The European Clinical Trials Directive (EU 2001; 2001/20/EC) was introduced to improve the efficiency of commercial and academic clinical trials. Concerns have been raised by interested organizations and institutions regarding the potential for negative impact of the Directive on non-commercial European clinical research. Interested researchers within the European Group for Blood and Marrow Transplantation (EBMT) were surveyed to determine whether researcher experiences confirmed this view. Following a pilot study, an internet-based questionnaire was distributed to individuals in key research positions in (...) the European haemopoietic SCT community. Seventy-one usable questionnaires were returned from participants in different EU member states. The results indicate that the perceived impact of the European Clinical Trials Directive has been negative, at least in the research areas of interest to the EBMT. (shrink)

This open access book offers insights into the development of the ground-breaking Global Code of Conduct for Research in Resource-Poor Settings (GCC) and the San Code of Research Ethics. Using a new, intuitive moral framework predicated on fairness, respect, care and honesty, both codes target ethics dumping – the export of unethical research practices from a high-income setting to a lower- or middle-income setting. The Global Burden of Disease Study is one of the largest-scale research collaborations in global health, producing critical data for researchers, policy-makers, and health workers about more than 350 diseases, injuries, and risk factors. Such an undertaking is, of course, extremely complex from an empirical perspective. But it also raises complex ethical and philosophical questions. In this volume, a group of leading philosophers, economists, epidemiologists, and policy scholars identify and discuss these philosophical questions. Better appreciating the philosophical dimensions of a (...) study like the GBD can make possible a more sophisticated interpretation of its results, and it can improve epidemiological studies in the future, so that they are better suited to produce results that help us to improve global health. Features of gait are determined at multiple levels, from the selection of the gait itself (e.g. walk or run) through the specific parameters utilized (stride length, frequency, etc.) to the pattern of muscular excitation. The ultimate choices are neurally determined, but what is involved with that decision process? Human locomotion appears stereotyped not so much because the pattern is predetermined, but because these movement patterns are good solutions for providing movement utilizing the machinery available to the individual (the legs and (...) their requisite components). Under different circumstances the appropriate solution may differ broadly (different gait) or subtly (different parameters). Interpretation of the neural decision making process would benefit from understanding the influences that determine the selection of the appropriate solution in any set of circumstances, including that of normal conditions. In this review we survey an array of studies that point to energetic cost as a key input to the gait coordination system, and not just an outcome of the gait pattern implemented. We then use that information to rigorously define the construct proposed by Sparrow and Newell (1998) where the effects of environment, organism and task act as constraints determining the solution set available, and the coordination pattern is then implemented under a pressure for energetic economy. Environment is defined in terms of affordances based on the ecological psychology definition of the concept and organism is defined as classic morphology and physiology based capabilities. We rely on a novel conceptualization of task that recognizes that the task goal needs to be separated from the mechanisms that achieve the goal if the motivation behind the selection of the mechanism strategy is to be exposed and understood. This reformulation of the Sparrow and Newell construct is then linked to the proposed pressure for economy by considering it as an optimization problem, where the most readily selected gait strategy will be that which achieves the task goal at (or near) the energetic minimum. Spatial, physical, and semantic magnitude dimensions can influence action decisions in human cognitive processing and interact with each other. For example, in the SNARC effect, semantic numerical magnitude facilitates left-hand or right-hand responding dependent on the small or large magnitude of number symbols. SNARC-like interactions of numerical magnitudes with the radial spatial dimension (depth) were postulated from early on. Usually, the SNARC effect in any direction is investigated using fronto-parallel computer monitors for presentation of stimuli. In such 2D setups, however, (...) the metaphorical and literal interpretation of the radial depth axis with seemingly close / far stimuli or responses are not distinct. Hence, it is difficult to draw clear conclusions with respect to the contribution of different spatial mappings to the SNARC effect. In order to disentangle the different mappings in a natural way, we studied parametrical interactions between semantic numerical magnitude, horizontal directional responses, and perceptual distance by means of stereoscopic depth in an immersive virtual reality (VR). Two VR experiments show horizontal SNARC effects across all spatial displacements in traditional latency measures and kinematic response parameters. No indications of a SNARC effect along the depth axis, as it would be predicted by a direct mapping account, were observed, but the results show a non-linear relationship between horizontal SNARC slopes and physical distance. Steepest SNARC slopes were observed for digits presented close to the hands. We conclude that spatial-numerical processing is susceptible to effector-based processes but relatively resilient to task-irrelevant variations of radial-spatial magnitudes. (shrink)

