The physician charter on medical professionalism creates standards of ethical behaviour for physicians and has been endorsed by professional organisations worldwide. It is based on the cardinal principles of the primacy of patient welfare, patient autonomy, and social welfare. There has been little discussion in the bioethics community of the doctrine of the charter and none from a Jewish ethical perspective. In this essay the authors discuss the obligations of the charter from a Jewish ethical viewpoint and call on other (...) cultures to develop their own unique perspectives on this important document. This work offers a new theory of what it means to be a legal person and suggests that it is best understood as a cluster property. The book explores the origins of legal personhood, the issues afflicting a traditional understanding of the concept, and the numerous debates surrounding the topic.

Moral education through service learning at post-secondary level is an important but under-researched field. Most existing studies center on its learning outcomes like academic progress, personal development, communication, and leadership skills, with only a few evaluating the moral development of college students participating in service-learning projects. The lack of study on moral development in service learning indicates a need for clarification of the theoretical underpinnings of service learning, John Dewey's ideas on moral growth, in particular his model of moral imagination (...) and the implications thereof, for current service-learning research and practice. In recent decades, the scientific study of consciousness has significantly increased our understanding of this elusive phenomenon. Yet, despite critical development in our understanding of the functional side of consciousness, we still lack a fundamental theory regarding its phenomenal aspect. There is an “explanatory gap” between our scientific knowledge of functional consciousness and its “subjective,” phenomenal aspects, referred to as the “hard problem” of consciousness. The phenomenal aspect of consciousness is the first-person answer to “what it’s like” question, and it (...) has thus far proved recalcitrant to direct scientific investigation. Naturalistic dualists argue that it is composed of a primitive, private, non-reductive element of reality that is independent from the functional and physical aspects of consciousness. Illusionists, on the other hand, argue that it is merely a cognitive illusion, and that all that exists are ultimately physical, non-phenomenal properties. We contend that both the dualist and illusionist positions are flawed because they tacitly assume consciousness to be an absolute property that doesn’t depend on the observer. We develop a conceptual and a mathematical argument for a relativistic theory of consciousness in which a system either has or doesn’t have phenomenal consciousness with respect to some observer. Phenomenal consciousness is neither private nor delusional, just relativistic. In the frame of reference of the cognitive system, it will be observable and in other frame of reference it will not. These two cognitive frames of reference are both correct, just as in the case of an observer that claims to be at rest while another will claim that the observer has constant velocity. Given that consciousness is a relativistic phenomenon, neither observer position can be privileged, as they both describe the same underlying reality. Based on relativistic phenomena in physics we developed a mathematical formalization for consciousness which bridges the explanatory gap and dissolves the hard problem. Given that the first-person cognitive frame of reference also offers legitimate observations on consciousness, we conclude by arguing that philosophers can usefully contribute to the science of consciousness by collaborating with neuroscientists to explore the neural basis of phenomenal structures. Magicians use misdirection to prevent you from realizing the methods used to create a magical effect, thereby allowing you to experience an apparently impossible event. Magicians have acquired much knowledge about misdirection, and have suggested several taxonomies of misdirection. These describe many of the fundamental principles in misdirection, focusing on how misdirection is achieved by magicians. In this article we review the strengths and weaknesses of past taxonomies, and argue that a more natural way of making sense of misdirection is (...) to focus on the perceptual and cognitive mechanisms involved. Our psychologically-based taxonomy has three basic categories, corresponding to the types of psychological mechanisms affected: perception, memory, and reasoning. Each of these categories is then divided into subcategories based on the mechanisms that control these effects. This new taxonomy can help organize magicians' knowledge of misdirection in a meaningful way, and facilitate the dialog between magicians and scientists. (shrink)

In this article I give a naturalistic-cum-formal analysis of therelation between beauty, empirical success, and truth. The analysis is based on the onehand on a hypothetical variant of the so-called `mere-exposure effect'' which has been more orless established in experimental psychology regarding exposure-affect relationshipsin general and aesthetic appreciation in particular (Zajonc 1968; Temme 1983; Bornstein 1989;Ye 2000). On the other hand it is based on the formal theory of truthlikeness andtruth approximation as presented in my From Instrumentalism to Constructive Realism (...) (2000).The analysis supports the findings of James McAllister in his beautifulBeauty and Revolution in Science (1996), by explaining and justifying them.First, scientists are essentially right in regarding aesthetic criteria useful for empiricalprogress and even for truth approximation, provided they conceive of them as less hard thanempirical criteria. Second, the aesthetic criteria of the time, the `aesthetic canon'', maywell be based on `aesthetic induction'' regarding nonempirical features of paradigms of successfultheories which scientists have come to appreciate as beautiful. Third, aestheticcriteria can play a crucial, schismatic role in scientific revolutions. Since they may well be wrong, they may, in the hands of aesthetic conservatives, retard empirical progress and hence truth approximation, but this does not happen in the hands of aesthetically flexible, `revolutionary'' scientists. We may find totallyopposite things beautiful: a simplemathematical principle as well as a series of unrepeatable complex contingencies. This article introduces a new formulation of the interest theory of rights. The focus is on ‘Bentham’s test’, which was devised by Matthew Kramer to limit the expansiveness of the interest theory. According to the test, a party holds a right correlative to a duty only if that party stands to undergo a development that is typically detrimental if the duty is breached. The article shows how the entire interest theory can be reformulated in terms of the test. The article (...) then focuses on a further strength of the interest theory, brought to the fore by the new formulation. In any Western legal system, the tortious maltreatment of a child or a mentally disabled individual results in a compensatory duty. The interest theory can account for such duties in a simple and elegant way. The will theory, on the other hand, struggles to explain such compensatory duties unless it abandons some of its main tenets. (shrink)

