experience pain in a morally relevant way is reasonable, though not certain. It is further argued that the proposal to explore the relationship between consciousness and various forms of learning challenges the aforementioned skeptics to provide more physiological details for their claims that nonhuman mammals are probably not conscious. Modeling is central to scientific inquiry. It also depends heavily upon the imagination. In modeling, scientists seem to turn their attention away from the complexity of the real world to imagine a realm of perfect spheres, frictionless planes and perfect rational agents. Modeling poses many questions. What are models? How do they relate to the real world? Recently, a number of philosophers have addressed these questions by focusing on the role of the imagination in modeling. Some have also drawn parallels (...) between models and fiction. What is the relationship between mental states and items of material culture, like notebooks, maps or lists? The extended mind thesis offers an influential and controversial answer to this question. According to ExM, items of material culture can form part of the material basis for our mental states. Although ExM offers a radical view of the location of mental states, it fits comfortably with a traditional, representationalist account of the nature of those states. I argue that proponents of ExM would (...) do better to adopt a fictionalist approach to mental states. In so doing, I suggest, they could retain the important insights underlying the extended mind thesis, while avoiding its more problematic consequences. (shrink)

Recent work in epistemology and philosophy of science has argued that understanding is an important cognitive state that philosophers should seek to analyse. This paper offers a new perspective on understanding by looking to work in philosophy of mind and cognitive science. Understanding is normally taken to be inside the head. I argue that this view is mistaken. Often, understanding is a state that criss-crosses brain, body and world. To support this claim, I draw on extended cognition, a burgeoning framework (...) in cognitive science that stresses the crucial role played by tools, material representations and the wider environment in our cognitive processes. I defend an extended view of understanding against likely objections and argue that it has important consequences for questions concerning the nature of understanding and its relationship to explanation. One important debate between scientific realists and constructive empiricists concerns whether we observe things using instruments. This paper offers a new perspective on the debate over instruments by looking to recent discussion in philosophy of mind and cognitive science. Realists often speak of instruments as ‘extensions’ to our senses. I ask whether the realist may strengthen her view by drawing on the extended mind thesis. Proponents of the extended mind thesis claim that cognitive processes can sometimes extend beyond our brains (...) and bodies into the environment. I suggest that the extended mind thesis offers a way to make sense of realists’ talk of instruments as extensions to the senses and that it provides the realist with a new argument against the constructive empiricist view of instruments. ABSTRACT Recruitment into the scientific community is one oft-stated goal of science education—in the post-Sputnik United States, for example—but this obscures the fact that science textbooks are often read by people who will never be scientists. It cannot be presupposed that science textbooks for younger audiences, students in primary and secondary schools, function in this way. For this reason, precollegiate-level science textbooks are sometimes discussed as a subset of literature popularizing science. The high school science classroom and the textbook are (...) forums for exposing the public to science. The role of governments and educational institutions in regulating the consumption of these texts not only determines which books are used; it influences how they are written, read, and deemed authoritative. Therefore such science textbooks should not be seen as (at best) the disjunction of texts-for-training and books-for-popularization. A changing sense of what “textbooks” are compels a different understanding of their use in the history of science. (shrink)

Today more than ever Marxism is profoundly in need of a full and precise modern reappraisal. In his belief that this may only be accomplished along with an examination of the "humanistic" young Marx, Adam Schaff presents in this volume an illumination of the thinker's early work and its relationship to the world-shaking economic philosophy that stemmed from it.

This paper addresses ethical questions surrounding death given imagined but not unlikely technological advancements in the near future. For example, how will highly detailed interactive simulations of deceased personalities affect the way we deal with dying and interact with the dead? Most cultures have at least a vague sense of duties to the dead, and many of these duties are related to the memorial preservation of decedents. I worry that our advances might be paralleled by a deteriorating grasp of what (...) proper preservation is all about. With the phenomenological assistance of the 19th and 20th century philosophers Søren Kierkegaard, Martin Heidegger, and Jean-Paul Sartre, we can get a sense of some potential problems for what we ordinarily call ‘progress’.