Codes of ethics and conduct typically demand the highest standard of ethical behaviour from every single employee. This implies a democratic or lobbyist understanding of ethics in business. The contrasting view would argue that business ethics is an elitist undertaking that can only be instigated from the top, by managing directors or owner managers. This article looks at three types of ethical businesses, three types of approaches to ethical problem‐solving, and three possible incentives for ethical business to see which of (...) the above is more convincing. It will be argued that the impulse for value‐driven business has to come from the top. Only top management and owner managers have the opportunity to foster major change in business practice. The hypothetical notion of consequence is normally understood as the transmission of a categorical notion from premisses to conclusion. In model-theoretic semantics this categorical notion is 'truth', in standard proof-theoretic semantics it is 'canonical provability'. Three underlying dogmas, (I) the priority of the categorical over the hypothetical, (II) the transmission view of consequence, and (III) the identification of consequence and correctness of inference are criticized from an alternative view of proof-theoretic semantics. It is argued that consequence is a basic semantical (...) concept which is directly governed by elementary reasoning principles such as definitional closure and definitional reflection, and not reduced to a categorical concept. This understanding of consequence allows in particular to deal with non-wellfounded phenomena as they arise from circular definitions. (shrink)

It is widely held that whenever someone φs, that person tries to do φ. I examine arguments by B. O’Shaughnessy and J. Hornsby, and considerations by P. Grice in support of that thesis. I argue that none of them are convincing. The remainder of the paper defends an analysis of the concept of trying along the lines opposed by Grice et al. By speaking of someone’s trying to φ the speaker leaves the room for failure or the possibility of failure. (...) This account of the function of the word ‘try’ makes it clear what is wrong with the claim that whenever someone φs, that person tries to do φ. For that claim amounts to saying that every action is either a failure or a possible failure – which clearly one can’t say of any action that one has already acknowledged to be successful. Furthermore, whether an action is possibly a failure depends on how much one knows about it. Hence the question whether in itself an action does or does not involve trying is as misguided as the question whether it’s intrinsically unexpected. It may be correct for some to describe it as ‘an attempt to φ’, but incorrect for others. (shrink)