So far, the most prominent measure for actual truthlikeness, i.e. the likeness of a theory to the actual truth, is Ilkka Niiniluoto’s minsum definition, which is purely based on distances. A competing definition is the average distance measure proposed by Pavel Tichy and Graham Oddie. We will define three related, distance and size based, measures for actual truthlikeness and compare them with the two well-known options. However, we will start, Sect. 2, from a trio of such measures for nomic truthlikeness. (...) The nomic truth, or the true theory, here refers to what is nomically, e.g. physically, possible. In a nomic (and factual) context there are two basic kinds of theories, viz. either based on an exclusion claim or on an inclusion claim. Two-sided theories combine these claims, with the maximal claim as extreme special case. We will base truthlikeness measures for exclusion, inclusion, two-sided, and hence maximal, nomic theories on two similarity measures, one in terms of distances between conceptual possibilities and the other in terms of sizes of sets of such possibilities. In Sect. 3 we will treat actual truthlikeness as extreme special case of nomic truthlikeness, viz. assuming that there is just one nomic possibility, the actual one. Next we will compare the resulting measures mutually and with the above mentioned measures of Niiniluoto and Tichy & Oddie. We argued last year in this journal that extensive integration of research and care is a worthy goal of health system design, and we second the call from Ruth Faden and colleagues to move toward learning health care systems. As they recognize, learning health care systems demand the coordination of research and medical ethics—two sets of normative commitments that have long been considered distinct. In offering a novel ethics framework for such systems, Faden et al. advance the scholarly debate about (...) how best to do this and challenge us to think more deeply about its practical implications. However, we believe that at least three issues they raise require additional attention. First, the research‐care distinction has more normative bite than they are willing to concede. Second, the role for independent oversight requires clarification. Finally, they neglect the concept of stewardship as a guiding obligation of learning health care systems. (shrink)

In the real world, many people suffer as a function of their subordinate position in social hierarchy. Deliberative, relativist, and essentialist political theorists have sketched philosophies of social criticism that alone are inadequate for criticizing some harmful social values, practices, and norms. Certainly, theirs are critical theories in the sense that they are actionable, coherent, and self-reflective. But they are not adequate theories of social criticism. They do not specify satisfactorily the roles, qualifications, and methodology of social critics worried about (...) the struggles and wishes of real people. I specify all three. Drawing from the practical experience of a wide variety of women activists, I generalize about the roles and qualifications of the social critic. In addition, I formally articulate a method of social criticism that feminists have been developing. Collectively, feminists--particularly Third World women activists-have pioneered a method of social criticism that allows them to criticize existing social values, practices, and norms that perpetuate inequalities. The method of social criticism I propose provides a discipline for ongoing questioning and evaluation of social practices by a society with the help of social critics. In the process of explicating my own philosophy of social criticism, I offer criticisms of the implications for social criticism of three political philosophies--deliberative democratic theory, Michael Walzer's relativism, and Martha Nussbaum's essentialism--and argue that feminist critics have managed to achieve in practice what adherents of those three schools do incompletely in theory. The paper summarizes, generalizes and reveals the physical content of a recently proposed framework that unifies the standard formalisms of special relativity and quantum mechanics. The framework is based on Hilbert spaces H of functions of four space-time variables x,t, furnished with an additional indefinite inner product invariant under Poincaré transformations. The indefinite metric is responsible for breaking the symmetry between space and time variables and for selecting a family of Hilbert subspaces that are preserved under Galileo transformations. Within these (...) subspaces the usual quantum mechanics with Shrödinger evolution and t as the evolution parameter is derived. Simultaneously, the Minkowski space-time is embedded into H as a set of point-localized states, Poincaré transformations obtain unique extensions to H and the embedding commutes with Poincaré transformations. Furthermore, the framework accommodates arbitrary pseudo-Riemannian space-times furnished with the action of the diffeomorphism group. (shrink)

The article is devoted to the problem of studying the activities of revolutionary and ideological virtuosi of the XX century by means of the historical sociology of modernity. It attempts both to identify the main trends in the participation of intellectually active strata of modern societies in the radical transformation of social reality, and to clarify the reasons that pushed them to do so. It is noted that the ideological background of such forms of socio-political radicalism were the symbolic means (...) of challenging the old forms of social reality and constructing new forms through secular ideologies of various types (socialism, communism, anarcho-syndicalism, fascism, national socialism, etc.). The role of conductors of the ideological message of these secular religions of salvation to the masses was usually performed by radical-minded intellectuals and students, for whom the worship of new idols and symbols of faith became the true meaning of life and struggle. In the XX century, it was the intellectuals who acted as the main creators and operators of collective salvation religions, and the social communities created on their basis. Moreover, they not only tried to save themselves with their help, but at the same time laid claim to the legitimate monopoly of determining who would be saved, and who would not. Thus, radical intellectuals acted as both the creators of the new norm and as agents of the policy of rationalization. The article pays special attention to the characteristics of the creators and social carriers of radical ideological views — and the worldviews based on them — as well as the refraction of these utopian visions in the socio-political practice of the last century. In conclusion, it is suggested that Max Weber’s historical sociology and Emile Durkheim’s symbolic theory of the “sacred”, supplemented by modern developments in the field of political sociology and socio-historical anthropology, can serve as a relevant system of theoretical coordinates for the study of ideological and revolutionary virtuosi of the XX century.