According to a naive view sometimes apparent in the writings of moral philosophers, 'ought' often expresses a relation between agents and actions—the relation that obtains between an agent and an action when that action is what that agent ought to do. It is not part of this naive view that 'ought' always expresses this relation—adherents of the naive view are happy to allow that 'ought' also has an evaluative sense, on which it means, roughly, that were things ideal, some proposition (...) would be the case. What is important to the naive view is that there is also a deliberative sense of 'ought', on which it relates agents to actions. In contrast, logically and linguistically sophisticated philosophers have typically rejected this naive view. According to them, there is no argument-place for an agent in any relation expressed by 'ought', nor is there any argument-place for an action. According to this view, if Jim ought to jam, that is not because there is a special distinctive deliberative ought relation between Jim and jamming; rather, it is because a certain proposition ought to be the case: namely, that Jim jams. This essay defends the naive view, by first arguing that there are two distinct normative senses of 'ought', which actually exhibit different syntactic behavior, and then going on to argue that the deliberative sense of 'ought' relates agents to actions, rather than to propositions. Like much in this book, the title and dust jacket illustration are clever. The first evokes Hume's remark in the Treatise that ‘Reason is, and ought only to be the slave of the passions.’ The second, which represents a cross between a dance-step and a clinch, links up with the title and anticipates an example used throughout the book to support its central claims: that Ronnie, unlike Bradley, has a reason to go to a party – namely, that there will (...) be dancing at the party – because Ronnie, unlike Bradley, loves dancing. So, the explanation of why Ronnie's and Bradley's reasons differ lies in their respective psychologies.Schroeder argues for a version of the Humean Theory of Reasons he calls Hypotheticalism, which says that every reason is explained by a desire in the same way as Ronnie's is. Schroeder argues that on almost every count, Hypotheticalism is as good as, or preferable to, the Humean and non-Humean alternatives; and he defends it against an array of objections. For example, he explains that while Hypotheticalism claims that ‘desires have to serve in the explanation of every reason because desires are part of the correct analysis of reasons’, it does not claim that a desire that explains a reason is part of that reason: rather it is a background condition for it. In its essence, post-trial obligations describe a duty by research sponsors to provide a successfully tested drug to research participants who took part in the relevant clinical trials after the trial has been concluded. In some instances,this duty is extended beyond the research participants. This article is divided into three main parts. The first part outlines the legal basis for post-trial obligations by looking at international guidelines, including those issued by the World Medical Association. National legislation is exemplified through resolutions (...) and guidelines issued by Brazil and South Africa respectively. The second part analyses the ethical foundation for post-trial obligations, in particular the attempt to minimize exploitation of research subjects. The third part raises obstacles and challenges for the implementation of post-trial obligations. The jury is still out on whether post-trial obligations in the form of access to drugs for clinical trial participants is the best, or even a good way, to avoid exploitation in medical research. To desire something is a condition familiar to everyone. It is uncontroversial that desiring has something to do with motivation, something to do with pleasure, and something to do with reward. Call these "the three faces of desire." The standard philosophical theory at present holds that the motivational face of desire presents its unique essence--to desire a state of affairs is to be disposed to act so as to bring it about. A familiar but less standard account holds the hedonic (...) face of desire to reveal to true nature of desire. In this view, to desire something is to tend to pleasure if it seems that the desired state of affairs has been achieved, or displeasure if it seems otherwise, thus tying desire to feelings instead of actions. In Three Faces of Desire, Schroeder goes beyond actions and feelings to advance a novel and controversial theory of desire that puts the focus on desire's neglected face, reward. Informed by contemporary science as much as by the philosophical tradition, Three Faces of Desire discusses recent scientific discoveries that tell us much about the way that actions and feelings are produced in the brain. In particular, recent experiments reveal that a distinctive system is responsible for promoting action, on the one hand, and causing feelings of pleasure and displeasure, on the other. Many philosophers of science have argued that social and ethical values have a significant role to play in core parts of the scientific process. This naturally suggests the following question: when such value choices need to be made, which or whose values should be used? A common answer to this question turns to democratic values—the values of the public or its representatives. I argue that this imposes a morally significant burden on certain scientists, effectively requiring them to advocate for policy (...) positions they strongly disagree with. “Grammar” is Ludwig Wittgenstein's preferred term for the workings of a language: the system of rules that determine linguistic meaning. A philosophical study of language is a study of “grammar”, in this sense, and insofar as any philosophical investigation is concerned with conceptual details, which manifest themselves in language, it is a grammatical investigation. In the Tractatus Logico‐Philosophicus Wittgenstein offered a mathematical picture of language: presenting language as a calculus. Like a calculus, language was claimed to be governed by syntactic (...) rules: formation rules about the licit combination of names to form elementary propositions; formation rules about the licit combination of elementary propositions to make complex propositions; and finally, truth‐table rules, which enable us to identify logical truths and entailments. Logical grammar, for the young Wittgenstein, is only logical syntax and logical syntax can be determined without paying any attention to the meaning of the signs. (shrink)

Benefit sharing has been a recurrent theme in international debates for the past two decades. However, despite its prominence in law, medical ethics and political philosophy, the concept has never been satisfactorily defined. In this conceptual paper, a definition that combines current legal guidelines with input from ethics debates is developed. Philosophers like boxes; protective casings into which they can put concisely-defined concepts. Autonomy is the human capacity for self-determination; beneficence denotes the virtue of good deeds, coercion is the intentional (...) threat of harm and so on. What about benefit sharing? Does the concept have a box and are the contents clearly defined? The answer to this question has to be no. The concept of benefit sharing is almost unique in that various disciplines use it regularly without precise definitions. In this article, a definition for benefit sharing is provided, to eliminate unnecessary ambiguity. (shrink)

Wittgenstein offers three objections to the idea of aesthetics as a branch of psychology: (i) Statistical data about people’s preferences have no normative force. (ii) Artistic value is not instrumental value, a capacity to produce independently identifiable – and scientifically measurable – psychological effects. (iii) While psychological investigations may bring to light the causes of aesthetic preferences, they fail to provide reasons for them. According to Wittgenstein, aesthetic explanations (unlike scientific explanations) are poignant synoptic representations of aspects of a work, (...) and the criterion of success of an aesthetic explanation is that it satisfies the addressee. He repeatedly remarked that they resemble philosophical explanations, which also try to dispel puzzlement or confusion. The difference, however, is that whereas in philosophy we deal with general conceptual problems, aesthetic explanations typically concern individual responses to particular works of art. (shrink)

In 2006, the Indonesian government decided to withhold avian flu samples from the World Health Organization. They argued that even though Indonesian samples were crucial to the development of vaccines, the results of vaccine research would be unaffordable for its citizens. Commentaries on the case varied from alleging blackmail to welcoming this strong stance against alleged exploitation. What is clear is that the concern expressed is related to benefit sharing.Benefit sharing requires resource users to return benefits to resource providers in (...) order to achieve justice. One benefit sharing tool within health research is the duty to provide a health care intervention which has been proven to be beneficial (or alternative benefits) to research participants after a study has been concluded. This duty is generally known as a post-study obligation. It was enshrined in the Declaration of Helsinki in 2000 and re-emphasized in 2008. Yet, there are few, if any, examples of good practice.In this article, we analyse the obstacles to giving more bite to benefit sharing provisions in health research through ethical review. We conclude that the provision of post-study access to healthcare interventions is not a promising mechanism when monitored through research ethics committees. Alternative benefit provision is preferable if one focuses on achieving compliance. However, even the latter faces challenges, which we address in specific recommendations. (shrink)

Research cannot be done by researchers alone. In most cases, additional resources are required, including human research participants, access to biodiversity for biological and genetic resources, or traditional knowledge. Benefit sharing has been part of global conventions and international ethics guidelines for over 25 years, predicated on the understanding that those who contribute to the research process and its outcomes should share in the benefits as a matter of fairness. This chapter explores the different understandings of benefit sharing in a (...) historical context, from the “Grand Bargain” of the Convention on Biological Diversity in 1992 to the Global Code of Conduct for Research in Resource-Poor Settings in 2018, and examines the contemporary potential for the UN Sustainable Development Goals (Agenda 2030) to facilitate benefit sharing. The discussion provides guidance to researchers, through examples and short case studies, on how to discharge the obligations of benefit sharing effectively and fairly, in pursuit of research integrity. Peter Kivy’s contour theory provides a promising explanation of the way we describe instrumental music as expressive of emotions. I argue that if, unlike Kivy, we emphasise the metaphorical character of such descriptions, the contour theory, as a strategy for unpacking such metaphors, can be defended convincingly against common objections. This approach is more satisfactory than those of Scruton and Peacocke, who make much of metaphorical experiences, but leave the underlying metaphors unexplained. Moreover, it gives the contour theory a wider (...) scope than Kivy intended, for even very specific narrative descriptions of music in non-musical terms are perfectly legitimate as long as they are presented, and justified, as metaphors, that is, as mere comparisons, rather than as interpretative claims about the music’s actual contents. I look at the two main approaches used to count COVID-19 deaths and show how each of those approaches can appear to both overcount COVID deaths (including deaths it should exclude) and undercount COVID deaths (excluding deaths it should include). I trace this to the fact - well-known to philosophers - that causal attribution is interest-relative. Which deaths we should attribute to COVID (as opposed to other causes) will depend on our particular interests and values. Contrary to what many journalists (...) and researchers report, there is therefore no such thing as the "true" COVID death toll. Understanding this can help us to become more sophisticated consumers of COVID information. I conclude by suggesting that scientists, by reflecting on society's varied interests and values, are in a position to construct measures of COVID-caused mortality that are potentially as useful, or more useful, than the measures we currently have. When the logical positivists espoused emotivism as a theory of moral discourse, they assumed that their general theories of meaning could be straightforwardly applied to the subject of metaethics. The philosophical research program of expressivism, emotivism's contemporary heir, has called this assumption into question. In this volume Mark Schroeder argues that the only plausible ways of developing expressivism or similar views require us to re-think what we may have thought that we knew about propositions, truth, and the nature of (...) attitudes like belief and desire. Informed by detailed scrutiny of the structural problems about understanding complex thoughts, he develops a range of alternative expressivist frameworks in detail as illustrations of general lessons, and applies them not just to metaethics, but to epistemic expressions and even to truth itself.
